Consumer Complaint: Back in XXXX I received a letter offering to lower my interest rate with Nationstar Mortgage which they also handle my mortgage So I called them to see if it could be done I was transferred to a XXXX XXXX gave him my acct number of my mortgage and he said he could it would be a very easy f h a streamline with out verify info. My first question to him would I need closing cost, which he reassured me NO. He pulled my credit report So we started the process. He emailed forms to electronic sign and I did all that was asked. Every time we spoke I asked the same question will there be a closing cost I did not want any surprises at time of closing XXXX XXXX reassured me in every conversation there would not be. He asked for my bank statements which I faxed he spoke to my ins company to send him all the info. which was done. About a week before signing I resceived the last of all the paper a SURPRISE XXXX close I spoke to his manager XXXX XXXX he sd will XXXX XXXX should have never sd that. but he I wanted this loan I needed closing cost. XXXX XXXX told me over and over again no money needed for a f h a streamline. Now mind you they never return phone calls I could leave messages send e mails and no one would contact me. I just tried to contact them every minute I had. XXXX XXXX only told me mortgages are like a mechanic ( do n't understand that ) and he was tired of doing what he was doing he wanted to do something else. Instead he was frustrated. I contacted the ceo office XXXX XXXX which I spoke to his asst, which transferred me to XXXX XXXX she toke the complain sd someone would be contacting me almost XXXX weeks ago. Still no call no letter. XXXX XXXX told me not to be upset all I lost was time. How dare him he pulled my credit ask for bank statements contact my home ins co. Told me over and over no money is need on loans like this. How can a mortgage company lie mislead consumers. and his manager sit back and sd yes XXXX are needed.l I told them they should have enough respect for consumers to let them know what might be excepted at the end of a loan not a week before. How are they allowed to do this to the people? Then show they are not concern with no return call. How can loan officer mislead people and we trust what they say. XXXX is very bad in taking care of there customers. Not caring what loan officers do. And I guess the problem starts a lot higher when the ceo office promises a call and yet no call. Just ignore there employees are doing and promises consumers then come back and say will this cant be done money or nothing I even have a Email repeating what XXXX XXXX told me do n't worry about money at closing. and he said all I lost is time. His manager could only tell me he would close the file if I did not have the money. Very little consideration for consumers. I quess they should go the the next person promise them the same and hope they come up with money. I think that should be sd up front and not weeks after. I think if they cared for the consumers they should have made good what was promised to me. But I cant get phone call back. and XXXX XXXX will just keep misleading consumers and his mgr. will reassure the consumer to close a loan bring money to the table while all the time the consumer believes no closing cost. I do n't understand how this is allowed and approved and what rights do we have. How can they do this and get away with it. No one ever returns calls. All they do is move on the next and do the same. I should have never been lied to or mislead. XXXX XXXX should have told me this could have happen then its up to me. All the paper work done the I need money. not a few XXXX but a few XXXX. Where are our rights? Is Nationstar allowed to do this lie through the whole process and repeat over and over no money till a week before? We should have some rights against this.

