Consumer Complaint: I tried talking with this company but seem like I didn't get anywhere with them XXXX XXXX XXXX XXXX XXXX did a foreclosure in XX/XX/XXXX and foreclosure sale in XXXX of XXXX and filed eviction in XXXX XXXX on a Texas home equity home loan line of credit contract. This has my mother and stepfather is named forged on this contract the original loan was paid off XX/XX/XXXX of XXXX the loan servicer was XXXX XXXX XXXX when the mortgage was paid off and full and satisfied I have been fighting with them for 7 years and they are breaking the law and the rules and regulations and I got a paper a a certificate of facts from the secretary of the state that shows they don't have no information of them doing any type of business here in Texas. This problem has caused me pain and suffering because they have stowed money and they're trying to steal the property and this is way above {>= $1,000,000} issue so I hope this problem to be solved and I will send a copy of the certificate of fact or any other documents that I can attach to this because they are criminals and his property I have the paperwork that shows proof that this property has been paid off everything has been filed and recorded the County recording office also have the release of XXXXien of the property that shows my parents are the rightful owners of this property and there is no mortgage on this property the due to the fraud and the forge that has been going on for 7 years now since I've been dealing with this company or these Crooks

Consumer Complaint: In XX/XX/XXXX, my mortgage servicer was transition from XXXX XXXX to SPS ( Select Portfolio Servicing ). It is important to note that my second mortgage had a maturity date of XX/XX/XXXX, triggering a balloon payment of approx $ XXXX. At the time of the transfer, I was working with XXXX on review of my loan for a COVID-19 hardship, but that transfer could not be halted during the review. Eventually, in XX/XX/XXXX I received a letter and subsequent customer service calls from SPS reminding me of the impending maturity date and asking if I was experiencing a hardship, especially around COVID-19, and was interested in a Request for Mortgage Assistance ( RMA ). After further discussions with SPS in late XXXX and early XXXX, I submitted a RMA package electronically through their website per their instruction on XX/XX/XXXX, with full backup of supporting documents due to both experiencing a XXXX hardship and need to extend the maturity date beyond XXXX. Each month well into XXXX, SPS would request additional documents to support my submission, beyond the initial requests. In late XX/XX/XXXX, I noticed that my autodraft month payments for this 2nd mortgage showed delinquent on my online account, and my bank records did not show payment of the {$210.00} due since XX/XX/XXXX. When I spoke to a SPS representative, the informed me that due to the maturity date in XX/XX/XXXX, they turned off my autopay feature. I then asked can I make a payment through the SPS webportal, they said that was not possible as that was shut off too. I then inquired as to how I was then being represented to the credit bureaus for these several months, and was told I was being marked as " late-no payment ''! I communicated that this was not something I had agreed to, and immediately wanted corrected. Another SPS representative finally stated I can make a payment by wire transfer for the missing 3 months for {$860.00}, plus they would correct my credit reporting as well to recognize I was in a mortgage modification review and not show me as " late ''. Per their instruction, I wired the funds on XX/XX/XXXX to SPS XXXX Bank account and they confirmed receipt. More month past, and XXXX continue to receive collections calls from SPS alerting me of the XX/XX/XXXX maturity date and asking me do I have a covid-19 hardship, for which I explain I do and am already in a review process. For every call I have ever received, I authorized them to be recorded, so there could be a record. This will continuously show my willing to cooperate and how this program is flawed and in the end caused me damage. In XXXX, I received the determination that I was not applicable to the mortgage assistance program, and nothing can be done -- after 7 months of review. I then noticed that SPS also reported me late to the credit bureaus still from XXXX to XXXX. They then offered me options to sell or foreclosure my home. I repeatedly requested them to re-review my account and situation to representatives and managers, with no further assistance available, but oddly they began to offer me an opportunity for a " forbearance program '', which I though was strange and ignored. When I reviewed my credit report, it showed I fell from a credit score of XXXX to XXXX due to being reported late during this review process -- - again, nothing I ever accepted, nor authorized! On XX/XX/XXXX I escalated a request for an internal dispute investigation within SPS through a manager to both review my delinquent credit reporting and my continued willingness to pay the account in full, and was told to expect a reply within 7 business days, plus the manager would call me directly to discuss the outcome soon after that determination. I followed up with a call to SPS on the XXXX, and told no determination was made at that time, plus told the review could take up to 30-days. This deeply concerned me as it meant that I could be marked additionally late for XXXX and XXXX depending on when the review completed and the final result, but I was instructed by the representatives time and time again to not pay the amount in full, but instead wait until the final result of the investigation. On XX/XX/XXXX, I received the determination from SPS that SPS will not request a change to my credit reporting and they would continue reporting as such " until the account is in final status ''. On XX/XX/XXXX, I called SPS to discuss this result with a manager, and they confirmed this was the result, which I stated was unfair to the entire process of a modification review. The SPS manager stated though that review was closed, I was applicable and approved for ANOTHER mortgage assistance review process if I was experiencing a COVID-19 hardship -- the COVID-19 forbearance program, and this program would abate payment for 3-months AND report to the credit bureaus as " Not Reported ''. I was confounded at this offer, and immediately asked why was I not offered that in XXXX or XXXX or at any time earlier?? I was told that they only reviewed me for one program initially, their typical mortgage assistance program that does not include consideration for COVID-19. Now that the initial consideration concluded, they would review me for this other one -- and I applicable for it. And this COVID-19 program allows for different than their typical program. You can imagine I was furious that I was only reviewed for a non-COVID-19 opportunity, when I clearly expressed my needs and concerns throughout the entire endeavor, and now I am damaged with a poor credit score. I am seeking help from the CFPB to intervene in this matter and provide assistance in fixing my credit report and getting me into a proper COVID-19 assistance program.

