Consumer Complaint: This complaint falls within the jurisdiction of CFPB because I am a unsophisticated consumer wronged mortgage broker, originating lender, XXXX, and subsequent assignees. STATEMENT OF FACTSXXXX XXXX was the local loan/mortgage broker who handled the refinance on behalf of the lender, XXXX XXXX. LENDER FALSIFIED MY LOAN APPLICATION DOCUMENTS1. Approximately XX/XX/XXXX, Loan originator ( XXXX XXXX XXXX ) forged my signature on Truth in lending application. Also, they altered the monthly amount of income by adding XXXX in front of {$5000.00} making it {$15000.00}, thereby putting me in an unaffordable loan. Consequently, I notified the lender via Rescission. UNLAWFUL APPRAISAL WHICH INFLATED ACTUAL VALUE OF PROPERTY2. Originator inflated the value of my home by stating non existent equipment on appraisal, e.g. falsely alleging a jacuzzi tub when in actuality I never owned a jacuzzi tub ; falsely stating granite upgrades to my home which is inaccurate. 3. XXXX denied me a choice in appraiser and insisted on their appraiser which inflated the value of my property. Consequently, closing was delayed 3 weeks, and caused my loan rate to increase. UNLAWFUL KICKBACK ( S ) 4. The mortgage broker from XXXX XXXX who arranged for my loan stated that {$10000.00} additional kickbacks were paid in addition to initially disclosed stated points and fees. Further, closing statement reflects that XXXX XXXX received an additional {$90000.00} in fees in addition to normal loan origination fees. I did not consent to these fees. IMPROPER, FRAUDULENT CHAIN OF TITLE5. Subsequently, Around XX/XX/XXXX, My ex transferred title to me, XXXX XXXX XXXX, the legal owner of record. The lender 's chain of title is broken by way of an assignment of Deed of Trust from XXXX XXXX to XXXX XXXX XXXX dated XXXX/XXXX/XXXX, which obviously omits transfer from XXXX XXXX to XXXX. Further, the executor of this document, XXXX XXXX as assistant secretary of XXXX, is a known robosigner as evidenced by online research. UNLAWFUL SECURITIZATION6. Upon closing in XXXX, loan was immediately securitized by XXXX XXXX to XXXX without my authorization, contrary to the stipulations in the loan documents. MORTGAGE BROKER CONVICTED7. Around XX/XX/XXXX, XXXX XXXX was convicted of fraud and lost their license in XXXX which reciprocated loss of license in XXXX. Further scrutiny by the XXXX Attorney General caused subsequent closure and bankruptcy of XXXX in XXXX at time of loan funding. WILFUL REFUSAL OF LENDER TO PROVIDE ME THE DOCUMENTS I REQUESTED8. During XXXX on a monthly basis I phoned XXXX to request copies of their loan, note, and closing documents on file. Customer service repeatedly failed and refused my lawful request, alleging such documents did not exist or could not be located. Therefore, XXXX did not have any lawful authority to service my loan. LENDER FRAUDULENTLY INDUCED ME TO DEFAULT11. When I requested a loan modification from XXXX XXXX XXXX ( the subsequent assignee from XXXX XXXX ), I was repeatedly told each month I would not qualify until I was at least XXXX days " into foreclosure ''. I continually requested a loan modification for XXXX but was denied the opportunity as a XXXX individual to even apply. Their tactic caused me great XXXX because I had been current on my mortgage up at the time of my request ( s ). LENDER HAS NO LAWFUL AUTHORITY TO INITIATE TRUSTEE SALE12. The trustee sale documents are unlawful and contain numerous defects including the lack of proper, verifiable signature ; nor was I served properly. XXXX : XXXX : XXXX/

Consumer Complaint: since XX/XX/2013 I have been applying for loss mitigation and have always denied saying they did not receive the documents they asked me, I even went with an organization that helps those who made me all the paperwork and sent the required documents, but when I called the specialist assigned for the Bank who never answers only record label, said that the Organizations had sent compressed documents and it could not be opened, it is clear that the bank is not suitable to accept my applying for loss mitigation denied on the pretext of not receiving my full documentationEven though I meet all the requirements for this program, The last time call with an employee of HOPE and they said they already had all completed documents, however just receive a letter from the bank saying that they Declined because they do n't have the required documents. I call the specialist they assigned me but were unable to attend me, and meanwhile my debt continues to grow and foreclosure continues for sale. This is my only shelter, I am a senior citizen and need to stay home if they approve my applications, I can make my payments.

