Consumer Complaint: After a lengthy divorce, I had fallen behind on my mortgage with XXXX XXXX XXXX and was forced to file Chapter XXXX bankruptcy. During the bankruptcy process, XXXX sold my loan to XXXX. I emerged from bankruptcy in XX/XX/XXXX with XXXX agreeing with the court that my mortgage was current. I made my XXXX post petition payment to XXXX in XX/XX/XXXX. XXXX applied the payment to XX/XX/XXXX. I was still in active bankruptcy XX/XX/XXXX. My XX/XX/XXXX payment was misapplied to XX/XX/XXXX. I continued making payments, and never missed a payment, but the payments continued to be applied to an arrearage that did not exist. XXXX continued to assure me the matter was under review, but at one point went so far as to put me into pre-foreclosure. XXXX also never updated my status to show I had emerged from bankruptcy. I made monthly payments to XXXX until XX/XX/XXXX, at which point the sold my loan to Nationstar without having resolved the issue. Nationstar now shows me roughly {$8000.00} behind in payments and wants me to agree to a loan modification, which I have not agreed to do. Nationstar says they continue to investigate, but now they have people taking pictures of my house. I have not missed a single post-petition payment with either XXXX or Nationstar since I emerged from bankruptcy in XX/XX/XXXX.

Consumer Complaint: NationStar Mortgage bought my loan from XXXX XXXX XXXX in XXXX # XXXX First Mortgage in the amount of Approx. {$460000.00} I had obtained this loan directly from XXXX in XXXX. I have been in a Chapter XXXX Bankruptcy since XXXX. case # XXXX XXXX XXXX, CA. In order to get a discharge in XXXX I obtained a 2nd Mortgage in XXXX and paid off all my creditors. As a part of my discharge I paid Nationstar Mortgage XXXX advance Mortgage payments of {$1700.00} which were the remaining XXXX payments in the Plan. I duly obtained the discharge and it was entered on XXXX/XXXX/XXXX as there was a XXXX day wait per the Trustee 's lawyer. I have since written to NationStar Mortgage, Called them several time and asked for a receipt of these payments, a mortgage statement showing the next due date of XXXX/XXXX/XXXX. They have not complied in ANY WAY, instead they sent me a copy of the note and collateral agreement showing that they own the loan. Every time I call I get a different and more confused phone representative, I was told that by XXXX/XXXX/XXXX my loan would be removed from the BK Department and would be put back into a normal loan servicing mode as it should be. I was also advised on XXXX/XXXX/XXXX that a Mortgage Statement was forthcoming and the excess amount of {$1700.00} ( Suspense ) in my account will be applied to my XXXX/XXXX/XXXX payment. The excess is due to the Trustee making an extra payment during the XXXX months that they handled my case. I contacted XXXX XXXX attorney at XXXX XXXX who claims to represent NationStar Mortgage and told him that I was not getting any cooperation or compliance from his client NationStar Mortgage, he said he would contact them, correspondence is attached. Today I called and spoke with another Customer Service Rep at NationStar Mortgage- XXXX in XXXX , AZ . She said all that I was told was incorrect- she said once an account is put in BK it is never removed and all correspondence is stopped to the borrower, so, I will never get a receipt or anything that I have asked for, when I told her that was incorrect she said " you want to speak with a manager? " I said yes, she transferred me to someone 's Voice Mail and I did not even get their name- just a message stating- Have a Good Day. As you can see despite paying them {$8600.00} and having {$1700.00} in my suspense account, they will not cooperate and hence my complaint. I have another issue that I will file a separate complaint on- NationStar Mortgage has sent me XXXX different Form 1098 showing the Mortgage Interest paid for XXXX, all of them are wrong. They have refused to correct that document by telling me that it is correct already.

Consumer Complaint: I started working with XXXX XXXX XXXX for a loan modification in XXXX. They approved my modification in XXXX. I made XXXX payment and then was one day late on the XXXX payment so they cancelled my modification. So, I tried again for another modification and they continued to request information over and over again. XXXX XXXX XXXX kept saying to just be patient. You do n't need to make a payment. We are going to help you. And then they eventually in XXXX of XXXX transferred my mortgage to Nationstar. So, I requested a loan modification from Nationstar. In XXXX of this year they started my loan modification processing. They also said they wanted to help me. I sent them information and never heard from them. Finally in XXXX of this year they requested more financial information about my business and insisted that my attorney send them the information. So, I had my attorney send them a XXXX page fax on XXXX/XXXX/XXXX and did not hear from them again until XXXX at which time they requested the contact information for my attorney. I had my attorney fax them that information on XXXX/XXXX/XXXX and have not heard from them again. On XXXX XXXX, XXXX I received a letter from an attorney saying my house was scheduled for auction XXXX/XXXX/XXXX. So, I immediately contacted a Realtor to list my home for short sale to try and avoid foreclosure but, Nationstar now says it is to close to the foreclosure date and they will not consider a short sale. Please help by having them postpone the foreclosure sale and at least allow me time to short sale my home.

