Issue: Struggling to repay your loan

Subissue: Can't temporarily delay making payments

Consumer Complaint: During the height of the pandemic, I lost my job after disclosing I was pregnant and requesting to continue my work from home. I was denied the right to work from home and terminated instead. Since then, I struggled to stay afloat supporting my XXXX daughters and myself and have requested to have my private student loans put on hold and Ive been denied by XXXX on numerous occasions. I filed for XXXX XXXX bankruptcy in XXXX and my student loans were included in the bankruptcy proceedings. I have my discharge paperwork and the original petition for bankruptcy itemizing each of my student loans and to date, I am still repeatedly contacted by Navient for repayment of loans that I can not afford. Ive been making interest only payments for at least the last two years because thats the only option Im told is available to me. Most recently, in XX/XX/XXXX, both my father and I have received repeat phone calls and voicemail messages from Navient indicating that my interest only payment term had come to an end and I was once again behind on my student loans. My father was a cosigner on at least XXXX private loan and my deceased grandmother a cosigner on another private loan. I have been unable to get either of them relieved from the loans and my father has taken it upon himself to stretch beyond his means to make your payments to Navient for the loan hes on just to get them off his back because they wont stop contacting him. As of XX/XX/XXXX, I was forced to re-enter into another interest only payment plan. I am still without work and I am stretched far beyond my means. My ex-husband stopped paying child support a year and a half ago for our XXXX daughter, I have no source of income and my savings is almost completely out. I communicated this to the person at Navient and told her I feel desperate and I have absolutely no way to ensure I can make the monthly payments And the only option I was given was a {$65.00} a month automatic withdrawal from my bank account for interest only payments. its either I pay the {$65.00} interest only payments or a default. I dont understand how this can happen when Ive done my best to pay despite the fact these loans should have been discharged in bankruptcy in XXXX.

Issue: Dealing with your lender or servicer

Subissue: Received bad information about your loan

Consumer Complaint: I have been sending correspondence to Navient since the XXXX of XXXX. I requested that Navient validate the debt attached to the account number XXXX, which comprise of both federal and private student debt. The only correspondence back from Navient was of accusations of breaking the law. They even included in the letter an FBI website that had implications of fraud schemes. This letter was intended to intimidate, and threaten. On the bottom of the letter sent by Navient I noticed their NMLS # XXXX. Upon searching this number I discovered that Navient is not licensed in the State of Georgia. My residents and schools XXXX XXXX and XXXX XXXX ( to which the alleged debt is attached ) are in Georgia. Since Navient has no legal rights to conduct business in Georgia I demand that they cancel/ discharge the above accounts, correct any damages with all three credit collection businesses and cease all contact with me.

Subissue: Problem with customer service

Consumer Complaint: I am a XXXX XXXX ( XXXX ). I took out federal loans ( XXXX ) to attend XXXX University XXXX XXXX. Navient refinanced my federal loans into private ones on or around XX/XX/XXXX, which would be made them ineligible for a loan forgiveness program announced by President Biden. I have contacted Navient for a refund. I should get a refund because I am a XXXX XXXX under the PSLF Waiver and one of the individuals covered under the {$1.00} XXXX Settlement With Student Loan Servicer Navient who has not received relief. I continued to pay my loans all through the Covid-19 pandemic. The response I continue to get from Navient is that, at the moment, we do not have any additional details on the forgiveness program. That is unacceptable.

Consumer Complaint: Before I start typing this message, I want to make sure that Navient does not mark this as a duplicate as they did with my last message. ( This is not a duplicate ). I contacted Navient through CFPB in XXXX because the student loan # ending in XXXX that Navient claims I have should have been relieved under the attorney generals settlement earlier this year. Navient got back and reported that my cosigners XXXX score was above the threshold of XXXX at the time of origination and thats why the loan can not be relieved. I am requesting Navient to please prove that. I did ask them this in my previous message sent to them through CFPB. They didnt have any answer, so they marked it as a duplicate message. If Navient can not provide me a copy of my XXXX XXXX score showing that my cosigners XXXX score was about XXXX at the time of origination, then they need to relieve my loan and inform all three credit bureaus. I am requesting all three credit bureaus agencies that if Navient can not provide me the proof of that XXXX score from the time they are claiming then it should be removed from my credit history. I will also send a complaint to the Virginia Attorney General 's office regarding this message. I will be waiting for Navient to respond on this matter. ( THIS IS NOT A DUPLICATE ).

Issue: Dealing with your lender or servicer

Subissue: Trouble with how payments are being handled

Consumer Complaint: I took out private student loans through Navient, and they went into default in 2008. It was at some point sent to XXXX XXXX XXXX, and I setup payments through them. I've been paying the collection agency faithfully for the past probably 6-7 years. No missed or late payments. About 2 weeks ago, I receivedan email from the collection agency that the payments were canceled. No explanation given, and when i tried calling it says they are closed. I then today received a letter from Navient about my loans being in default. When I called them, all they told me was that XXXX XXXX stopped handling the debt, and that my only options were to make a settlement or pay in full. I asked for a letter and they refused to send me anything about the loan. I received zero help or information.

