Consumer Complaint: Portfolio Recovery Associates LLC has failed to validate a purported debt they've been claiming I owed them and refuses to cease and desist from inaccurate reporting and debt collection malpractice by somewhat renewing dates of the so called debt being owed allegedly by me, They have violated sections of 15USC 1681 ( e ) ( n ) ( o ). They claim they've investigated and verified the debt to be valid but has yet to produce one single signatory document or contract that validates their claim. They have also failed to produce any methods or processes that they used to come to such a conclusion to an alleged debt that they have failed to validate, This has been very frustrating for me and my family as my letters to Portfolio to delete such information from my credit file has gone unheeded as required by the law.

I was shocked to discover that my recent credit report contains a Portfolio Recovery " collection '' allegedly owed to XXXX XXXX XXXX, initiated in XX/XX/XXXX. This information is categorically false and incorrect. I do not owe any amount to XXXX XXXX XXXX as alleged in this report. The information being reported is false, inaccurate, incorrect, and fraudulent. It is important to note that the matter about the XXXX XXXX XXXX account was conclusively resolved through a Joint Dismissal With Prejudice in XXXX. This legal resolution unequivocally confirms that there is no outstanding debt or obligation on my part regarding the said account. Attached are copies of the relevant documents that substantiate my claim. These documents include the legal dismissal paperwork, indicating a full and final settlement of any claims associated with the XXXX XXXX XXXX account. I request the Consumer Financial Protection Bureau to investigate this matter promptly and ensure the correction of this inaccurate information on my credit report. I have never done business with this company and just the fact that they have access to my private and personal information without my consent is causing me great mental anquish. I have NEVER agreed to or transacted to do any business with PORTFOLIO RECOVERY or any of its affiliates and my identity has been comprised and I will seek relief if not rectified and deleted immediately. This reporting is fraudulent and a violation of my rights under FCRA, FDCPA and my right to privacy.

Consumer Complaint: Around XXXX XXXX XXXX, my bank notified me of a Garnishment on a shared family account. It was from Portfolio Recovery Associates LLC. The bank provided me with a case number and a phone number for an attorney associated with Portfolio Recovery. I contacted them immediately, and asked for copies of the Court Case, but was told they had no idea who I was and hung up. I have attempted to contact Portfolio Recovery numerous times for copies of the actual debt, the Summons and Complaint, any exhibits used for court, Proof of Service, and the Judgment. The only case number I was given was from the Bank which is XXXX However, I can not even locate what state this alleged Court Case was in. I have requested this paperwork continually over the last few years, but still have not been provided any of it. This is the second complaint I have filed with the CFPB on this matter as well.
