Consumer Complaint: Nature of complaint : Select Portfio Servicing ( SPS XXXX is charging me {$330.00} in fees and {$56.00} in unpaid late fees. On XX/XX/XXXX, XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX ) notified me that they were granting a repayment agreement to allow additional time to repay the past due amounts on my mortgage by making additional payments in addition to my regular monthly payments. The total past due was {$3300.00} and the amount became part of my new total monthly payment listed in the Repayment Agreement terms. Per XXXX XXXX XXXX, the amount included all past due payments of interest, principal, and escrow as well as any outstanding fees and costs including unbilled fees and costs. The Agreement would began XX/XX/XXXX and would continue through XX/XX/XXXX. The regular monthly payment of {$550.00} would increase to {$870.00}. The Terms of Agreement was 12 months and if all new total monthly payments were made on time I would resume the regular scheduled payments under the Note and Security Instrument. I signed and accepted the offer. On XX/XX/XXXX, XXXX XXXX XXXX notified me that my loan was being sold, assigned or transferred to XXXX XXXX XXXX ( ShellPoint Mortgage ). Consumer Complaint: I had a Covid forbearance with Select Portfolio Servicing that is coming to an end. They offered a loan modification that is with an even worser interest rate than what I should have been paying during the forbearance, as well as what I should be paying going forward. The forbearance started XX/XX/XXXX when my ARM interest rate was 5 %, but XX/XX/XXXX onwards my ARM interest rate decreased to 3.25 %. XX/XX/XXXX onwards my ARM interest rate adjusts to 2.5 %. However the modification the company has offered is to take the balloon payment owed over the forbearance period, from XX/XX/XXXX to XX/XX/XXXX, ( 11 months of which should have been at 3.25 % ) put it to the back of the loan, and have my interest rate starting XXXX of XXXX be at 5 % for the lifetime of the loan, i.e. TWICE the interest rate I should be paying based on my adjusted rate. I have never heard of a loan modification where the rates was INCREASED, much less doubled, when a modification is supposed to help the borrower. I have written them an email and spoken to two representatives but the supervisor even claims that " this is the BEST solution for YOU '' and that if I don't accept it the loan will go into default. I told her NO this is the best solution for the lender - they get to charge a higher interest rate for most of the entire amount of the forbearance ( 5 % instead of 3.25 % ) as well as going forward and I think this is unconscionable. But she still insisted that this is the best solution for me. I find it hard to understand how a doubling of my interest rate and increase of my monthly payment going forward for the lifetime of the loan, is in my best interest. It's almost like the company is trying to gouge more money out of me as I am in a position of having no choice but to accept their new and worser terms.

