Consumer Complaint: THIS BUSINESS HAS BEEN VIOLATING THE FAIR DEBT COLLECTION PRACTICES ACT BY SOLICITING CONTACT INFORMATION AND LOCATIONS FROM FAMILY MEMBERS AND NON-MEMBERS. THIS COMPANY HAS LEFT DETAILED VOICEMAILS PERTAINING TO ACCOUNT INFORMATION WITH OUTSIDE PARTIES CLEARLY VIOLATING THE ( FDCPA ) I HAVE BEEN CONTACTED BY SEVERAL INDIVIDUALS THAT THEY HAVE TRIED TO CONTACT VIA PHONE CALL, LEFT VOICEMAILS, AND SPOKEN TO INDIVIDUALS REGARDING SENSITIVE ACCOUNT INFORMATION AND DEADLINES. I HAVE BEEN SENT CONFIRMATION BY TWO INDIVIDUALS THAT HAVE RECEIVED VOICEMAILS WITHIN THE SAME DAY. I HAVE NOTIFIED THEM VIA CERTIFIED LETTER ASKING THEM TO CEASE AND DESIST THESE PRACTICES IMMEDIATELY AND NOTIFIED THEM THAT THEY ARE IN VIOLATION OF THE FDCPA.

Every year I would call Navient about not being able to make payments and every time they suggested that I either go into forbearance or deferment. Not once over the years did, they suggest income base repayment. If they had my loans would have been paid off now instead of me owing over {$120000.00} because of all the interest, they have added on. I recently saw that Navient was being sued because of these allegations.

Consumer Complaint: Navient as should be clear by now has 1 set of rules for all borrowers regardless of individual Promissory Note terms and conditions. This is by their own admission. On XX/XX/XXXX Navient confirmed to me via email inquiry that they are amortizing my 2 Notes on a 180 month and 179 month repayment term in complete disregard for for the plain language of my Notes. Navient wrote to me and stated, at my 2nd request to confirm, " I am confirming, the original terms for your loan ending XXXX has 180 months of repayment in total and the original terms for your loan ending XXXX has 179 months of repayment total ''. My 2nd request for which these quotes were in response to were to have them confirm they were not conflating the remaining months but the original terms. My Promissory Notes for each loan clearly and plainly state in a section labeled " Repayment Period '' - The 'Repayment Period ' will being on the day after the Interim Period ends and will continue up to 300 months ''. So, by Navients own admission they are fraudulently amortizing my loans off a 15 year repayment term vs my Notes stated 25 year term. This has also now negatively placed credit harm on the cosigner they also refuse to release in accordance with my Promissory Note. A previous CFPB complaint addressed this, for which they still have not corrected their contract breach. As to their validity, in a letter dated XX/XX/XXXX their representative wrote " the Promissory Note [ s ] do not list the specific requirements associated with the cosigner release process. This is because the qualifications may change '' ... '' The requirements are valid as of the date of this response and are subject to change at any time without notice ''. The same Navient representative on a letter dated XX/XX/XXXX stated " Under the cosigner release requirements outlined in XXXX Promissory Note '' ( so they state no such requirements exist then state they do, but this is because they finally read my Notes and realized- but again, 1 set of rules regardless of individual borrower Notes ). To add to their lack of credibility that representative who stated requirements can change without Notice, my Notes state " The Note may be modified *only* if you ( Navient ) put the modification in writing and the modification is agreed to by any borrower or cosigner '' - so, not at anytime and not without notice ... ..but, 1 set of rules regardless of an individuals Note. This level of fraud is on par with the fact they have also placed my loans into forbearance twice without my knowledge or permission resulting in fraudulent accrued interest. They have stated I requested these forbearance 's " verbally '' - which as usual ... is a complete fabrication. Those forbearance 's were fraudulently placed on my loans in XXXX and XXXX. I'm sure it is only a coincidence their executive at the time XXXX XXXX 's XXXX memo stating " Our battle cry remains, 'forbear them, forbear them, make them relinquish the ball ''. I tried to control the " ball '' by paying in accordance with the terms of my Note but their " battle cry '' won out when they do not follow individual Promissory Notes that do not conform to their rules that apparently can change without Notice, even if a Note states otherwise. I am accustomed to the response Navient will give to this complaint, but these actions need to be searchable for others they are breaching their Notes and amortizing on fraudulent terms.

Consumer Complaint: In the period of XXXX, I XXXX in a XXXX XXXX school called XXXX. The school offered hands on classes, and certification post completion of classes. The school when bankrupt, and closed its doors leaving me with debt via Sallie Mae. As I was younger I did not seek legal action and just continued my monthly payments. in the period XXXX Sallie Mae transferred my loan to Navient. I continued to pay my monthly payments. In XXXX I received documentation around a class action lawsuit with Navient that I was automatically included in which would include a pardon of my loan. shortly after all navient communication stopped, my account no longer worked on their website portal as well. Information on this class action can be found here : XXXX XXXX XXXXXXXX My identify theft credit check service recently alerted me that navient has reported me delinquent to XXXX XXXX XXXX and XXXX damaging my credit exponentially after years of no communication via mail, phone, email. I have reached out multiple times to navient via phone with no success due to extensive hold times and automated systems. Please advise on what I can do as a consumer, and essentially a victim of services not rendered. Thank you

Consumer Complaint: I co-signed a private loan for my son, the company came after me when he decided no to make good on his promise to pay back the loan, I made payments to Navient but the harassment from them became too much and in 2017 I filed bankruptcy Navient continued to receive payments the five years I was in my bankruptcy, which ended XXXX of this year, Navient sent a claim for {$22000.00} to my bankruptcy, they were paid {$13000.00} as soon as the bankruptcy ended they sent me a bill to restart my payments when I called them for my total amount owed they stated it was {$15000.00} when I asked them how that could be possible first they stated it was because my loans were in forbearance even though they received monthly payments the entire time I was in bankruptcy I filed a XXXX XXXXXXXX the next time I called they said it was 5 years worth of interest rates I knew I would owe something but the amount they are telling me seems a lot higher than what I expected also my bankruptcy trustee also said it was too much Please know I am willing to pay what I owe them, but because they have been so disrespectful and untrustworthy and they will stop at nothing to get you I just do not trust what they say I sent them via fax all the paperwork I have from my bankruptcy showing payments and dates to no avail, if your company can't help me please feel free to refer me to someone who maybe can help me, I totally blame my son for this but I am just trying to clear my name, I am XXXX XXXX XXXX, still working and trying to maintain, I really can't afford to pay them what I don't owe them, I have all my paperwork and will be glad to send it to whomever can help me.
