Consumer Complaint: " I am a member of a group attempting to get free from the terrible Spousal consolidation loan product of early 2000 's which was discontinued due to just how bad of a situation it put people in. This loan was sold as FFELP by govt. to private service companies so not only is it currently impossible to separate the loans after divorce, I am not eligible to consolidate into a Direct Loan that would allow for a more reasonable income based refinancing option or qualify for PSLF which I would surely be eligible for based on my close to 2 decades working in the non-profit XXXX XXXX field in XXXX XXXX XXXX, where I currently the XXXX XXXX of a private not-for-profit Supported Employment program for adults with severe XXXX XXXX. I have made every single payment both when married and once divorced, at the expense of other things such as owning a home, and am requesting your assistance to put me back on an even playing field with those in Direct loans and eligible for PSLF.

My loans were shifted to numerous services, mostly recently Navient. I spoke repeatedly with Navient about reducing my monthly payment of {$950.00} ( XXXX my monthly rent ) only to be told there were no other options available to me.

Subissue: Frequent or repeated calls
Consumer Complaint: I get called a minimum 3 times a day XXXX XXXX XXXX XXXX XXXX and sometimes up to 7 calls a day over a missed monthly payment. I have also received voicemails saying that if I do not contact them back by X date they will negatively impact my credit. Most of the time they call from an unlisted number and do not leave a voicemail which is not a good way of making sure that I know why I was called in the first place. These are the same robo-call tactics that phone scammers use. This has been going on for years.

Consumer Complaint: This complaint is in regard to my private student loans with Navient. A couple of years ago I tried to work with Navient on a payment plan. What they were asking at the time was not affordable to the point I wouldn't even be able to pay my rent. I contacted them to see if they had any programs or could assist me with coming up with a payment that I could afford. The representative said he would need to discuss it with his team, but if I could make a " good faith payment '' then it would buy me some time and will show the company that I am serious about working something out. I made the payment and tried to contact the representative several times to inquire about the status without success. All of a sudden, I receive a letter from XXXX XXXX XXXX, stating that my loans have been turned over to them from Navient and to reach out to them to work out a plan. I was devastated because that's what I was trying to avoid. I soon learn that Navient charged off the accounts and reported my accounts as derogatory, which is still the same status they are reporting today, which is incorrect. I wasn't sure what to do or my options, and felt like I had been tricked, so I just went ahead and worked out a plan with XXXX XXXX XXXX and have been paying them faithfully for over a year now and they send the money to Navient, which Navient has confirmed. Navient also refuses to update the status of my credit report as well as they are reporting a past due balance. I have been making payments for over a year, but they stated that they dont update statuses when they are derogatory. However, how is it derogatory if I have been making payments? There should not be a past-due balance as well. Their negligence in not providing me with options for a payment plan, falsely making an agreement and conning me into making a payment in hopes of working something out, and not accurately reporting to the bureaus has negatively affected me and my family tremendously. I am not able to buy a home due to their negligence and I am hoping to come to some sort of resolution via an investigation and at least have my credit report information reporting accurately.

Consumer Complaint: This letter is regarding Navient ( the largest student loan servicer ) and their continued systematic, manipulative, and fraudulent treatment of borrowers. [ i ] I understand that the Iowa Attorney General is a signatory on the XXXX brief filed with the United States Court of Appeals for the Third Circuit on XX/XX/XXXX. [ ii ] However, the class action lawsuit will likely take several years, at best, to resolve. Meanwhile, Navient is still making money by actively defrauding borrowers and cosigners in a multitude of ways, to wit : changing repayment plans without the borrowers consent, poor customer service and bad information causing borrowers distress, servicing transfers leading to surprising fees and lost benefits, and Co-signer policies causing auto-defaults and borrower distress, and using roadblocks to refinance keeping borrowers tied to high-rate loans, just to name a few. [ iii ] Specifically, I ask you to provide relief for XXXX XXXX ( borrower ) who owes thousands more than her original loan taken out in XXXX, and XXXX XXXX ( cosigner ). We have tried for several years to have XXXX removed as a co-signer, but every time XXXX gets close to the year required for on-time, level, auto payments, Navient changes the rules quite literally keeping XXXX captive to Navient. XXXX is being held hostage and when she called Navient on several occasions there is always some reason why she can not be released. During one conversation, a Navient rep actually hung up on her! If Navient were XXXX or some other company, the public would be enraged, and the government would have fixed this behavior within a year. If Navient is doing this to the above-mentioned individuals, it stands to reason that they are treating all customers in this way. [ 1 ] The complaint against Navient Corporation, Navient Solutions, and Pioneer Credit Recovery is available at : XXXXXXXX XXXX XXXX.consumerfinance.gov/XXXXcfpb_Navient-Pioneer-Credit-Recovery-XXXX XXXX 1 ] XXXX brief filed in the U.S. Court of Appeals for the Third Circuit XXXX XXXX XXXX [ 1 ] XXXX XXXX //www.consumerfinance.gov/XXXX/cfpb-XXXX