Consumer Complaint: SPS offered me an Unemployment Forbearance Plan. The attached document describing the plan is confusing to me and XXXX. On XX/XX/XXXX XXXX XXXX from XXXX XXXX and I called SPS to get clarification of the plan. We spoke with SPS representative XXXX ext XXXX. The two main questions were is there a balloon payment and where will the reduced monthly payment be applied to XXXX principle, interest, insurance and property tax escrow ) XXXX could not answer the escrow question but said " don't worry about the balloon payment, we will call you and see what your financial situation is and make adjustments to the Forbearance Plan. I would like the solution XXXX proposed to be put in writing. When I asked XXXX to put it in writing she refused. Why was the forbearance stopped in XX/XX/XXXX when guarantee existed till XXXX? The CFPB wrote and the original document is attached. " The Coronavirus Aid, Relief, and Economic Security Act ( CARES Act ) 1, which was signed into law on XX/XX/XXXX, provides up to 360 days of forbearance for mortgage borrowers with federally backed mortgages who request forbearance from their servicer and attest to a financial hardship during the COVID-19 emergency.3 In addition, in XX/XX/XXXX, the Federal Housing Finance Agency ( FHFA ), Federal Housing Administration ( FHA ), Department of Veterans Affairs ( VA ), or Department of Agriculture ( USDA ) announced that they were expanding their forbearance programs beyond the minimum required by the CARES Act for a maximum of up to 18 months of forbearance for borrowers who requested additional forbearance by a date certain.4 Through its mortgage market monitoring, the Bureau understands that servicers of mortgage loans that are not federally backed may be offering similar forbearance programs to borrowers. In addition, FHFA, FHA, USDA, and VA extended Federal foreclosure moratoria until XX/XX/XXXX '' SPS unemployment offer ( see attached for the original document " Congratulations! Consumer Complaint: I have no hopes for a resolution with SPS, it is more of a complaint about their practices and the Federal government for allowing such practices to go forward. You can read complaint after complaint and lawsuit after lawsuit with this company on this site and other sites. They have been sued in Federal court numerous times ; them and their parent company XXXX XXXX but yet, nothing is done. I filed a complaint about them charging me inspection fees, even right after I talked to someone on the phone. They send people to my home, charge the fee, bang on my door, take pictures. One man even begged me to let him take the pictures as he said " it was his job, and he would get in trouble otherwise. '' They have banged on the screen startling my children who are home alone when I'm at work. This company has called me at work in the past and nothing was done to them. They have a fake forged loan assignment on file that is against Oklahoma law. They say the assignment was signed in XXXX, but it was not filed with the County Clerk 's office until XXXX with a handwritten copy which is two years after the fact, when state law is clear that it must be no later than 6 MONTHS. I have entered into modifications w/ them only to find out at the end of the modification there would be a balloon payment. When they got a slap on the wrist regarding that, they moved to " escrow shortage '' every year. When I know my state property tax has not increased and my insurance agent happens to be a friend as well so that has not changed. They continue to say " escrow shortage '' and add on to my monthly payments to increase it each year. This year, it is now $ XXXX an apartment isn't even that much. And they write a letter stating " if you can not afford your home other options are available. '' That is all they want, to scare you out of your home the easy way. In XXXX, my work hours were cut, my parents contracted XXXX and I had to be there for my mother and father. My mother was in the hospital for 2 months before passing away from XXXX in XXXX. In spite all this, I still made payments which SPS happily collected and even applied some to my loan even though I was supposedly in foreclosure status ( even with a date scheduled and forbearance status. But when I attempt to make a payment in XXXX, they tell me that can't accept it unless I make a $ XXXX payment. Two times they have attempted to foreclose on my home w/out an assignment attached. The federal government again slapped them on the wrist so they attached the forged one mentioned above. The lady who is supposedly a manager has written statements that she was NEVER a manager with XXXX ( the original owner of my loan before it got sold in the SEC predatory lending mess of XXXX ). In XXXX they told me I had until XX/XX/XXXX to make the $ XXXX but on XX/XX/XXXX their attorney 's filed papers to set a date for the foreclosure. My bankruptcy attorney is set to file paperwork to file for bankruptcy, the only other option this single mother of 3 has to keep a home over her children 's head. My credit score is in the XXXX due to reporting from SPS so no landlord will rent to me especially with the way the housing market is. I have attempted to make payments and stay current, but it is impossible with this company because they continue to prey and add on fees. I've even had representatives of the company in the past tell me that if I can't afford the home, I should move. I've had my relationship manager hang up on me because I asked for a response in writing. One representative even told me to ask my church for money. This company has not responded to XXXX in 30 days prior with no consequences. XXXX XXXX has repeatedly stated they are not the owner of the loan. SPS is now foreclosing as the bank on other people 's homes in my county. They are a service provider, but somehow this is legal and OK. All I ask is, is on XX/XX/XXXX if my home sells, that the sheriff not make a scene, no one throw any of my belongings out. And if the new owners would show me the courtesy of trying to find a home. I have no where else to turn. I do believe I will have 30 days for an eviction or at least squatter rights. But filing for bankruptcy is the action I will take on Friday XX/XX/XXXX. I have attempted to pay, just not $ XXXX. I can not afford it after everything that happened last year. Hours cut, parents sick and life flight bills for my mother, funeral expenses that we have not received reimbursement from FEMA yet. She was on life support for 2 months. A procedure called ECMO which is over {$1000.00} a day and guess who had to help pay for that? I have no savings left due to the effects of XXXX, but I am trying to make payments. I have two jobs ( and they will say I was denied for every program and income was never considered ). I made payments on time all year long last year even in the mist of my hardship. I bought my home in XXXX as a single mother and at no fault of my own, it was sold in the housing crisis to this company who loves to prey on people like me. I sent payments in the past to XXXX before I knew the loan was sold and XXXX went out of business. They keep throwing homes in foreclosure status to collect those fees, and not helping with Escrow payments when you are in a deferral status. I have shown proof but yet, those payments are lost forever. I am waiting on a response to see what their written policy and practices are for denial and their other procedures. I have no more money, time, or energy to fight. I just want the government to stop them before this happens to anyone else. It has happened to too many as you can already see. Could you tell me what their modification underwriting procedures and practices are. Interest rates are 2 % but my loan is at 4 % plus.

