Consumer Complaint: I applied for assistance for my mortgage with Nationstar and was denied for a loan modification on XXXX XXXX, 2015. The reason for the denial was due to an error in calculating my net income. I make tips and my tips are shown ( separately ) on my pay stubs apart from my base salary. Whom ever calculated my net income DID NOT count my tips which are also shown clearly on my pay stub. I appealed the denial from Nationstar by mailing in a written appeal via my attorney and it was confirmed received by Nationstar on XXXX XXXX, 2015. This was within the 30 day period in which I could appeal their obvious error. Nationstar never replied to me and upon having my attorney contact them today ( XXXX/XXXX/2015 ) they state my appeal was denied. My attorney asked them why no letter went out as a response to my appeal and the person who answered the phone simply refused to state why. My attorney advised me that this is common for Nationstar that they continually block people from review for assistance. They are now commonly NOT sending out the required responses and replying within the 30 day period required by law. I am very upset they did not reply to my appeal as they made an error that may cost me my home.

Consumer Complaint: Aurora Loan Services has ruined my life. I have never been able to recover financially after they foreclosed on my property. Like many Americans, I lost my job in XX/XX/XXXX and had no income coming in. I tried working out many options with Aurora Loans. However their reps told me that I would never qualify for any of their programs because I had no job. They advised that I enroll in their forbearance program in order to give me time to get a job and keep my house. I was unaware that the money I was going to pay was not being applied to my interest only mortgage. One a representative told me that they were holding my money I backed out of the account. They were setting me up for foreclosure and not applying any of my money. They began charging a Preservation Fee and various other bogus fees were added. They called me non stop. One representative told me that if I was in Bankruptcy that they could n't foreclose. So I lowed their advise, I filed Bankruptcy just to prevent a foreclosure. As soon as the BK was discharged they demanded money and began foreclosure. They would never tell me where money was applied or how it was held. I filed a complaint with the XXXX in XX/XX/XXXX because I did n't know what to do. That did n't help. I plan to provide documentation to show their unfair collection practices and how they did not apply my money when it was sent in. I have XXXX different Account History printouts from the with the same dates and they do not match. Aurora Loan Services set me up and took my all money. Once I paid them their demands, all money was applied to interest. I will provide a copy of the check I sent and you will see that it does n't even show on my account history. I want some justice. I have been done wrong.

Mortgage sold by XXXX XXXX XXXX to the XXXX office company ( Nationstar Mortgage LLC ) in XXXX Texas. 2..Loan Documents provide a period between the XXXX of the month until the XXXX of the month within which payments received are NOT considered " Late '' ... .Nationstar Mortgage LLC disputes this part of the loan documents. 3. If a payment was received during XXXX and XXXX, I, XXXX XXXX, Home Owner, consequently would receive phone harassing phone calls form Nationstar Mortgage LLC, demanding payment, at once, or legal action would be taken by Nationstar Morgage LLC against me. I had as many as XXXX phone calls on the XXXX of the month demanding payment. 4. Once again, the loan documents allow payments to be received any time between the XXXX of month and the XXXX of the month without being considered " Late '' ... ... 5. I filed a complaint with the XXXX and the XXXX issued an order cease order that forbid the phone calls demanding payment, at once! 6. Today, Nationstar Mortgage LLC posted a notice, in retaliation for my BBB complaint, denying me access to the mortgage records on their Wed Site ( Transferred from XXXX when the Mortgage was sold ) .. Furthermore, the notice forced me to deny the results of the XXXX order pertaining only to the Phone harassing phone calls ( by forcing me to click on the Opposite target of the notice from my desired answer ) in order to gain access to the information on the Nartionstar LLC web site about my account. 7. I, XXXX XXXX, home owner, urge the Agency to investigate the operations of Nationstar LLC..

In the XX/XX/XXXX mortgage statement dated XXXX/XXXX/XXXX, Nationstar charged us a late fee of {$110.00}. I called them on XXXX/XXXX/XXXX to notify them that my XX/XX/XXXX payment is not late. Nationstar representative researched and found that my payment was applied to escrow and she said she will correct the mistake and also stated it will reverse the late fee. However, Nationstar reported my account as 30 days late to the credit bureaus.

Consumer Complaint: Nationstar Mortgage has received numerous completed loss mitigation applications from me requesting a short sale on my property since XXXX XXXX. I have made several complaints against them via this website with regards to their handling of this process and my account. All of their responses deny any wrongdoing and they outright lie about their actions. Nationstar has failed to send me the customer, the appropriate notices required by CFPB regulations regarding my loss mitigation application ; utilized unfair and deceptive communication and actions ; failed to timely decision my numerous loss mitigation requests ; and most recently is guilty of dual tracking. I received a letter dated XXXX XXXX, XXXX from XXXX XXXX, XXXX attorneys stating Nationstar has forwarded my account to them for foreclosure while at the same time they currently have a completed loss mitigation application they have not decisioned. On XXXX XXXX, XXXX the current negotiator advised my realtor through XXXX that a decison could be expected this week. Needless to say, that did n't happen. Additionally, I received a letter dated XXXX XXXX, XXXX from Nationstar stating they received my sales contract and requested yet another Hardship Affidavit and that the short sale request review will not even begin until this is received. In responsse to my last CFPB complaint, Nationstar provided a list of documents they needed to complete my application. They were submitted as requested by the date they requested. And now this. This whole process has been unbelivable and completely unnecessary simply because Nationstar is not following the law. I require the following : 1. Remove my account removed from foreclosure. 2. I want the complete timeline of the communications between Nationstar and my realtor since the initial short sale request was made in XXXX XXXX. 3. I want all notices that Nationstar claims to have sent me throughout this process including but not limited to Acknowledgement Letters, Incomplete Information Notices, approval and/or denial letters, delay notifications, etc. 4. Provide a decision on the current request. They have all the documents they have requested ten times over.

