Consumer Complaint: I recently discovered that Navy Federal Credit Union seems to be sharing my non-public personal information XXXX XXXX XXXX with XXXX XXXX, more specifically XXXX, XXXX XXXX XXXX. This raises serious concerns about compliance with federal laws and regulations. The sharing of XXXX with XXXX XXXX is a direct violation of my rights under various federal statutes, including the Fair Credit Reporting Act ( FCRA ), Equal Credit Opportunity Act ( ECOA ), Gramm-Leach-Bliley Act ( GLBA ), and the Privacy Act of XXXX. These laws are in place to safeguard the privacy and rights of individuals, and any violation thereof is taken very seriously. According to the Fair Credit Reporting Act 15 USC 1681 section 602 A states, There is a need to insure that consumer reporting agencies exercise their grave responsibilities with fairness, impartiality, and a respect for the consumers right to privacy. '' XXXX, XXXX XXXX XXXX are consumer reporting agencies and as a Consumer I have the right to make sure there is no private information being shared which is protected by 15 USC 6801 which states '' It is the policy of the XXXX that each financial institution has an affirmative and continuing obligation to respect the privacy of its customers and to protect the security and confidentiality of those customers nonpublic personal information. '' ( Furnisher of information to credit agencies ) is a financial institution by definition under that title. 15 USC 1681 section 604 a section 2 states that " In general Subject to subsection ( c ), XXXX consumer reporting agency may furnish a consumer report under the following circumstances and no other : in accordance with the written instructions of the consumer to whom it relates. '' ( Furnisher of information to credit agencies ) not only the financial institution but also the consumer reporting agencies such as XXXX and XXXX do not have my authorization to furnish this nor any information also never have I ever gave or given my written consent to do so. XXXX and XXXX consent to XXXX, XXXX, ( Furnisher of information to credit agencies ) whether it be verbal, non-verbal, written, implied or otherwise is revoked. 15 USC 6802 ( b ) ( c ) states that " A financial institution may not disclose nonpublic personal information to a nonaffiliated third party unless the consumer is given an explanation of how the consumer can exercise that nondisclosure option. '' ( Furnisher of information to credit agencies ) Never informed me of my right to exercise my nondisclosure option. Not only that 15 USC 1681C ( a ) ( 5 ) states '' Except as authorized under subsection ( b ), no consumer reporting agency may make any consumer report containing XXXX of the following items of information XXXX other adverse item of information, other than records of convictions of crimes which antedates the report by more than XXXX years. '' This account is an adverse item they are reporting again without my authorization which is designed to avoid violations of section 1681c of this title and to limit the furnishing of consumer reports to the purposes listed under section 1681b of this title. XXXX and XXXX are not maintaining reasonable procedures. Also 12 CFR 1016.7 states that " A consumer may exercise the right to opt out at any time. '' I am opting out of your reporting services.I recently discovered that there have been instances where my non-public personal information ( NPPI ) has been shared with non-affiliate parties, more specifically XXXX, XXXX XXXX XXXX. This raises serious concerns about compliance with federal laws and regulations. The sharing of XXXX with non-affiliate parties is a direct violation of my rights under various federal statutes, including the Fair Credit Reporting Act ( FCRA ), Equal Credit Opportunity Act ( ECOA ), Gramm-Leach-Bliley Act ( GLBA ), and the Privacy Act of XXXX. These laws are in place to safeguard the privacy and rights of individuals, and any violation thereof is taken very seriously

Now On XX/XX/XXXX I Called Navy Federal And They Advised Me That Checking Account Was Closed So They Cashed Refund Check To Pay Off Loans Someone Fraudulently Opened in My Name. After Speaking With The Navy Federal Credit Fraud Department They Told Ne They Have Right To Off Set Account Because I Signed A Security Interest and Disclosure Granting Permission. It Should Be Noted That Navy Federal Has Failed To Provide 1. Copy of ID Used To Open Loan. 2. Copy of Signatures. 3. Copy of How Refund Check Was Used 4. They Never Answered Questions About Why They Took Funds Sent To Closed Account and Never Returned Back To Irs. 5. They Failed To Provide Investigative Procedure. 6. They Are Reporting Inaccurate Information on My Reports.