Issue: Dealing with your lender or servicer

Subissue: Keep getting calls about your loan

Consumer Complaint: NAVIENT is my fed student loan servicer and ever since the federal moratorium has been in affect, i am constantly being hounded by Navient with phone calls and texts to pay my bill. In the month of XXXX I have received a call almost every day. And now I am getting letters from Ascendium warning me that they will be reporting to my credit sources if i don't make a payment by XXXX My understanding is that Biden told loan servicers NOT TO CONTACT THEIR STUDENT LOAN BORROWERS DURING THE MORATORIUM. So why is Navient getting away with this harrasment???

Issue: Incorrect information on your report

Subissue: Account information incorrect

Consumer Complaint: My complaint is relatively simple. I have a few student loans on my credit that are not valid. First there is a loan on my credit that shows a balance of {$63000.00}. This loan is from XXXX University and is a federal student loan. Recently, on XX/XX/22, a new law agreement settlement came into play under Sweet v. Cardona. The Department of Education identified as having evidence of misleading job prospects, employment opportunities, and even how much students would earn after graduating. Former students of those schools who applied for debt relief are entitled to full loan forgiveness under the settlement, including reimbursement of payments they have already made to their lender. The Case XXXX. This CASE PRECEDANT, exclaims that I am eligible for full student loan forgiveness for the schools i went to, both XXXX University and XXXX XXXX. I have disputed this information numerous times and any denial is a direct violation of law. Stop playing with me, or you will get sued. I am not liable for the {$63000.00} federal student loan XXXX XXXX University ) on my credit from the Dept of XXXX nor am i responsible for the {$3100.00} US Dept of EDUXXXX XXXX XXXX XXXX XXXX ), as expressively stated in the case precedent. The proof can be found here XXXX XXXX XXXX XXXX XXXX XXXX XXXXXXXX % XXXX % XXXX UNDER THIS SETTLEMENT I AM FULLY ENTITLED TO THE ENTIRE LOAN BEING RELIEFED AND ANY PAYMENTS MADE ON THE LOAN ARE DUE BACK TO ME. THIS IS THE LAW, YOU MUST ABIDE, THERE IS NO LAW OR SETTLEMENT STATING OTHERWISE. I WILL UNDER NO CIRCUMSTANCE TAKE NO FOR AN ANSWER. YOU WILL ABIDE BY THE LAW OR I WILL FORCE YOU TO BY MEANS OF A LAWSUIT. I AM NOT RESPONSIBLE FOR ANY STUDENT LOAN DEBT. THE LAW FORGIVES THIS. I DO NOT OWE ANY OTHER THE DEPARTMENT OF EDU LOANS ON MY CREDIT, ALL LOANS HAVE BEEN FULLY FORGIVEN AS THE SCHOOLS HAVE BEEN FOUND TO BE FRAUDS. THE MULTI XXXX DOLLAR SETTLEMENT IN SWEET V. CARDONA ALSO BACKS MY CLAIM. THERE IS XXXX REASON TO DENY THIS CLAIM. CONTINUED DENIALS WILL RESULT IN AN IMMEDIATE LAWSUIT.

Issue: Dealing with your lender or servicer

Subissue: Trouble with how payments are being handled

Consumer Complaint: It's my understanding that federal student loan repayment has been paused until 2023. Navient however is attempting to collect payments, charging massive late fees and capitalizing the interest in violation of current laws. They're also sending out false statements, attempting to collect in spite of the current pause. In the statement I'm enclosing, for XXXX unpaid month, they're charging over {$80.00} in fees. Over a third of the bill is late fees during a time they aren't supposed to be collecting. Further, they give you less than XXXX weeks to pay your statement. The one I'm including is for the XXXX with a due date of the XXXX and is for nearly {$250.00}. This is a blatant attempt to make it as difficult as possible to pay so they can charge more extraordinary fees

Issue: Dealing with your lender or servicer

Subissue: Received bad information about your loan

Consumer Complaint: I am writing to request my loans and the actions of Navient be investigated for requiring payments and charging interest during the student loan freeze. Navient did not freeze my loans nor did they stop charging me interest throughout the entire pandemic. I emailed Navient during the summer of 2021 and asked why I was being charged interest and required to make payments. I also requested they remove the late/penalty fees they charged me while I was under the impression that I was not required to make student loan repayments. They told me my loans were not federal loans and did not qualify for the national student loan freeze and did not grant my request for a refund for the fees. When I checked on this website, I saw there were 4 loans listed ; 2 of them show 6.8 % interest and 2 show 0 % interest. I have been being charged 6.8 % and 3.3 % interest on each of the 4 loans listed by Navient. I also paid off other loans through Navient during the pandemic that I feel like I should not have had to pay, but was forced to. I request that an investigation be conducted into the handling of all my loans by Navient.
