Consumer Complaint: My husband passed away on XX/XX/XXXX. Select portfolio Servicing and XXXX XXXX have denied me the rights to survivorship- and assumption of the loan- when my husband and I were up to date with the mortgage payments- and found it concerning - when they paid the ex-wife- XXXX XXXX- XXXX for title and keys, as they were working with me, on the transfer of the loan as a successor as my husband passed without a will. the offer was accepted by the ex-wife- and she did just that burglarized and changed locks on me- and I was physically attacked. I filed a motion for the administration of letters- with an attorney- who was paid in full- and did nothing to help me- with the dependent administrator appointed who was highly recommended by the attorneys for the mortgage servicing company Select portfolio and XXXX XXXX- I was working with XXXX XXXX a relationship manager- who eluded me for three months as she stated during this process no payment would be taken- she was also the same person who stated she did not mean for the ex-wife to burglarize my home and change locks and not allow me back into my home. I told XXXX XXXX that I can not afford to live in a hotel and pay my mortgage- and my business was in my home- and have money in my business account but it was robbed - she promised my keys and I was trusted her. they have deceptively and criminally caused me the loss of my rights to my home and my property- and have entered my home trespassing without notice- there is no notice for any of this because- there was no eviction? In probate court, the Judge seemed bias and he made statements that it was not my residence and that I have no rights - no constitutional rights to due process and no property- I had him recused, I fired my attorney it took a whole year to have that hearing- and lost the ability to have legal aid as the court recommended- as the aided and abetted this crime as they hung up on me- and clerks were entering motion after motion to foreclose and nothing entered to protect me or my assets- as the mortgage company attorney lied and met with me to tell me in court- no hearing how they do not want to foreclose they want to help me- as it's their goal to help me be successful- and it was the same day he had entered into the record a morion of my agreement to foreclose- That never happened- XXXX XXXX changed its name to the XXXX XXXX XXXX- and title transfers started from the ex-wife to XXXX XXXX to the court appointed dependent administrator who refused to do an inventory as he also fraudulently entered XXXX for property- to aide the ex wife on her burgalry- and even helped her with representation by US Bank- as they contestested my Motion to administration - when it should be the wife/widow- as this was not how my husband intended things to go if he passed. when I disputed the title transfers as I caught the glitches- and no joiner- my signature- to also include- no death certificate or divorce decree- and the deputy clerk investigated as it was title transfer- fraud, as they then entered a forgery document where my husband is said to have given his 50 % of the property to the ex-wife- on XX/XX/XXXX, XXXX conveniently to fraud the court and to make the fraudulent title transfers to deprive me of my rights to the legacy of my husband- they failed to get a signature from me as a joiner is needed - even if my husband did sign a document in XXXX entered in XXXX after I made statements of a fraud transfer no joiner- to repo home- even if it were true- I still by Texas Law have to give up my rights to my interest as a spouse, in an event a scam such as this would not deprive me of my constitutional rights to my homestead as a survivor. As this is consumer fraud and deception- deprivation of my rights to be successful in a mortgage loan and home- as I still have yet to return home as they threatened me- and as for my property- I have been deprived- all to fraud and deceive me of this assumption that has caused me more than the house is worth. This is mortgage fraud and forgery- white color crime- I reported it to FBI to you and to DA- and Police- DA office said they do not handle these cases- yet when I read how it does they hung up on me- and when I reported to the police- he said they do not help people like me- and nor will the DA- and all of the credit card theft and identity theft to include the loss of my contract and my career- has put me in a position of loss and financial hardship- recovery at my age, and I am disabled- yet no one will help me- as these individuals get away with a crime to steal my homestead- and without notice or eviction- Select portfolio took my information submitted documents important and private information bank statements and pay stubs- to assume the loan was tols they had everything they needed- and then- it was a deceptive and fraud to elude me for 90 days as they deprived me of my rights to my home and property- gave away illegally autos as they even had the ex wife- portraying herself as the widow- as their attorneys receptioniest at XXXX XXXX XXXX said if your the widow- who is XXXX? A document entered into probate court with inventory with the wrong date of death giving the ex-wife the right to transfer auto titles and property taken as if she was me from my home- with the bank and court-appointed dependent administrator- who told me he was not there for my interest but to foreclose. He was highly recommended by the XXXX attorneys, and he was from XXXX as is the judge and substitute judge- and seems, to me its a conspiracy. They did this to Debra Rangel vs. US Bank- and its their stlye to fraud consumers. please help me.

