Issue: Dealing with your lender or servicer

Subissue: Trouble with how payments are being handled

Consumer Complaint: I have made four additional payments over the last four months on my student loans. This is in addition to my regular scheduled auto-payments that debit from my checking account every month. After I made the first additional payment I received an email stating that my next auto-payment due date was moved even though I indicated on the website that this was meant to be an additional payment towards the principal of the loan. I then called Navient and they stated that I would need to call them every time I make an additional payment to make sure that my regular auto-payment would stay on schedule and that my additional payment would go towards the principal. I have called with all four payments, but when I look at my payment history online I can see that interest is being taken from my additional payments, so I'm not sure what is going on. Navient has taken advantage of me in the past, so I want to be sure that my interest is being calculated appropriately. No one should have to call every month to ensure their payments are applied correctly. Doing things over the phone is how Navient took advantage of me in the past since I had no proof of our conversations.

Issue: Struggling to repay your loan

Subissue: Problem lowering your monthly payments

Consumer Complaint: After graduated with my XXXX from XXXX XXXX College. I decided to continue my journey and go for my XXXX right after. I was told that my private ( Sallie Mae ) loans would be put on hold for the meantime until I finished school. Once I finished up school and began to look for a job that could afford the loans and support me my loan kicked in. At the time I only owed about XXXX which was understand able for the type of education that i received in the matter of 5 years. One afternoon, after doing research and calls. I reached out to Sallie Mae to let them know that the job that I got I wasn't making enough to be able to pay the month balance. I was then told by the agent. " We offer a program where we can put your loan on pause for a certain amount of months. '' I was then told this would be good for me because I could focus on my other loans and bring them down so that I could have more room to pay the monthly with Sallie Mae/Navient. About a few months later I recieved a email, letter, phone calls stating that my payment was due on a certain date for 3x the amount that I couldnt afford the first time. I reached out to Sallie Mae and Navient and they told me that the loan was put on pause but that the interest was still building up in the back. I went from XXXX to XXXX. In a much worse situation that I was in to begin with. I got tricked into that forbearance plan. Please help me. I don't know who to go to in order to have them review my loans and what illegal practices have been committed. I really think I have been a victim of the allegations against navient / sallie mae. I know I am not the only one. These people are thieves. I will be paying these debits off until I am XXXX years old. It has delayed me from buying a house, settling down and starting a family.

Issue: Communication tactics

Subissue: Frequent or repeated calls

Consumer Complaint: In XX/XX/2016, I was electrocuted in an accident which caused me to be medically unable to work until a few months ago. As a result of this I have been forced to declare bankruptcy. For that purpose I retained Attorney XXXX XXXX of XXXX XXXX, WA, XXXX. Attorney XXXX still represents me. During that time I was contacted by Pioneer Credit Recovery of XXXX XXXX XXXX, XXXX NY XXXX regarding my student loan. I informed them of my attorney 's contact info, and asked that they direct all communication through him as required by law, until my bankruptcy proceeding was completed. I would then make arrangements to resume payments on my student loan once working again. Despite being given this information, Pioneer has not only refused to contact my attorney, they have continued collection activity by continually calling me, my family members and threatening further action. As you know, under the FDCPA, all collection activity must cease during a bankruptcy proceeding. Pioneer has refused to abide by the law. Under The FDCPA, a company is required to send to me in writing all information relating to the reasons and amounts they are trying to collect. Despite having been over a month since their first contact of me and having my correct address, they have refused to do so. Furthermore, under R.C.W RCW 19.16.430 ViolationsOperating agency without a licensePenaltyReturn of fees or compensation. ( 1 ) Any person who knowingly operates as a collection agency or out-of-state collection agency without a license or knowingly aids and abets such violation is punishable by a fine not exceeding five hundred dollars or by imprisonment not exceeding one year or both. I have repeatedly asked Pioneer for proof they are licensed and bonded in the state of Washington to collect a debt as required by law, but they refuse to provide me this information. This is my last attempt, in good faith, to ask Pioneer Credit Recovery to follow federal and state law and cease all collection activity until my bankruptcy proceeding is complete, and direct communication through my attorney, whose contact information they have. At that time I will make arrangements with them for rehabilitation of my student loan debt. I am filing complaints with the Federal Trade Commission, the Consumer Financial Protection Bureau, the both the NY and WA State Attorneys General. IT is illegal to circumvent the bankruptcy laws of Washington State and the FDCPA. I am requesting that Pioneer follow the law.

Issue: Incorrect information on your report

Subissue: Account information incorrect

Consumer Complaint: I am not able to obtain housing because Navient is reporting 3 late payments on two different loans for a total of 6 late payments. I lost my job in XX/XX/2018. I became XXXX in XXXX 2018. I am a single mother. I recently gained full time steady employment and I have attempted to obtain housing and I am unable to because of these late payments. I was working less than 30 hours a week for the last year and I am still XXXX. I was on unemployment from XXXX XXXX to XX/XX/2018 and I was on public assistance for even longer than that. I received these late payments during a time when my focus was on providing for me and my child. My unemployment forbearance was granted in 2018 and back dated but the late payments are still being reported. I have tried to resolve this issue with Navient and have not been successful.

Issue: Dealing with your lender or servicer

Subissue: Trouble with how payments are being handled

Consumer Complaint: I took out the school loan in 2006. After I left school, I was told I had to pay {$50.00} per month and a certain percentage of that would go towards interest. I was told I could make additional payments towards the principal, but in fact my payments were only applied to future payments. The problem continued to get worse as the automatic payments continued to be withdrawn from my bank account and applied to principal and interest. After 10 years, my loan hardly decreased at all. I finally moved it to a 0 % credit card and paid it off in 1 year. I should also mention my interest went up several times with no notification. From 2 % to 6.5 %, I think. Navient is terrible.

Issue: Dealing with your lender or servicer

Subissue: Don't agree with the fees charged

Consumer Complaint: My original Student Loans from Navient totaled {$5200.00}. I made payments from XX/XX/XXXX to XX/XX/XXXX totaling {$2900.00}. I received a notice of default on XX/XX/XXXX with the amount due totaling {$4800.00}. I received tax offset notices from The Dept. of Education on XX/XX/XXXX ( {$330.00} ) and XX/XX/XXXX ( {$520.00} ). I received a debt collection notice on XX/XX/XXXX for {$6000.00} ( principal bal {$2900.00} ). I disputed the amount owed, but was answered with another debt collection notice on XX/XX/XXXX for {$6100.00}, which did not provide any payment history or other details as to how the payments were applied. I received additional tax offset notices from DOE on XX/XX/XXXX ( {$720.00} ), and XX/XX/XXXX ( {$53.00} ). The additional {$1600.00} in payments made between XX/XX/XXXX to XX/XX/XXXX via tax offset, bring my total payments made towards this loan to {$4500.00}. After being turned down for an FHA loan in XX/XX/XXXX, I contacted the Dept of Education regarding my student loan. Again, I disputed the amount owed. I received a letter on XX/XX/XXXX detailing my payment history from XX/XX/XXXX to XX/XX/XXXX, which did not include payments before the default. What it did show was that {$0.00} of the {$1600.00} collected was applied to the principal balance. I then contacted Navient in an effort to obtain my payment history prior to the default. I received a letter on XX/XX/XXXX stating that a claim was filed and the loans were transferred to the guarantee agency. Their records show the outstanding principal to be XXXX. As a result of my inquiries I received a debt collection notice on XX/XX/XXXX for {$7700.00} and the principal balance is still {$2900.00}.