Issue: Incorrect information on your report

Consumer Complaint: Navient had gotten 5 of my student loans from the Department of Education. First and foremost, I have spoken at length with the Department of Education on this matter and they have confirmed that Navient had a duty to notify me that my student loans had been placed with them, which they did not. The way I found out about this was I got my bankruptcy discharged in XXXX of XXXX and was looking through my credit report and found they had reported five accounts as being 90 days or more past due. At that time I initiated calls with them to correct my report as I was never notified that I was late on a payment much less that they were the servicer. During my bankruptcy filings they reported to the credit reporting agencies that my accounts were flagged for bankruptcy and my balances were XXXX which I have enclosed one of those notices from XXXX but could produce all of them if needed by the CFPB. Moving forward to XXXX of XXXX because of being determined to be XXXX percent XXXX by the Department of Veterans Affairs I initiated a disability loan forgiveness petition with the Department of Education that I provided all of the information required by them, they investigated, and approved. From that point in XXXX I spoke with the Department of Education and was informed that all of the loan servicers had 90 days to discharge those loans. By XXXX all of the loans were already discharged and reported as such on my credit report except for the loans from Navient. Being naturally curious why all but those were taken care of except the ones from Navient I called them around the if not on XXXX of XXXX ( and I invite the CFPB to request that conversation as I was told by Navient it was recorded to prove this statement is accurate ) and discussed the matter with them where they told me that they were waiting for to guarantor to finish their end of the paperwork but it would be finished before the 90 day period. I told them I would be calling back after that 30 day period, which would have been the XXXX of XXXX to ensure everything was taken care of properly. Before I was able to call them back on the XXXX of XXXX they had already reported me to the credit bureaus as missing a payment on loans that they knew was already approved for discharge and I had spoken with them about the prior month. So they willfully and with malice reported information to the credit bureaus they knew XXXX percent was false. That not withstanding, I was curious how they were reporting on accounts that they had already flagged as XXXX balance to the credit report agencies due to bankruptcy. That is something that I will be posing to the XXXX XXXX XXXX of West Virginia as well but, it is still an important part of this complaint that the CFPB should be aware happened. My credit score before this began made it to within points of XXXX and just on their flagrant actions caused my score to drop XXXX points for which it has still not recovered to this day. So they have willingly and wrongfully injured my credit score as I should be well in to the XXXX by now as I have not missed a payment on any account since this incident which means my credit score would have increased over that time had it not been for their defamatory and willful slander. I will be happy to provide copies of my credit report and any other documents the CFPB should require to substantiate this complaint. Thank you.

Consumer Complaint: I attended XXXX XXXX XXXX now known as XXXX XXXX XXXX XXXX from XX/XX/XXXX till XX/XX/XXXX. XXXX XXXX XXXX closed in XX/XX/XXXX. Any student who wanted to further their education wasn't able to due to colleges not accepting credits from this school. XXXX XXXX XXXX was involved in a lawsuit similar to XXXX and other technical school. In XXXX, XXXX XXXX XXXX reached a settlement with Attorney General XXXX XXXX for {$200000.00}. This followed a 2-year investigation into the school 's practices and communications related to student loans, job placement and the ability to transfer credits. The students who attended this school are still struggling to pay their student loans despite the settlement. The students were left with high cost loans, no help with job placement and no credit transfers. Students who attended XXXX XXXX XXXX deserve the same relief as students who attended XXXX and the University XXXX XXXX. Navient has been misleading. Everytime I've not been able to make a payment a deferment was placed on my account without my permission. My income driven payments were not income driven. I always had to pay the same amount whether I was on the program or not. Due to their negligence in reporting my delinquencies, I was not able to get my loans forgiven. Navient has not been able to help me lower my monthly payments and do not consider other factors that may contribute to you needing to do so. Instead, their suggestions would make it more difficult for borrowers.

Consumer Complaint: Navient sent me a letter regarding my fees and interest accessed during the period my loans were being held with the Ohio Department of Education to be accessed for forgiveness. Due to unfair practices my documents were never accessed properly and the application was declined. I received a letter statement all interest in fees would be removed from the account this week an email came stating those fees and interest is still applicable. Loans and fees are currently being deferred, but I check my account and I am see a monthly charged. I received a letter with a small settlement regarding my loans stating Navient was negligent with my loan forgiveness and that a {$260.00} check would be sent why not just re-evaluate my application. My accounts have been mishandled by Navient which has impacted my credit history

Consumer Complaint: On XX/XX/XXXX, I received a call from a person named XXXX XXXX Phone Number XXXX, claiming to represent Navient, explaining that the Navient Student Loan that shows up on my Credit report, is solely in my name and he is calling to offer a settlement. He said the loan is for {$23000.00}, it has been on my credit report since XXXX, and has been delinquent since. He explained that he would like to help me remove it from my credit report, by speaking with the higher ups in Navient, and negotiate a settlement of {$5000.00} dollars. I explained to him that I did not go to school during that time, though I co-signed a loan for my daughter that the loan that I signed she is paying, and that the loan showing up on my credit must be fraudulent, or not to with me at all. My daughter 's loan I Cosigned is current, and because this loan on my credit does not show her name, I am under the impression it has nothing to do with me, and mistakenly on my Credit Report. I was a cosigner to her loan, so her name would appear on the loan on my credit report, but it does not. If in fact this XXXX XXXX is from Navient, I am being harassed, because there was no corresponds sent to me, just him asking for $ XXXX. Besides, if Navient was trying to settle a loan, it would be between them and my daughter not me. She was the primary on her loan. Also, in a document on their site Navient stated that if she made XXXX consecutive payments, she could remove her cosigner from the loan. My daughter made XXXX consecutive payments and they refused to remove me as cosigner from her loan. This loan on my credit is not my loan, and it should not be on my Credit Report. Perhaps it belongs to someone with the same exact name, because I did not apply for a loan from Navient.
