Consumer Complaint: I requested a lower payment with navient back when COVID hit. From XX/XX/XXXX through XX/XX/XXXX I would call to discuss lowering my payment as I could not afford to pay the loan amount any longer and all they would offer me to do is a loan forbarence due to COVID 19 and the 12 month hardship option and now work with me about lowering my payment. I have asked in XXXX to reach a settlement and Navient would not offer me one or lower my payment. I would receive threatening letters about legal action and still now offers to help lower payment

Consumer Complaint: Federal Student loan debt is is {$190000.00}. These loans have been in XXXX status since XX/XX/XXXX. There was a class action lawsuit filed against Navient ( Formerly XXXX XXXX now XXXX ). According to navientagsettlement.com, Navient was ordered to pay restitution and cancel loans for its unfair and deceptive servicing and collection practices as formerly being XXXX XXXX and other predatory practices. According to the Navient XXXX XXXX XXXX website # 4 " Who is eligible for restitution relating to federal loan forbearance steering? ", Generally, borrowers are eligible for restitution if they : >Resided in a restitution-participating state and were serviced by Navient as of XX/XX/XXXX ; >Entered repayment on a Direct or FFEL Program loan before XX/XX/XXXX ; >Had at least one federal loan that was eligible for income-driven repayment ; >Had at least two years of consecutive verbal or administrative forbearance between XX/XX/XXXX and XX/XX/XXXX, where at least one of the forbearances was entered through a phone call, and where at least half of the forbearance time was prospective ( i.e., not used to bring a past-due loan current ) ; and >Did not enroll in income-driven repayment prior to the forbearance period. >Eligibility for a federal loan forbearance steering payment is not affected by the transfer of servicing to XXXX. Although I qualify, I was not sent a postcard, letter, or email of any kind from Navient. Upon calling Navient XXXX XXXX XXXX hotline, there was no record of me in their system or database. The loans have been in XXXX ( income-based repayment ) and/or forbearance since XX/XX/XXXX. I was told to start making complaints, etc. I was not supposed to be left off of the list according to XXXX ( Supervisor ) at Navient XXXX XXXX ( XXXX ), but there was nothing they could do. I am struggling to pay these loans is an understatement.

Consumer Complaint: As I am so the victim of circumstance of a transferred promissery note, I should be considered for loan forgiveness due to the recent Navient lawsuit. Per what I have read on the matter, as part of the agreement, Navient vowed to erase {$1.00} billion of subprime private student loans that its predecessor, XXXX XXXX, gave to students who attended for-profit schools, many of whom had low credit scores. Many of these schools have now shuttered their doors. You must have borrowed a private student loan from Navient or its predecessor, XXXX XXXX, between XXXX XXXX XXXX while, of which I did, attending certain for-profit school such as XXXX XXXX XXXXXXXX XXXX And speaking of XXXX XXXX XXXX, On XX/XX/XXXX an absolutely massive settlement between XXXX XXXX XXXX and the Federal Trade Commission was finally settled, under which XXXX agreed to provide {$140.00} XXXX in student loan forgiveness benefits to former students still on the hook with outstanding Federal student debt. This lawsuit stems from the same accusations Ive been tracking here for years, that XXXX committed unfair and deceptive marketing practices, giving the impression that the school worked with large national companies to create great job opportunities for students, and tailoring its courses and lessons specifically to help students land those jobs. In reality, the FTC found that many XXXX students graduated with poor job prospects, very little actual support from XXXX, and tons of student loans that they were on the hook for, but which they were having trouble paying off. Allegedly, XXXX also apparently purposefully targeted their marketing campaigns at XXXX XXXX XXXX, myself included, thus making me a again a victim by scandalous means. At last checked Naviant has created some type of double entry on my credit report showing that I owe twice as much as I should. If my loans were prior federal I should have been a part of the government for parents issued by president Biden. Yet XXXX 's showing link that I am past due for over several months making my credit rating plummet to the 4 hundreds. I am not able to refinance my home or purchase a car at a decent rate that I may maintain some standard of livelihood. Henceforth, As a victim of circumstance, I respectfully request that my loans be reviewed while in forbearance, and my credit report brought current for the Navient lawsuit forgiveness as well as the University of XXXX XXXX. XXXX XXXX

Consumer Complaint: Navient didn't apply my income-based repayment ( IBR ) paperwork to the account for 4 months. They wrongfully charged the full {$500.00} automatically from my bank, which caused an overdraft fee of {$30.00}. XXXX XX/XX/22 - Navient sent a reminder to recertify for the IBR plan. XX/XX/22 - I mailed the IBR paperwork to Navient via certified mail. XXXX XX/XX/22 - Navient sent another reminder to certify IBR before XX/XX/22. XX/XX/22 - Confused, since I had sent the IBR paperwork previously, I called Navient and I did the " eSign '' IBR application on the phone with a Navient representative. XXXX XXXX XXXX I called Navient to validate my IBR paperwork was settled. The customer service representative confirmed it was in process and I would not be charged the {$500.00}. XX/XX/22 Navient wrongfully charged me {$500.00} from my bank account, which then charged me an overdraft fee of {$30.00}. Under the IBR plan, I should have been charged {$59.00} XX/XX/22 - I protested the XXXX wrongful charge, which Navient refunded to my bank but did not remove from my account balance. The account showed me as overdue a {$500.00} payment. XXXX I paid the {$59.00} IBR that I could afford. My account still showed the {$500.00} wrongful charge. XXXX XX/XX/22 - XXXX payed my XXXX IBR. Navient still showed my account as in the red. XX/XX/22 - I checked the account and saw I still had a XXXX balance owed. To ensure this didn't impact my PSLF application, a friend loaned me money to pay it.

