Consumer Complaint: Loans indicate a starting amount that is much higher than the disbursement plus capitalized interest. Some include disbursement fee and repayment fee . There are 3 that still have my cosigner even after being in repayment almost 20 years. Repayment total {$20000.00}, interest paid total {$51000.00}. How is my interest paid 149 % the amount of loan paid? How is this not predatory lending? Of my original {$55000.00} I still owe {$34000.00}. After 17years I have only paid 37 % of my loan? My loan with the highest interest for the first 2 years I only paid down {$550.00} and paid {$2400.00} in interest. Of the original loan amount of {$15000.00} they added on {$520.00} ( 3 % ) repayment fee, {$900.00} ( 6 % ) disbursement fee, and {$1500.00} of capitalized interest. All of my loans also show an unpaid Principal balance value that is almost twice the amount of the loan plus fees. For example on the {$15000.00} loan with fees above ( {$520.00}, {$900.00}, {$1500.00} ) was total {$17000.00}. However the unpaid principal balance value was {$32000.00}. Was interest calculated on this higher incorrect amount?

Consumer Complaint: I was contacted by a Navient agent around XX/XX/XXXX inquiring if I was interested in lowering my monthly payments of {$420.00}. During the call, she requested some information, mostly none PII, with the exception of my current salary. Because I was contacted by them and as a precaution, I refused to provide my yearly salary. The agent then advised me that there were other options not requiring salary information and started processing the request to lower the amount. She offered 2, 3, and 4 year plans, with the last one lowering the monthly payment to approx. {$240.00}. I asked to be included in that plan with the understanding that it would go up at the end of the 4 years. The agent even added that before the expiration of the new loan, I would be able to resubmit a new request and restructure my loan all over again. Due to what the agent described as some processing issues, she said that she will just submit the request and that I would be getting a letter in a few days with a confirmation that the payments have been changed. On XX/XX/XXXX I received the letter and the amount of my monthly payment was increased to XXXX. Instead of lowering the amount, it actually increased it by {$3.00}. I immediately contacted Navient and they advised me that I did not qualify for the loan that I was offered ( Graduated loan ). Also, and due to my yearly salary of $ XXXX I do not qualify for any other plans. Why this did not come up in the original discussion baffles me. Navient says that this change was going to happen regardless of my request for lowering my monthly payment, but that seems to much of a coincidence. This is bait and switch. They call me and offer me an option to lower my payments and then end up increasing them. The increase is negligible, but how many other people with a different income are they doing this too.

Consumer Complaint: Navient is falsifying information to still report on my account. The first delinquency from Navient was in XX/XX/XXXX. I have credit reports from XXXX supporting my claim. I was unemployed all of XXXX and returned to work in the summer of XXXX at a job paying half of what I made in XXXX. As a result, Navient 's claim that I caught up in XXXX is FALSE. Therefore, they should be made to prove that I caught up with my past due balance in XXXX by submitting other evidence payments. To further illustrate their deception, I spoke with a Navient executive who refused to review the evidence I provided, only to reply with, " our records are correct. '' It is unjust that Navient is allowed to report misinformation for their own benefit without providing substantial proof that their financial records are true.

Consumer Complaint: I attended XXXX XXXX from XXXX to XXXX and I was successful in discharging my federal student loans through the Borrower Defense to Repayment program. The Obama administration had previously enacted regulations in XXXX governing that program, which was established to provide student debt relief to students who were misled, defrauded, or otherwise harmed by predatory colleges and universities often, for-profit schools like XXXX. But the program only covers federal student loans. Private student loans are not eligible for Borrower Defense relief, and Navient refused to discharge my private loans. I believe I am entitled to cancellation of my private student loans under the Holder Rule theory. This rule requires that loans disbursed by commercial entity through a lenders or creditors relationship with that entity include a provision in the loan promissory note that allows a borrower to raise the same claims and defenses against the lender that they could raise against the commercial entity. In other words, if the borrower could raise claims of fraud against XXXX, the borrower should be able to raise those same claims of fraud against Navient and Sallie Mae.
