Consumer Complaint: Last XXXX 2014 Nationstar fraudulently started foreclosing on my home in and returned my payment that has since been resolved with a modification. Now I was going to open a new account with a local credit union and my score has dropped XXXX point due to Nationstar say I have XXXX-XXXX day lates from XXXX and XXXX of 2014 which I was not late they falsely started foreclosure. This will now cost me more in interest on a car loan, insurance and credit. Nationstar should have fixed this problem when they figured out they had made the mistake. There are no XXXX or XXXX day late payment on my repot so how did I get XXXX non sequential XXXX day late payments?

Consumer Complaint: XXXX during the bank collapse and stock market crash our business took a serious hit. Our family is XXXX here in the states and our construction company provided income for our family and funded our XXXX work. XX/XX/XXXX I contacted our mortgage company, which was XXXX XXXX at that time, and explained to them that we wanted to do some type of modification on our loan. Due to the fact that we were not behind, they said they could not help me. After using up all of our resources we fell behind on our payments and the bank began to contact me. During the next several months we worked on a modification to resolve our problem. After months of work and mountains of paper work, which was lost several times, XXXX XXXX contacted me and told me that they could no longer help me that XXXX XXXX XXXX was taking over their company and that some one would contact me. Several months passed and XXXX contacted us and we started the modification process over again. This was a nightmare for over a year. We went round and around with these incompetent people. XXXX lost our paper work several times, the modification numbers were all wrong. They had us paying HOA dues, which we do not have, the homeowners insurance was incorrect. It was a total mess. Finally I wrote each of the board of directors of XXXX explaining the situation. I was contacted by a XXXX vice president a few weeks later. This man promised me that we will work out a modification that will work for the bank and us. After several months working with this gentleman, we were feeling good about the progress we were making and the direction we were headed. I received a letter in the mail from the court house saying they had dismissed our case with XXXX due to missing documents.Then out of no where this man quit calling me. I would call him, but there was no answer. I called for weeks the phone would ring several times and then the call would be dropped. Roughly a month later I was contacted by XXXX and they told me that they would no longer be helping me, that Nationstar would be my new servicer. Over the next few weeks Nationstar began to contact me. As of this time several years have passed and I still do n't have a modification, not even close to one. As we start the process all over again with Nationstar unbeknown to me the worst was yet to come. This company has lost literally hundreds and hundreds of documents. I mailed documents, even certified them and they were still lost. As months continued to pass we were still with out a modification of any type. XX/XX/XXXX, XXXX years later we have a modification plan that I thought would work. After making the XXXX trial payments I received my documents to sign. I was totally blown away. The modification plan added up all the past payments that were not made, which is 75 % interest and added it to the principle and now the principle is XXXX over tax value. The plan calls for me to pay interest on the interest. This is predatory lending in the first degree. The modification also extended the loan to XXXX years. There is no way a person with average intelligence would sign such a document. I contacted Nationstar and filed an appeal. There comment back to me was " take or leave it ''. So as of today we have been forced in to bankruptcy in order to stay in our home. XXXX XXXX, XXXX XXXX XXXX and Nationstar have taken a bad situation and has made it worse. Can someone please help us.

Consumer Complaint: On XXXX XXXX, a QUALIFIED WRITTEN REQUEST, COMPLAINT, DISPUTE OF DEBT, VALIDATION OF DEBT LETTER, & TILA REQUEST was sent to Nationstar Mortgage on behalf of our client. Per RESPA law, we are required to receive written acknowledgment within a few days. On XXXX XXXX, nearly 17 days had passed with no acknowledgement. I called Nationstar and spoke with an agent who faxed me an acknowledgment letter dated for XXXX XXXX, advising their goal was that a full response to our request would be provided no later than XXXX XXXX, 2015. As we have crossed that deadline, today i called Nationstar to find out where our legally required response would be. I was advised by an agent named XXXX, that although they acknowledged receipt of the QWR verbally and in writing, and even established a time frame for this response - that Nationstar has seemingly ignored the complete request and we would have to send another to POSSIBLY get a response. As this violates RESPA and TILA protocols, we have escalated to complain through your regulatory agency, who has jurisdiction over RESPA matters.