Consumer Complaint: My loan is under a modification agreement which has not been honored by SPS, Inc. Based on the Home Affordable Modificationn Agreement, ( HAM ), signed XX/XX/XXXX, the Unpaid Principal Balance was {$230000.00} and {$120000.00} of that balance was to be deferred ( DPB ). The DPB was to be forgiven in 3 forgiveness installments ; 1st forgiveness, XXXX, XXXX ; 2nd forgiveness, XXXX, XXXX and the 3rd and final on XXXX, XXXX. The forgiveness was set at {$42000.00} per installment. All payments, as required, were made in a timely manner and in full compliance. The DPB should have been cleared ; completely forgiven XXXX, XXXX. XXXXXXXX XXXX XXXX XXXX ( prior servicer for XXXX XXXX XXXX ) processed the 1st DPB on XX/XX/XXXX, reducing the DPB to {$85000.00}. SPS transaction records show that with the transfer to SPS in XX/XX/XXXX, there were 4 payments provided and XXXX, XXXX, 4 more payments provided. These payments satisfied the requirements for the 2nd forgiveness! Additionally, {$4400.00} and {$1500.00} was posted XXXX and XX/XX/XXXX, which paid the account through XX/XX/XXXX when the 3rd and final forgiveness should have posted. Only the principal balance should have been remaining! Transaction records provided by SPS prove this, yet SPS will not post the 2nd and 3rd forgiveness that is due. The payments were received as transfers to SPS from the prior servicing carrier. SPS actually issued the DPB forgiveness XX/XX/XXXX ; {$85000.00} and then reversed the transaction. When questioned about it, SPS would never provide a reason for the reversal! All terms of the HAM were complied with, all payments made. The change of servicing carriers is not a reason to not honor the terms of the HAM nor process the forgiveness as stipulated in the HAM. Numerous inquiries, calls and letters have been sent to SPS to honor the terms of the HAM and forgiveness. Records, charts, graphs-all complied from transaction records provided by SPS have been presented to them and I receive no answers. SPS choses to not address the forgiveness ; instead they continually offer a modification agreement for signature-which they have acknowledged through their legal department, would make the forgiveness terms of my original HAM null and void. This lack of action on the part of SPS, is at the least unethical and certainly justification for a thorough investigation of their practices in handling home loans! Documentation of all payments, charts and graphs and other information sent to SPS with my continued inquiries, is all attached.

Consumer Complaint: On XX/XX/2021 we received a letter from Select Portfolio Servicing with a mortgage assistance plan to make double payments for the next 12 months to get back on track. I can provide the letter which states the following : " Right to Appeal You have the right to appeal any non-approval for which you believe an error has occurred by providing a written explanation of why you believe our determination was incorrect, along with all supporting evidence, within thirty ( 30 ) days of the date of this letter to : Select Portfolio Servicing , Inc . XXXX XXXX XXXX XXXX XXXX XXXX, UT XXXX XXXX You have thirty ( 30 ) calendar days from the date of this notice to contact SPS to discuss the reason for non-approval. No foreclosure sale will be conducted and you will not lose your home during this 30-day period or any longer period required for us to review supplemental material you may provide in response to this notice. If a foreclosure sale has already been scheduled, we will instruct our attorney to file a motion to postpone such sale. It is possible however that a court will deny the motion and the sale will proceed. '' On 4/21/2021 I sent and email to Select Portfolio Servicing requesting an APPEAL. and after speaking with our Relationship Manager on the phone, he gave me the instructions and what to include in my appeal email. After 4 weeks I received a from an attorney stating our property would be sold on XX/XX/2021 at a public auction. A few days letter I received a letter from SPS stating my application for assistance was 'WITHDRAWN ''. The next letter I received from SPS stated that I was no longer eligible to mortgage assistance? I was perplex and devastated by the response as I was only following the instructions I was given in the letter. If the APPEAL was not an option then why would the suggestion be included in the Mortgage Assistance Letter dated XX/XX/2021? I just want a chance to make the payments and get my mortgage back on track. Select Portfolio Servicing stopped taking my payments and returned my payments I made in XXXX and XXXX. SPS has serious communication issues and drastic collection methods. We are a minority family trying to keep our home of 14 years. Our kids are getting ready to start high school and it would hurt their development by having to change schools. I am not asking for something that SPS was not willing to offer. They offered us a very difficult method to get back on track but it was the only offer so of course we want to start making the payments. Please help as they have scheduled the foreclosure on XX/XX/2021. Sincerely, XXXX XXXX

Consumer Complaint: I obtained a payoff quote for a HELOC with SPS Portfolio that was good until XX/XX/2021. I paid the amount stated in full on XX/XX/2021. The amount due was less than {$100.00}. The mortgage company is refusing to verify this loan is paid, remove the lien from my home, and have added a fee of {$17.00} which I am refusing to pay XXXX what is it for? ). I have emailed my " Relationship Manager '' 6 times in 4 weeks and the only reply I get is a form letter " Acknowledgement. '' I called and spoke to a rep and supervisor who assured me that I was correct and the situation would be rectified. It has not been. Now they are saying funds " must be certified '' when that was never a stipulation before and the funds were removed from my account weeks ago. On top of all that, they then sent a letter that my loan has been sold.

Consumer Complaint: In XXXX I ran into a hardship and SPS modified my loan. I paid the modified payment until the pandemic hit in XXXX, XXXX. I called and asked for assistance. I received a lowered payment of {$380.00} for 3 months. I then sent in bank statements and proof I was receiving unemployment ( I am in Florida, unemployment caps at {$270.00} week ). I sent in my bank statements showing the deposits from unemployment and my unemployment paperwork. I then received an offer for a repayment plan with payments of {$3400.00}. I was only receiving a total of XXXX XXXX monthly and there is no way I could pay the amount they were asking for. I then sent in an application for a modification and was told I could not get a modification because I refused an earlier offer. The only offer I ever refused was the repayment plan and it is because I could not afford it. I feel as though this is unfair. I defaulted only because of the pandemic and I would like assistance as everything was out of my control. Now, I have been through a pandemic, lost my job and now am at risk of losing my home.