Consumer Complaint: On XX/XX/XXXX I deposited a check wrote to myself from my XXXX business account into my Navy Federal Credit Union personal account via ATM machine on XXXX XXXX. in XXXX XXXX, XXXX On the line I wrote out {$7000.00} but, in the box, I wrote {$1700.00}. XXXX flagged the check and asked me to call them once I was made aware of the error XXXX advised that they go by what is written on the line so they will go ahead and process the check and release the funds. I spoke to NFCU and they advised the check would be on hold for 5 business days to ensure the funds cleared. After 5 days they advised the check was on a permanent hold until XXXX provided a letter stating the check is indeed valid. I reached out to XXXX via phone and in person and was told they do not write letters that the funds were release to NFCU on XX/XX/XXXX so they are not sure why they are holding the funds, but they can do a bank-to-bank verification NFCU would just need to reach out to them. NFCU stated they would reach out, but it would take 30 days that I would need to call back in 2 business days to see if the case had been assigned to an officer. I called NFCU back 3 business days later they advised they not sure why I was told that, but the check is on a permanent hold until XXXX provides the letter and they would not be reaching out to XXXX. I am filing a complaint because I have provided everything to prove I am the sole owner of the business account and bank account. XXXX has made the funds available and NFCU is asking me to provide a letter the issuing bank is stating they do not provide so I don't understand why they are still holding the funds and are stating the funds are on a permanent hold. I don't understand how a bank can hold your funds and tell you they are on a permanent hold to not be released but not send the money back to the issuing bank. They will not offer any help each time I call the next CSR agent tells me to do something different.

I called and disputed the charges and they told me that it would take 10 days to investigate. After the XXXX days I was not contacted or sent a letter stating the findings, XX/XX/XXXX they put my account in a negative balance of XXXX $ and said that there was nothing else they could do about the situation.

Consumer Complaint: We had initially applied for an auto loan with Navy Federal Credit Union in early XXXX and had XXXX as the dealership to be paid. There was various additional documentation that XXXX XXXX wanted for the loan because of my wife 's name change when we got married. By the time the loan was approved, we had already picked up the car and went with XXXX 's finance company, XXXX XXXX. When the loan approval came through, we called and told them this. Then, we asked if we could switch the payee from XXXX to XXXX XXXX. We were told yes and that the representative would do that. We were told that we could then sign the loan documents. So, 2 days later, we signed the loan documents. When we went to get the check to produce to XXXX XXXX, we were told that it was still made out to XXXX. After multiple inquiries, we were told the phone representative had technical issues and could not switch the payee to XXXX XXXX. We were never notified that the payee was not switched. So, we were misled into signing the promissory note. They now state that the only way to change the payee is to cancel the loan and reapply. The whole process has been time-consuming and could potentially have a financial impact due to the credit reporting.

Consumer Complaint: Hello Sir/ma'am, this issue is in direct relation upon termination or closure of a checking account through contract work involving social media I completed for s client and they mailed a check. Upon becoming aware of the unexpected issue with the deposit, I was immediately consumed with a mix of confusion and concern. At the young age of XXXX, my world was predominantly framed by school, family, occasional job, and occasional freelancing work, with banking intricacies being far from my day-to-day experiences. Being a XXXX my exposure to the broader financial world was limited, and my ability to discern complex financial malfeasance was understandably undeveloped. The individual who provided the fraudulent check was someone I had completed freelance services for, in relation to social media marketing, and the work I undertook was carried out with sincerity and dedication. Given the professional nature of our interaction and the tangible services I rendered, the thought that the compensation could be anything but genuine never crossed my youthful mind. In accepting and depositing the check, I acted in good faith, based on the trust I placed in the person who I believed was compensating me fairly for my efforts. At the time of the incident, I was merely XXXX XXXX XXXX. At such a young age, my understanding of banking and financial transactions was minimal. My age made me vulnerable to such deceit, and I genuinely acted in good faith. I possess a contract between the lady who commited fraud against me, and you, that being XXXX XXXX XXXX and myself. This document outlines the nature of the work, its duration, and the agreed-upon compensation. In addition my association with NFCU is not just personal but familial. My fianc, brother, and mother have all trusted NFCU for their banking. Their enduring and positive relationship with the institution was a significant influence to bank with you. They stand by me in this situation, ready to attest to my character and our collective commitment to NFCU. Recognizing the necessity to bridge my knowledge gaps, I enrolled in financial literacy courses and financial fraud prevention measures. This proactive measure illustrates my dedication to preventing similar misunderstandings in the future and my earnest intent to grow from past experiences. Again, just to re-iterate, this was not a purposeful attempt done on my part, but was done in good faith, and since then I have refused to accept any form of payment as mentioned previously and now utilize Stripe for freelance services, and I have a career in security and tech. Based on the foregoing, I respectfully request Navy Federal Credit Union reconsider the decision in place and vacate the previous decision. See the attached documentation for reference through the government portal. I want to work with NFCU to build a relationship just as my mom, brother, and fianc have.

