Issue: Attempts to collect debt not owed
Subissue: Debt was already discharged in bankruptcy and is no longer owed
Consumer Complaint: consumer : XXXX XXXX, XXXX XXXX XXXX XXXX, XXXX, AZ XXXX XXXX : XXXX [ ARIZONA BANKRUPTSY COURT- XXXX XXXX ] Debt Collectors : 1. Navient-XXXX XXXX XXXX, XXXX XXXX, Pa XXXX 2. XXXX XXXX XXXX, XXXX XXXX XXXXXXXX, XXXX, Pa XXXX 3. Pioneer Credit Recovery Inc, XXXX XXXX XXXX, XXXX, NY XXXX These 3 companies continue to contact me to pay a dept that was discharged in Bankrupsy Court filed on XXXX. XXXX XXXX the court trustee specifically told me to stop paying on the student loan debt which was listed as a XXXX XXXX debt. Both Navient and XXXX added their names to the Bankrupsy filing, and at the time did not identify themselves as collectors for XXXX XXXX, infact, I am not sure who they represent as I never made any student loan payments to either company directly. I wrote a letter months ago asking them to verify this debt and show that XXXX XXXX had authorized them to pursue this debt. They sent me back a doctored up agreement without reflecting any dates and showing that my last payment on this debt was XXXX of XXXX. Then they jammed my credit report with the fictious amount of approx. 6k. 1. It is against the law to report - reflect an old past due debt as new - if infact the debt was sold, but how could wells fargo sell a debt charged off in bankruptsy? 2. Since this company has removed all dates from the one piece of paper they did send me, it is my contention that it has well been six years since this debt existed. 3. It is against the law for a debt collector to try and get money from a debt discharged in Bankruptsy under federal law section 524 title II. 4. This amount of XXXX is inflated from the original balance due to XXXX XXXX over six years ago 5. As a senior XXXX years old, I am on a fixed income of social security and a pension and would not have the ability to make any amount of payment, which was the whole reason to go through the humiliating act of filing bankruptsy At present I feel if you cant help me get these persistent fraudulent creditors off my agenda, I still have hope of contacting the AZ Bankruptsy Court XXXX XXXX and asking for his advice.

Consumer Complaint: On Thursday, XX/XX/XXXX, I decided to change my loan repayment plan from income-driven repayment ( IDR ) to standard repayment. I wasn't able to complete this change on the website and was directed to call customer service. I told the representative that I'd like to adjust my repayment from IDR to standard and she proceeded to immediately read me forbearance terms to agree to. I paused her to understand why she's reading this because I'm not asking for forbearance and she asked, do you not know what forbearance is? I replied something along the lines of, yes, I do know but I'm not clear why I would agree because I am able to pay my loans. In fact, through the new plan, I would be paying more per month in order to repay my loans faster. The statement that stood out the most and was definitely not true for my situation, " I am not required to make payments of loan principal or interest during my forbearance, but interest will continue to be charged on all my loans. '' I clearly never mentioned anything about not being able to pay. Since I was aware of the lawsuit I continued to ask questions until she very quickly shifted gears and said, " would you like to proceed without forbearance? ". Clearly, my answer was yes. However, she didn't make that an option. I felt very misled during this discussion and imagine that many other borrowers just say yes. This is morally wrong and an obvious attempt for Navient to take advantage of and make more money from borrowers. Additionally, I haven't reapplied for IDR since XX/XX/XXXX and somehow I'm still enrolled even though they threaten removal from the plan if the application isn't complete. I've received a few emails that are inaccurate as well stating that my monthly payment will increase to $ XXX.XX if I don't reapply for IDR. That number provided wasn't any higher than what I was currently paying. Again, another example of Navient 's deception and ability to cause confusion. Last, I had to pay {$5.00} to switch planswhy?

