MY FIRST COMPLAINT WAS RECEIVED BY Y0U ON XX/XX/XXXX, XXXXREFERENCE # XXXX COMPLAINT STATED THAT IN MY SETTLEMENT AGREEMENT I WAS GIVEN ONLY {$600.00} FOR MY TROUBLE BUT A PRINCIPAL REDUCTION ON MY LOAN. RECEIVED OFFER FROM XXXX XXXX XXXX XX/XX/XXXX. THIS WAS NOT A FORM MAILOUT AS IT INCLUDE MY LOAN NUMBER AND BORROWERS NAME PROBLEM ONE THEY ACCELERATED MY PRINCIPAL FROM XXXX TO XXXX.YOU HAVE THIS COMPLAINT IN MY FILE WITH SUPPORTING DOCUMENTS. XX/XX/XXXX OUR ATTORNEY ISSUED A LETTER TO BOA WITH CORRECTIONS ON THE OFFER AND WE WERE TO PAY OFF THE LOAN BASED ON TRUE NUMBERS OF MY SETTLEMENT. THEY HAD 30 DAY TO RESPOND INSTEAD SOLD SERVICING RIGHTS TO SELECT PORTFOLIO. SELECT REFUSES TO HONOR THAT SETTLEMENT. AT THE TIME ATTORNEY. NOW WITH MONEY TIME STRESS WHERE WE ONCE HAD THE CASH NOW I HAVE A BUYERS AND I WANT WHAT WAS PROMISED ME THRU MY EFFORTS TO HELP YOU BRING DOWN THE FRAUD SCHEME WITH THE BANK. SELECT HAS STALLED ME WONT COME TO THE TABLE TALKS ONLY OF LOAN MODIFICATIONS WHICH IN THAT TRAP THEY DENY IN THE END AND THEN YOUR CASE FOR PROBLEMS FROM THE FIRST LOAN U CAN NOT USE. Consumer Complaint: Allow me to once again respond to Select Portfolio Servicing 's ( SPS ) false claims. SPS states, " We have billed for Brokers Price Opinions, Property Inspections, Foreclosure Attorney Fees and Foreclosure Costs. These items are allowed under the terms of the origination documentation, and the Estate is responsible to repay the fees. '' First of all, SPS never made a legitimate claim against the estate of XXXX XXXX XXXX, so I'm not sure how the estate can be responsible for anything SPS alleges. Secondly, SPS has been in frequent contact with executor of the estate. Property inspections are unwarranted and fraudulent per previous lawsuits filed against SPS. Also, BPOs are riddled with errors, e.g., the property has no well, one BPO has repairs needed, others do not, property is not the property described in any of the alleged notes and several state 1.5 acres and others state .25 acres. BPOs are completely fabricated and erroneous. And thirdly, persons conducting inspections are trespassing on private property by their own admission. Although they state they leave pamphlets at the door, not one has been discovered. Cease and desist any and all inspections/BPOs immediately. SPS states, " Please know that the XXXX County disbursements reflected as paid prior to the county receiving our payments, and as a result, the payments we sent have been voided, and the funds were retrieved on the escrow account as of XX/XX/XXXX. '' Not sure how that can be, there is no escrow or account. SPS admits they closed an escrow account based on executor 's request due to the fact it was erroneous. SPS states, " Please know that correspondence is being sent to the property address of XXXX XXXX, XXXX, NY XXXX. '' Correspondence has never been sent to address SPS states. There is no mailbox at that location. A completely fabricated statement. SPS states, " SPS is confident that the servicing of the loan by SPS has been compliant with all applicable state and federal regulations. '' Not sure that is the case. On XX/XX/XXXX, the Estate of XXXX XXXX XXXX received correspondence from SPS stating, " ... This letter is to notify you that the ownership of your mortgage loan has changed. The terms of your mortgage loan have not changed ... '' " ... The ownership of your mortgage loan has been transferred to XXXX XXXX XXXX effective XX/XX/XXXX. XXXX XXXX XXXX does not make mortgage loans but instead purchases, or is otherwise assigned, mortgage loans from lenders and other entities ... '' If that is the case, then why is there a XXXX XXXX XXXX Assignment ( XXXX ), holders of XXXX XXXX XXXX, dated XX/XX/XXXX filed with the XXXX County, XXXX XXXX XXXX. This assignment is fraudulent and needs to be removed from County records, along with a Corporate Assignment of Mortgage, dated XX/XX/XXXX. SPS has been made aware and is aware of my disagreement with these erroneous documents. Please remove immediately.