Consumer Complaint: NAVY FEDERAL CREDIT UNION CONSUMER FINANCIAL PROTECTION BUREAU COMPLAINT VIOLATIONS/AUTHORITY : The Privacy Act of 1974, 15 USC 1681 Fair Credit Reporting ACT ; 15 USC 1681a ( 2 ) ( A ) ( i ) ; 15 USC 1681b ( 2 ) ; PL 90 ( 82 Stat 146 ) 15 USC 1681c ; 12 CFR 1022.3 ; 15 USC 1681e ; 15 USC 1681n ; 15 USC 1681o ; 15 USC 1681s-2 ; 12 CFR 1016.1 ; 12 CFR 1016.4 ; 12 CFR 1016.7 ; 15 USC 6802 ; 15 USC 6805 ; This is a complaint about NAVY FEDERAL CREDIT UNION ( NFCU ) violating my privacy rights by reporting my private transactions, to include, derogatory items, to the Credit Reporting Agencies : XXXX XXXX XXXX ) XXXX XXXX ( XXXX ) and XXXX ( XXXX ) XXXX Please see to Attachments A, B, and C as the violations to my privacy and derogatory reporting are referenced in this complaint are marked in the side-by-side Consumer Report and are color coded with highlighter orange and yellow. A. Items marked in ORANGE color in the three attachments ( A, B, C ) pertain to my established relationship with NFCU and its violations to my right to privacy by reporting private transaction history to third parties without my explicit and express agreement or authorization. NFCU violations of the Fair Credit Reporting Act, Federal Law, and The Privacy Act of 1974 and all laws stated below. a. The Privacy Act of 1974which states ( b ) Conditions of disclosure that no agency shall disclose any record which is contained in a system of consumer transactions without written request or with prior written consent of the consumer XXXX NFCU provided nonpublic information to third parties such as XXXX, XXXX, and XXXX without giving proper notice complying with section 6803 of this. Furthermore, NFCU disclosed my nonpublic information to third parties without clearly and conspicuously disclosing in writing to me so I can have an opportunity to opt out as prescribed in 15 U.S. Code 6802 ( a ) ( b ) and 15 U.S. Code 6803 ( a ), ( b ), ( c ) ; NFCU did not provide notice to me about its privacy policies and practices regarding nonpublic information to third parties as prescribed in 12 CFR 1016.1, 12 CFR 1016.4 ; 12 CFR 1016.7 c. NFCU has violated all privacy laws that pertain to prohibitions of reporting nonpublic information such as transaction history between me and NFCU to third parties as stated in 15 USC 1681a ( 2 ) ( A ) ( i ) which states that consumer report explicitly excludes report containing information solely as to transactions or experiences between the consumer and the person making the report ) d. Chargeoffs reported to third parties. Chargeoffs are written off by creditor and a 1099C given to consumer when an account has been charged off to profit loss statement. That amount written off then becomes income to the consumer and must be reported as such to the IRS. Income can not be reported to a Consumer Report. B. Following is a list of NFCU Violations of the laws stated above as shown in Attachements A, B, and C will show violations specifically reporting of private transaction history to third parties as derogatory information prohibited under 15 USC 1681a ( 2 ) ( A ) ( i ) and must be corrected Please see Attachments for Violations as shown in the side-by-side Consumer report by XXXX, XXXX, XXXX. Consumer Complaint: According to the Fair Credit Reporting Act 15 USC 1681 section 602, There is a need to insure that consumer reporting agencies exercise their grave responsibilities with fairness, impartiality, and respect for the consumer 's right to privacy. XXXX, XXXX and XXXX are consumer reporting agencies and I am the consumer. I have the right to make sure my private information isn't shared which is backed by 15 USC 6801 which states. '' It is the policy of the Congress that each financial Institution has an obligation to respect the privacy of it's customers and to protect the security and confidentiality of those customers non public personal information. The financial institution and the consumer reporting agencies XXXX, XXXX and XXXX do not have my consent to furnish this information and they surely do not have my written consent. Any and all consent to XXXX, XXXX and XXXX whether it be verbal, non verbal, written, implied or otherwise is revoked. XXXX, XXXX and XXXX are not maintaining reasonable procedures. Also 12 CFR 1016.7 states that '' A consumer may exercise the right to opt out at any time. '' I am opting out of your reporting services.
