Consumer Complaint: After researching my issue and determining that I am eligible ( no late payments, LTV under 78 %, loan active over 5 years ) to have my FHA MIP removed from my account, I contacted my lender to start the process. I was slightly confused when i ended my call with them, due to the fact that they insisted that I would have to pay for a new appraisal in order for them to make a determination ( with no guarantees ) whether to cancel my PMI. I could under no circumstance get them to even call it MIP, let alone admit that any difference between MIP and PMI existed. They sent me a form to start the process, the form is basically an agreement on my part to pay for an appraisal. I called them back and eventually their representative told me to call the XXXX at XXXX. The center sent me a summary of their guidelines in my situation. Following these guidelines I sent my lender a written request of my desire to have MIP cancelled on the loan, and asked them to forward my request, along with supporting payment documentation to the FHA for approval. I also included a copy of FHA 's guidelines for their reference. After waiting over 60 days for a response I contacted them by phone again and was informed that they received my letter, however no action was taken since it did not include the form releasing them to order an appraisal at my expense. After much discussion with this representative his only recourse was to have me call the XXXX again. All any representative at my lender will do is quote some lines from what I believe to be a summary of the PMI Act of 1999. They will not admit that a FHA insured loan is different in any way from a private contract loan, even after me offering specific guidance as to Mortgage Letter numbers published by XXXX specific to this issue. The XXXX, being an informational entity and not an enforcement one could offer me no further guidance, hence, my complaint filed here. I have attached all correspondence I have relating to this issue, including the form my lender wants me to sign, the guidance email sent me by the FHA, the corresponding XXXX Mortgage Letter relevant in my situation, and the original request I made to my lender to have my MIP terminated.

Consumer Complaint: Our Mortgage interest rate resets as of XXXX XXXX, 2015. The loan provides for XXXX years of fixed interest only payments converting to a fully amortized adjustable rate for the final XXXX years. 12 USC 1026.20 ( d ) requires a servicer to provide the borrower with a notice between XXXX days before the mortgage rate resets that includes an estimate of the new mortgage payment and other required information. We never received this required disclosure, and at the time it should have been provided we were not receiving monthly mortgage statements. Nationstar did not provide monthly statements in XXXX our of XXXX months and still has failed to provide us with a copy of the note as required by California Civil Code Section 2943 ( b ) ( 1 ) and the Deed of Trust. Today, XXXX XXXX, 2015 we did receive the Change in Interest Rate that is required XXXX days before the reset, but this document does not fulfill the requirements of the estimated notice we never received.

I found out that I should n't have been paying PMI for 7 months and when I asked for a refund they never called me back! Consumer Complaint: My wife and I have been separated since XXXX of XXXX. She stayed in the house. In XXXX of XXXX, she informed me she was moving out and filing bankruptcy. The mortgage was 3 months behind. I contacted the Mortgage company-Nationstar and discussed getting the account current. XXXX XXXX ( first name, they will not give out full names ) informed me that if I made 3 consecutive payments that they would adjust my account current. This conversation took place at the end of XXXX. He stated that the payment due at the end of XXXX would be the first of 3 consecutive payments to bring the account current and that the first payment would count as my XXXX XXXX payment. Later I was told that the payment due at the end of the month was for XXXX and another payment was due the next day. I was very careful to insure that I would not have a payment due 2 days in a row. XXXX XXXX insured me this was not the case. He informed me the payment was {$1700.00} and due on the first of the month. I told XXXX XXXX that I was retired and on XXXX and that if my pension deposit, which is the XXXX of the month fell on the weekend or a holiday that it might take a few more days to get there. he stated that would nt be a problem because there is a 2 week grace period on there accounts. He also told me that because my wife was filing bankruptcy that they could n't send any paperwork to verify this agreement. I told him I was very uncomfortable sending such large amounts of money without the mortgage acknowledging this payment. He was adamant that this was the only way they could do it. I continued in XXXX faith and sent 4 monthly payments. I was not getting statements and had to call my pay ments in for electronic transfer. two months they gave me a payment amount which was about {$20.00} different from the one XXXX XXXX had given me, I inquired with the Nation star representative each time. They told that they database gave them this number and that was the only thing they could process. The computer would n't accept anything else. After phoning in 4 payments and paying what the representative told me to pay, I received a foreclosure notice. I called Nationstar immediately. I was told by the representative that they did n't get several payments. I had copies of my bank statement made and sent to Nationstar, XXXX through XXXX, I called back and the next representative pointed out that 2 payments were {$20.00} off and 2 were late, I told him that the payments were made on the phone with their representative who directed me to pay that amount. I told him that I had discussed the due date with XXXX XXXX and he told me the grace period allowed to the payments to arrive a few days late. This representative told me that was not true and this trial period only proved that I was not responsible enough to handle this account. I asked him if he would turn a family out of their home for a {$20.00} discrepancy and he said yes. This person was very belligerent. He indicated that the only recourse was at this point was to apply for a Making Homes Affordable loan. I sent the application package in XXXX XXXX, XXXX, sending duplicate copies of the entire package, one by E-mail and one by Fax. I have all receipts. I called back the next week and was told they needed more documentation, a better narrative, that was sent XXXX XXXX, XXXX. I called back the next week and was told that it was not received. I was told that more documents were needed. The form XXXX which they filled out with the year needed on it did not have the year XXXX. They filled this form out with the years they needed. They put the years needed on the original form and left out XXXX and now told me that I must update XXXX to the form even though they filled in the other years? They needed a quit claim deed which had already been sent twice. see closing