Consumer Complaint: I have a home in XXXX and was XXXX in XXXX XXXX XXXX. After XXXX to XXXX I found out that a Lien has been placed on my home by a local XXXX. I had no knowledge of the bill or that I owe her anything. I never received a bill from her. When i tried to place the house on the market to sell, I found out about the Lien. I went to her office to try to get it straighten out and could n't get any information on how to pay the bill or who to contact. The XXXX said she did n't know how to contact them. She would n't take the money I was trying to pay her for the bill. I am trying to sell the house before i loose it due to being XXXX from the XXXX and not being able to afford to pay the notes but I ca n't get the Lien off to put it on the market. I got behind on my payments and XXXX XXXX XXXX sold my loan to another mortgage company that does not have a office in my area/state. I told her I was in the military and had just gotten back from XXXX and knew nothing about a bill i owed her. She had went to court and gotten a judgement against me and placed a XXXX on my house without me knowing anything about it.

Consumer Complaint: NationStar has XXXX in less than 6 months reported erroneously Loan No. XXXX. I received a letter from there research Dept in which they acknowledged an error in reporting this information and the correction and updates to credit bureaus to be performed in XXXX 2015. After having made the corrections and updates, today XXXX/XXXX/2015 they have again fro a XXXX time reported erroneously this loan information on my credit profile and have directly impacted my credit worthiness reducing my credit score by more than XXXX points from XXXX to XXXX. Consumer Complaint: Nationstar Mortgage discontinued sending my monthly statements two months ago for no reason. I have contacted them several times only to be assured that they will be promptly continued, then nothing happens. Their customer people are rude and unhelpful. In reading their reviews online, it is apparent they are doing this to many other clients in an attempt to generate more late fees. I am hoping you can help me with this matter.

Attached is the value page of the appraisal this lender performed and the statement for the month which LTV fell below 20 %, using the lender 's own appraisal amount.

Consumer Complaint: My ex-wife and I submitted an application through Nationstar Mortgage in XX/XX/XXXX to allow me to assume the mortgage loan in her name. I submitted all of the information and was told I would receive a call back in XXXX business days. I never received a call back and when I contacted Nationstar in XXXX, I was told the information was never received. I resubmitted the information a XXXX time and confirmed with Nationstar that it was received. I then received a letter in the mail dated XXXX XXXX stating Nationstar received our request for an assumption and asked for the exact same information a XXXX time. I called Nationstar and was told again that they did n't have my information. When I informed them I confirmed with Nationstar the last time it was submitted, the representative was able to find the data I submitted XXXX before. I was then told it was with the research department and someone would contact me within XXXX business days. However, once again, I received no return calls or mail correspondence. I contacted again on XXXX XXXX and was asked to resubmit the same information for the XXXX time. I received a XXXX confirmation from Nationstar that my information was received. In XXXX, I called back for the XXXX time and was told that it was being researched by the research department and someone would contact me soon. I called again in XXXX and was told that the assumption was approved and it was in the hands of a third party for closing and could take up to XXXX days. It is now XX/XX/XXXX and I have not received any closing information, no return calls from Nationstar and continually get transferred from XXXX department to another, and eventually get hung up on. XXXX months have now elapsed and I am still no closer to resolving this issue. Again, I want to stress that I was told in XXXX the assumption was " approved '' yet I have heard nothing since. This is unacceptable lending practice and I feel an intentional attempt to not honor the approval that was verbally provided by phone. Nationstar records calls per their voice messaging system, so they clearly have access to verify these statements. Additionally, it has been impossible to speak to a member of management. I am always told they are unavailable but they will have someone contact as soon as possible, and as usual no one ever returns my calls.

