In accordance with the Fair credit recording act this creditor as violated my rights. Under 15 USC 1681 section 602 states I have the right to privacy, 15 USC 1681 604A section 2 it also states that a consumer reporting agency can not furnish an account without my written instructions. under 15 USC 1666B a creditor may not treat a payment on a credit card account under an open account consumer plan as late for any purpose

Consumer Complaint: I took out a {$6000.00} loan with a 10.5 % interest rate in XX/XX/XXXX. Repayment began XX/XX/XXXX after graduating. To date Ive paid Navient {$7000.00}. They are constantly calling myself and my elderly father, who co-signed for me, as they state I owe another {$6400.00} as of XX/XX/XXXX. My account shows that Ive been charged {$7700.00} in interest since the loan was disbursed. So thats {$6000.00} for the principal & another {$7700.00} in interest for a total of {$13000.00}. I dont understand how a 10.5 % interest rate on {$6000.00} equals almost {$14000.00}. Do I have any recourse here to get them to stop calling or get them to close the loan as paid-in-full?

Consumer Complaint: I have a private student loan with Navient. I am trying to pay the loan, but they keep giving me reduced payments and forbearance options and they lie about how that is being handled. I am really at my wits end with their illegal practices, the lies, harrassment, and repeated phone calls with more lies. I have requested that they never call me and they only correspond through the mail or email. They refuse and say ; it is our right to call you, which I know is illegal upon my request. I know that there is a lawsuit that was awarded for Navient private student loans and I did not receive anything in the mail, but we did move. I am not sure if I will be a part of that, but I feel that I should, because I have been a victim of their illegal forbearance practices and harrassment.

Consumer Complaint: This is a formal complaint regarding a private student loan account with Navient XXXX XXXX At present, Navient has sent threatening/intimidating mail and has routinely harassed authorized representative about the account. Navient uses different auto dialer programs from random numbers in Washington, New York, and Pennsylvania with attempts to bully/intimidate this account representative and co-signor. This is a violation of 15 USC Code 1692d et seq.-Harrassment or abuse. Navient has received corrective notification via online portal that this authorized representative has exclusive POA of this account. XXXX XXXX has been appointed fiduciary of this account. In addition, I have common law copyright of the all caps ENTITY and and have FULL FAITH AND CREDIT of the BC. I, as the living woman, was never given full disclosure that my living human was being used as a transmitting utility for the fictitious ENTITY created via the registration of birth certificate by the bankrupt UNITED STATES OF AMERICA XXXX. As a result, I am correcting all ENTITLEMENTS of use of this BC and SSN account which includes NAVIENT. In addition, I have sent documents reflecting the harassment and lack of cooperation with NAVIENT to correct this account. These documents have been sent to all branches of IRS regarding fraud, the DIVISION OF DEPOSITOR AND CONSUMER PROTECTION of the FDIC, and the SECURITIES AND EXCHANGE COMMISSION as formal complaints.

I have tried several times reaching out directly to them without success. I demanded as a consumer that pursuant to 15 USC 1666b under the FCRA they can not report late payments to my consumer reports but they are above the law I believe. The refused to prove I was ever late and still haven't removed these late payments.

Consumer Complaint: I had a personal student loan with Navient that was XXXX by XXXX XXXX bankruptcy in 2019. Navient account number : XXXX The company is trying to act like they are a Department of Education loan, that is not cancelled by XXXX XXXX or any Bankruptcy titles, unless extreme hardship. Under the Brunner Act, any category of student loan can be discharged when extreme hardship can be proven. Also, the XXXX XXXX XXXX has ruled that private student loan can be discharged and do not have the same protection as Federal loans. I have sent the Navient discharge notice, and Notice to creditor of the XXXX hearing held before receiving my discharge. Navient, is still sending payment due date notices and offering Income Driven Payment Plans when the loan is discharged. Feel free to share this with other who may be experiencing similar request for payment well after the loan has been discharged. Thank you for your assistance.

Consumer Complaint: I have been making payments on my loans since XXXX. I started on a rate reduction plan and in XXXX I went off the rate reduction plan and paid the full amount of my loan due with normal terms. My payment was just under $ XXXX. The year of XXXX my payment went from XXXX to XXXX because my loans have variable interest. In XX/XX/XXXX I called to get on a different repayment plan. I explained I am a XXXX XXXX XXXX XXXX XXXX I do not receive child support or aide of any kind. I can not afford any more than a {$650.00} payment as I already am living paycheck to paycheck. I was then placed on an interest only payment plan that I set up reoccurring payments of XXXX to pull from my bank every month. Unfortunately, this interest only plan did not lock in my interest rate at the time. I found out recently that that has since changed right after that plan was set up. Interest only plans now lock in the interest rates. By XXXX my interest rates continued to go up and my payment was back over $ XXXX. The reoccurring payments that were set up now did not cover what was due and I honestly could not afford it. I received a phone call from Navient in XXXX looking to collect the short amount on my account. I explained my situation and express I could not afford to pay any more a month and asked about any other possible programs. He told me I was not eligible for any other programs because I was enrolled in the interest only XXXX and had to wait out the 6 months in that program. I received another phone call looking to bring my account current right before XXXX. I again explained my hardship and willingness to make payments, but needed a more reasonable payment. He told me he could get me cancelled out of my current program and after the holiday we would discuss and go over what was available for me. XX/XX/XXXX we resumed our conversation about a different repayment plan. He told me I was only eligible for an interest only plan and it would now be over $ XXXX. I explained I could not afford that much. He then tried to run numbers for a rate reduction plan. He collected my financial profile for the month ( I live pay check to paycheck, things are very tight ). He spoke to his supervisor and said there was nothing else they could do. I am willing to make payments and have been consistently making payments to Navient for years. After years of payment, I have not even started to make a dent in the amount I owe them and they continue to raise my interest rates and my monthly payment to unrealistic amounts.

Consumer Complaint: In XX/XX/2022 I receive documentation that all XXXX XXXX would be dismissed personal and federal student loans and I receive documentation stating what loan to be closed and the value an estimated to {$40000.00} which is still currently showing on my credit report I have contacted XXXX and explain to them that it needs to be removed and they will not remove it. This is making my credit report look bad because it still shows that I am in debt and additional {$40000.00} and I am not.