Consumer Complaint: My family income rate decreased which lead us to apply for a loan modification 3 years ago. This process of mitigation has gone back and forth for 3 years with no resolution until now ... .FORECLOSURE! A realtor company just arrived to my door to inform me that our home was forclosed on Tue, XXXX XXXX. No one from Nationstar had contacted us at all. We were told that the foreclosure process would be stopped upon receiving the requested documents. This loan started with XXXX XXXX XXXX but was sold to Nationstar. The communication is horrible with Nationstar, until the last minute, to request an IMMEDIATE update on paperwork and repetitive forms that have already been faxed or emailed with confirmation. However, we ALWAYS immediately send every form/document, hardship letter, profit and loss statement, letter of explaination, etc has been sent in a timely manner. We do n't always get a confirmation from Nationstar that they 've received the documents so we have to call or email them. We ca n't get any one particular person to handle our case so it 's always difficult and almost impossible to consistently reach someone to discuss your case or issues. No clerk/technician ever has any concrete information about your case being settled, etc. They can only tell you if the documents have been received or not. After successfully receiving all requested documents our home has now been foreclosed. We 're capable of paying for our home but not at these extremely high interest rates. We 'd still love to keep our home but just do n't know what else to do. We 've even been using a third party, XXXX XXXX XXXX ( Foreclosure Prevention ) to no avail. XXXX is just as shocked about the foreclosure as we are and instructed me to file this complaint. Also, the realtor, XXXX, suggested I file a complaint as well because this happens too often and it does n't seem as though banks want to work with the occupants at all. What else is the consumer to do when you 've done all that was requested? All requests were honored in timely manners. If at all possible, IMMEDIATELY. We 've worked hard for what we have and are fighting for our rights to be property owners at this address. We 're young hard working professionals as a family of XXXX, who 's faced hardships and misfortunes just like others but we 're financially stable now and do n't know what else to do. PLEASE HELP!

Her attorney 's office contacted the lender to verify if we could attempt a modification or short sale review. On XXXX/XXXX/2015, the authorized XXXX party was advised by a representative at NationStar named XXXX, that the foreclosure sale is set for XXXX/XXXX/2015. He stated at this point they need at least XXXX days to review for a short sale and the borrower could do short sale. The attorney 's office had sent a HOME AFFORDABLE ALTERNATIVE PROGRAM ( HAFA ) notice stating that they have failed to provide the borrower in writing these options. That notice was sent XXXX/XXXX/2015 and has yet to be responded to. The borrower is prepared to list the property for short sale and just wants the opportunity to do so.

Consumer Complaint: Between XXXX and XXXX, I suffered a series of hardships. I was laid off XXXX times due to downsizing, then in XXXX, I was diagnosed with a XXXX XXXX. I had surgery and it took over a year to recover and be able to go back into the workforce. Commencing in XXXX, I entered into the process of loan modification negotiations with XXXX XXXX XXXX. Shortly after the process began, XXXX XXXX XXXX informed me that they had switched to Nationstar as their servicer and I was forced to submit all the paperwork over again. I then went for monthly modification negotiation meetings at Court and made the timely payments required. This process continued up until XXXX XXXX, when XXXX XXXX XXXX withdrew their foreclosure action. The next day, I received XXXX Certified letters from Nationstar saying that I was delinquent in my payments and that Nationstar was starting foreclosure actions against me. Impossible! My nightmare had only just begun. I noticed that I was not getting any other physical mail from Nationstar. Nationstar never sent me or my attorney any statements or other documentation confirming the payments I had been making. Also, my attorney was and is supposed to be copied on all correspondence from Nationstar and Nationstar has not done so. I had to go on-line to their website to get my statements and information. Upon viewing my account information on line, I found XXXX more letters ( which neither I nor my attorney ever received in the mail ) saying that my payments were only partial andNationstar was keeping my account in " suspense '' pending full payment. What does this mean? Now, Nationstar claims that I owe them about {$8000.00} more due to fees and interest. Nationstar escrowed my taxes AFTER we agreed on a loan modification, making my monthly payment {$500.00} more per month! This was not a part of the terms of my loan modification! I am a homeowner who wants to pay my mortgage, but even as an honest hard working individual, it is impossible to keep up with the alleged " fees '' that Nationstar keeps adding on without cause. None of these " fees '' were reflected in my loan modification, nor was any of this discussed in the loan modification negotiations with the representative from XXXX XXXX XXXX at the pre-foreclosure meetings in Court. I can not refinance because Nationstar consistently keeps reporting me late even though my mortgage loan has been modified and I have been making timely payments. Nationstar has also threatened to put this on my credit report, thereby making it impossible for me to ever get out of this twisted situation and ensuring that I have no future. It took me 10 years to save up enough money to put a down payment on my home. For the past twelve ( 12 ) years, I have been paying for my home and maintaining my home and Nationstar wants to take my home away from me even though I have complied and cooperated completely! I am a hard working professional and I will not walk away from my home! I have done NOTHING to deserve this and I intend to bring these unlawful practices by Nationstar to an end!
