Consumer Complaint: I have a home equity loan that is being serviced by Select Portfolio Servicing ( SPS ). This loan is a 15 year loan that is scheduled to mature on XX/XX/2021. The current balance reflected on my loan by SPS is {$17000.00} and my monthly payments are {$1200.00}. My account is not delinquent and with 3 months of payments remaining, the loan will not be fully amortized as it should be. There will be a balance owing of {$13000.00} that includes an agreed upon 3 month payment deferment of {$3800.00}, leaving an unpaid principal balance of {$9800.00} that is incorrect. Since XX/XX/2021, I have attempted to resolve this matter with SPS numerous times as I should not be responsible for a balance for which payments have been made. In my review of the payment history that was provided, it does not appear that payments were properly applied to my account and several unusual adjustments were made. SPS representatives indicated that an audit would be performed on my account and that I would receive a resolution to the disputed amount remaining at the maturity of my loan in XX/XX/2021. The responses that I received were inadequate and did not address the disputed principal balance. The first response I received on XX/XX/2021 included a 15 year amortization schedule that suggested that my current principal balance should be {$3800.00} instead of {$17000.00} ; however, no adjustment was made to correct it. The second response that I received on XX/XX/2021 referenced adjustments made to the payment history but stated that the balance of {$17000.00} was correct as stated although it does not match the amortization schedule. There was no documentation provided to support this statement. It suggested that I am responsible for the overstated principal balance. For your review, I have attached the " dispute resolution '' letters that I received from SPS. Again, I would like this matter resolved prior to the maturity of the loan on XX/XX/2021 to avoid any negative impact to my credit reporting.

Consumer Complaint: REF : SPS SELECT PORTFOLIO SERVICING MY SIGNIFICANT OTHER PASSED XX/XX/XXXX. THE MORTGAGE WAS TRANSFERRED TO THE ESTATE UPON PASSING. HOME WAS TITLED AND DEEDED TO MYSELF WITHIN THE PAST TWO YEARS. THE FINANCE COMPANY APPROVED ME AND THEN DENIED IN XXXX XXXX. I HAVE BEEN TRYING TO HAVE AN AFFORDABLE PAYMENT WITH SPS AND THEY HAVE NOT AT ALL BEEN HELPFUL. WE HAVE FILED MODIFICATIONS, HARDSHIP LETTERS AND SHORT SALE. TO DATE SPS FORWARDED THAT THE HOME TAXES AND INSURANCE ARE MY RESPONSIBILITY. THE MORTGAGE IS STILL IN THE DECEASED NAME BUT TITLED IN MY NAME. THE MORTGAGE COMPANY HAS NOT ASSISTED OR HELPED AND WE KEEP GETTING A RUN AROUND AND DIFFERENT ANSWERS EVERYTIME WE CALL FROM DIFFERENT PERSONNEL. I AM AT A LOSS AS TO WHAT TO DO IN ORDER TO NOT LOOSE THE HOME I HAVE BEEN RESIDING AT SINCE XX/XX/XXXX. I APPRECIATE ANY ASSISTANCE AS THIS COMPANY HAS NOT WORKED WITH ME AT ALL. Consumer Complaint: We have been struggling to get assistance from SPS since our mortgage was sold to them by XXXX XXXX XXXX. In XXXX our mortgage was sold to SPS and it took over 6 months ( almost a year ) for us to be acknowledged as successors in interest. We actually had to make a previous complaint and they finally called us and said ok we will make a payment plan with you guys so that we could catch up and begin to pay our mortgage. The payment plan they offerred would have required us to pay double our mortgage payment to catch up and nothing went towards the arrears so we suggested a plan that would pay towards the arrears and pay on the current mortgage which was denied! We were then told that we can not pay on our mortgage unless it was the full balance owed. Then CORONA hit!! We submitted a loss mitigation application in XX/XX/XXXX. We submitted our information over and over again and SPS kept sending letters saying we were missing information. After calling and emailing throughout the pandemic now XX/XX/XXXX they are now saying that all of our info in submitted andour application was complete as of XX/XX/XXXX and now 30 days later it is XX/XX/XXXX and they quickly denied us for a loan modification and assumption within 2 weeks after having our application for a year!!! We are constantly being denied assistance to pay our mortgage. We are constantly being denied any payment arrangement or being offered an arrangement that is so large that they have forced us into foreclosure we believe for the betterment of the company and not homeowners who have faced a terrible financial loss. We believe that SPS is not acting in good faith especially during a pandemic. We will resort to requesting a hearing as per CPLR 34087. SPS has never offerred us any assistance or allowed us to make payments to remedy this foreclosure. SPS has taken so much time verifying documents that have been sent in over and over to purposefully waste time and accelerate a foreclosure proceeding.

