Issue: Dealing with your lender or servicer

Subissue: Trouble with how payments are being handled

Consumer Complaint: On XX/XX/2020 I made my monthly payment. I paid extra money on that date expecting it to go to the principle of the loan I targeted. On XX/XX/2020 I noticed it all went into interest. I called them on XX/XX/2020 and was told it has to go to interest. I explained it shouldnt and I paid it on the day due so it would all go to principle. I then asked for a reimbursement of the extra money paid and was told it couldnt be unless the whole payment was reimbursed which would mean I didnt pay for the month.

Issue: Incorrect information on your report

Subissue: Old information reappears or never goes away

Consumer Complaint: I went to inquire about a car I have been renting and their buying options. I was informed that my credit score was below 500, which sounds odd because it was closer to 600 the last time I checked. I checked my credit to discover that the department of Education and Navient have been making reports to my credit which has taken my credit down by 100 points and more! One report from Navient took my credit score down 91 points in a single day! I have not had any communication with Navient to discuss repayment options even after the last disputes, which they were supposed to organize! I have no new loans with Navient yet they are continuously reporting missed payments to the credit bureaus almost weekly! In the duration of the covid-19 shut down and the CARES ACT ; the department of education has consistently made numerous reports to the credit bureaus, but when I contacted them to speak with someone who could help me set up a payment arrangement they continuously gather information, are condescending, not helpful, and try to get me to contact 3rd party collection agencies instead of dealing with me directly while Im on the phone. I do not wish to deal with 3rd party collection agencies when theyre the ones the original debt came from and theyre the ones who consistently make reports to the credit bureaus. This is unlawful practices! Theyre controlling my life and not giving me the opportunity to pay off debt. They make it impossible to set up arrangements and to re-establish my credit and it feels debilitating and hopeless. Navient keeps changing the dates of the supposed debt I have with them. I need to have all charges investigated and disputed from the department of education and from Navient, because something is not right and I HAVE to have good credit! Ive been working on my credit since last fall and I paid off some things. However, the level of student loan activity is absolutely absurd especially since I havent been in school for about 10 years. The debt from these 2 companies are mostly 8-10 years old and should not be bringing my credit score down so low! My credit score went from XXXX, which isnt that great to XXXX in less than 30 days and when I call these people Im SICK AND TIRED of dealing with their snarky nasty attitudes and their games! I would like to start an investigation immediately.

Issue: Credit monitoring or identity theft protection services

Subissue: Billing dispute for services

Consumer Complaint: XXXX XXXX I filed a dispute with XXXX in regards to a debt with The loan servicer, Navient. In my dispute I argued I've never taken a loan out with Navient, I don't know them and never signed a contract with them for a student loan. To this day, the debt still remains on my credit report as deferred because Navient supposedly reported certified information to XXXX as accurate. Therefore the information was not changed. I'm not sure what certified information they could have used to show the information reported as accurate however I have yet to see any such information. It is clearly false information since I have never heard of, seen or signed any legal documents with Navient. The loan amount balances : 1. {$54000.00} 2. {$4000.00} 3. {$2200.00} 4. {$4400.00} 5. XXXX XXXX 6. {$670.00} I have no idea why these loans exist on my credit report, however I would like to resolve this issue as quickly as possible. This is a case of stolen identity.

Issue: Dealing with your lender or servicer

Subissue: Don't agree with the fees charged

Consumer Complaint: I received an email from Navient on XX/XX/2020 saying that there is a payment due on my student loans which there shouldn't have been because I am on an income based repayment plan which is {$0.00} due to my income. I called them and spoke with a customer service representative and asked her why it was showing charges when I am on that plan. She said that those fees are being added now for interest from a few years ago. I don't know how that is possible when I was already been charged interest then and it was applied to my loan balance already. I believe that since XX/XX/2020 until XXXX there are not supposed to be any interest charged due to what was signed into office over covid-19.

Issue: Communication tactics

Subissue: You told them to stop contacting you, but they keep trying

Consumer Complaint: I began to receive calls at my cell number from a variety of phone numbers regarding student loan debt for a person with a name similar to mine. Callers would leave a message about 3/4 of the time, stating they were calling from Navient ( with whom I have no accounts ). On XX/XX/2020 I called Navient at XXXX and spoke with XXXX, customer service number XXXX. I explained that I have no customer relationship with them, and requested that my phone number be removed from their system. She asked for, and I provided, the phone number. She stated that the number was removed and I should expect calls to cease within 24 hours. Since then ( today is XX/XX/2020 ) I have received at least two dozen calls and voicemails, again from various numbers, purporting to be from Navient and requesting callbacks from me. Although I have blocked each number, I do receive an alert each time a blocked number calls, and I have to listen to the voicemails to verify that they aren't relevant to me. Phone numbers that have called and left messages claiming to be from Navient include : XXXX, XXXX, XXXX, XXXX, XXXX, XXXX, XXXX I believe this constitutes unlawful harassment on the part of Navient or their agent.