Consumer Complaint: Due to loss of income before and after Covid 19 I have been struggling to make my mortgage monthly payments. When Covid 19 came I contacted SPS and I was offered a Covid 19 Forbearance plan for only one month paying {$860.00} on XX/XX/XXXX. I was never explained why they did not continue with this amount for at least a few months. Before XX/XX/XXXX, I had also contacted SPS, due to loss of income, and I was put on a plan for 3 month 's paying {$500.00} from XX/XX/XXXX to XX/XX/XXXX. Unfortunately I was never told that the amount that I was not paying on the regular monthly payment of {$1200.00} would continue to accrue as late. I believed that this would just stay at the end of the loan and after my repayment plan I could continue with my regular monthly mortgage payment of XXXX. Now on XX/XX/XXXX they send me a letter that I am approved for a temporary repayment plan of 12 months paying {$2200.00}. How could they expect me to pay XXXX XXXXXXXX when I am struggling to pay XXXX XXXX? I appealed this decision, asking them to please modify this plan to 18 months instead of 12, hoping this would lower the monthly payment. I initially had asked to please put this total repayment amount at the end of the loan but they refused. They have also denied my appeal request.

Consumer Complaint: I have been disputing this issue with XXXX since XXXX. I have had a mortgage on my home since XXXX. SPS ( Select Portfolio Servicing ) is my current mortgage holder and has been for the last several years. For some reason in XXXX, XXXX deleted SPS off of my credit report. SPS was finally added back on this year, but a few weeks later I received a message from my credit monitoring company that it had been deleted again. This is my third complaint to CFPB. Im not sure what your purpose is at this point. I have checked with SPS and they assured me that they are reporting to XXXX every month. XXXX XXXX XXXX has it right, but for some reason XXXX can not get it right. This is damaging my credit score as it is lowering my credit age and my credit mix is not accurate. Also, this mortgage has never been late so I want the benefit of all my on time payments for the almost 15 years. I have sent XXXX a total of 5 letters and they still have not address why they are not reporting my mortgage. At this point I am ready to hire an attorney because the level of incompetence is ridiculous. There are several other items that are incorrect on my credit report but I need XXXX to fix this one first. I am attaching my XX/XX/XXXX statement from SPS as proof that I have a mortgage.

Consumer Complaint: After years of SPS telling me that XXXX XXXX is the Trustee on my loan and XXXX XXXX telling me they are not the owner of my loan, my attorney received a notice in the mail stating there is no trustee of record listed and the supposed foreclosing lender is XXXX XXXX XXXX XXXX. However, in XXXX SPS and their attorney published something in the assessor 's office with a handwritten document that XXXX XXXX is the trustee on my property. We have asked for a copy of the title to my home. And have yet to receive it. The only thing I have received from SPS is a letter stating XXXX XXXX is the trustee. How can they foreclose on my home without the title? It was supposedly assigned from XXXX to XXXX XXXX in XXXX, but against Oklahoma law that states it should be filed within 6 months of assignment, but this was 2 years. They are set to sell my home in 2 weeks, and I have nowhere to go! I am a single mom of 3 and have been in my home for 15+ years. SPS will not stop until they get money or get my home. I will be homeless.

