Consumer Complaint: I have accounts in Navient that are reporting incorrect data and nonpayment status. The accounts are being paid and almost zeroed out. I have asked that this matter be looked into as they are reporting outdated information to my consumer credit files in XXXX, XXXX and XXXX affecting my scoring and limiting my ability to attain loans and/or other credit based services or products. I am current and have made all payments on time. Consumer Complaint: I have been repaying my student loans for 6.5 years with little to no issues in making my monthly payments. In XXXX I was involved in a car accident which left me with both a new and unexpected car payment ( my job requires owning a reliable vehicle ) along with other unforeseen expenses. My husband and I found ourselves in a financial hardship and reached out to a debt relief company- XXXX XXXX XXXX . Two of the accounts that they took on are student loans that are currently being held by NAVIENT, although they were originally through XXXX, and previously owned by XXXX. With the debt relief program we were instructed to stop making payments and to change the contact information to their phone number and address. Soon however, we began to receive calls anyway, multiple times a day. Then both my parents and in-laws started receiving phone calls multiples times a day, every day ( over 100 calls within a weeks span ) regardless that they had said I was unreachable at those numbers. I spoke to them once explaining that I was in a financial hardship and that they would be paid as soon as possible but to please stop calling. The calls continued. Tonight, fed up I decided to call them myself and try to explain my situation. The man who is assigned to my case, XXXX XXXX was telling me that they had on their record that my number, the same one I was calling them from was a bad number they could not call and that was why they were continuing to call the other numbers. I stated that I have also been receiving calls and the others had told them I was not able to be reached and to please stop calling. After confirming my phone number with them, he continued on to the matter of my loans not being paid on. He was explaining what the next steps would be if I didnt make payments, about going into default and that they would seek the help of a collection agency and the risks associated with that. I told him that I understood and that unfortunately we were in a financial hardship and unable to make the payments at the moment, that they would be paid once we were able to. I stated that we were working with a debt relief agency that they would be reaching out to them to work out a payment plan. That is about when the conversation turned. XXXX became very nasty with me. He began threatening me and implying that I am stupid for going to a debt relief program saying that they werent going to help me at all and that NAVIENT does not and will not work with agencies like that, and that they are going to wind up suing me. I stated that I will face it when it comes. XXXX scoffed at me mocking what I had just said. He then brought up the auto loan that I took out in XXXX and was saying that clearly I am capable of managing credit. I tried to explain that the hardship we faced began with that, that if he looked at my account he would see I made payments through XXXX but then had the hardship. Without even allowing me to speak, he started talking about how of course because a lot of people all of a sudden have financial hardships after taking out auto loans and something about a lack of responsibility. He was yelling over me not allowing me to speak. I said that he didnt have the right to talk to me the way that he was, said I would not listen to it anymore, said goodbye and hung up. My husband and I agreed there are much nicer more professional ways he could have spoken to me and that his practices are both unfair and unprofessional and he should not get away with it

Consumer Complaint: Dates are to numerous to list. Have been in a state of forbearance or deferrment since intital graduation in XXXX. Returned to school for XXXX in XXXX, graduated XXXX, continued on in dual XXXX 's graduated with single XXXX 's XXXX. Told will need additional course 's not in originial enrollment to complete second XXXX. Only needed internship at time. Started XXXX, had to postpone due to husbands XXXX XXXX, payments on loans higher than income permits, income potential has never come close to earning potentials put out by schools. Additionally assert that institutions do no consider hiring their alumni as instructors without terminal degrees as a means of generating greater enrollement. This leads to additional student loan debt and even more hardship on the student. Worse is the latest request for deferrment due to personal health issue. Deferrement granted along with an auto stop on repayment plan, which included a payment adjustment 2x the amount which is now over {$2300.00} a month. They also added over {$30000.00} to my loan balances and increased my interest rate to 10.76 %. News flash.. this is three car payments or a house payment and a car payment. Also, if there was no co-borrower to begin with, than how is it they think they can include income from said source that did not exist when factoring repayment? I have been told multiple times I would qualify for teacher forgiveness, or other types of loan forgiveness by navient staff. Turns out none of them know what they are talking about..

