Consumer Complaint: I called in to make a payment on or about XX/XX/2019. I spoke to a representative who advised me of different payment options to bring my loan current. She told me that my payment would be around {$570.00} and that I would not have any capitalized interest. I specifically asked her about the amount of my payment and about the capitalized interest. She gave me answers to those questions before I agreed to the forbearance. She then put me in the IVR to say I accepted what she told me. Then, she set me up on auto payment and told me that my payment would be lower the next month because I would get the interest rate point deduction for being enrolled in auto pay. I called Navient on XX/XX/2019 to request that my next payment be drafted on XX/XX/2019. I was advised at that time that my next payment was going to be around {$610.00} dollars. This was higher than the representative quoted so I requested to be transferred to the department that handled this. I spoke with XXXX, a supervisor in that department. I asked him to review the phone call I had with the representative before I voiced my complaint, as I wanted to make sure I was remembering the XX/XX/XXXX called correctly. He reviewed the call and called me back. He confirmed that the representative did give me incorrect information. Specifically, she told me that my payments would be {$570.00} dollars per month and she told me that I would not have capitalized interest. She also told me that my interest rate would be reduced due to enrollment in the auto pay. She told me all of those things and that is what I relied upon in making the decision to enroll in this forbearance. He told me that it did not matter that she told me this incorrect information because I accepted the terms on the ivr system. He said there was nothing he could do.

Consumer Complaint: I enrolled into a student loan consolidation company in XX/XX/2018 which was called The XXXX XXXX XXXX. I supplied the XXXX with all necessary documentation to consolidate my student loans along with my bank information to make monthly payments to the XXXX while they consolidated my loans. XXXX was to pay minimum balances on student loans and or place them on hold or in a forbearance until the consolidation process was complete which I was told by XXXX would take up to 6 months. Fast forward to XX/XX/2018 I pulled my credit to find out XXXX did not make any payments to my student loans causing them to default. XXXX also changed all of the my contact information to their contact information therefore I was not notified. I discussed this issue with XXXX and they agreed it was an error on their part and even submitted an " At Fault '' letter to all 3 credit agencies and the credit agencies have denied removing the negative remark on my credit report.

Consumer Complaint: I have sufficient evidence the debt in question is not in default, and has been in repayment based on the agreed upon terms of {$200.00} per month since XXXX with the Department of Defense. Furthermore, the amount that is stated as owed is incorrect and should be corrected to reflect the actual balance due. My records indicate the amount outstanding after the four subsequent wage garnishments is {$9600.00}. While in administrative review, I expect the amount in question to be held constant and only be netted down in the even a wage garnishment is applied. The exhibit below shows the payments made since XX/XX/XXXX, showing consistent and continual payments. Secondarily, I object to the administrative fee that was applied to the note of approximately {$5000.00}, which represents approximately $ 41 % of the total outstanding loan balance. This practice and act was not approved and I gave no prior consent to adding this fee, it is also applied in error as this should have never been moved over in the first place to the US Treasury and should have been kept and housed within the DOD repayment website. This fee amount represents predatory lending practices and is a fee that is unconscionable, especially since the 10yr US Treasury Yield is 2.668 % as of XX/XX/XXXX. The mere size and existence of this fee is unacceptable ; in other terms it represents 2 years of hard work and labor paying down the note. As of XX/XX/XXXX - Four wage garnishments have been extracted from my pay in the last 36 days equating to {$3700.00} challenging my ability to pay my normal monthly bills and living expenses to support my wife and child. An agent of XXXX XXXX XXXX stated they were unwilling to accept a settlement agreement along with not responding to my formal request for a hearing.