Consumer Complaint: I am XXXX XXXX XXXX writing this complaint. I am a resident of XXXX, CA and have my residence at XXXX XXXX, XXXX, CA XXXX. I had purchased this property from a company called XXXX XXXX XXXX in XXXX. This company got closed and was shut down due to Bankrutpcy. Later, various banks such as XXXX XXXX XXXX, XXXX Bank, XXXX XXXX and The XXXX started sending me letters on the property claiming Illegal and Fraudulent Ownership on my home in XXXX, CA. In the year XXXX, my then attorney, sent legal notices to these various banks and also filed complaint with The California XXXX Department XXXX XXXX XXXX and The XXXX Office XXXX Controller of Currencies and filed serious complaints against these banks. Recently, on or about XXXX XXXX, XXXX, The XXXX Mortgage XXXX and XXXX XXXX XXXX illegally and fraudulently claimed ownership on my home and they allegedly sold my property through illegal auction sale and sent some people of their own in my home criminally trespassing my home, and taking unlawfull possession of my home, all my personal belongings and other property. I never had any Truth in Lending Agreement signed between myself, or my exwife XXXX XXXX and between any of these banks, and/or specifically with The XXXX Mortgage XXXX and XXXX XXXX XXXX. I believe that The XXXX Mortgage XXXX and XXXX XXXX XXXX is barred by the State and Federal Statutes to enter into another TILA with me and/or with my ex wife, XXXX XXXX. The XXXX Mortgage XXXX and XXXX XXXX XXXX were previously on Notice throuth The California XXXX Department XXXX XXXX XXXX and the XXXX Office of Controller XXXX Currencies on this matter. The XXXX Mortgage XXXX and XXXX XXXX XXXX have unlawfully entered into my home, occupied it unlawfully as Constructive Trust and as Adverse Possession without the Color of Title and without the Color of Law and Authority. Criminal charges must be filed against the officials of the XXXX Mortgage XXXX and XXXX XXXX XXXX immediately. I am gravely hurt and I need justice. Consumer Complaint: To whom it may concern : I have lived in the XXXX area for 35 years. I bought my home 12 years ago and have really felt blessed living here. I am a XXXX and have been in the XXXX field for over 20 years. I also XXXX and my wife just began working as a XXXX. In addition to our professions, we also volunteer our time helping with fundraisers for the school ( we love kids ) and also our church, and with events geared towards helping the needy in our area too. We are active assets to our community, but we are now in need of some help ourselves. Due to some unfortunate circumstances and our lender 's unwillingness to cooperate, we are in danger of losing our precious home ... it is scheduled to go up for sale on XXXX/XXXX/XXXX!!! There have been problems with this loan from the beginning. I was lured into refinancing this property to take advantage of the equity that had built in this property when the market was skyrocketing in the XX/XX/XXXX 's. I was put into a " stated income '' loan and nothing was explained to me about the terms of this loan. I was n't very experienced with all the mortgage options out there, and I feel I was taken advantage of when they put me into an option ARM. I did n't know what that was or what it meant ( that my interest rate and payment could and likely would increase!! ). I was handling the mortgage until I lost my emergency teaching credential around XX/XX/XXXX. I started missing payments, but I would find a way to catch up or at least stay out of default ; I struggled doing this for over 4 years just trying to honor my commitment to pay for my home. I finally contacted XXXX XXXX XXXX for help. I applied for a modification, but I was put on an endless cycle of missing paperwork for months, until I was offered a solution that was just a reset of the same predatory loan ( high interest rate that 's adjustable and a high payment ). Again, it was n't explained to me, but I had to accept it to avoid losing my home. I made the payments as long as I could until XX/XX/XXXX when I fell behind again. So I went ahead and tried again and applied for a modification. Once again, I was constantly asked to submit documents over and over again. I was never given XXXX person to call regarding my file, just a department phone number where I got different answers each time I spoke to someone new. Due to their inefficiency, I had to start the process over repeatedly, and to this day I still have n't gotten an answer to my applications for a modification. I know XXXX XXXX XXXX and Nationstar are in legal trouble for how they 've handled borrowers like us. It must be illegal to proceed with a foreclosure while you 're evaluating someone for a loan modification, right? I 'm not asking for a handout, but my situation seems to be ideal candidate for a loan modification ( predatory loan, legitimate hardships, and my property value has over XXXX of its value since the loan was taken out!! ). Plus, we are in a better financial position now, especially with my wife now working as well. We just want a fair chance to save our home and get out of this predatory loan and into a loan we can sustain into the future. Any help towards these goals would be much appreciated.