Consumer Complaint: On XXXX XXXX, the final docs for a HAMP modification on my CA home was signed with Nationstar XXXX XXXX XXXX XXXX TX XXXX. The process took about XXXX months to complete. I submitted copies of the initial application XXXX times as they stated documentation was never received. I received a letter in XXXX XXXX stating I did n't qualify for HAMP, which turned out to be an arithmetic error on their part. Upon correcting that, in XXXX of XXXX, Nationstar set up an escrow account for taxes and insurance per HAMP guidelines. I was not informed that escrow account had been opened and the misapplication of funds started. My original P & I payment amount was approximately {$920.00}. per month. There was no escrow account on the original loan. Over the next XXXX months, my payments varied monthly from {$1100.00}. to {$1400.00}.! The explanation I was given at the time was that the Escrow acct had to be funded, hence the changing figures. EACH OF THOSE PAYMENTS WERE MADE IN THE FULL AMOUNT REQUESTED AND ALL PAID ON TIME. Because of the misapplication of funds, most of my payments went into a forbearance account as " partial payments '', XXXX as they referred to them XXXX, and could not be applied to either P & I or escrow. Remember, I paid all invoices IN FULL AND ON TIME per THEIR instruction. In XXXX XXXX, there was a issue about my property taxes being paid, as the escrow account did not have the funds available because funds were being held in forbearance. I was told to pay the property taxes directly and was later informed that they ( Nationstar ) had paid them FROM FUNDS I 'D PAID TO THEM AS P & I. At this point, I contacted my Congressman, who in turn, contacted the Treasury department, and the process BEGAN to proceed in a less chaotic fashion, until the duplicate tax payment was returned to Nationstar, as mine had been received XXXX. That amount was credited to my escrow account. ( it should have been applied to P & I per their invoices ) All told, over the period from XXXX/XXXX/XXXX to XXXX/XXXX/XXXX, I paid approximately {$7900.00}. in P & I and approximately {$2000.00}. into escrow. Upon looking at my payment history after the modification trial periods were complete ( XXXX trial periods existed because of a filing error on Nationstar 's part on the XXXX set of loan docs ), I realized that my P & I had been reduced by a mere {$640.00} over the course of ten months! During the modification period, the P & I figure actually went UP from approximately {$140000.00} to {$140000.00}.! To reiterate, all payments were made IN THE AMOUNTS REQUESTED ON TIME during this period. Bringing this to their attention, I was sent a copy of my payment history with no letter and no explanation other than a verbal " it 's correct '' over the phone. The payments, application to P & I, reversals of payments, forbearance holdings and payments and refunds to and from Escrow make the payment history basically unreadable, except possibly by a forensic accountant. By my calculations, I am due a credit toward my principal of about {$2800.00}, and approximately {$5500.00}. in interest. Note that I have been trying to settle this since early XXXX. Additionally, XXXX of the provisions of the HAMP program is that the homeowner is to receive {$1000.00}. in principal credit XXXX {$83.00}. per month applied annually ) for each XXXX month period in which all payments were made on time and in full. To date, I have received NO incentive payments which now total approximately {$3500.00}. If these payments were applied, the amortization schedule would change, as more $ would have been allocated to principal & less to interest. I worked with the HAMP XXXX and XXXX directly to no avail. The response from Nationstar is that they 're investigating the claim and need more time. After XXXX YEARS?? My house is sold ( Closing scheduled for XXXX/XXXX/XXXX ), yet the escrow company ca n't get an accurate payoff figure due to the unresolved issues. I ca n't wait longer. Please help.

Consumer Complaint: I received a call from a mortgage broker from XXXX XXXX on XX/XX/XXXX. She said she was returning a call about a refi I had applied for. My BK has not been discharged a year so I told her I did not apply for a refi. I thought someone was trying to steal my identity so I began to ask her questions. When I got to the bottom of the problem it turns out that Nationstar mortgage had applied for a refi in my name on the XXXX website. I did have a mortgage with Nationstar but it was included in my BK. I do believe this is predatory lending on behalf of Nationstar and XXXX. I also believe this is against the Fair Debt Collection laws since my BK was discharged in XX/XX/XXXX.

Consumer Complaint: My mortgage of {$1000.00} ( monthly ) was sold to Nationstar Mortgage by XXXX XXXX XXXX. Since the inception, It has always been my practice to pay {$1200.00} monthly instead of the amount due, in hopes that I can complete my payment earlier. Once Nationstar received my mortagage, they began charging me a monthly inspection fee of {$10.00} even though no inspection was being done. Upon questioning this in writing, the practice of taking the fee was stopped. Just this month, Nationstar sent me a notice that my regular monthly payment is now {$1300.00} and not the {$1000.00} which was based upon an agreed fixed-rate XXXX-year mortgage. On calling their Customer Service on XXXX, the representative told me that this was an Escrow increase, despite my contract. It is my belief that Nationstar have been conducting fraudulent and dubious business and I am further convinced of this after I took a look at their reviews on XXXX. I need your help.

Consumer Complaint: I make my payment on the last day of each month. When this date occurs on a weekend, Nationstar 's website shows " for the selected loan online payments are not allowed. Online payments cost {$9.00} to make my payment, but to call on the phone to make my payment they charge me {$19.00}. I feel this is discriminatory. This forces me to pay a higher fee to make my payment before the end of the month. To avoid becoming further behind ... or chance referral to foreclosure.