Consumer Complaint: In XX/XX/XXXX, I checked my student loan status with Navient. At this time, I was in my second year of a Chapter XXXX bankruptcy and wanted to know where I stood. When I checked the loan status, I was surprised to learn that my loan balances indicated " Paid in Full '' status and that I had no payments due. There was no reason why listed, so I assumed that the loans had been forgiven under some Federal Program that I was not aware of. I checked my credit reports at this time also and saw that they, too, reflected that my loans had been paid in full and nothing was due. In XX/XX/XXXX, I became unemployed and my financial circumstances made it impossible to continue making my Chapter XXXX payments, so the bankruptcy was converted to a Chapter XXXX and discharged. My student loans were still showing as paid in full, so I felt very blessed. In XX/XX/XXXX, months after the bankruptcy had been discharged, I received a notification from Navient that my loans had been " repurchased '' and the balance they presented me with was over {$16000.00} higher than it was previously. The notice stated that I now owed {$110000.00} and that the payments would be in excess of {$800.00} / month. Mind you, I had just became re-employed in XX/XX/XXXX after a period of approximately 7 months being unemployed. The job I took in XX/XX/XXXX does not pay enough that I can afford a payment this high and I was still recovering from months of unemployment. I contacted Navient and requested a forbearance for a few months until I could configure my finances in some way that I could maybe make a lesser payment. Navient did not even respond to my request. Since it is impossible in my present financial state to make these payments, I have been trying to work something out with Navient to prevent worsening of my situation. They have been non responsive to my continued requests for forbearance until I can figure something out and at the time I am writing this, I am behind several months - creating even more issues. In my current employment, I am grossly underemployed. I make a less than half of what I was making in XX/XX/XXXX-XX/XX/XXXX when I was actively repaying the loans. In fact, I made approximately {$28000.00} in payments which are NOT BEING REFLECTED in my current loan history. This further proves my point that the loans were, in fact, cleared - along with any of my old history. This " repurchased '' loan shows NO HISTORY before XX/XX/XXXX. I have been questioning this with Navient for the past five months and they still will not provide an answer as to where my payment history has gone. As I said, I am now several months behind and to further complicate things, Navient has now reported my to the credit bureaus as delinquent - causing a 141 point drop in my struggling to be rebuilt credit score. This drop will have financial implications on me for everything - even potentially impacting my ability to get a better job or some form of assistance to help unbury me from my present situation. I should mention that I am presently XXXX years-old and my under-employed condition remains. I was XXXX XXXX military when I earned my first degree and was forced to defer payments due to my income at that time. Since then, I have only had one position that paid enough to allow me to make student loan payments. I have had to defer for economic hardship for some time. The current balances show that on my original balance of {$66000.00} there has now been an accrual of interest ( from legal and approved " relief '' programs ) in the amount of {$51000.00} - almost equivalent to my principal amounts. I need help. The " income sensitive '' options do not take into consideration one 's NET income or other life expenses. I drive an 11-year-old car and live in an apartment because I can not afford to own a home. I continue to seek " appropriate employment '' for a person of my education and experience, but this area is significantly repressed and I consider myself fortunate to have what I have, but making these payments is impossible for me. I have documentation to show that my loans were indicated as paid in full and I did not expect them the mysteriously " re-appear '' at a time when I am recovering from unemployment and under-employed. I communicate with Navient via writing only because I do not trust anything I can not prove by hard-copy given what has happened to me thus far. I desperately need the assistance and guidance of the CFPB.

Consumer Complaint: NAVIENT whom has already been under scrutiny for its poor, shady collection practices is making it absolutely impossible to pay off my student loans. They try to put you in a forbearance or an income driven payment plan neither of which ever pays on the principal balance but continues to incur interest. I am doing my best to pay off my all my debts but this is unjust and impossible to pay off a loan under these conditions. Its hard for me to understand how this is even legal. If you reference the show the patriot act volume 2 episode 4 aired on XX/XX/2019 it gives a breakdown of how Navient is conducting business and it is absolutely unjust if not criminal. I have spoke with Navient in regards to me only paying the interest and it being impossible to ever pay the principal and i received no argument to my claim while on the phone, instead just what steps i need to take to begin paying them. Something has to be done, this seems unconstitutional like im being robbed because i spent a period of time in school trying to better my education, when in reality all these loans have done is allow Navient to place be in Debt that I will never ever be able to pay off. Please help me find a solution to this ongoing problem that's not only effecting me but thousands if not millions of others.

Consumer Complaint: In XX/XX/XXXX, I applied for a home loan. When the lender pulled my credit, Navient had placed statements on my account stating that it was in deferment due to a natural disaster. This stopped my loan from processing. When I called them, they stated that FEMA had given them this information and they took it upon themselves to place that on my report. I did not ask for that at the time. Navient told me it would be taken off XX/XX/XXXX and would show on my Credit reports XX/XX/XXXX. When the lender pulled my credit report again, nothing had changed. I called Navient again and they continued to argue with me and said that I was still in the deferment and they would not remove it. I had to argue with them for several weeks and into XX/XX/XXXX. They would not remove it until I threatened to get an attorney. Then all of a sudden they agreed that it should have been taken off. I finally got it taken off but had to be subjected to the stress of arguing with them. Some of these comments are still on my credit reports. It also states that my last payment was XXXX XXXX. I have made payments since that time. This is not the first time that I have had to deal with this issue with Navient reporting bogus information to my credit report. Then it takes forever to get it removed. XXXX is the worst about removing comments, etc. even when you prove it is wrong. They do not appear to investigate anything unless you threaten to sue them. It is just the first time I knew that I could file a complaint. They consistently put me on different payment plans than what I apply for. When I asked them about a forgiveness, they actually laughed at me. Then laughed while telling me that I could not even file bankruptcy and get out of it because it was a Federal Loan and I was stuck paying for this and they didn't care how old I was. ( I am XXXX years old now ) Prior to this my billing and fees were consistently wrong and Sallie Mae and Navient refused to justify any of the charges as well as the schools charges when I saw that I was being charged bogus fees or being charged double fees by the school and the Student Loan Servicer.

Consumer Complaint: I got a XXXX dollar private loan from Sallie mae, a small portion which was federal, to attend XXXX school. The interest for the loan was 14 %, I payed {$600.00} a month for 7 years. I payed back XXXX and still had 10 more years estimated that i pay them {$600.00} a month. I have never made more than 20k in a year but I'm obligated to give them XXXX of that a year and yet the best lowering of payment they ever offered me was paying {$550.00} a month. Now that I've defaulted I can no longer get any record of how much I payed them and I am no longer able to login on my online account. I was XXXX and didnt know better but was told after I asked that I would be able to afford this. This loan was predatory and paying $ 600+ a month for 17 years of my life when I never made more than {$1500.00} dollars in a month is absurd. Their help was to lower my payments by not even a three digit number. I also no longer have access to my account to prove how much I have payed them.
