Consumer Complaint: On approx XX/XX/XXXX I made a request to Select Portfolio Servicing, via a telephone call, for a complete servicing file on my account. Three days later I received a payoff and a letter advising me about what I can obtain from their website. When I spoke to the representative I was very clear that I was having foreclosure issues and would like a copy of my servicing file including all notes on my account. What was sent to me ( I am attaching a copy ) falls woefully short of providing me a servicing file on my account. I am requesting the file because, last XX/XX/XXXX, a local assistance program had provided me enough money to bring my account current and the company according to what phone reps told me, either separated the instructions from the check, destroyed check, or forwarded the check to their accounting department. Had this check been applied I would have been able to make a XXXX payment and try to move forward. After they did whatever they did with the check I was then 4 months short and did not have enough money to make a full payment that big. In reality their sloppy payment processing led to my account being in foreclose. Also they sat on my loss mitigation request for months without doing anything for it..then after months they said I was missing information. I have resubmitted my RMA Form on XX/XX/XXXX the last representative I spoke to said that was the only piece of information they needed. The one in file had become too old and the one a social worker obtained for me from the FHLMC or FHFA was not good enough for them. I'd also like to stress that on multiple occasions over the last year I requested a new workout information package be mailed to me because I am XXXX, I don't have a car, or a computer with a printer. Until the letter I received near the end of XX/XX/XXXX I had not received any documentation just letters telling me to access the information on their website. I had already informed them that my phone And thier website don't work well enough together the requests always fail. And mentioned the above information about being XXXX and not driving. I have one more issue I would like to bring up and that is the manner of making payments to SPS. They operate thier business like we are in XXXX not XXXX. As a recipient of Social Security XXXX my money is placed monthly into a XXXX XXXX ( XXXX ) account managed by XXXX XXXX. I am able to use the XXXX card anywhere else in the US for any reason except with SPS who refused to accept payments from my XXXX. I do not have access to the routing and account number because technically the account belongs to the Social Security Administration and I can not even place funds into the account only Social Security can. I can understand where in the past cards always had a credit feature attached to them and do were not accepted as payment toward a mortgage because you would be creating a debt to pay your debt ... .however ; this is XXXX. The XXXX XXXX is used to pay millions of SSI and XXXX recipients and there is no credit feature attached to this card. It will not you to pay out a penny more than what is in the account. There should be no reason my payments can't be taken from my XXXX card other than this companies ability to provide customer service comparative to any other company thier size. This is dory of rhetorical but how many peple have been forced to foreclosure because SPS will not take our payments from the account the federal government put my payments in. Due to their sloppy customer service, inadequate collection activities and payment processing methods I formally request that the foreclosure action on my account be vacated. That all fees charged to me due to the foreclosure and late payments be removed from my account and that a modification be approved to bring my account more in line with prevailing interest rates instead of the 6.765 % I am being charged now. I maintain that even on my XXXX payment I get monthly I can afford my payment if they reset the account back to a 40 year mortgage and drop the interest rate to 2.5 % or something that is actually a help. My father had this house built in the XXXX 's and a member of my family has lived here ever since then, it would be a shame to lose my family home because of a host of servicing errors made on my account and this companies inability to process an electronic payment from a card.

Consumer Complaint: Misrepresentation, fraud and false statements. Once again, Select Portfolio Servicing, Inc. ( SPS XXXX has criminally misrepresented the facts of this erroneous alleged account. Specifically, on XX/XX/XXXX, SPS sent the Estate of XXXX XXXX XXXX and Estate of XXXX XXXX XXXX a notice entitled " Delinquent Tax Advance Notification. '' First, there is no estate for XXXX XXXX XXXX. She pre-deceased my father on XX/XX/XXXX. My father passed away on XX/XX/XXXX. I am the executor of his estate. No claims on behalf of SPS or affiliates have been filed against the estate. I have communicated this to SPS on numerous occasions. Secondly, SPS continues to send correspondence to XXXX XXXX XXXX, XXXX XXXX, NJ XXXX. This address is incorrect. It should be Estate of XXXX XXXX XXXX, XXXX XXXX XXXX, XXXX XXXX, FL XXXX. I have made notification to SPS as evidence by them responding using the correct address for CFPB complaints. Thirdly, SPS has committed and continues to commit fraud by falsely stating they had advanced funds in the amount of {$5500.00} for delinquent taxes. This is false because the family of XXXX XXXX XXXX paid taxes in the amount of {$2500.00} for fiscal year ending XXXX. Taxes for fiscal year XXXX in the amount of {$2500.00} remain unpaid as of XX/XX/XXXX. On a fictitious statement dated XX/XX/XXXX, SPS misrepresents and fraudulently lists {$4800.00} as Tax Advances. On a statement dated XX/XX/XXXX, they misrepresent advanced taxes in the amount of {$10000.00}. All without any explanation or description complete with receipts of such paid taxes. Complete fraud. Additionally, there is no escrow account associated with this account. SPS canceled the escrow after my numerous complaints about them trying to erroneously pay taxes which is NOT subject to any mortgage or promissory note. This also has been communicated to SPS in which they state they are looking into it, yet have never actually responded to any complaint with specifics in five years of communication. Where are the receipts from the tax collector? How come the amounts are different in the letter vs the monthly statements. Why are the taxes reflected as not being fully paid? In all actually, they advanced {$0.00} and misrepresented they did in writing via false correspondence and fraudulent statements. Additionally, in several statements SPS continues to list transactions for XXXX ATTY Fees {$1100.00}, Property Inspections {$18.00}, although they have been in frequent contact with me, are fully aware of my position, and know the property is not listed as a security interest for any mortgage or promissory note. This is in addition to property preservation fees in the amount of {$300.00}, for which they have done absolutely nothing with regards to preserving the property, nor should they as they have no legal right, although they are charging for it. Complete fraud. I would like a complete detailed transaction history of everything SPS has charged to this account, since XXXX XXXX, as well as copies of any receipts from the tax collectors office for paid taxes in addition to every property inspection report completed on behalf of SPS and/or affiliates.