In the end XXXX XXXX XXXX kept our 6 % interest rate and changed us to a XXXX YEAR LOAN ... Not changing our payment enough, but makes nag them a lot more money. Right after that they sold our loan to Nationstar mortgage ... We 've checked on XXXX but though they claim to be able to get us a lower rate ... it will add XXXX dollars in fees back to the loan

Consumer Complaint: XXXX & XXXX XXXX brought up an ACT 91 Notice and we will send out to XXXX. We will send out a complaint to CFPB. They havebeen working with XXXX since XX/XX/XXXX first to get a loan modification with XXXX XXXX XXXX and now withNationstar Mortgage. They have been contacted by lawyers to scam them out of their money to pay them @ {$750.00} a month. People keep comingout to take pictures of their house even as we are waiting for an answer to our request for the loan modifications sent : XX/XX/XXXX, XX/XX/XXXX, XX/XX/XXXX. Atrial modification was offered on XX/XX/XXXX for XXXX payments of {$730.00} starting on XX/XX/XXXX. XXXX XXXX received a letter dated XX/XX/XXXX sayingNationstar has received their loan modification application and generally take 30 days to evaluate. In a letter dated XX/XX/XXXX Nationstar offered aForbearance Plan and Agreement for 3 months starting on XX/XX/XXXX, XX/XX/XXXX, XX/XX/XXXX at {$520.00} a month. During the Deferral Period they willbe evaluated for the HAMP program. Here we are still waiting to hear a positive response on XX/XX/XXXX.

Consumer Complaint: I have repeatedly requested information from Nationstar regarding their alleged right to service my mortgage. I have sent numerous validation requests, QWR 's, as well as letters to the CEO regarding the inconsistent, misleading, and disturbing information I have received from Nationstar. I have several documents from Nationstar with claims that they are servicing this mortgage for different entities at the same time. As a consumer, I have the right to make sure that I am paying the correct entity who has the right to collect. I have made numerous phone calls to Nationstar and each time I receive different information. It is no secret that there is rampant mortgage fraud going on in this country and I am trying to protect my family becoming victims to this fraud. Nationstar has also charged my family monthly for inspections that were never done. They refuse to correct or explain why we were charged for inspections. My latest request for information was sent to Nationstar CEO XXXX XXXX hoping that he could shed some light on the misinformation coming from his company. During calls to Nationstar they mislead consumers as to whether they are a debt collector or not. After repeated questioning about why they state " At times Nationstar may act as a debt collector '', they reluctantly indulge that they are a debt collector. This is very misleading to consumers.

Consumer Complaint: XXXX XXXX XXXX took out a reverse mortgage for me. Soon after, I started realizing something was wrong. I was paying property taxes and insurance on my house this entire time, since the end of XX/XX/XXXX/beginning of XXXX. I was then receiving notices of nonpayment from Champion Mortgage even though I have receipts of payment from the city. I sent in some handwritten complaint letters to Champion Mortgage, who had taken over my reverse mortgage, requesting information about transactions they had done. I also sent notarized letters to the CEO of Champion Mortgage. He stated, " I just bought this company. That 's neither here nor there. This is a new day and from now on everything will be in writing and I will furnish complete records on spreadsheets of the true and full accounting of what happened to your money ''. I failed to receive ANY of this information. All they did was send me a list of letters they had previously mailed me, which I still had at my home. I applied for help through the Step Forward Program in the State of Michigan with NO results. I also went through the legal motions when I learned about the right to recission. I sent in a notice to cancel ( mortgage XXXX on XXXX/XXXX/XXXX ), a XXXX notice to cancel ( reverse mortgage XXXX on XXXX/XXXX/XXXX ), an addendum to cancel, notice of removal of trustee, and a notice of revocation of power of attorney to CFO XXXX XXXX of XXXX XXXX XXXX, XXXX XXXX, Executive VP at Nation Star Mortgage LLC, and XXXX XXXX, CEO at Champion Mortgage. I retained notarized records of these notices. - There was a Sheriff 's deed on mortgage foreclosure XXXX XXXX, XXXX. On the Sheriff 's deed, the world 'exempt ' is written in the left margin for me to be notified of this. - Everything is notarized by a notary public/paralegal, and everything was certified by postal mailing. Now, they are trying to evict me from my house for the Sheriff 's sale on Tuesday, XXXX XXXX, XXXX at XXXX. Judicial district XXXX, XXXX XXXX XXXX XXXX, XXXX, MI, XXXX. The case number is XXXX. I had sent in a notice prior to the Sheriff 's sale demanding the it not happen, but this notice was ignored. I did not receive payments on the reverse mortgage. I only received a small payment and no monthly payments therafter.

Consumer Complaint: I am writing in reference to my history of payments and what is being reported or what is present on my statements, which contains a wide range of discrepancies according to my bank records and what is being reported. I am wanting to come to a resolution of the issues as they present and the continued calls on a monthly basis which was portrayed in the beginning as following BAC transfer back in XX/XX/XXXX and Nationstar Mortage, LLC stated that terms of my loan would not change. This is false and deceptive practice as according to my records and their records they are charging me unknown fees, taking more out of my escrow and can not explain where my escrow is placed I always seem to be short according to them. They are engaging in deceptive practices by calling me daily this month of XXXX and prior to that I was told that they were to cease all communication efforts, quite confusing and frustrating. I was current according to my records as of XX/XX/XXXX however they state on their records from XX/XX/XXXX report I was XXXX past due, then XX/XX/XXXX stating I was XXXX behind when in both months a payment was made XX/XX/XXXX of XXXX, XX/XX/XXXX XXXX with no reflection of where my difference was placed then your statement reflected on XX/XX/XXXX I was past due XXXX I then paid XXXX on XX/XX/XXXX which was to bring my account current, I am wanting some assistance in addressing this matter ASAP as I apparently am still in collection status which is not acceptable when a payment of XXXX was made in XXXX and no explanation of fees over the course of the time they have taken over my loan it was not a new loan but a transfer from XXXX XXXX XXXX and I have my statements from XXXX and transaction history.