Consumer Complaint: I was going through a divorce and had to move out of my home. My wife was still living in the home. I began to work with a real estate agent to complete a short sale on my home. Per the lender, all documents were submitted that were needed. We had been working and cooperating with the Select Portfolio since the short sale file had been opened. My lender began asking for duplicates of information already sent. At the request of the lender, my agent re-submitted all information. Upon calling in to get an update, the mortgage lender stated they cant help me due to a foreclosure sale date being established and because they mailed out a document that needed to be sent back that I never received. I am just trying to sell my home via a short sale and have done everything that was requested of me. It seems as though they are trying to force me into a foreclosure and not assist me with my property and that's not right. Can you help me in some way please. My foreclosure date is XX/XX/21

Consumer Complaint: I went into a Covid forebaerance and I was granted 3 months this started in XX/XX/2020. When the plan was up the but the small amount onto the back end of the loan and advised me to start making my new payments. My loan adjusted and the payments went up over 4,000 per month. I was told to submit a modification package to see if they could help lower the payment. I requested the modification and sent in all the papers. The first time I submitted they came back saying that the mortgage was ineligible because the current unpaid principal balance on my loan was higher than the program limit. I did a appeal asking why you had me submit a modification and wait over 50 days to hear this answer. I received the appeal response and was told try again in 30 days. We submitted again and then got another response stating that based on the delinquency of the account they could not modify my loan. They knew the delinquency yet still put us thru another review. We were called several times and told to resubmit again we also received letters asking up to resubmit our Mod. We did this several more time at the request of SPS. Each time would drag out the process 30 or more days. I sent a letter to SPS request Why I was not given the right answers and also why they kept asking me and sending me packages to submit for a Mod but they would not respond. Under each plan that would be offered I was turned down for with only a short line response. I requested the full investor guidelines for my review and I requested the proof that the investor had turned down my requests. They also did not do the correct income figures which was 4000 less than my true income. I want all phone records as that way I can prove how many times they asked me to submit a Modification request. I was given the run around for months. SPS would come back and request More and More documents.

