Consumer Complaint: I refinanced my rental property in XXXX 2015. In conjunction with the closing, I paid off my old loan, with Nationstar Mortgage, in full and on time. The payoff check was received at the Nationstar mail room on XXXX XXXX, 2015 ( per XXXX tracking ), well before the deadline to make a timely XXXX payment, XXXX XXXX, 2015. For some reason, Nationstar erroneously reported my payment as " late '', and I recently discovered my credit score was negatively impacted. I am now trying to secure a financing on a new home, but my credit score is preventing me from doing so. My attorney and I have contacted Nationstar 's customer service department nearly every business day for the last two weeks, asking them to write a simple letter stating I made all mortgage payments on time, I was never delinquent, and it was Nationstar 's error that led to my decreased credit score. I am currently in escrow on my new home, and every day that I can not secure financing puts me closer to losing my contract. I have begged Nationstar daily to write me the simple letter acknowledging their error, so that I can use it as evidence of my improperly dinged credit score, and try to rectify the situation. Despite the fact that it was THEIR error, and the fact that it is rapidly becoming more problematic for me, Nationstar claims it has no ability to expedite the processing of my complaint and " credit dispute '', and the customer service department will not connect me to anyone who has more authority or power to write the requested letter. More than a week ago, I was able to open a " credit dispute '', which the customer service representative told me would be the only way to get the letter I am requesting. Every time I have called since the dispute was opened, the representatives tell me I have to wait up to seven business days for a result. This is simply unacceptable! I may lose my contract on my new home because of Nationstar 's delay in correcting their error - an error I only found out about when I was refused financing on my new home! I am frustrated, disappointed, and increasingly disgusted by the lack of accountability Nationstar has exhibited, as well as its lack of sympathy for ( or even mere acknowledgement of ) the distress their error has caused me. I am poised to lose my contract on a new home because Nationstar has dragged its feet in the face of its SIGNIFICANT error.

Consumer Complaint: My Mortgage lender lied to the court in a foreclosure proceeding. They stated to me, the borrower, that they were reviewing my loan modification request. Instead, every time I call the Mortgage Lender ( NationStar LLC ), I am transferred from representative to representative without getting an answer to the complaint filed with CFPB. In particular, NationStar LLC lied to the court in a foreclosure proceeding against our home and fraudulently obtained the title to my property. With the title on hand, Nationstar LLC sold my home to a third party without my knowledge. Since the law now protects innocent third parties, the judge decided to side with Nationstar LLC and we were given XXXX days to move out of our home. However, the third party buyer in this case is not an innocent home-buyer, it is a subsidiary of Nationstar LLC. In addition, NationStar was to provide a response to our initial complaint on this case and instead has filed frivolous paperwork with CFPB extending the deadline to file a response so that we are left with only one week to vacate the property. We have tried on various occasions to work out a loan repayment plan but NarionStar has refused to work with us. On XXXX XXXX, 2015, I called NationStar to request a response to our complaint. I spoke with XXXX customer service representatives and XXXX accounts resolutions specialist before I finally reached XXXX XXXX badge number XXXX ). I demanded a response to my complaint to which she read me the letter from NationStar dated XXXX/XXXX/2015. In that letter NationStar claims that they are reviewing my complaint and that the NEW deadline for them to send me a response is XXXX/XXXX/2015. Since we are " required '' to move out by XXXX/XXXX/2015, we will not have enough time to make arrangements with only XXXX days notice from their response. In the CFPB guidelines it states that the lender is to provide a response to our complaint within XXXX days. Clearly, NationStar LLC is evading their responsibility to answer our complaint. As of XXXX/XXXX/2015 I have not received a verbal or written response to my complaint from NationStar LLC. Again, I spoke to XXXX at Nation Star LLC. XXXX 's badge number is XXXX and her mailing address at NationStar LLC is XXXX XXXX XXXX XXXX, TX XXXX. The phone call was made at XXXX XXXX XXXX time.

Consumer Complaint: I received a letter from my mortgage holder, Nationstar Mortgage, dated XXXX XXXX, 2015. The letter stated that Nationstar had received my application for a deed-in-lieu of foreclosure and requested supporting documentation. The letter also stated that " The evaluation period for a deed-in-lieu of foreclosure has now begun '', but did not state when the evaluation period began or when the period expired. I contacted Nationstar via the mynationstar.com messaging system and by phone message to inquire the beginning and end dates of the evaluation period, as well as to ask for clarification of some of the requested documentation. Nationstar has not responded to any of my inquiries about this matter.