Issue: Incorrect information on your report

Subissue: Account information incorrect

Consumer Complaint: Hello, I understand that Navient thinks data was reported accurately to the credit agencies, but the way it was reported was very damaging. I had open emails with Navient regarding my loan consolidation and the confusion of repayment of my loans when this hit my credit report. Navients reporting to the consumer reporting agencies was done in such a way that it would crush anyones credit. I show about 15 late payments on my credit report. To the credit agencies they see this as 15 delinquent accounts, which is just not the case. I was waiting for my loan consolidation when this happened and I was trying to get in communications with someone at Navient to get a handle on my repayment. The timing was terrible and it was a complete shock that Navient reported this when we clearly had open discussions about consolidating my loans and I was waiting on responses from Navient. The communication issues when trying to figure out my repayment plan went on and on and it was unacceptable that you can not get in touch with someone to discuss your account in detail. Not only does my credit report show 15 delinquent accounts, but when my loan actually was consolidated, my past accounts with Navient were removed from my credit report so my 'credit age ' was drastically shortened as well! This shows me as closing a credit account and opening a new account which completely destroyed my credit score as well! Navient has not made it easy to repay my loans. There are 13 loans, some Stafford, some direct, some subsidized, some unsubsidized. Some had payments of {$70.00} and others $ XXXX. It was never made clear on what I had to do to pay these back without completely breaking the bank. As you can see, it is very confusing and stressful. The only time Navient calls me is to try to sell me the Navient ReFi, but when I try to get actual data on my loans, it goes nowhere. It's just sales tactics when I try to talk to an actual person for help. I understand that Navient has 6 lawsuits currently in progress due to similar issues that I have stated above. Please point me in the right direction. " Navient Corp., a major servicer of private and federal student loans, is facing six lawsuits alleging that it harmed student loan borrowers throughout the repayment process. '' I need my credit report to be cleaned up. I need Navient to make this right. I make my payments on time ( even during the pandemic ). My loans are now consolidated. I just need my credit report to remove those 15 delinquent accounts. It is ruining my life. All the underwriter requires is a letter on their letterhead, noting these delinquencies, stating they were paid in full and have been removed from my credit history. I authorize anybody to verbally release this information to the credit bureaus. Navient Account # : XXXX FYI I have had almost no response from Navient in months. My main contact, a customer advocate, has not responded to me in months. No response from XXXX. No response from XXXX. No response from XXXX What am I supposed to do? How is anybody supposed to get answers? They don't have a problem communicating when a payment is late. I am asking for some assistance to help with the XXXX. reporting to the credit agencies to try to revert the damage done to my near perfect credit score. I need to obtain a loan for my family ( and new XXXX ). Navient is stopping this from happening by destroying my credit because of their communication issues and disorganization.

Issue: Dealing with your lender or servicer

Subissue: Trouble with how payments are being handled

Consumer Complaint: Navient provided an incoherent response. Navient did not respond to any of the issues raised and only admitted to not properly handling the servicing requirements provided by the Department of Education. Navient also admits it fails to follow Federal law with proper payment allocation. Navient is failing to take the correct accounting of the payments. Navient stole the payments made for the next month and misapplied them to what they term as " Unpaid Interest, then to Unpaid Principal. '' THIS IS INCORRECT as all interest payments and principal are current. The total due for XXXX is {$280.00} the total paid was {$500.00}. The total due for XXXX should have been {$100.00} the total paid was {$320.00}. Therefore, total due for XXXX should be {$100.00} AND WITH NO UNPAID INTEREST AND UNPAID PRINCIPAL AS EVERYTHING HAS BEEN AND WILL ALWAYS BE CURRENT. Proper allocation of payment to account and thus an amount due for XXXX for {$100.00}.

Issue: Struggling to repay your loan

Subissue: Can't get other flexible options for repaying your loan

Consumer Complaint: My job is making payments on my behalf and all of those funds are going to interest only. I am told it calculates daily but that is not shown anywhere on the system. First i was in a bankruptcy for 5 years and making payments thru the bk system once it was completed they charge interest for 5 years. I don't think that is fair since i was making payment thru the bk system monthly. If it can be included in your repayment plan why would they be allow to accrue interest that whole time. now that i am out and have been making payments for the last 3 years my balance still is NOT going down. when i asked about it i was told i was in an interest only loan repayment. also found out that the XXXX that my job is paying on my behalf is going to interest only. I think this is crazy and no one can really explain how to resolve. Any assistance would be greatly appreciated. XX/XX/2020 Payment - {$150.00} - principal - {$100.00} - interest {$0.00} - {$250.00} XX/XX/2020 Payment {$0.00} - {$100.00} - my job - all interest {$0.00} - {$100.00}

Issue: Dealing with your lender or servicer

Subissue: Don't agree with the fees charged

Consumer Complaint: This problem involves Navient and the issue of reapplying for my income-driven repayment plan. Navient divides my Federal student loans into two buckets : those owned by the US Dept of Education, and those owned by Navient. But I am only supposed to have to complete one reapplication for my IDR repayment plan each year. This year, I completed my application in XX/XX/XXXX, many months before either set of loans was scheduled to come out of IDR. My application was approved. However, Navient only processed it for my US Dept of Education loans, not my loans owned by Navient. As a consequence, inXX/XX/XXXX, I was given notice that I was no longer in the IDR and that my payment was about to increase by a very large amount ( the amount of the standard repayment plan ). Coming out of the IDR also resulted in them capitalizing my accrued interest, which amounted to about {$10000.00}. I was able to call Navient and explain that they failed to process my IDR application, and they corrected that error and put me back in the IDR. HOWEVER, they did NOT remove the {$10000.00} in capitalized interest. To summarize, Navient failed to process my IDR application correctly, charged me what amounts to a penalty of {$10000.00} because of their mistake, and then failed to remove that penalty when they realized and corrected their mistake. I have asked them to correct this, and they might, but it alarms me that it was only because I was closely monitoring my online account that I was able to see that they capitalized my interest. I am worried about who else they may have done this to and am worried that others might not even be aware that they have been improperly penalized.
