Consumer Complaint: I called Navient on XX/XX/2022 XXXX XXXX asking about the public service loan forgiveness. I was told I do not have the correct type of loan and it could not be changed. I then proceeded to ask about the Biden forgiveness and was told to wait and not consolidate because my payment and interest could go higher ( currently at 6.5 % ). Again incorrect information. My husband has the same loans and we chose to wait. I confirmed I should follow up in a month. I called today and was told the deadline had passed. I only found out from a friend today that I could consolidate into a " direct loan '' in order to qualify for the public service loan forgiveness ( in 2 years ). We have now lost out on the opportunity to forgiveness $ XXXX from my husband 's loan ( pell grant + loan ) and my student loan. I believe this was just providing false information in order to keep our loans and continue to pay 6.5 %.

Consumer Complaint: Account # XXXX XXXX & # XXXX To be honest with you, I have no idea regarding this company because if my student loans were sold or transferred to someone else I would have gotten a letter etc. I never got anything from my original lender etc. I have no idea regarding this company etc. I've tried reasoning with them to let them know I was never informed etc. XXXX XXXX-I 've filed with all three bureaus and of course, nothing was done with them- certified mail never heard anything back. Looked at my report all they stated is the other party disagree. I requested specific documents with my signature but never got anything back from the company and the 3 credit bureaus.

Consumer Complaint: I had a Federal Loan being serviced thru Navient.. I clicked on a link on my payment page offering a lower interest rate and a 5 year repayment.. I thought I was just getting a better rate on my loan -- Turns out my loan is now thru NaviRefi -- I had no clue this was a private loan company -- Now i lost all my federal benefits on my student loan. They basically made their site look like i was just getting a lower federal rate on my loan. They basically scam people into taking their private loans and hiding the details on very hard to see fine print.

Consumer Complaint: Dear XXXX XXXX XXXX XXXX and XXXX, Navient Solutions , LLC, and XXXX XXXX and XXXX XXXX, XXXXXXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXXXXXX XXXX XXXX XXXX Sec XXXX XXXX you are hereby given notice that XXXX XXXX intends to commence a lawsuit against you for ___ $ XXXX plus additional punitive damages due to your Deceptive Business Practices while acting as the Guarantee Agency and/or Loan Servicer for a XXXX Loan Number XXXX during the Covid 19 Pandemic Era. On XX/XX/2020, in the XXXX XXXX XXXX. XXXX, Congress passed the Coronavirus Aid, Relief, and Economic Security Act or the CARES Act. Contained in the CARES Act were provisions for student loan relief for borrowers which granted the Department of Education ( DOE ) the Authority to implement and enforce. The Rule Making Authority provisions were also waived and the DOE issued a series of Dear Colleague Letters ( DCLs ) directing and demanding Guarantee Agencies and Loan Servicers to perform certain actions. XXXX, Navient, and XXXX failed to abide by the CARES Act and defied the Department of Educations directives and other laws, specifically XXXX XXXX XXXX, Navient, and XXXX Violated Dept of Education XXXX XXXX whereby they : a. Failed to communicate rights to borrower b. Failed to Assign to defaulted loan to the Department of Education ( sold loan to Navient and XXXX ). If a loan defaulted during the pandemic and the borrower is working toward rehabilitation, those loans should also be assigned to the Department. c. Failed to assign 0 % interest rate XXXX further sold loan to Navient and XXXX who charged interest and Demanded, performed relentless collection activities. d. Furthered collection attempts through XXXX, XXXX, and Navient while under Covid 19 Cares Act relief. XXXX, Navient, and XXXX knowingly, intentionally, and willingly engaged in unconscionable actions to the detriment of the borrower XXXX XXXX and used Deceptive Business Practices to benefit themselves by failing to assign the loan to the Department of Education as directed by law, but instead further kept the loan in their possession, seeking benefits and monetary gain from credit offsets, reimbursements, interest payment collection, and other DOE Funds. These actions negatively affected the borrowers ability to obtain relief entitled by law, his credit worthiness as reflected in the negative credit reports, and caused extensive financial issues, and mental anguish. As a direct and proximate cause of these actions, XXXX XXXX has suffered financially because he could not refinance his home at the lowest rate in history ( denied loan request due to poor credit score only being negatively affected by inaccurate loan reporting ). Further XXXX XXXX must now enter a loan modification at 6.5 % at the highest point in many years which effectively causes {$170000.00} worth of additional interest over the span of the mortgage loan. This could have been prevented if not but for the selfless actions of XXXX, XXXX, and Navient to not transfer the loan back to the DOE and remove negative trade line reporting as directed by law. Further Fair Credit Reporting Act violations occurred because XXXX XXXX disputed the negative information directly with XXXX, XXXX, and Navient whereas they failed to investigate and prove accuracy of what they were reporting. Other violations and causes of actions without limitations will be pursued against all parties : 1 ) Breach of Contract Rehabilitation 2 ) Breach of Contract Original Loan Agreement 3 ) Breach of an Implied Warranty of Authority- a. Navient and XXXX purported to " enter into a contract '' with them on behalf of the Department or " to take some legally significant action '' on behalf of the Department and service the loan. 4 ) Tortious Interference with Contract 5 ) Breach of an Express or Implied warranty 6 ) Breach of Fiduciary Duty, Fraud, Negligence, and Negligent Misrepresentation as stated in the contract 7 ) Unjust Enrichment 8 ) Penal Code Section 32.45 ( misapplication of fiduciary property or property of financial institution ) 9 ) Loss of the benefit of the bargain XXXX, XXXX, and Navient knowingly and intentionally sought monetary gain by its Deceptive Practices and not transferring the loan to the DOE and preventing needed Covid 19 relief to borrower.

