Issue: Attempts to collect debt not owed
Subissue: Debt is not yours
Consumer Complaint: I have been going back and forth with Navient, as well as a dirty tactic collection firm named XXXX and XXXX, as per the XXXX XXXX Courts reps I have spoken to. I currently have XXXX private student loans showing on a record pulled by my credit union that are showing as court based judgements, even though I have worked with Navient to get these corrected. I spoke to a rep in their executive services office who worked with me to get them out of the judgement/collection, supposedly out of the office of XXXX and XXXX and off my records. I was illegally garnished for almost 2 years and this was lifted based on Navient FINALLY pulling it. Once pulled, they told me they would be off my record, back in their office and out of XXXX and XXXX, which none of these things have happened. I still have them on my records, have been unable to defend loans which ARE NOT mine and they are still illegally listing them under judgements, which they said would be lifted. I was never served papers in order to defend myself, never given my day in court to force them to prove they are all mine ( Which most are not ) and Navient has failed to live up to promise after promise to fulfil what they said they would. They consistently state " Under court terms '' and throw these complaints out, which is unfair to me. If they are not pushed to follow their own terms, I will be forced to join some class action lawsuit against them for their lying practices, when all I want are these off my records. These are causing me to be unable to buy my mothers home, which was offered to me and are causing me irrefutable damage.

Consumer Complaint: Navient. Tried to auto enroll me in deferment of payments. My loan provider has changed multiple times unnecessarly since first beginning payments. I have selected an automatic payment option to focus on the highest interest loan first. Worked out fine for a couple months. Now it's not paying the other loans, allowing them to default and causing high fees. THEIR AUTO PAYMENT OPTION. Automatically changing my address unless I call them. I haven't moved. I can only assume this is to XXXX people over on their tax deductions. Tired of baby sitting them. Grade A corrupt business practices at every turn. Selling all my investments ( my entire nest egg ) to clear out of this debt which is suppose to just be 3-5 % APR but it's just not with all their XXXX. Going to encourage my son and anyone else who's interested in college to steer clear.

He has never paid my loan ever and they need to call me and try to reach me before calling and harassing him. He is elderly and XXXX and they are taking advantage of him. They threaten him when they call.

Issue: Struggling to repay your loan
Subissue: Can't get other flexible options for repaying your loan
Consumer Complaint: I had countously time called and talked to Navient about them helping me start a repayment plan that will be affordable for me. After speaking with them I told them to help generate a report for me to see so I can see it in detail but I never recovers anything. So when I tried to connect with them again regarding the report and the repayment program, they kept saying that they will have something for me in the next few days. Then when I saw the new payment reflected my account I had to pay, it was more than what it was the first time theyre charging me. Furthermore, I reapplied for the repayment plan and then all of sudden they came up with XXXX dollars for me to pay so I went and go ahead and paid for the first two months now and when I looked at my account history he two months Ive been paying for was only Going towards the interest to the organization and not even towards my principle I took out. Im very frustrated and I need your help to demand them to stop my loan. Its something I can not trust them with anymore. Please contact help me with what you can. Thanks you!

Consumer Complaint: In XXXX and XX/XX/2018 It says I missed Payments. I thought my Student loans were still in deferment. I am was in financial hardship and couldn't afford any I didn't know the information needed to see my status of delinquency at the time. The balance had gotten up to {$920.00} and I couldn't afford that. I reapplied to deferment and got approved again but the damage was already done and my delinquency was reported to the credit bureau.

Subissue: Their investigation did not fix an error on your report
Consumer Complaint: XXXX XXXX XXXX / Navient is reporting my student loan account information inaccurately. XXXX XXXX XXXX / Navient is reporting that I pay a monthly payment of {$1900.00}. The problem is, I have never paid a payment of {$1900.00} because I have either been in forbearance or deferment status. My credit report should reflect accurately what I have paid or that the status in which I am currently in. This inaccurate reporting affects my dept to income ratio which adversely effects my utilization rate which has a negative effect on my credit score which results in me getting financed at a higher interest rate. I have spoken with Navient several times only to have them tell me to file a dispute with the credit bureau. I have filed a dispute with the credit report only to have Navient send up the same information. According to the Fair Credit Reporting Act, my credit report should accurately reflect my monthly payments therefore, XXXX XXXX XXXX / Navient should be reporting {$0.00} or Forbearance or Deferred.