Consumer Complaint: Our home was burnt down due to the California fires. the 1st mortgage insurance paid to fix the home. we offered to short pay the 2nd mortgage and was recently denied ( I was informed XX/XX/2021, as of XX/XX/XXXX I was told that my appeal was under review ... and today I received notification that SPS has put my home up for foreclosure sale on XX/XX/2021. Please help me deal with these people. they told me I was under appeal..and that I was still under covid forbearance protection and now they put my home for sale.

Consumer Complaint: To whom it may concern, In XXXX of 2020 I contacted my mortgage company to defer payment due to Covid 19. which I was approved for. Earlier that year I had applied for a loan modification which I was also approved for reducing my mortgage payment from {$850.00} to {$760.00} approximately. I was told that I could defer payment and once the period ends that I would start payment on my loan modification. I was also told that the months that were deferred would be added to the end of the mortgage 's life. I had to take a live of absence for two months from work due to my XXXX XXXX XXXX from XXXX XXXX XXXX and XXXX treatment that had just ended. As a result I was getting less pay. The mortgage company kept deferring. At the end of XXXX I contacted them to try to continue the deferment but at that time they declined it. I told them that I could not resume the payment at that time and asked them to please continue the deferment until I can catch up. They refused so I was falling behind. They told me to re-apply for the modification and was denied and disputed it and was declined again. Now they were telling me that they feel that I can not make my payments and could not afford this place. I wanted to start making payments online and could not. I contacted them and then was told that my account was sent to a law firm for foreclosure. I told them that I do not want to foreclose and would like to start making payments. I had been putting the money in the bank. As of today I was not contacted yet by any law firm most likely because of the mandates in regards to Covid 19 and refraining them to foreclose and forcing people to loose their homes. The mortgage company told me that the only way to be current is to get re-instated. In XXXX I requested the re-instatement figures. It took about a month after many calls. When they gave me the figures I was in shock. I thought that the figure would be for the three months at the time that I was delinquent but they included everything since XXXX of 2020. I told them that this was unfair because the deferred payments should be added the end of the loan. I feel that this is a set up for people to loose their homes. Please advise ...

I applied to a forbearance plan on XX/XX/XXXX and it was accepted. I agreed to send the portion of the escrow money of each payment. On XX/XX/XXXX my full payment was {$1600.00} ( {$1100.00} Principal + Interest and {$530.00} Escrow ) so on XX/XX/XXXX I paid {$530.00} Later in XXXX my payment changed to {$1700.00} ( {$1100.00} P & I and Escrow {$600.00} and make payments on XX/XX/XXXX, XX/XX/XXXX, XX/XX/XXXX and XX/XX/XXXX of the escrow Portion {$600.00}. So from XXXX to XXXX I pay {$2900.00} but they didn't take it in consideration, it was like I don't send any money. So, on XXXX I started to make my regular full payment of {$1700.00} on XX/XX/XXXX, XX/XX/XXXX, XX/XX/XXXX and XX/XX/XXXX, on these 4 payments I sent {$6900.00}. I spoke with a Supervisor on XXXX and they had a different amount, so I was very worry with the way they use my money and on XXXX I made the 5 payments of P+I of {$1100.00} for each of the payments that I sent only the escrow portion, I pay on XXXX, XXXX, XXXX, XXXX, XXXX and XXXX all these 5 payments which equaled a total of {$5600.00}. If you added all the 3 amounts : {$2900.00} + {$6900.00} + XXXX = {$15000.00} to put my account on time, all payments from XXXX to XXXX, but they still claimed from me more money. I'm sending an XXXX with all the amounts, I spoke with more than 40 different people and 15 supervisor and they said they will fix the problem, but they didn't. XXXX promised me that he will call me back with the resolution because I spoke with him two times, but he never called me back. Also, I programed my payments on XX/XX/XXXX of XXXX reference # XXXX for {$1700.00} XX/XX/XXXX # XXXX, XX/XX/XXXX # XXXX, XX/XX/XXXX # XXXX, XX/XX/XXXX # XXXX and XX/XX/XXXX # XXXX I have with me more names of each individual that I spoke with, as well as their extension # ; all the payments was by phone in a recording line. They also charged a late fee of {$56.00} on XXXX but later they credit back, but again I was charged for {$56.00} on XX/XX/XXXX on the statement and again in XXXX and XXXX There is another amount that we are in a disagreement, which is for {$810.00}, this amount come from XXXX XXXX XXXX my previous Mortgage Bank, and start charging me interest for that amount that is part of the modification and I am supposed to pay that amount with no interest at all at the end of the mortgage. So for all these problem, which are making me sick, please write a letter in my favor to complain for all this problems and try to fix because they don't pay attention to me If you have any questions please feel free to call me at any time or write to me

