Issue: Dealing with your lender or servicer

Subissue: Trouble with how payments are being handled

Consumer Complaint: Navient is so confusing to deal with and they seem dishonest. I have applied for Income Driven Repayment for the last few years. Each year, I receive multiple conflicting emails and notices via their website that I have different amounts due. And it seems that my balance due NEVER goes down and I am only paying on the interest. I was in forbearance for a long time but now it seems I am not making any headway on the payments I have made. I am constantly fighting with Navient over their lack of timely response and truth in what I am to pay every month. I have attached emails, the statement page that shows on their website today, and the IDR emails that they have sent. I need a straight answer and help. I have been paying in a timely manner and my payments were never stopped due to the COVID protocols in the last two years.

Issue: Dealing with your lender or servicer

Subissue: Trouble with how payments are being handled

Consumer Complaint: I returned back to school in XX/XX/2020 and at that time I was still making monthly payments to Navient on my private student loans. I requested that the payment be paused for in-school deferment, however, after speaking with several agents I was bullied into keeping my payments going. I was told that I would no longer qualify for the rate reduction program upon reentrying the program. I felt very ashamed and bullied by the individuals I spoke with, while still struggling to make payments. I was even called by an agent who, before even asking how I was doing, asked whether I was going to send my payment. Mind you, I had a payment pending on my account, but he'd rather I make a payment with him over the phone. I verified that this was an actual Navient agent and not a scam call when I hung up and called the number back.

Issue: Incorrect information on your report

Subissue: Account status incorrect

Consumer Complaint: On XX/XX/XXXX, I received a letter from Navient stating that I was 95 days late for my payment and requesting me to call their office on or by XX/XX/XXXX to take care of the matter. I spoke to a lady on XX/XX/XXXX who told me that I was 105 days past due on my payment. I asked her, " how could that be '' President Trump and Biden indicated that the payments were placed on hold ''. She stated that Navient didn't fall under those guidelines. I was confused at that point. She stated that was for my other loans, meaning my federal loans, not private loans. She stated that Navient had my private loans for $ {$29000.00} and XXXX had my federal loans for {$5000.00}. She then proceeds to tell me that my federal loans were transferred in XX/XX/XXXX. I stated to her that I had no knowledge of this. She indicated that I could be placed back on track for {$20.00} today, during the conversation. I became skeptical when she had mentioned this because I never heard of a loan facilitator offering such. an offer... I did some investigation and found out that the transfer of my loans was done without my knowledge until I received a letter in the mail from Navient. I'm very angry with the wayt Navient has handled this situation. I went thru a terrible hardship during this pandemic I explained this to several different people at Navient. After I told them what I endured and the fact they offered to get me back on track you would think they would have a heart and remove the inaccurate information they reported about my account with them. I felt this was inconsiderate and cruel.

Issue: False statements or representation

Subissue: Attempted to collect wrong amount

Consumer Complaint: I originally accepted a federal student loan through XXXX XXXX for about {$20000.00}. The loan was assumed by Navient from XXXX XXXX and I have repaid almost {$18000.00} towards the original loan amount. However, Navient claims I owe them over {$24000.00} still. This is more than the original loan amount that I have been paying on for over 20 years. This is mathematically impossible for a loan with an 8.25 % interest rate. I have had several " forebearances '' that were applied to my account by Navient without my consent and that have made the payoff amount out of reach. I have also been told they are compounding the interest daily, and even though I have paid over {$300.00} a month for almost 20 years, they claim I am deeper in debt than when I originally took out the loan. I would be glad to settle the loan for a reasonable amount but I am not repaying double the original loan amount. Please provide some arbitration or legal assistance with this matter. Navient is well-known for handling federal student loans with very questionable practices that has led to the deception of millions of American taxpayers and they have stolen millions from the students of this country in the name of the federal government. They should be already have been prosecuted criminally for these actions but I really just want to be able to pay-off my loan for a reasonable amount. Please intervene and stop Navient from continuing to perform these types of practices.

