Consumer Complaint: When my ex-spouse and I, XXXX ( XXXX ) XXXX purchased our home with a mortgage loan in XXXX, we had XXXX and a XXXX loan. In the year XXXX we decided to refinance the loans in order to consolidate the loans and stay with XXXX loan, XXXX payment. On the original loan in XXXX I, XXXX was only on the deed but when we refinanced the loans, I signed the note. In XXXX I, XXXX applied for a modification with XXXX and they granted a trial temporary stipulation agreement, which in turn I paid the set down payment and amount designated monthly to completion. XXXX then proceeded and sent me the second modification package but my ex-spouse went on a drug binge and decided to call and tell the bank, asking them not do the modification, he lied to the bank stating that I was never on the note. Soon thereafter, XXXX had sold the loan as a high risk loan in the secondary market to XXXX XXXX XXXX who bought my loan. XXXX XXXX XXXX went with my ex-spouses false statement of me not being on the note and refused to deal with me at all, forced me to get court mandated motion after motion in order for me to act on behalf of my husband, filed a power of attorney to act upon my interest to modification for the loan and XXXX XXXX XXXX never responded to XXXX plus RMA packages which I filed and submitted with all of the documentation necessary and thorough follow through. Eventually, I was forced to default on the loan as I waited for a modification response from XXXX XXXX XXXX who refused to accept payments from me and then was served with a foreclosure order, which I addressed by going to court properly within the 20 days afforded as to continue asking XXXX XXXX XXXX to please award a modification so I could afford my home. Eight years later, XXXX attorneys later, I found the refinanced loan note that names me as the note owner as well as my ex-spouse. I moved forward and hired another attorney who in turn found that on the original foreclosure petition served to me and my ex-spouse, clearly states that I signed the note on the refinance and rightfully owned the property all along. I state once again, when XXXX XXXX XXXX served me with the foreclosure notice, they named me has XXXX of the note owners ( signed note by me ) yet they denied my rights as a real estate property owner, all the while denying me the ability to act upon the loan. Because, I was a battered women, in an awful marriage, physically, mentally and emotionally abused by my ex-spouse, I was under great duress and my mind was led to believe that I really was n't on the note, for years I believed that statement which also did not allow me to properly defend my stance for ownership of my home loan. XXXX XXXX XXXX refused to accept my previously stipulated agreement payment as the monthly payment in order to keep my loan up to date, stating that I would need to apply for the modification with an RMA application, which I did but they continued to ignore the RMA packages which in turn was creating an excessive forbearance, of course separating me further and further from the TRUTH. Now, moving forward, In the year XXXX my ex-spouse and I became separated and I filed for divorce, the judge awarded me my home in the divorce, gave me a permanent stay away order for my ex-spouse, granted the motion for me too act upon the mortgage in order to act upon the modification of the loan which I did, still to no avail. Again, drifting further into an accrued forbearance and further from someone defending the TRUTH.Unfortunately for me, I have been forced to hire council, XXXX attorneys of which, none were experts in the world of home loan modification processes, costing hundreds and thousands of dollars that could have, should have been used to pay down my mortgage. Consumer Complaint: This is a formal complaint against Mortgage Service Provider : NationstarI am a victim of mortgage, lending and appraisal fraud. Nationstar is the current mortgage service provider for my loan. XXXX Bank, XXXX of XXXX XXXX and XXXX, was closed down on XXXX XXXX, XXXX. XXXX XXXX and XXXX XXXX declared bankruptcy after an FBI investigation into fraud. After the FBI put XXXX and parent company XXXX Bank under for deceptive trade violations, my mortgage was sold to Nationstar. Nationstar is the residential mortgage loan providers for my loan and they left me with a toxic asset that I will never be able to recover from. The Nationstar management have left me with a mortgage that was induced by the lenders that resulted in me signing a consumer residential mortgage transaction riddled with fraud. Nationstar has not provided mortgage reduction from the appraisal and mortgage that was over valued by XXXX due to functional obsolescence and diminished site utility. As a result of the numerous violations that were committed by the service providers on my loan, I now am forced to sell by home as a XXXX bedroom house instead of a XXXX bedroom home as appraised and underwritten for my collateral. I tried to seek a judicial remedy in Texas but the Statute of Limitations has prevented me seeking recovery. XXXX and XXXX bank have been put into bankruptcy by the FBI, and my home was fraudulently appraised and Nationstar has been informed of the fraud. BACKGROUNDIn XXXX I bought a For Sale by Owner property described as a XXXX acre, XXXX square foot, XXXX Bedroom home for XXXX. The asking price for the home was XXXX. I made an offer of XXXX based on the public record tax evaluation of XXXX. The offer was rejected and a contract was established half way at XXXX. My median credit average of XXXX out of XXXX applied for financing and a good faith estimate was issued by XXXX to include an inspection and appraisal. The property appraised at XXXX Cost Approach, XXXX Sales Approach, and a final offer of XXXX was established. A retroactive appraisal and appraisal review were performed in XXXX. The two reports discovered that the property should have appraised at XXXX. The XXXX over inflated valuation has left me with a toxic asset and Nationstar has left me with a burden that has forever ruined my financial stability and destroyed my credit rating. By not reimbursing me for stripped equity, Nationstar violates both federal and state laws designed to protect borrowers from illegal appraisal practices, and without the intervention from the CFPB I will forever be burdened with a debt that I can not possibly repay in this lifetime. I would not presume to know the various channels available to anyone at the CFPB for making either direct or indirect subtle inquiries into federal and state fraud claims on my behalf. However, given the MASSIVE negligence surrounding my concerns and complaint, combined with the complacency from all the agencies I have reached out to, the very least the CFPB can do is to provide a measure of support that will give me some perspective of use for these organizations. BEFORE any suggestions by the management or Board or Governors or Examiners at the CFPB to not handle this complaint by citing statute of limitation claims, no contract of duty, not my problem, or by simply forwarding my file yet again to another state agency that is supposedly charged with safeguarding my consumer rights, it has to be emphasized that this is NOT an equitable solution to this hardship. Small or large leaps of intervention from the CFPB would go miles to restoring some sense of credibility that has been lost by this experience.