Consumer Complaint: Please review complaint number XXXX that was submitted to the CFPB. I have additional evidence and was not able to attach to the original complaint. Therefore, I have opened this complaint. Navient has refused to remove late payments from XX/XX/XXXX thru XX/XX/XXXX. However, I have requested deferment multiple times with this organization. Navient was first informed in XX/XX/XXXX of my economic hardship. I sent a letter during that time and sent another letter in XX/XX/XXXX. Also, a phone call was made to Navient on XX/XX/XXXX. According to Navient 's response in complaint number XXXX, Navient claims they were not contacted until XX/XX/XXXX. This is false and Navient is lying to a federal agency, which is a violation of federal law. Please see attached email, phone record, and letter from XX/XX/XXXX. The email correspondence shows that Navient was informed of economic hardship. Navient responded to my email requesting that I call for assistance. I called Navient ( as shown in the attached phone record from my XXXX wireless service ) at XXXX XXXX on XX/XX/XXXX at XXXX. The representative requested that I send a letter. See attached letter that was sent along with a printout of my economic hardship. Navient did not place my accounts in deferment and is reporting late payments, although they were informed of my deferment request.

Subissue: Don't agree with the fees charged
Consumer Complaint: I have already attempted to resolve my issues with Navient and this is my second complaint to you. I wanted to bring some new information to your attention after my own investigation. First off Navient has stated that I consolidated loans in 1997. I have no knowledge of such a thing. Apparently they redid my loan and raised the interest rate and of course more fees. This apparent consolidation loan would have been no benefit to me what so ever. Another I did is get on the student aid website, to try to dig some more into this. My original loan balance should have been {$5800.00} instead of {$8400.00}. I couldn't quite figure that part out. My pell grant never got all applied because somewhere along the line someone put down, a withdrawn status. Well I GRADUATED, it still has a withdrawn status on the website. I should not be having to go through all of this to try to figure this out. This is my last attempt with Navient and XXXX XXXX to figure out who dropped the ball! I will be getting an attorney and let him/her figure out who in the XXXX is at fault! XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX, IN XXXX XXXX

Consumer Complaint: I was given misleading information from Navient in regards to my loans. When inquiring about the public service loan forgiveness, which I am a candidate. This company did not give me correct information. I was mislead in thinking that if took care of my loans on time for the 120 payment that my loan would be forgiven. Come to find out I am not even enrolled in said program, and my loans are not under the right lender. When information seeking about this issue, I found that my loans could have been changed to the lender. I have definitely been harmed related to this issue. I would close to the end of my term if they had taken care of me properly and not mislead me.

Subissue: Trouble with how payments are being handled
Consumer Complaint: I graduated in XX/XX/2016. My grace period ended 6 months later. I promptly enrolled in NAVIENT 's auto-pay feature and have made my payments on time and in-full ever since. Lately, I have been focusing on my loan with the highest interest rate. After logging in recently, I noticed that the principle balance on this particular loan has not decreased appreciably since XXXX. The minimum payment on this loan is ~ {$330.00}. Yet, when reviewing the payment summaries for XXXX ( XX/XX/XXXX ) and XXXXr ( XX/XX/XXXX ), only ~ {$94.00} in interest has been applied. NAVIENT is misallocating my payments among my lower interest loans while preserving the principle balance of my higher interest loan.

Consumer Complaint: navient-formerly sallie mae, dept of ed has student loans listed at times that i was not attending college. i also had only XXXX in student loan debt and some years ago then i jumped to XXXX even though i was not in college at the time and now, it has jumped to XXXX. huge jumps from XXXX and i have not used any type of student loans since early XXXX. that last student loan was at XXXX XXXX XXXX in XXXX. why am i being gouged like this. i did not incur all of this. i have reported numerous times that my identity was stolen and have fraud alerts and several confirmations from the federal trade commission including two police reports in which the last one was obtained because someone stole my amended tax return info through the united states postal service. please resolve this. they also reported the same student loans multiple times on my credit report to make it look like i have more debit that what i actually have. for example, one student loan ( with the same account number ) is reported three times even though it is only one loan. i tried to apply for a home loan and the banker caught the fact that they were reporting the same loan several times to make it look like i had several loans or what bankers call trade loans.