Issue: Communication tactics

Subissue: Frequent or repeated calls

Consumer Complaint: In the last three days, I have received seven phone calls from Navient. Two calls came on Wednesday six hours apart from each other. On Thursday two more calls came in. This time it was less than two hours apart from each other. On Friday, I received three phone calls less than three hours apart from each other. The phone calls Friday used a XXXX area code number and spoofed the calls. Also the third call when I answered no one spoke up and sat silent. It was their intent to have me hang up then call back which would then direct me to Navient. That phone call there is deceptive. Also, according to FCC regulations a business attempting to collect debt can not spoof a phone number. It is misleading and deceptive. Also, repeated attempts to contact in this case is a illegal under the Fair Debt Collection Practices Act. I want to make a formal complaint and speak to someone in regards to having my entire account removed from Navient. The company did not notify me that a chunk of my federal student loans, which I had consolidated into my private loans, were sold off to a separate company. This not only nullified any prior payment agreements with Navient, it also means I now and paying for double student loans. My payment options did not change under Navient and it was expected I continue to pay the current payment without getting an updated breakdown on my account or how this move impacts my account. Under the Fair Debt Collection Practices Act, the company has broken several of the binding privacy and best practices and I would like to file a lawsuit against the company.

Consumer Complaint: Loan was taken out under XXXX XXXX for $ XXXX in XXXX and transferred to Navient. During that time, finances were strained and payments unable to be made. Company offered only deferment, no income based repayment plan. In XXXX borrower joined the XXXX XXXX XXXX and was XXXX XXXX. During that time we again requested assistance and were told no forgiveness was available because these loans were private loans. Borrower is now full time XXXX XXXX with the XXXX XXXX - XXXX staff out of XXXX XXXX XXXX. Navient is now telling borrower he is no longer eligible for military forbearance because XXXX XXXX XXXX are at the state level, not federal. Federal authority over XXXX XXXX members falls under Title 32 of the U.S. Code. This is considered federal XXXX XXXX for specific state missions and full-time XXXX XXXX. Borrower demanded proof of this policy from Navient and their definition of the difference and is awaiting a response. Current amount of the loan is over $ XXXX.

Issue: Struggling to repay your loan

Subissue: Can't get other flexible options for repaying your loan

Consumer Complaint: In XXXX, I became unemployed and had difficulty finding full time job for the next four years. Thus, I was constrained to obtain 4 private loans with XXXX XXXX, now Navient, during the time my eldest son was attending XXXX XXXX XXXXXXXX XXXX in the following amount : 1 ) {$20000.00} disbursed on XX/XX/XXXX under loan number ending in XXXX 2 ) {$10000.00} disbursed on XX/XX/XXXX under loan number ending in XXXX 3 ) {$30000.00} disbursed on XX/XX/XXXX under loan number ending in XXXX 4 ) {$30000.00} disbursed on XX/XX/XXXX under loan number ending in XXXX. Please note when these loans were obtained, the XXXX XXXX representative did not disclose that these loans would be considered private loans and not backed by the federal government. I believed then that these loans were parent loans since having a student in college was an eligibility pre-requisite. The first three loans were already paid off as follows : 1 ) Loan XXXX was paid off on XX/XX/XXXX for a total of {$42000.00} 2 ) Loan XXXX was paid off on XX/XX/XXXX for a total of {$32000.00}. 3 ) Loan XXXX was paid off on XX/XX/XXXX for a total of {$63000.00} These first three loans were paid off with the help of my eldest son as he was able to obtain a fixed rate of 6 % interest rate being in the military. The fourth loan, XXXX, Navient said I still owe over {$53000.00}. However, upon analyzing the payment history during the life of the loan, it showed that a total of {$39000.00} has been paid as of XX/XX/XXXX when I had to stop the automatic payment because I have been experiencing financial difficulties due to many health issues for an aging XXXX old, on fixed income, and widowed. I have asked Navient for a reconsideration on the loan converting it to a fixed interest rate, but I was declined. They recommended that I apply with another financial institution who can offer a fixed rate. I tried that as well with XXXX, the company Navient recommended. I was also declined. In my last phone call with Navient representative in late XX/XX/XXXX, I tried to ask again for any affordable options to make payments, such lowering the interest rate. I was told they could not do anything about it. Hence, I asked for a department head I could write to file a complaint and seek total relief from the loan as I believed loan ending in XXXX has been paid for, principal and interests. Most recently, I read an article that Navient made a settlement to forgive student loans in the amount of {$1.00} billion, and another {$1.00} billion in private student loans, primarily those with subprime loans. In the same article, I read that the Consumer Financial Protection Bureau is also assisting borrowers who have experienced harmful and deceitful lending practices. I understand there is a pending lawsuit against Navient. Hence, I am seeking your help.