Consumer Complaint: Hi, I was approved for Covid relief forbearance on my mortgage held XXXX XXXX in XX/XX/XXXX. I extended it in 3 month increments until XX/XX/XXXX with no problems. My loan was transferred to a different services in XX/XX/XXXX. It was transferred to XXXX XXXX XXXX. Due to new legislation, FHA, XXXX XXXX, and XXXX XXXX loans were eligible for another 6 month extension. My loan is privately held and not one of those. But even still, under XXXX XXXX, applying for the forbearance was very easy and straightforward. When it came time to extend the forbearance again after XX/XX/XXXX, XXXX XXXX XXXX required proof of unemployment with paperwork that is not available from my states unemployment office. I sent them as many things that I could like bank statements, my unemployment account screenshot, my original unemployment award letter, etc but they said everything was insufficient. They said that I need to submitted a current award letter saying that I am currently getting unemployment benefits in XXXX. Virginia XXXX XXXX did not send a updated award letters to people and they do not answer phone calls or emails so I can not even request one. The legislation on Covid relief explicitly states that no proof is required yet this company is requiring it. I understand that the legislation is only for specific loans but my loan holder has been the same and XXXX XXXX did not require any documentation. It is XXXX XXXX XXXX that is requiring it

The title agent prepared Hud settlement statement reflecting {$10000.00} relocation fee, submitted to mortgage servicer. Mortgage servicer requested the relocation amount be lowered to 3 % per the investor request, resubmitted HUD settlement statement reflecting {$7600.00} per mortgage servicer request. I call today and I'm informed relocation expense was denied. I have been mislead by my mortgage servicer and the investor. II have spoken with several individuals in the short sale dept. and I given different. information each time. I feel my mortgage servicer is not providing me with truthful information. I also feel they have not contacted my investor for the relocation funds even I received correspondence stating they would give me relocation expenses

Consumer Complaint: my previous mortgage servicer ( XXXX XXXX ) sold our loans to SPS ( Select Portfolio Servicing ) starting XX/XX/XXXX ( EHIBIT A ) on XX/XX/XXXX I forward SPS my information to start auto withdrawing my payments come XX/XX/XXXX. So around mid XX/XX/XXXX I noticed no withdraw from SPS had take place. So I called SPS and a representative informed me that my mortgage was PAID IN FULL. I verified my information with the representative and she confirmed it and said yes PAID IN FULL. I waited and called back a few weeks later and that representative said the same thing PAID IN FULL and that I would be getting my escrow of XXXX in the mail and all the necessary paperwork showing paid off. I received the escrow check, a statement showing that my informaiton was paid off, my county tax provided sent me my tax statement showing that I would be paying my own taxes, my insurance provider sent me my notice saying that the insurance would be transferred in my name and I would assume payments in full. So then on XX/XX/XXXX I received a notice stating something about a payment reversal ( EXHIBIT B-1 ), then XX/XX/XXXX they sent another statement stating A NOTICE OF DEFAULT that I was gravely behind and delinquent in my mortgage payments ( EXHIBIT C1 ), the the SAME DAY XX/XX/XXXX they sent a statement saying that you are in FORECLOSURE due to being gravely in default on your mortgage payments and I am that my case is being sent to a forclosure attorney. After receiving ALL ( 3 ) notices the same day on XX/XX/XXXX I called SPS and the person on the other end said that my case has been referred to a forclosure attorney. I am TOTALLY APPAULLED on how SPS is trying to QUICKLY cover up their error and not even try to call apologize and work with me but try to take my home from me. This can ; t be acceptable and ethical or legal behavior in the United States because of an error of their that they are trying to fille unethical paper work to assume my home from under me without trying to correct the error or eating up the cost of their error. I need something to take place IMMEDIATELY because this company should not be able to do this, there have to be something done about this before they are allowed to go any further with this unethical behavior.