Consumer Complaint: I am writing this letter to the CFPB as well as the DOJ and other government regulatory agencies to address the recent information and documentation that has just come to light. Through my extensive research, this complaint against XXXX will address both the false foreclosure proceeding that took place back in XX/XX/XXXX as well as the validity of the Note attached and used to perpetuate false foreclosure presented to the courts. First, let 's address the false foreclosure and in order to begin the inquiry, I call your attention to the attached Assignment of Deed of Trust dated XX/XX/XXXX. This document alone might not stir up any concern or cause regarding false foreclosure but coupled with the attached Motion for Relief from Automatic Stay, it provides evidence that reinforces the claims of false foreclosure due to the fact that the Motion was filed prior to the Assignment. ( ILLEGAL MOTION FOR RELIEF FILE BY XXXX XXXX ) PLEASE PROVIDE A DETAILED EXPLANATION AS TO HOW XXXX XXXX XXXX XXXX XXXX XXXX COULD LEGALLY FILE A MOTION FOR RELIEF FROM AUTOMATIC STAY IN XX/XX/XXXX AND BE GRANTED THE RELIEF IN XX/XX/XXXX WHEN THE ASSIGNMENT OF DEED OF TRUST FROM XXXX TO XXXX XXXX XXXX XXXX XXXX XXXX WAS NOT EXECUTED UNTIL XX/XX/XXXX PER THE ATTACHED. Next, let 's address the Note that was not only attached to the Motion for Relief from Automatic Stay by XXXX XXXX XXXX XXXX XXXX XXXX but has also been used in an attempt to validate XXXX XXXX XXXX XXXX XXXX XXXX 's right to collect the debt, which I have and will continue to challenge. In reviewing the attached Note, it is transparently clear that the Note states a promise to pay {$270000.00} with a corresponding interest rate of 7.125 % but it is also transparently clear that this is also a Residential Construction Loan that has verbiage contained within as follows : NOTICE TO BORROWER : THE INTEREST RATE INDICATED ON THE FACE OF THE NOTE EXECUTED AT THE INITIAL CLOSING MAY NOT BE THE ACTUAL RATE AFTER CONVERSION OF THE LOAN FROM THE CONSTRUCTION PHASE TO THE PERMANENT PHASE OF THE LOAN. ... THE FINAL RATE WILL BE REFLECTED IN A MODIFICATION AGREEMENT TO BE EXECUTED AT THE CONVERSION DATEXXXX XXXX presented an invalid Note to the courts to remove the mortgage loan from bankruptcy even though Nationstar continued to send me mortgage statements like the XXXX attached for XX/XX/XXXX that reflect not only a different interest rate ( Note states 7.125 % and mortgage statement states 6.250 % ) but also reflects a different loan origination amount per the payment received in the payment history provided by Nationstar in XX/XX/XXXX. Therefore, XXXX XXXX XXXX XXXX XXXX XXXX perpetually and continually utilized an invalid or false Note to perpetuate wrongful foreclosure of the property prior to their assignment as the Investor/Owner/Trustee of my mortgage loan and legal right to do so ; this would be construed as a false and wrongful foreclosure now in multiple ways since XXXX XXXX lied to the court as to their right to foreclose. XXXX XXXX XXXX XXXX XXXX XXXX can continue to dance around these wrongful and false foreclosure issues but sooner or later, XXXX XXXX XXXX XXXX XXXX XXXX will have to answer these questions as to why they lied to the courts and how they had the right to remove my mortgage loan from bankruptcy prior to their assignment as the Investor/Owner/Trustee. Consumer Complaint: Last year ( XXXX ) i sent in a full payment to get my loan caught up to date.i was behind in payment., including all back owed taxes. They applied the funds and gave me a new adjusted monthly payment, now to include my taxes. i was making my payments, then in XXXX my payment almost doubled, I contacted them and it took until ( XXXX ) to resolve the issue. I could not make payments during this time because they still wanted the doubled payment amount. After funds were applied to the correct loan i then sent a payment ( XXXX 2015 ) to once again get current, Now still to this date my account is delinquent and they will not up date it so i can make a payment. They are doing this to me on purpose to try to force me into foreclosure once again. The initial funds i sent in back in XXXX last year and their miss appropriation of funds is still unknown exactly how and where funds were applied. I have asked for a detail to explain all fund disbursement and it still is not current and.i 'm notallowed to make a payment, because they do not show current balance of my last payment to get all owed amount applied to my loan.