Consumer Complaint: My loan was recently transferred from XXXX to XXXX to owcen to now nationstar mortgage. I have had the loan for 8 years. In that time I have had an escrow that paid my insurance and taxes. I have paid {$400.00} per month and it has covered the payment, insurance, and taxes. Now that nationstar has my account since XXXX of this year, my insurance and taxes are not only behind but my insurance was canceled and I was not allowed to renew. I have called nation star several times and got no help. Sometimes I call and they say I do n't have an escrow account, other times they say I have over {$1000.00} in escrow but my insurance company needs to send an affidavit. Once they told me they put in a work order to release my escrow but I would have to pay the past due balance out of pocket. I called once and they said my account was set up without escrow and I have to pay everything on my own. I am not sure what is going on. All I know is I 'm paying money and no one will tell me where it 's going or my escrow information. I should know where my funds are being held, the account number, and how much comes and goes in the account. Instead I keep getting transfered between the escrow, customer service, and insurance department. When I request to speak with a supervisor I 'm told that they are on break. They say they will follow up with my request but I do n't get any response. I need to know what they are doing with the funds in my escrow account and I want my taxes and insurance paid

Consumer Complaint: I faxed a letter as initially directed by customer service requesting my PMI cancellation because it is meeting the ratio required. I make my payments on time, make extra payments and I have no junior loans. The Federal Reserve has the Homeowner 's Protection Act which states that in the case of a refinanced loan the " original value '' is interpreted as the appraisal used at the time of the refinance. I do not feel I should need to pay over XXXX dollars for a new appraisal when the Act states that the ratio is based on the original value/ appraisal. I called two hours later to confirm if fax was received. They said they have their own procedures, requested I fill sign their ( PMI Removal form " immediately '' ( which had a built in consent to pay for appraisal that I did n't see ) and to fax it to a different number. After debating the legality of their " required '' appraisal and fee, the employee XXXX XXXX then they said they are referring the matter to their PMI department and they will call me back in four days. I sent them the request, the appraisal, and I also sent the section of the Homeowners Protection Act pertaining to refinanced loans. I spoke with XXXX separate people and it took hours. Both women had heavy accents that were unintelligible. I have never received documentation from this company on PMI cancellation, nor is it visible anywhere in their website.

