Consumer Complaint: Navient is attempting to reach out to me to repay my student loan, even though the freeze on student loan payments runs through the end of the year. Navient is well known for predatory practices, and this is just another report of predatory collection practices in an attempt to circumvent the law.

Consumer Complaint: Navientwas the loan servicer for my federal student loans between XX/XX/XXXX- XX/XX/XXXX. During which time I was employed in an education based non-profit residency training program. At the timeNavientrepresentatives instructed me to complete forms for deferment/forbearance for my private loans and disregarded the income based loan repayment option for my federal loans. Pursuant to their recommendation I submitted those documents. After reviewing my PSLF qualifying payments I recognized there is a gap for the XX/XX/XXXX- XX/XX/XXXX period. I was under the impression my federal loans were in an income based {$0.00} ( XXXX dollar payment ) as it was in XXXX based on my low income. However it is my belief Navient placed both federal and private loans if deferment status which detrimentally impacted my eligibility for qualifying payments under the PSLF program. Had this deferment not been applied to my federal loans I would be closer to federal loan forgiveness under PSLF. I understand loan servicers like Navient claim there was a lack of guidance provided by the U.S. Dept of Education during this time and specifics regarding PSLF were not obvious according to them ; fortunately the U.S. Department of Education has provided an opportunity to amend the unintended consequences of this mixup.

Consumer Complaint: I called my student loan servicer ( Navient ) to discuss a payment. Somehow I was connected to a third party company. I was under the impression I was on the phone with Navient but I was actually on the phone with XXXX XXXX XXXX XXXX ( XXXX XXXX XXXX told me I was eligible to apply for the Public Student Loan Forgiveness program but need to pay {$390.00} I gave them payment on XXXX XXXX, 2022. When I called to check the status of my loans, I was told by XXXX and the Department of Education that XXXX should not charge me for this.

Consumer Complaint: I have two private student loans that have been settled in full with Navient who continue to inaccurately report their balance and status. I had two Navient private loans go to one of their own collection agencies, XXXX XXXX XXXX. I settled this debt in full for both accounts. Navient still reports one account as open, both as still having a balance, and also have reported new late payments after the account was already settled in full. Both accounts were settled on XX/XX/2022. Both accounts settled in full with lender/collection agency letter verifying accounts settled in full.

Consumer Complaint: Starting XX/XX/XXXX, out of nowhere my federal student loan started showing as delinquent while we were under a national covid-19 pandemic. Federal student loans are suppose to be in forbearance and protected from wrong reporting and collection activities. I reached out to my student loan servicer Navient & they informed me that the account payment information will be corrected, they also advised me to reach out the all credit bureaus. It's been months and my credit reports still show delinquent payments from XX/XX/XXXX to XX/XX/XXXX.

Consumer Complaint: Back in XX/XX/22, I received an email from the the US Department of Education advising me that my student loans, formerly with Navient, had been transferred, and that I was to register soon with XXXX XXXX, which I did. However, despite doing so, I have consistently received emails and calls from Navient stating I still need to deal with them, or that I am in arrears with a payment soon due, or that they still hold a private loan of mine. None of these assertions can be true, since I have never taken a private loan, did not enter repayment bc still in deferment and only recently graduated, and we are all still under the federal COVID deferment. They also indicated my request for consolidation " was not processed '' since I needed to do that with them instead of the XXXX website where I have completed request for consolidation, request for PSLF, and request for cancellation due to faulty school ( XXXX XXXX XXXX XXXX ). The last and several calls were from XXXX.

Issue: Communication tactics
Subissue: Frequent or repeated calls
Consumer Complaint: Navient has been repeatedly calling my personal cell phone several times a day, and occasionally late at night. In addition to repeatedly calling, on Tuesday XX/XX/2022 they deceptively contacted me through a third party, using a local phone number that was unfamiliar to me and that Navient has never used before ( The number used was XXXX ). When I answered the phone I was told by a woman that someone, on a different line wanted to talk to me about business between us. No name of the person or company or nature of the business was disclosed prior to being transferred to the other line. When I was connected, a person identified themselves and that they were with Navient trying to collect a debt. These practices by Navient are abusive and deceptive, but this seems to be par for the course with them. Also in light of recent lawsuits against them, I am beginning to think that my first complaint against them was valid and that they are illegally trying to collect a debt that was discharged in bankruptcy, as they have done with other people as well. Navient was not present for the bankruptcy hearing to object to my debt being XXXX and nothing was mentioned by the court that they would object.

Consumer Complaint: I have been put on an interest only repayment plan by Navient for the past 6 months, due to my inability to pay my whole monthly payment. From XXXX to XX/XX/XXXX, I have paid interest only on all of my student loans that I have through Navient and they were directly debited from my account every month. My monthly payments were {$430.00} and they were all scheduled to be automatically taken out of my bank account on the same day each month. I have four loans with Navient and they all have a variable interest rate. The interest rates and balance of each loan ( as of XX/XX/XXXX ) are as follows : {$18000.00} - 8 % {$19000.00} - 10.5 % {$14000.00} - 10.5 % {$10000.00} - 11.25 % My last payment on the interest only program was made on XX/XX/XXXX. In XXXX, I logged into my online account at navient.com and it showed that I owed {$20.00}, so I went ahead and paid that amount on XX/XX/XXXX. It did not show that I owed anything more than that for the month of XXXX. I knew that my interest only arrangements had come to an end, and the {$20.00} balance did not seem quite right, so I called the customer service number to try to get set up with another reduced payment plan. I was told on the phone that I would get a call back on XX/XX/XXXX to be enrolled in another interest only plan for the upcoming 6 months. The representative told me that it could not be set up until XX/XX/XXXX. I repeatedly asked if I owed anything for XXXX, and she told me that I did not because I was coming off of the interest only plan. She called me back on XX/XX/XXXX and set me up with another interest only plan for the next 6 months. Starting on XX/XX/XXXX through XX/XX/XXXX, my monthly payment would be {$500.00}. I checked my online account today, XX/XX/XXXX and viewed my account history to make sure everything was on track and set up for XXXX. Upon reviewing my account history, I noticed that I had been charged {$520.00} in capitalized interest on XX/XX/XXXX. And charged again for {$2700.00} in capitalized interest on XX/XX/XXXX. Both of these totals have been added to my principal balance on my loans, even though I was paying the interest every month for 6 months prior. None of these totals were present when logging onto my account in XXXX or XXXX in my monthly account balance and these totals do not even add up to what my interest is per month. Not only that, but I was also charged a late fee on XX/XX/XXXX, even though I was enrolled in a direct debit payment plan. As of today, XX/XX/XXXX, I am set up with the interest only payment plan for the next 6 months, and as of today, my account is showing that I owe the full payment for XXXX and that it is past due. I had better not be charged any late fees or unnecessary interest this month, because my payment agreement has already been set. The practices and business conduct by Navient is unacceptable, and I was wrongly charged with this capitalized interest. They do not let the consumer know of any unpaid interest easily, but instead try to keep it hidden from them so that they can add it onto the borrower 's principal balance so that the borrower can never get ahead in paying down their loan. I now have more of a balance on my loans that what I originally took out and I have been paying them regularly ( at least on the interest ) every month for over 10 years. This company already has lawsuits compiled on them and something more needs to be done about how they are operating.
