Issue: Dealing with your lender or servicer

Subissue: Keep getting calls about your loan

Consumer Complaint: I discussed having my name taken off my grandaughter 's student loan. The full amount of her two loans was {$21000.00}. I was told that if I paid {$5400.00}, my name would be removed from the loans. This was the latest offer as of XX/XX/XXXX. I then asked if that would leave the balance of the loans at the difference of the two amounts and was told : no, the full amount of {$21000.00} would still be owed by my grandaughter. She would be responsible for the full amount even though I had paid the {$5400.00}. There is something definitely wrong here. I had been having {$110.00} per month automatically deducted from my checking account for years, but have put a stop payment to Navient for that amount which is effective until XX/XX/XXXX. The above offer was only available until XX/XX/XXXX. I may be wrong but I think this is fraud. If I made the smaller payment, only the balance of the loan should be due, not the full amount. They also continue to call via automated phone calls after XXXX XXXX very frequently. I have been dealing with them for some time now and find them arrogant, rude and totally annoying. You are shifted to several different people in the course of a conversation with them. It is very upsetting and aggravating. I do not like this company at all.

Issue: Incorrect information on your report

Subissue: Account status incorrect

Consumer Complaint: I was XXXX from XX/XX/XXXX until XX/XX/XXXX. I submitted that information to my lenders Navient and the adept of Education. My loans were not delinquent before XXXX. Dept of Education decided to payoff to of the delinquent loans from XXXX yet there are still being report delinquent. I have several delinquencies reporting from both Navient and Dept of Ed even after sending them proof of my XXXX and agreeing to rehab the loan. I know that it is no one fault for my XXXX except my own. Yet these reports cause my scores to drop 100 points. I dont want a statement to be put on my credit report stating I was XXXX for that will only cause more harm. I have a problem that government agencies should as Lenders are allowed to report information when I believe they knew I was incarcerated and never reached out to me to try and defer my account until I was released from custody.

Issue: Incorrect information on your report

Subissue: Account status incorrect

Consumer Complaint: I have 3 student loans that I recently consolidated into one loan. When the 3 loans were open they were always in deferment or forbearance. However, upon checking my credit report I am showing that all 3 loans have a late payment. The payment only shows that it was 90 days late - no other reports as far as 30 or 60 days late were reported prior to that. I have disputed this with Navient and all three credit bureaus and they are reporting it as verified as being late. I asked for proof that the accounts were late with no response. I want the late payments removed from my report as these accounts were never late.

Issue: Struggling to repay your loan

Subissue: Can't get other flexible options for repaying your loan

Consumer Complaint: First of all I was furloughed due to COVID-19 starting XX/XX/XXXX. My payments are automatically deducted on the XXXX of the month. XXXX 's payment was not a concern I had enough to cover. I did check the company website in late XXXX early XXXX as it became more clear that i was not returning to work soon. The information I got was that they ( Navient ) was working with the government on a solution. After I heard about the Federal governments plan forgive student loans until XXXX XXXX I went and checked the status of my FFELP loan status. I understood, from the information I had, that I didn't need to do anything further. That was mid XXXX, it showed that I owed nothing come XX/XX/XXXX. So, I figured everything was good. I received a voice message from Navient on XX/XX/XXXX claiming that my payment was past due and I owed an additional {$27.00} late handling fee. I called them back on XX/XX/XXXX after checking the website first. According to the website I owed {$0.00} on XX/XX/XXXX and about 2 lines down it said there was past due payment from XXXX plus the late fee. So, I asked the agent what that is about? She said it showed {$0.00} owed because I have automatic payments. I said that is very confusing and then I asked her why my loan wasn't being included in the government COVID assistance program? She explained it was because i needed to consolidate my loan with the Dept of Education. I said it is a consolidated loan. I consolidated over 10 years ago when the POTUS said the interests rates were going up and students should consolidate their loans to lock in the interest rate. So, I contacted my service provider at the time and consolidated my loans. The Navient agent proceeded to then tell me that my loan is indeed consolidated, by not by the Dept of Ed. Navient owns my loan outright. So, I proceed to tell her that I've been furloughed due to COVID-19. I ask what are my options. She said my only option is Navient 's Emergency Relief program which lasts 90 days. I then asked will you be charging interest during this time. She replied yes. I went on to say this is why I fought Navient taking over my loan again. About 20 years ago I was working, but having trouble making payments. XXXXSallie Mae was my service provider then and told me the only real option I had was forebearance. Well, I ended owing double the original loan amount. The Navient agent said that in order for me to have control over who services my loan I would have to consolidate my loan through the Dept of Ed, and that she would email me the information. I said fine to that because I would like nothing more than to get rid of Navient from my life. I did agree to the Navient relief program for now, so that I don't keep getting hit with late fees and they don't keep trying to draft money that isn't there. Apparently in the meantime I have to consolidate and already consolidated loan.