First my interest rate remained at 6.25 %. But even more egregious was the fact that they are charging interest on an advance of {$6000.00}. SPS offered an 11-month Deferral Plan. Due to ongoing hardship caused by the Covid-19 Pandemic I requested and request an extension of the forbearance plan I was enrolled in mandated in the FHA, XX/XX/2021 Mortgage Letter XXXX. SPS ignored my requests in violation of White House Rules necessitated by the Covid-19 National Emergency. SPS needs to enrol me in the extension and remove the delinquencies from my account. Consumer Complaint: In XXXX of XXXX, the Homeowner applied for and received loan forbearance due to financial hardship caused by XXXX as provided by the XXXX CARES Act for the following time periods totaling 11 months : XX/XX/XXXX XX/XX/XXXX to XX/XX/XXXX XX/XX/XXXX to XX/XX/XXXX XX/XX/XXXX to XX/XX/XXXX On XX/XX/XXXX, the Homeowner received a letter from the Servicer stating that the COVID-19 forbearance period was ending. The letter directed the Homeowner to the Servicers website for up to date available options for mortgage forbearance. The options presented on the Servicers website in XX/XX/XXXX did not include a COVID-19 forbearance extension option as guaranteed by the 2021 CARES Act for government backed loans. The Servicers website provided the following as the list of all available mortgage assistance options : Modification, Payment Deferral, Repayment Plan, Short Sale, Deed-in-Lieu of Foreclosure. On XX/XX/XXXX the Homeowner telephoned the Servicer to discuss the COVID-19 forbearance. At that time, the Servicer informed the Homeowner that the forbearance was scheduled to end on XX/XX/XXXX. To receive the full 12 months of COVID-19 forbearance guaranteed under the XXXX CARES Act, the Homeowners COVID-19 forbearance should have ended on XX/XX/XXXX. In addition to reducing the duration of the existing COVID-19 forbearance by one month, the Servicer also did not make the Homeowner aware of the COVID-19 forbearance extension provided by the 2021 CARES Act as an option to address difficulty making payments in addition to the options presented on the Servicers website. Presented only with the options of Modification, Payment Deferral, Repayment Plan, Short Sale, Deed-in-Lieu of Foreclosure, the Homeowner agreed to resume responsibility for making mortgage payments as of XX/XX/XXXX. The impacts of XXXX have caused ongoing financial hardship for the Homeowner. Had the XXXX forbearance extension guaranteed by the 2021 CARES Act for government backed loans been presented as an option by the Servicer in XX/XX/XXXX, the Homeowner would have accepted. Had the Homeowner been given the benefit of the full 12 months of forbearance guaranteed by the 2020 CARES Act, the Homeowner would have had the benefit of one additional month of relief and an additional month to secure the benefit of the COVID-19 forbearance extension guaranteed by the 2021 CARES Act. Given the errors committed by the Servicer, the Homeowner is requesting that the XXXX forbearance be reinstated on the Account for the period starting XX/XX/XXXX and ending XX/XX/XXXX. This reflects an additional forbearance period of seven months, to include the month reduced from the initial 12 month forbearance period and the six month extension guaranteed by the CARES Act of 2021 for government backed mortgage loans.

Consumer Complaint: My second mortgage, originally a home equity line of credit with a " balloon '' payment at the end matured in XXXX of this year. The amount is XXXX. I am unable to come up with that amount. I have tried no less that 5 times to successfully submit the application to modify this loan with SPS, aka Select Portfolio Servicing. Each time, some mistake or flaw is found which completely " voids '' the entire submission-it is not amenable to correction or amendment. Please note : this is essentially the same paperwork, with the stipulated corrections, that is filed, only for some clerk to " discover missing '' or " erroneous '' information. on XXXX application, I checked the " wrong '' tiny box. This process is time-consuming and extremely frustrating and so out of desperation, I made them a cash offer of XXXX. At this juncture, they " need '' information about my " social security benefits ''. I have repeatedly told them I DO NOT receive any form of social security, to no avail. Meanwhile, I continue to receive harassing letters threatening me with imminent foreclosure if I do not " act quickly ''. Their " customer service '' dept. is of no help whatsoever ; the " mortgage concierges '' are hostile, abrupt and condescending. In addition, they reported two of my payments to them as " late '' to credit bureaus. My payments have always been early or on time and I see from other customers that this is their standard practice to harass and wear people down in order to force them into foreclosure. My goal is to avoid foreclosure, get rid of this now XXXX year old loan in a fair fashion and move on. Thank you