Consumer Complaint: In college, I took out two private loans from XXXX XXXX in 3 disbursements, the first was on XX/XX/XXXX for {$4400.00}, XX/XX/XXXX for {$4400.00}, and last on XX/XX/XXXX for {$3100.00}, for a total of {$12000.00}. After graduating from college and the 6 month grace period before entering loan repayment, I was unable to make payments with my current income at the time and used the forbearance option available to me to postpone my payments. At the time, the servicer was Sallie Mae. Total amount owed after graduating and grace period for my two private loans on XX/XX/XXXX was {$15000.00}. After the various periods of forbearance, my balance jumped to {$23000.00} on XX/XX/XXXX. When I started making payments, there was an inconsistency on how the payment was being applied to my principal and interest balances as demonstrated by the document attached. The loan was sold to Navient on XX/XX/XXXX at which the balance remained almost the same at {$23000.00} after two years of making payments. The inconsistency of how the payments I make are being handled is still occurring and after over 5 years making payments, my balance remains at {$19000.00} on XX/XX/XXXX. To this day, I have made {$19000.00} worth of payments that have been inconsistently applied to principal, interest, and fee balances since XX/XX/XXXX. How do I still owe almost the same that I already paid and much more than I originally borrowed? I never agreed to any type of repayment plan where my money was primarily used for interest payments. In addition, I am currently unemployed and have not source of income to continue paying this ridiculous balance.

Consumer Complaint: I called in on XX/XX/18 and spoke to a lady about a forbearance. She advised me that I was no longer allowed to forbear my student loans. I advised her that I have been struggling to raise a family of XXXX for the last 20yrs and I know that at some point I will have a to start paying, but not today. I still have one more child in school and hopefully after that we'll be financially stable to start paying. She said now that my loan is serviced by Navient, I am no longer to do a forbearance unless I transfer all my loans to them. I said no, that sounds like a housing refinance scam, when one servicer takes over managing an account, I have no reason why I need to refinance my student loans. She said then you have to start paying. I told her that was not acceptable. She advised she can do an emergency forbearance for 60 days, but I had to pay {$50.00} and then decide in XXXX if I want to consolidate my student loans under Navient. I have XXXX XXXX Funds student loans from Sallie Mae. One I obtained while I was in school at the University of XXXX XXXX, XXXX XXXX Ohio and the other when I went back to school with the University XXXX XXXX ( online ) to finish up my bachelors. As head of household, mother of 3, I had to finish getting my bachelors in order to provide for my family. Though the years, I've been able to progress in my career and am finally almost to a point where I'll be able to start being financially stable. Having to make a $ 500 monthly payment will continue to cripple our family and we'll never be able to enjoy financial stability. Again, I know eventually I'll need to start making payments, however until then, I would like to continue forbearing them until I am ready. The lady on the phone said I am limited to 60mths of forbearing, I told her I have been doing so for the last 20yrs with Sallie Mae, she said now that I am with Navient that I can't do that any more. She said the only way I can start doing it again, is if I transfer my loans to them. I'm concerned with losing my interest rate and any benefits of having a government student loans. I asked her to point out where in my contract that says I am limited to 60mths, and she said that she can't do that. That she's only going by her servicing rules. I told her that if that is not in my contract as a restriction, that she can not restrict me in this manner and force me to refinance. I also asked that she have someone review my contract and let me know what I am " required '' to do.

Consumer Complaint: I set up auto pay with navent and they went into my account and withdrew money without out my consent my payments are due on the XXXX of the month they withdrew money XX/XX/XXXX, for the month of XX/XX/XXXXthey withdrew from my account three times making it overdrawn and costing me fees for stop payment. XX/XX/XXXX they withdrew XXXX and my payments are not due until the XXXX of each month. I made a payment of XXXX XX/XX/XXXX and they they withdrew XXXX and then on XX/XX/XXXX tried to with draw XXXX out of my account I had to stop payment on it and was charged by XXXX XXXX XXXX 30.00. I am not comfortable allowing them to do auto pay they have lost my trust and I feel that they have not given me correct information on my loans

Consumer Complaint: XXXX XXXX XXXX XXXX has violated several consumer protection laws. My employer received a garnishment letter from them and I have never received any communication from this company of any kind verbal or written. I have no idea who they really are if they are collecting on legitimate debt that I owe or if this is an error. Clear violation of FDCPA and CFPB for 3rd party company. I was Never given an attempt to validate the debt. And they have ordered my employer to withhold 15 % of my disposable income starting this week. I already have child support wage garnishments for half my income and cant afford to lose money to a company that I know for a debt that I dont even know for sure that I owe. Its deceptive and unfair!