Consumer Complaint: this time they sent XXXX at XXXX ext XXXX he stated I am the successor and he was sending me a packet in the mail to complete the assumption even though this has been done a few times this time it was for real??? I went to go see my home???? My home is completely destroyed- that code compliance when I called told me the owner is XXXX XXXX XXXX the highly recommended dependent administrator- whom with the ex-wife working with XXXX XXXX and XXXX trustees and select portfolio service who hired- XXXX- as charges on every single bill was for preservation, and the fact that the Code Compliance by XXXX XXXX on his sending a cleaning crew to clean up and they clean out my home of property and autos are all gone- and grand theft auto? every single file and computer device burglarized- and it makes sense why they prevented my return to my home- was because they had made it so unlivable- and demand they repair the damages and the cease and desist on the fraud acts of charges for services they never planned to do but only wanted to extort money viacariously to charge and make a fraud earning at my expense and losses- They took the laws into their own hands and trespassed, had others trespass without notice or warning of such destruction- They have extorted a vulnerable adult protected under ADA sec 504- as they deprived me the rights to have an assumption and modification- as it was used to run the clock and tally up a loss by their hand not by mine- and then want to tac it on as a bill I owe when in fact they owe me as the law states 3x my losses- I meed to file an insurance claim- not on the insurance I was paying for via the billing statements as this is fraud and corruption to ruin the structure of the home to bank on insurance- so need my home back to a home that is not a health hazard as it is for me and the public- I have been deprived of home and property by the court appointed administrator the liasons who viacariously are responsible for the gross neglect of the illegal acts of this dependant administratpr- as he never cared about the benificiaries just the forclosure- I demand Justice- I been complaint after complaint- still they do not care as its like too many people they have hurt one class action after another- please advise

Consumer Complaint: This is a complaint about XXXX XXXX XXXX, although theyre a law firm, in this case by their own admission they are acting as a collection agency, therefore my complaint against them as a collection agency. I have received a letter from them on XX/XX/XXXX, marked as Exhibit 1, alleging I owe a certain amount of money to my Mortgage Company and they asked me to request verification of this alleged debt within 30 days of their letter, in response I sent a letter marked as Exhibit 2, which hat they received on XX/XX/XXXX. According to their letter, I had 30 days to verify the debt which would give me time until XX/XX/XXXX. To my dismay I have received a non-Judicial foreclosure notice dated XX/XX/XXXX. Marked as Exhibit 3. This is a clear violation of FDCPA which is a federal law. I would like you to look into this matter and take appropriate action against the collection agency whos responsible for this violation. Thank you for your time, looking forward to hearing from you soon. FYI, XXXX XXXX was known as the foreclosure mill in the state of Georgia during the 2008 financial crisis.

Consumer Complaint: I have applied for XXXX in order to refinance my mortgage with Select Portfolio Servicing ( SPS ) since XX/XX/2021 and they still have not completed this documents. I was told at the beginning of this process to allow them 6-8 weeks, but now it has been more than 16 weeks and nothing has happened. I have made all my payments on time since 3 years ago that they took over my mortgage but because I have a very high interest rate, I'm having hard time making my future payments. I have tried calling and communicating with them numerous times and every time my complains don't get anywhere. It seems like they are holding the note XXXX so please help me get my XXXX completed so I can finish my refinancing to a lower affordable rate with my new lender. Thank you.

Consumer Complaint: I own the property and was renting it out since XX/XX/XXXX. My tenants experienced major hardships due to covid job/income loss. This issue started in XX/XX/XXXX and they were unable to catch up on the rent. They made a payment on XX/XX/XXXX, in which i applied it to the XX/XX/XXXX rent/mortgage. During that time SPS ( Select Portfolio Servicing Inc ) .the loan servicing company had the loan in a forbearance status. XX/XX/XXXX i was told by them that no further forbearance they can offer. I was very shocked that they would not offer any more assistance. I asked for a modification and was denied. They basically said to pay or they could offer me XXXX to move. Im trying to understand, how can i pay them without receiving rent.? Furthermore the Tennant 's are federally protected against evictions etc. Landlords aren't offered any protection thru this company at all. They sent me a letter dated XXXX XX/XX/XXXX stating that if i pay XXXX they would reinstate me. That amount is only good till XX/XX/XXXX then it will change and go up with legal fees and charges etc..I need a modification to help go current during theses extreme times.