Issue: Cont'd attempts collect debt not owed
Subissue: Debt was paid
Consumer Complaint: Beginning in XX/XX/XXXX, a mortgage servicer, acting as a debt collector, contacted me XXXX years after a foreclosure was conducted on a property I owned in Massachusetts. I had no prior knowledge of this mortgage servicer/debt collector, Nationstar Mortgage , LLC prior to this contact. I had a first and second mortgage on the property at the time of foreclosure. Both mortgages were serviced by the same company : initially XXXX and later XXXX XXXX XXXX. XXXX conducted the foreclosure in XX/XX/XXXX. 1 ) According to MA state law, a mortgagee or mortgage servicer needs a deficiency judgement to collect remaining loan debt after a property foreclosure. In order to seek deficiency judgement, the mortgagee must provide proof of having sent a notice of intention to pursue any deficiency after a foreclosure. This notice must be sent by registered mail at least XXXX days prior to the foreclosure. Also, the mortgagee must sign and swear to an affidavit of the mailing of the above notice within XXXX days after the foreclosure. Nationstar Mortgage has not presented me with a deficiency judgement on the debt they are attempting to collect. They have not provided evidence that a notice of intention was sent to me or that an affidavit was produced as described above even when these documents or proof were specifically requested by me in a dispute letter. 2 ) In addition, MA law has a statute of limitation for attempting to collect a debt of deficiency from a foreclosure of XXXX years. This attempt to collect the debt is XXXX years past the expiration of the allowed timeframe. 3 ) Nationstar Mortgage made reports to the major credit bureaus about this debt that now appear as negatiave reports on all my credit histories. These reports have negatively affected my credit score at a significant level. I consider this reporting to be fraud and defamation. They also ignored a direct request to retract their reports to credit bureaus until they can prove the validity of the debt. 4 ) Nationstar Mortgage has " threatened '' foreclosure on the property attached to the XXXX mortgage. I do n't believe they can foreclose on a property that has already been sold in foreclosure. Nationstar appears to have partial or incomplete information on this loan and its disposition. They never refer to the previous foreclosure or a deficiency after foreclosure. I no longer have any ownership or legal access to this property. I consider this to be fraud and making false statements in attempting to collect a debt. 5 ) I have never received any notification that this loan had been sold and/or transferred to another bank/lender, OR that the loan had a new servicer. The documentation from Nationstar states that the loan is now held by " XXXX XXXX XXXX XXXX XXXX XXXX, as Trustee for XXXX XXXX XXXX XXXX XXXX XXXX Certificates, XXXX XXXX. '' At the time of foreclosure, the mortgagee was XXXX with XXXX XXXX XXXX as servicer. I never heard anything from XXXX or XXXX after the foreclosure was complete. However, I did receive communication and settlement funds from federal and state government as part of class action settlements with XXXX for illegal foreclosure practices. 6 ) The amount Nationstar claims I owe and are trying to collect appears to be based on partial or incomplete information. The foreclosure that occurred back in XX/XX/XXXX netted over {$35000.00} MORE than the balance on the XXXX mortgage. There is no mention of the funds from the auction of the property or of any funds being applied to the XXXX mortgage. Nationstar claims that I owe the balance of the loan prior to foreclosure, about {$52000.00} PLUS an additional $ XXXX for interest and fees. Again, I would consider these amounts to be false statements, threats, and fraudulant.

Consumer Complaint: I paid off my mortgage w/Nationstar on XX/XX/2015. The said they mailed out the release of lien on XX/XX/2015. I 've contacted them XXXX times since then and they assured me that the release of lien is being sent each time. As of XX/XX/2015 the recorder 's office at XXXX XXXX has not received it. The last time I talked to them they said it will be mailed and I will receive a email copy. When I opened my email I found a payoff statement of which I have XXXX of. That 's what they keep sending me. On XX/XX/2015 I got a email saying the release of lien has been sent to the recorder 's office and to contact them. I then received a postal letter that said it was in response to my request on XX/XX/2015 for documents to be mailed to me. Guess what, it was another payoff statement. The loan has been paid in full since XX/XX/XXXX. I would find it hard to believe that a company could remain in business and be so incompetent but Nationstar is living proof. And I am not the only XXXX, I plugged Nationstar on XXXX and I read about XXXX letters worse than my situation and I had n't got an XXXX of the way down the page before I gave up. Not XXXX had anything good to say about them. I was going to write the CEO XXXX XXXX but after I saw that XXXX page I figured that he must know how XXXX up his company was, so I came here.
