Issue: False statements or representation

Subissue: Attempted to collect wrong amount

Consumer Complaint: Navient is claiming they do not have to follow the CARES act on certain loans and are refusing to allow extended forbearance in the middle of a global pandemic. Someone needs to hold these student loan companies accountable. They are attempting to collect on student debt with interest in the middle of this pandemic with millions unemployed. They leave people like me, who lost my job due to Covid in an impossible situation of not being able to pay my loans and ruining my credit because of it.

Issue: Dealing with your lender or servicer

Subissue: Received bad information about your loan

Consumer Complaint: My name is XXXX XXXX XXXX. In XXXX, I co-signed with my daughter to get a loan for her education to attend XXXX XXXX University in XXXX, Georgia. After completing school, she and her husband encountered some difficulties paying her loan. I had problems of my own, therefore I couldn't help her financially. I also had a student loan at the time. In the year between XXXX, her loan was paid in full due to IRS sending her refund to cover her loan amount to the U.S. Department of Education. Since that time, Navient took over my loan from Sallie Mae in XXXX. The last four of her loan was XXXX, whereas, the last four of my loan is XXXX, however, my entire account number is XXXX. Navient has placed her loan, which is already paid on my account in the amount of {$5800.00}. I wrote to the company about this on XX/XX/XXXX, but their response was, " We are unable to adequately address your concern via email due to the status of your loan. '' They gave me a number to call by telephone, which was XXXX. The Navient Email Representative was Ms. XXXX. All she could tell me was that the loan was mine. I understand how co-signing works, but the loan was paid in full after the IRS sent my daughter 's refund to the U.S. Department of Education.

Issue: Dealing with your lender or servicer

Subissue: Keep getting calls about your loan

Consumer Complaint: My sons student loans ( of which I am the co-signer ) were taken over by Navient. His payments have been sporadic but he always ends up making a payment. Over the last 2 to 3 years I have personally received numerous phone calls, statements from Navient saying the account is overdue and letters threatening to send the account to a collection agency. I personally have contacted Navient to request that the phone calls stop, I have made payments to bring the accounts up-to-date. Most recently, I found out that Navient had faxed my employer asking for information, and called my sister trying to get information. At the beginning of XXXX, I called Navient and negociated a pay off amount. That amount was paid in full on XX/XX/XXXX. Since that time I have received two statements from Navient saying there was a balance and they also called my brothers house within the last week to request information about me. At this time I am seriously considering filing a lawsuit for harassment against Navient. The account is paid in full, why are they still harassing me??

Issue: Dealing with your lender or servicer

Subissue: Received bad information about your loan

Consumer Complaint: I was alerted by my credit monitoring system that my credit score decreased significantly and I had 12 missed payments. I immediately looked at my report and saw Navient my Student loan servicer reported my accounts were 90 days past due. I am on a income repayment plan and my payments have been zero each month. When I called Navient in XX/XX/XXXX, they stated I failed to renew my income repayment plan I never received anything from them stating I was up for renewal. Navient stated they emailed me as that was my preferred method of contact. I told them no I updated my mailing address which you have on file the email address is no longer able to receive emails. I was told I had to ask for a forbearance if not my account would continue to report negative to the credit bureau while I renewed my income based repayment plan, so I did. I disputed being 90 day late on my 12 student loans with all three Credit bureaus, however each time Navient reports back they have stated my balance increased by ( as example XXXX on one loan, XXXX on another ) etc. With the payment rating still showing late. They capitalized on interest loans from when I graduated XX/XX/XXXX until now have XXXX in interest charges.

Issue: Struggling to repay your loan

Subissue: Can't temporarily delay making payments

Consumer Complaint: Navient is my student loan provider. I know that there was legislation passed for student loans providing for at least 90 days of deferment and waiving of late fees. I have two loan providers. one of them auto enrolled me into the deferment, whereas navient has kept the loan active and has been charging me late fees. I have attempted to call them on several occasions and receive a message that the office is closed and am then disconnected. Issue: Dealing with your lender or servicer

Subissue: Trouble with how payments are being handled

Consumer Complaint: Every month when I make my payment, I choose the Custom Pay option and pay the minimum on one loan and an overpayment on the other in an attempt to pay it off faster. I have kept track of my payment amounts and balance amounts since XX/XX/XXXX though I have been doing it this way for much longer than that ). Every month when I would log in to pay, I viewed the balance information and noticed that they consistently disregarded how I wanted the extra money to be allocated. I called on XX/XX/XXXX to discuss. The rep told me that she recommended that I make the minimum payment then log back in after several days to make an additional payment, which is ridiculous. Why have the Custom Pay option if it must be done that way? She also said she would put in a ticket to have the payments fixed from XX/XX/XXXX going forward ( since thats how long my records went back to show how much was being allocated to each loan ). I never heard anything else from them regarding this. The payments were never fixed. I continue to pay this way and each month they seem to disregard how I want that extra money allocated.

Issue: Dealing with your lender or servicer

Subissue: Trouble with how payments are being handled

Consumer Complaint: I have been paying on 1 of my student loans with Navient but instead of the payments going to the balance, my payments have been going to late fees and interest. The problem with that is whenever I have been late in the past, the fees and interest were added to the previous balance. Therefore by Navient putting my payments towards those fees and not reducing the balance I am paying for them TWICE. Not only that I have 2 loans and I have chosen to pay off the smaller loan. The fees aren't that much but instead Navient is putting my payments towards the entire amount of both loans even though I have specified exactly which loan I want my payment to be applied to. Since XX/XX/XXXX until XX/XX/XXXX, I have paid a total of {$1200.00} of that amount {$630.00} have gone to interest and late. fees. The total amount that should be paid on Loan 1 is {$1500.00}. How can Navient ADD late fees and interest to my account and then submit my payments only to those fees but my balance does not decrease? Also, since I am given the choice of which loan I want to pay off what right does Navient have to put my payments where they want them to be? Not only that they report to the credit bureaus every month that I am NOT making payments.!!

Consumer Complaint: I went to XXXX College XXXX XXXX XXXX in XXXX, CO from XX/XX/XXXX to XX/XX/XXXX. I was unable to complete school due to a death of spouse and child. I have asked for student loan forgiveness due to uncontrollable circumstances. I have been denied or never get an answer. Also the school closed and is now XXXX. I never attended XXXX or any other school name it became. If school closed. It should have been written off in bankruptcy. It is deception and fraudulent to continue to collect on loans due to hardship and school closure. I am needing help navigating this issue. I have dreams to be successful for my family and loved ones. Any help would be appreciated. Thank you.
