Issue: Problem with a credit reporting company's investigation into an existing problem
Subissue: Their investigation did not fix an error on your report
Consumer Complaint: This particular account situation that is lately filing on my own credit document has a seriously unfavorable relation to my personal ability to obtain a present loan application. I highly recommend you generate verification that NAVIENT has been reported completely in accordance with the Fair Credit Reporting Act regulations, it's really a serious problem to mis-report. More confirmation of the aforesaid item too. My proper request must over, I was never 30 days/60 days/120 days late in any of my payments and I'm not greatly tuned in to the date opened so I prefer to ask you be investigated as soon as possible and confirmed to be correct. Thanks!

Issue: Dealing with your lender or servicer
Subissue: Trouble with how payments are being handled
Consumer Complaint: Navient is misdirecting overpayments of my student loans. As I understand, for federal student loans, it is required that any extra payment goes first to outstanding fees, then to interest accrued since my last payment, and then to the principal of the loan. I have two loans with them ( subsidized and unsubsidized ). My monthly payments are made on time with extra towards principal each time. Their online platform provides two options to make a prepayment, direct an overpayment and specify for each loan. Each time I request that an overpayment be directed to one of the two loans using either option for prepayments, Navient ignores the request ( even though the monthly payment is paid in full ) and divides the prepayment equally among both loans. It is my preference to pay loan XXXX consolidation off before the loan XXXX. My attempts to speak with Navient brought me to customer service people who were unhelpful and would not take my compliant over the phone. The misappropriation of payment has been consistent for at least the past 12 months. If the payment requests had been appropriated correctly the balance of the XXXX student loan would be close to paid in full leaving me with half the payment I am currently making. By offering the ability to direct payments and then not honoring the directed overpayments is nothing more than deceptive and unfair. If Navient considers this one loan then they will likely force me to get a payoff letter for XXXX and just move the balance to credit cards which do not want to do.

Issue: Attempts to collect debt not owed
Subissue: Debt was result of identity theft
Consumer Complaint: This agency has refused to provide documentation of the so called defaulted loan. They continue to report inaccurate and false information about a debt that does not exist. They have violated my rights as they continue to garnish my wages without ever submitting adequate documentation to support their claim nor was I ever offered an opportunity to dispute the debt. They immediately began to take my wages for debt that I do not owe. The data that is listed on their website about this apparent debt doesnt even make sense. After several recorded conversations two reps have admitted that they cant send documents that dont exist. They continue to violate my rights and steal my wages.

Issue: Dealing with your lender or servicer
Subissue: Trouble with how payments are being handled
Consumer Complaint: Navient applied a deferment to my XX/XX/XXXX loans without my consent and now refuses to remove it. They are XXXX me out of qualifying payments towards Public Service Loan Forgiveness. Have tried multiple times to get them to understand my situation and have requested they put all my loans back into repayment. Their representatives give false and inaccurate information. I graduated in XX/XX/2018 and should have my graduate loans in repayment status.

Issue: Incorrect information on your report
Subissue: Account status incorrect
Consumer Complaint: Navient is reporting to the credit bureaus every month that my payments are 90-120 days late. I checked with them and I do not owe anything to them for several more months because I am in deferment. I disputed this with XXXX and they changed it to reflect an even worse and more incorrect payment history. Attempted to contact navient regarding the issue and they said they couldn't help me with credit reporting issues.

Issue: Dealing with your lender or servicer
Subissue: Keep getting calls about your loan
Consumer Complaint: So i am getting calls about a Navient Settlement from a XXXX XXXX. She is claiming that they have Student Loan forgiveness options. Told me to call XXXX. Provided me with a validation code. I don't have any documents, however i do still have the voicemail they left. Not entirely sure how i would get that to you. These things keep happening and somehow they have my information. I am displeased and have reason to believe that Navient either has a security leak or they are selling my information. On researching my options, reporting this to the CFPB was the best offered solution. Any other suggestions or a course of action would be appreciated.

Issue: Dealing with your lender or servicer
Subissue: Need information about your loan balance or loan terms
Consumer Complaint: Navient Solutions ; In response to complaint ID:XXXX ; Requested legally required documentation supporting the detailed information in amounts owed, etc. for student loan accounts. Was not provided within the timeframe given via direct mail correspondences. Received one letter with nothing requested other than account amounts which is unsatisfactory and required to be provided by law. Violating the Truth In Lending Act and other applicable laws. Thus lawsuit filed. Dismissed without prejudice with intent to resubmit in making corrections as per the judges recommendations. Navient states they have provided " copies '' by mail as well as supposedly resubmitted with the previous CFPB complaint listed above. No attachments provided once again. Nothing actually providing legal proof for Navient to continue with it's illegal activity in maintaining these accounts. Also threatening the consumer with emails regarding credit score decreases for nonpayment while in the process of disputing the accounts with Navient directly. The persons credit was then harmed during this process despite a formal investigation requested into the validity of the student loan accounts, amounts owed, and the legality of their ability to collect money from the consumer. FTC, FDCPA, FCRA violations. Thank you for advice in filing fraud and police reports regarding this matter.