Issue: Applying for a mortgage or refinancing an existing mortgage

Consumer Complaint: I am trying to get select portfolio to modify my loan and they keep requesting the same information that I have already submitted electronically over and over again. I have spoken to different people via telephone conversation regarding this and no one seams to be able to help. I need some assistance with a modifications on my loan. I lost my job during covid and fell behind on my payments I have now started working and would like to continue making payments to keep my home. Select portfolio keep telling me every week when I call that they are getting ready to take legal action if I do not bring my account current. I am asking to put my past due at the end of my note and allow me to make payments to keep my home. I was told that they are not a mortgage bank and they can not do that..i need someone to assist me with this. It's difficult to deal with this company with all the miss information that the representative give. Seems like everytime I call i speak to someone new who don't know what they are doing.. Please help me with this company. I don't want to lose my home please. XXXX XXXX

Consumer Complaint: In XX/XX/XXXX when the pandemic shutdown was announced I notified my mortgage company Select Portfolio Serving Inc that I had concerns about paying my mortgage because being self employed, my client ( a prom attire store ) knew his business would collapse for the XXXX season. I was advised that I would not have to make mortgage payments for the months for XXXX. I did not make those payments and SPS reported to all credit bureaus my account as current for those three months. For XXXX as the pandemic continued, I continued my contact with SPS and I was repeatedly told that I did not have to make payments. However for XXXX SPS reported my account to all three credit bureaus as " Unknown. '' For XXXX I entered into a modified agreement paying {$290.00} per month. I was advised by SPS that had I to make all the payments by the 1st of the month, if not, my home would be turned over for foreclosure. I made all 4 payments on time yet SPS reported " Unknown '' to all the credit bureaus for those 4 months. SPS notified me that I needed to enter into another modified agreement for the months of XXXX to pay {$850.00} per month with the same conditions of timely payments. Again, I made all four payments on time but this time SPS reported to the credit bureaus XXXX & XXXX as *Current*, XXXX & XXXX as *Unknown* I entered into the final modification in XX/XX/XXXX. I have made all payments on time and XXXX has been reported as current. I have now contacted SPS on 2 separate occasions about the inconsistent reporting of my account to all current bureaus but to no avail. Both of my letters were successfully uploaded to their website. I have contacted SPS last month to request an old tax document. SPS was timely in their response ; however, they refuse to address the inaccurate reporting on my credit report.

Consumer Complaint: I purchased my property in XXXX of XXXX. Through XXXX XXXX. I ha a first and second. I was denied at first and within about a day or two after the denial they sent another correspondence stating that I was approved. ( I still had my mortgage on the XXXX XXXX XXXX XXXX XXXX, Az ). I was shocked as I did not sell that property and had a mortgage on it and purchasing as a single individual. In XXXX the market fell apart. I tried to modify my loan and it took SPS ( Select Portfolio Services almost a year to complete my MOD ) Shortly after my arm came due and they set my interest at 7.5 % making py payments go from XXXX to XXXX. When my loan was modified I assumed that both first and second was modified. Once my modification and ARM was completed I was only paying one payment, ( XXXX.aprox. ) Until the pandemic. Last year I contacted SPS and advised them that I had not received any type of commission from XX/XX/XXXX to XX/XX/XXXX. I then started my modification with them and they just keep requesting more and more documents each time. I would submit my documents and they would ask for the same documents; stating that the time had expired. In the meantime I received a letter from XXXX XXXX stating that I had a second lien that I was not paying on. I tried working with them and received no response. Once I got to talk to someone, she advised me that it was not XXXX XXXX, that I should be talking to but to XXXX XXXX. I then contacted XXXX and told them I was corresponding with XXXX and they did not care. They placed a Foreclosure date on my home. I called, I begged them to give me some time to research and work this out and again they transferred me to one person to the next. No help whatsoever The foreclosure date was then changed from the XXXX to the XXXX. I called and they stated to me that the property was reverted back to the bank. There was not a sale. Since then I have not received any correspondence from XXXX XXXX, XXXX XXXX until yesterday when I received a letter form XXXX, XXXX, XXXX XXXX XXXX, XXXX. XXXX XXXX XXXX, .XXXX XXXX XXXX XXXX Florida XXXX giving me 5 days from the date of the letter ( letter dated XX/XX/XXXX ) to vacate the premises. I have been looking for a rental for the past four weeks. Arizona 's demand for rentals is high so it is taking longer to find a home. I have a home filled with my belongings that I have accumulated for the past 40 years. How can I move in such short notice. They can have my home. It is a material possession. My well being is more important than a home. Houses come and go. I just need at least a month to find a place to live. It also takes money to move. My life will continue and I hope that just as I feel I can live with myself ; I hope that all the parties involve can say the same.