After a period of time I realized this would extend my repayment period, thus leading to higher cost of loan repayment. Instead of standard repayment, I was misled into extended repayment plan. My loans were issued in XXXX and at this rate, won't be paid off until XXXX. I was misled into the fact that these private loans would never qualify for Public Loan Forgiveness as well. Consumer Complaint: I have had my student loans since 1997. The principal was originally around {$24000.00}. It has been sold a number of times to different banks. I have made payment on XXXX 's, used forbearances and everything within my ability to make payments. I've ask Navient for information regarding payment historys, but with the loans being sold so many times, i've never gotten close to 20years worth of repayment in order to be forgiven. OR so i've been told. I've raised my 3 children on a single income for the past 20 years and still have made payments on time, every time. I was never told that i might qualify for a {$0.00} dollar pymnt using an XXXX rather than allowing the forbearance to build in interest. I want to payoff this loan, but ... the {$60000.00}. balance is insane. I have asked Navient a number of times, what I can do and they do not have any options out there for me other than the XXXX. I need this loan to be recalculated and looked into by someone. Since its handled through Navient, i don't think I will qualify for any of the government assistance program.

Consumer Complaint: For the past XXXX years, Navient has been calling my number daily at XXXX. I have no debt with them, and when I called and spoke to their rep on XX/XX/XXXX, I gave her my social security number and she verfied that I am not in their system. In fact, I have no debt with them, nor do I have a student loan. I requested to have them remove me from their call list, so she took my information and forward it to the calling department. I have been on the Do-Not-Call Registry since XX/XX/XXXX. On XX/XX/XXXX I had reported the unwanted calls on that Registry. As usual, the calls continued and I began documenting them. On XX/XX/XXXX I got a call at XXXX XXXX, and the following day XX/XX/XXXX at XXXXXXXX XXXX I got another call. I blocked them. However, they manage to call from new numbers to call from after they have been blocked. These are harrassing phone calls, as they occur every day ( sometimes multiple times per day ). Here are some of the numbers I have blocked from them in the last few months : XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX Again, I do not owe a debt with them, nor do I have a student loan.