Subissue: Can't get other flexible options for repaying your loan

Consumer Complaint: In 2005, I attended XXXX University for XXXX. At that time the loan amount was {$20000.00}. I was told I was getting a student which at the time was called Sallie Mae. Later I learn it was a private loan. When Obama was in office he came out with the student loan forgiveness program. Sallie Mae which is now Navient wasn't a part of the forgiveness. Now I am learning that Navient were supposed to provide the service. Because I couldn't get help with my loan. It has been in default for about 3 years.

Issue: Communication tactics

Subissue: Frequent or repeated calls

Consumer Complaint: In the past I communicate with Navient contact me at me work place. On XX/XX/2020 I received 7 voicemail from them. Leaving my personal in formation on a company phone that I have no access. On XX/XX/2020 I received 9 voicemail in a span of 6 hours. All with personal information on company phone that I don't have access to. They repeated called family members that have no association with debt. The called one family twice left a message and then called said person while they were working harassed them until they told them to never call again. I believe they have violated the Fair Debt Collection Practices Act with these actions.

Issue: Dealing with your lender or servicer

Subissue: Trouble with how payments are being handled

Consumer Complaint: I have student loans serviced by Navient ( navient.com ). I like to pay my student loans several months ahead. As of XX/XX/XXXX, I had paid them up to XX/XX/2020. That is, Next payment due date, XX/XX/2020. Then the CARES Act was applied, whose intent was to provide a pause period, give borrowers more time to pay. So what did Navient do? Navient TOOK AWAY two ( 2 ) months of payments I had already made by setting the next-payment due date TWO MONTHS EARLIER, from XX/XX/2020 to XX/XX/2020! Their reasoning was : All loans go into Covid forbearance Covid forbearance ends XX/XX/2020 Therefore all loan have a due date for next payment of XX/XX/2020 XXXX. Specifically, Navient 's statement was : "... Because the deferment ended on XX/XX/2020, your extra XX/XX/2020, payments were no longer applied toward future payments due. '' Is that even legal? If a borrower has made payments to XX/XX/2020, there is no way Navient should be allowed to move the next payment due date backwards, to XX/XX/2020. Navient must have done this to thousands of borrowers who paid their loans ahead.

Issue: Dealing with your lender or servicer

Subissue: Problem with customer service

Consumer Complaint: I became XXXX on XX/XX/XXXX. I filed a new Income Based Repayment plan and the servicer ( Navient ) acknowledged receiving this on XX/XX/XXXX. They increased my payments instead of lowering them. I had included my Income Verification with that application, but, as is their habit, they discard the Income Verification information or claim it has not been received so that they can miscalculate the IBR plan ( or so it would seem ). I received NO income between XX/XX/XXXX and XX/XX/XXXX, yet Navient increased my payment amount by 30 %. My income after XX/XX/XXXX ( and since ) is only 66 % of my previous income. They finally recalculated my IBR on XX/XX/XXXX but claim I must pay the inflated payment from XX/XX/XXXX. This is unfair, as during the month preceding XX/XX/XXXX my income was only HALF of my previous income ( 66 % for 3 of 4 weeks and nothing for one week ). I received information that Student Loan payments have been suspended until XXXX. However Navient claims I must continue to make payments. I know that I refinanced my student loans with the Department of Education years ago, but there is now a claim that only Department of Education loans after 2009 are eligible. It is highly disturbing that this claim is made, since there has never been any public notice that there was a cutoff date associated with Department of Education loans. All government notices ( including notices from Navient ) do not include any such cutoff date. This certainly appears to be negligent activity and a case of intentional disinformation ( if it is true ).