However, when I attempted multiple times to discuss this with Navient and explain to them that I meet the requirements for cancellation of my loans, they tell me that Im not, but without providing me with a clear reason/explanation as to why Im not able for loan relief. I relied on the following information from the multi-state Navient Settlement information released online that states the following : The private loan debt relief will primarily go to borrowers who took out private subprime student loans ( made to borrowers with low credit scores ) through Navients predecessor, Sallie Mae, between XXXX and XXXX, and then had more than seven consecutive months of delinquent payments prior to XX/XX/XXXX.

During the federal student loan pause, I was paying what I could when I could to my servicer, Navient. I do not understand how my account could have gone into arrears during this time. On XX/XX/21 I tried to call Navient to discuss the situation. Three times I was told by a recording that I was being transferred to a customer service agent and was subsequently disconnected. My credit score has dropped XXXX points due to this and I can not contact Navient to get this resolved in a timely manner. We are currently trying to move into an apartment in a safer neighborhood and this drop in score is affecting our ability to secure safe housing.

Consumer Complaint: I am interested in consolidating my XXXX loans into a Direct loan, in light of the recent change in policy announced here : XXXX XXXX XXXX This announcement states that prior payments made to the XXXX loans that are consolidated into Direct loans will count towards the Income Driven Repayment plan forgiveness. However, the loan consolidation application on the studentaid.gov website states the opposite, in section J. It states : " J. Any payments I made on the loans I am consolidating ( including any Direct Loans ) before the date of consolidation will not count toward : The number of years of qualifying repayment required for loan forgiveness under the XXXX Plan, the XXXX, the XXXX Plan, or the XXXX XXXX ( see XXXX Item XXXX ), or The XXXX qualifying payments required for Public Service Loan Forgiveness ( see XXXX Item XXXX ). '' I called XXXX XXXX XXXX XXXX XXXX ( XXXX ) and stated that I do not want to sign a loan consolidation agreement that contains provisions that conflict with the policy announced in XXXX. The agent said that there is only XXXX consolidation application. I asked to escalate the issue to a XXXX and was told that IF the consolidation agreement is updated that I would be able to see it in the announcement section of the XXXX website. This is simply not acceptable. It is unfair and unconscionable that I am being forced to choose to rely on public statement of policy regarding prior payments and pray that this statement is adhered to, when the actual agreement I am signing does not reflect the policy. I am only interested in consolidating my loans into Direct loans if my prior payments are counted for purposes of XXXX forgiveness. In light of the conflicting information, I do not want to sign a loan consolidation agreement that reflects terms that are not in my favor ( because it states that the prior payments on the XXXX loans will not count towards XXXX forgiveness ), and if enforced as written, which would cause me to lose many years of repayment.

Consumer Complaint: I have continued to pay my private student loans on time, but my interest rate keeps increasing which has gone from XXXX in XXXX of 2022 to 12 % in XXXX. I have been working to make my payment on time and have been trying to refinance but with inflation and not having secure hours at my teaching position it has been a challenge to get the loan refinanced. However, I have asked if they have any programs which they do not, or only offer ones that only make me pay more in the long-term and they just keep increasing my rate. Not offering any information as to how high the rates can go. I did not qualify for the lawsuit because I have always been making my payments, which I have always tried to do. But if they keep raising the rate I will never be able to pay off my loan and how will I survive or work if I can not keep a roof over my head or eat? For example, my one loan was for XXXX and now it is at 12 % I currently own XXXX dollars and will never pay it off at this rate. I have asked for help or options but they offer nothing but options that cost more, or no options at all. Instead, they just keep raising the rates with no end in sight.

Consumer Complaint: My student loan payments doubled this year from roughly XXXX to roughly XXXX. I am a XXXX XXXX and have been making my payments for the time I've been in XXXX XXXX. This is not counting the XXXX years I made massive ( XXXX $ XXXX ) payments and never was able to touch the principle amount due to the predatory interest rates. I called the company ( XX/XX/XXXX ) to attempt to work with them to lower the payments while I'm in school for the rest of this school year ( XX/XX/XXXX ). I was told ( my an incredibly rue and condescending manager ) that the loan ran out of in school deferment and that they only people who qualify for in school deferment extension are XXXX XXXX students and " people who can write a prescription '' despite my program being longer than law school. Apparently Navient doesn't consider XXXX programs to be as important as law school. I explained that there is no way I can afford almost XXXX $ a month since my entire stipend is only XXXX a month and I have a child and an elderly parent I provide for. The manager 's response was to " figure it out. '' I was also asked " if there is any reason my cosigner can't help '' despite the company having record that he died almost a decade ago. I know they have that information because they threatened to sue my grandmother for money despite the fact that I have been making full and on time payments.