Consumer Complaint: In XXXX of XXXX my Mother passed away suddenly. She and I had been living in a house which was in her name since XXXX. She left me this house in her Will, which I immediately had to get an attorney to go to probate court to get the house put in my name. This did n't fully happen until XXXX of XXXX. I paid the house note by myself up until XXXX of XXXX. I tried to catch it up in XXXX of XXXX, but my payments were returned to me by Nationstar Bank. ( XXXX XXXX XXXX sold my loan to Nationstar in XXXX of XXXX, and they said I was missing a payment then, but I told them I made the payment, they just lost it. ) They hounded me and hounded me from XXXX XXXX until XXXX XXXX. This is when they sent me a letter stating they were going to foreclose on me if I did n't come up with like {$18000.00} for two months notes and fees, etc. There was no way I could do this. I tried several avenues to try to get the house refinanced and all of them fell through. My credit was n't good enough. I filed bankruptcy Chapter XXXX in XXXX hoping this would help me be able to get back on track with my mortgage payments, but Nationstar refused to work with me. I began getting threatening letters from them stating they had attorney 's who would be foreclosing on me. Finally in XXXX of XXXX I got a letter from them stating they would be putting the sale of my house in the paper three days in XXXX. I panicked and found an attorney who would help me put a stop to this. So he filed Chapter XXXX which put a stop to the sale of the house the day before. However, the house then went to the hands of the Trustee 's office for me to begin making payments to them for the house, my car and arrearages on the house. This is totalling {$1900.00} per month just to keep my house and my car. I only bring home {$2600.00}. I do n't know what to do anymore. If I cancel the bankruptcy then I lose the house and car, if I continue on with these payments ( which they are garnishing my check for ) I wo n't ever have any money for other things. I 'm between a rock and a hard place. I do n't which way to turn. Please someone help me. Thanks, XXXX

Consumer Complaint: My mortgage was just recently sold to Nationstar mortgage from XXXX XXXX XXXX. I have been trying to get my PMI of {$160.00} removed since we have 20 % into our mortgage. After several attempts to get the paperwork, I received it 2 months late. I have tried to e-mail, regular mail and have tried to fax it to more than XXXX fax # 's that were giving to me by nationstar employees. The faxes do n't ever go through, and when I call they just give me another # that does n't work. They receive my payment checks but seem to disregard the paperwork about the PMI cancellation. Their lack of professionalism has cost my family hundreds so far.

They will not release the Deed of Trust and have indicated on two occasions that I still have a debt of {$17000.00} that the Trustee never paid them. All the terms of my bankruptcy were met as is evident by its discharge. In addition, per Federal Law all creditors are prohibited from attempting to collect any debt that has been discharged or was part of a Chapter XXXX filing.

Consumer Complaint: Entered into a short sale 1 month before the seller declared bankruptcy. A {$170000.00} judgement from default of a business loan. A third lien holder was assigned to the home. After the dust settled and with consent of the sellers we provided a HUD-1 to the bankruptcy trustee to move forward with the sale of the house. The cost of the house {$800000.00}. The HUD-1 represented the payoff to XXXX and XXXX mortgage holders and {$25000.00}. for removal of the lien from the judgment. This appeared to allow the short sale to move forward. Because of the HUD-1 showed funds that would be available for her creditors. The trustee petition the court to hire an attorney, then used our HUD-1 to file an adversary case ( XXXX ) to remove the judgment. After nine months we expected a revised HUD-1 with the trustee as the third party to develop and move forward with the short sale. To everybody 's surprise Nationstar the senior lien holder changed the price of the house and increased it by {$90000.00} which was way out of align with the value of the other homes. Nationstar has around {$750000.00} payoff. You could ask yourself why does n't Nationstar sell the house and just take what 's owed. Four months, after trying to negotiate a sale, we were told that Nationstar is like a bank. Unlike a real bank that requires to have percentage of cash in its reserves Nationstar uses the asset as the reserve. If the house was bought buy the previous seller at {$1000000.00}. the bank looks at its book value and compare is liability. They are {$250000.00} into the money. Immediately this property became a valuable asset to their portfolio. Nationstar uses advances through securitization of servicing agreements. Unlike XXXX and other banks Nationstar business is building a portfolio of performing assets. Nationstar had acquired a lot of properties in the last 2 years. The regulatory agencies have n't caught up. As far as this short sale is concerned Nationstar over stepped by misrepresenting to the Bankruptcy court. What 's in it for me. I am half of the HUD-1 the buyer. Half of that government document is me and Nationstar used it to remove a judgment for their own financial gain. I just wanted to buy the house.