Consumer Complaint: Up to XXXX we have made every payment we were supposed to under the forbearance agreement and then when the forbearance was over gave them XXXX XXXX dollars ie. three regular payments even though we were rock solid on the XXXX a month forbearance terms. We wrote you before with recordings because we did not understand what was going on and included recordings. They have tried to put us under a forbearance plan stripping us of all federal protections which we call and rejected. They have ignored the rejection and though nothing was signed electronically and though I called and said no, insist on this illegal plan. The letter states if you do not agree with the forbearance do not make the first payment. We will not be making the first payment but will be resuming regular monthly payments. You are my witnesses and documentation that we are not agreeing to go into a XXXX XXXX dollar a month repayment plan for six months that strips us of federal protections when we are only XXXX XXXX dollars behind. We will be resuming regular payments not their plan. Thank you

Consumer Complaint: I have submitted an offer on the home for a short pay because the home is an underwater loan. I offered to pay the note holder the FULL amount of the appraisal on the property. I've sent letter since last year letting them know I was in financial XXXX and that it was getting harder and harder to pay the mortgage. I was choosing between paying for the home or food on the table. Finally I had to stop paying on the home because the payment was to much. However, if they would have worked with me I have a loan secured to pay the amount I offered which is the appraisal amount. This seems like a good solution to me since it would benefit both parties. I wouldn't lose my home and the note holder wouldn't incur foreclosure fees. I have a loan secured until XX/XX/2021 to take care of this and have told this company numerous times I need to know if this can happen before this date or I will lose my home. I have worked since I was XXXX XXXX XXXX, always had a job and raised XXXX kids. This company is determined to see me lose my home and if it wouldn't have been for this pandemic I don't think this would have ever happen. My whole family had XXXX and we have struggled with the virus and financial problems since the start but I held on as long as I could and instead of helping me retain my home this company would rather see me lose it. I have even told them I have a XXXX son but does that matter. It a sad day in this country when a XXXX dollar company would see a family lose everything it has worked for instead of helping them. I have paid more so much in interest on this loan it's done paid for the money borrowed and then some but XXXX is the new Normal in our country. It's not about helping the person that has worked hard all their life. Or to the family that whose husband served in the XXXX to defend their freedoms so they could take advantage of people like me. This company is all about taking and taking!

SPS Servicing has informed me, my forebearance has expired and foreclosure proceedings will start in XXXX, XXXX, unless my application is received and approved. SPS Servicing has continually rejected my documents, requested documents, such HOA fees, and military pay stubs, where none exist, and none were listed. I applied in XX/XX/XXXX, and it is now XXXX XXXX. SPS is still rejecting and requesting documents. My relationship manager has never spoken to me directly, when I call, I speak with random representatives. I and my realtor, have both informed SPS Servicing that I plan on selling the house over the summer, prior to XXXX. I need more time to settle my husband 's affairs. I also am recovering from XXXX XXXX XXXX, XXXX XXXX, XXXX and XXXX XXXX in XXXX, as well as job loss due to the Pandemic. Consumer Complaint: To whom it may concern, My mortgage servicer. XXXX XXXX XXXX, XXXX XXXX. XXXX XXXX XXXX XXXX XXXX, UT XXXX XXXX the investor is Deutsche Bank. On XX/XX/XXXX my mortgage was modified. I really wasn't paying attention to the amortization until XX/XX/XXXX. After I did some calculation I realized that the terms of the note where changed without disclosure. You should also know that I had to discharge a BK in XX/XX/XXXX and my attorney unfortunately forget to reaffirm the mortgage so I am worried if I keep pushing for answers the investor will or may call in the note. I have never missed any payment since the modification went into effect and my credit is excellent now so I can refinance it with no issues. My background is mortgage origination and I have my NMLS number so I understand mortgages. I have been concerned about why my principal balance not agreeing with the amortization schedule. After doing several calculations I finally figured it out what happened. The payments were calculated with the following terms. Year 1-5 of the modification was at 40 years. Year 2 was at 35 years and the now its at 34 years. When I reviewed the modification contracts and note there is no disclosure ( s ) that the terms were changed. Also the maturity date didn't chance so how can the maturity date stay the same but the terms changed. Basically even-though I have a modification agreement disclosing the new payments I don't have have any disclosures that the terms changed. I hope it make sense how I am trying explain it.