Consumer Complaint: My mortgage company Nationstar has been unreasonable and unfair while reviewing my request for modification assistance and then short sale. My home was at the epicenter of Hurricane XXXX and suffered significant damage. However the original lender XXXX XXXX XXXX and then Nationstar did not honor the moratorium on payments and have pushed me into foreclosure. I was forced to pay for the majority of repairs from my own pocket due to FEMA only covering a portion of this, yet the house still has significant damage and the zoning requirement has been changed and for title to be transferred or for a new loan to be written the house would have to be raised off of the ground. Nationstar would not be able to liquidate the property through foreclosure ; they could only sell the land. It would be much more profitable and wise to work with me ; I have a good job and have existing financing. To date though, Nationstar has not been willing to engage in any type of productive negotiation, and when I gave up and tried to do a short sale we ran into a brick wall as well. We need you to investigate their servicing practices and accounting practices. I bought this house XX/XX/XXXX. I refinanced into this {$800000.00} loan XX/XX/XXXX in order to pay off my ex wife as part of a divorce. I was convinced by the lender at origination to take out a larger loan amount because the rate and payment was so low. I did not know this was a teaser rate ; my payment went from about {$1700.00} a month all the way up to {$6000.00} a month literally within months. As the payment went higher and higher, my income started going lower and lower due to the financial meltdown and housing crisis. I continued to make my payments as agreed by using credit cards and borrowing money but then Hurricane XXXX came and caused significant damage to my home. I was really struggling and tried to work things out with XXXX XXXX XXXX as I began sporadically missing payments. I was dealing with agents overseas who spoke poor English and could not make any progress. At one point in time I sent XXXX XXXX XXXX {$20000.00} to try and get back into good standing and show my willingness to resolve this issue, but they rejected the payment because they said I owed additional legal fees that had not been paid. After XXXX XXXX hit my basement was like XXXX XXXX, my roof was torn off. I went to XXXX for assistance but the money they gave me only covered half of the major damage. At that time contractors were in short supply and would not work on spec waiting for XXXX money, they had to be paid in cash. This further exacerbated my situation, I obviously had to get a roof on the house, etc. I was offered a hotel room to stay in by XXXX but it was XXXX hours away so I stayed put and tried to get repairs done one by one while my kids moved back in with my wife. The loan was still with XXXX XXXX XXXX after Hurricane XXXX and as I understand it they were supposed to put me on some type of moratorium due to the hurricane damage. However, the opposite happened and XXXX XXXX XXXX began the foreclosure process against me I challenged this and was able to get the case put on hold. At that time the loan was transferred to Nationstar. I have tried to work with Nationstar and eventually was presented with a take it or leave it deal that would make my mortgage payment over {$5000.00} a month and increase my loan balance to XXXX XXXX and was told I had XXXX hours to accept this and had to sign a waiver to never challenge Nationstar in court over any aspect of this loan. That is not really a deal, it was more of an attempt to back me into a corner and force me to comply with unreasonable demands. At that time I listed the house for short sale but my realtor has made no progress with Nationstar, they are completely non responsive.

Consumer Complaint: XXXX XXXX has a sale date on her home set for XX/XX/2015. A completed thorough investigation on the above mentioned client/ borrowers ' property with regards to requesting the true identity of the " Beneficiary '' and the true " Party of Interest '' has been done.The comprehensive title report " Chain of Title '' and/or " Foreclosure Validation '' show the following error ( s ) have occurred during the foreclosure process.The comprehensive title report " Chain of Title '' and/or " Foreclosure Validation '' show the following error ( s ) have occurred during the foreclosure process.Cal. Civ. Code 2923.5 states a notice of default recorded pursuant to Section 2924 shall include a declaration that the mortgage servicer has contacted the borrower, hast tried with due diligence to contact the borrower as required. The notice of default, document number XXXX, is invalid as the servicer did not contact the borrower in person or by telephone in order to assess the borrower 's financial situation and explore options for the borrower to avoid foreclosure. The notice of default, document number XXXX, is invalid as it had passed the 90 days before issuing the notice of trustee sale ( document number XXXX ). Furthermore, XXXX XXXX has reached out to Nationstar on numerous occasions for assistance. The inability of Nationstar to receive a simple facsimile, email, or simply maintain a file is inexcusable. Most recently, our office has repeatedly sent in information to Nationstar and they claim they did not receive the documents. By unreasonably and unnecessarily delaying the assistance request, XXXX XXXX continues to get farther and farther behind on her mortgage payments. Practically speaking, it can only be inferred that Nationstar has pushed XXXX XXXX farther into delinquency and foreclosure. The events described above are just a sample of the practices that are taking place at Nationstar. Nationstar appears to be more interested in foreclosing on homes and fire selling them at auction to make a profit. It appears that Nationstars lack of participation in following CA. Civ. Codes indicate a preference to profit directly from her hardships. XXXX XXXX is XXXX and it is apparent that Nationstar has discriminated against XXXX XXXX by refusing to review her file for assistance to retain her home. At this time we are requesting that the sale date be postponed, or Nationstar and XXXX XXXX XXXX XXXX will be named as defendants District Court Complaint.
