Consumer Complaint: I have been sending letters to Portfolio Recovery to validate an alleged debt and requested that they remove it from my credit reports, however, they sent me a generic letter showing a bill. As we know, that is not a debt validation. On XX/XX/XXXX, I sent another certified letter to PRA requesting specific documents to validate the alleged debt, however, they sent me a letter dated XX/XX/XXXX stating that they will not conduct another investigation after they completely ignored the one sent XX/XX/XXXX. On XX/XX/XXXX at XXXX, I received a call from XXXX XXXX XXXX XXXX, and spoke to agent XXXX XXXX XXXX XXXX who informed me that my letter dated XX/XX/XXXX was denied ; which makes no sense, and practically harrassed me, I never once stated/confirmed who I was, and he started talking about this alleged debt. I have been requesting debt validation, they have not been able to provide that to me, and they have not removed the account from my credit report like I have asked. They continue to stall me and report this allegation on my credit report.

Consumer Complaint: I AM filing this complaint on portfolio recovery, as they are claiming I owe {$450.00}, for not replying in a timely manner to my initial debt validation letter that I certified mailed on { XXXX }, portfolio recovery has NOT only violated federal and state laws, but they have also failed to provide me with a copy of any viable evidence, bearing my signature, showing the account is being reported accurately. According to 15 U.S.C. 1692k, any failure to validate this debt or any violation of the FDCPA will leave portfolio recovery subject to potential legal action for damages. They have not sent me any correspondence whatsoever and it is impacting my credit worthiness.

Consumer Complaint: I am so tired of dealing with this company. They claim to have mailed the consent judgment on or around XXXX XXXX. I received it on XXXX XXXX and the due date to send it back was the XXXX! I have proof from the post office that I didnt receive it until later. Why mail something after the actual due date that you put in the letter. That is setting someone up. I did however go ahead and sign the consent judgement and returned it immediately to the company. This should mean that I would not need to go to court, but I have not received any news that my court case is canceled. This should have been taken care of already. This was 3 weeks ago! At this point I would rather file bankruptcy than wait for someone to contact me. The case should have been dismissed due to the agreement and consent judgement that I signed. Why has this not happened? They want me to pay extra court fees and miss a day of work. I can not miss a day of work for this.

Consumer Complaint: Consistent with Congressional policy, I have the right to ensure my private information is not shared without my consent. 15 USC 6801. 15 USC 1681 ( b ) ( 2 ) states that " [ i ] n general Subject to subsection ( c ), any consumer reporting agency may furnish a consumer report under the following circumstances and no other : in accordance with the written instructions of the consumer to whom it relates. '' See also P.L 90-321 ( 82 Stat. 146 ). Portfolio Recovery Associates , LLC ( " PRA '' ) does not have my consent to furnish this information and they surely do not have my written consent. This lack of consent is confirmed by the attached legal opt-out notice. Moreover, 5 U.S. Code 552a ( a ) ( 4 ) and 5 U.S. Code 552a ( b ) ( 12 ) ( hereinafter the Privacy Act ) protects my right to privacy. Under the Privacy Act, subsection ( a ) ( 4 ), the term records include a consumer report. The disclosure of a consumer report ( a record ) under the Privacy Act can not be furnished without the prior written instruction of the consumer ( the individual to whom it relates ). PRA does not have my written consent to publicly furnish these records nor can they produce the same as it was never given to them. Additionally, 15 USC 6802 ( b ) ( c ) forbids the disclosure of " nonpublic information to a nonaffiliated third party unless the consumer is given an explanation of how the consumer can exercise that nondisclosure option. PRA never informed me of my right to exercise my nondisclosure option. And per the enclosed notice, I revoked any consent - implied, express, verbal, or non-verbal- to which PRA may have been relying on is legally revoked indefinitely. 15 U.S.C. 1681s-2 ( A ) ( 1 ) states : [ a ] person shall not furnish any information relating to a consumer to any consumer reporting agency if the person knows or has reasonable cause to believe that information is inaccurate. Also, 12 CFR 1016.17 states that [ a ] consumer may exercise the right to opt-out at any time. I am opting out of PRA 's reporting of this account. Accordingly, PRA has received lawful notice of my opt-out of their reporting of the following account to non-affiliated third parties- such as XXXX, XXXX, and XXXX. Thus, PRA is not lawfully permitted to continue reporting this account on any of the consumer 's credit reports.