Consumer Complaint: I was late making a payment on my mortgage and my services decided to offer me a loan modification, with a trial period followed by a mod. I made my XXXX monthly payments, and noticed whatnwas once {$1000.00} in arrears was now close to {$3200.00} in less than 6 months. I then rechecked all my statements since XXXX and noticed there were several questionable and obvious problems and issues taking place in the crediting and servicing of my loan as a whole. There was an {$18.00} 'other fee '' I had been paying since XXXX, come to find out it was a XXXX party insurance company the loan servicer had a policy underwritten and was adding the fee on to my loan and now is charging up interest. There were XXXX home inspections added monthly as fees plus legal doc fees for {$400.00} 3 months in a row. Now I 'm really digging into what this company is thinking by pencil whipping me, it was my fault at first for not following my statement but I had been taking care of my father XXXX. The next illegal move was after I had drFted my monthly mortgage payment on XXXX, the servicer re deposited my payment right back to my account on XXXX. I have never had a company flat return my payment By redepositing and charging me more late fees more home inspections, and the like. It I now has tried to get modified by servicer but when they sent the papers for my signature I laughed at the obvious lack of attention as the forms came with lines blank, legal descriptions not filled out, the monthly payment and interest rate never was modified, yet the added 18 years to my loan and we 're starting the amount owed back at my original loan amount. I sure hope no one else has fallen for this bull. When I did n't sign and return these poor excuses for legal documents the servicer called constantly with threats of foreclosure if these were n't sent in immediately. Did n't fall for any XXXX. Started looking into exposing this wicked greedy and. Underhanded actions by my mortgage company, also I found. Out the. We 're overcharging me for the escrow account which never asked for the same monthly amount over the 4 years plus they were putting all of my extra " principal only '' in a suspense account, and this caused moe delinquent monthly payments again. I hop you can use this info to maybe help me as to what to do next. I refused to refinance or ever modify with any amount over the true amount owedXXXX

Consumer Complaint: Back in 2006 I purchased a home for {$150000.00}. XXXX lending was suppose to close me and could not at closing because my credit score dropped. I was in a panic because I gave up my apartment and have XXXX children so XXXX Mortgage which was the title company that was there for closing said they could close me. I got hit with a {$560.00} a month PMI leaving my mortgage payment to be approx. {$1900.00} a month on an income of only {$30000.00} a year. XXXX then purchased the account from XXXX and I paid on time for a year and a half and had the PMI dropped. At that point I was so far behind because of the struggle with the high mortgage payment that I applied for a Mortgage Modification. In the interim XXXX gave me a payment to pay of {$820.00} a month which included principal, escrow and a reduced interest rate. I paid this on time for close to 2 years and then my modification went through. The problem though was that they gave me a term that I had no choice to take because I could not sell the house due to property values going down below what I owed. They added {$31000.00} to the back of my loan for capitalized fees and interest. They then sold the mortgage to Nationstar. At this point I still owe the same amount that I owed when purchasing the property {$150000.00} even though the property is only worth {$110000.00}. Please assist if you can with having this {$31000.00} removed or reduced due to the beginning of the mortgage being a predatory lending case. Sincerely. XXXX XXXX, XXXX

Consumer Complaint: Last week I began receiving collections calls from Nationstar Mortgage concerning this month 's payment which was due on the XXXX the month, but was now the XXXX the month ( a week and half after the XXXX ). After that first call I went to their secure website, logged in and sent them an email advising them not to either call my work or cell phone in accordance with the Fair Debt Collections and Practices Act of 1974. The next day and each proceeding day after that I kept receiving collection calls from Nationstar Mortgage. I went back to retrieve that email that I had sent them and it had been deleted by Nationstar. The second time Nationstar called I advised them that my wife and I were advised by our Real Estate Agent not to make this month 's payment in that this may cause some difficulty somewhere in the selling process. I also advised them that I would provide Nationstar with documents showing that our house is being sold. Nationstar still kept calling and sending emails. They refused to either work with me or believe my story. In short, Nationstar violated the Fair Debt Collections and Practices Act of 1974 and based on that I am filing a complaint.

Consumer Complaint: I have been served with foreclosure papers from Nationstar Morgage. I am currently working with a Foreclosure Prevention Program Manager. See the contact info below. XXXX XXXX XXXX XXXX , XXXX. XXXX XXXX XXXX XXXX XXXX, NY XXXX ( XXXX ) XXXX XXXX. XXXX XXXX is my representative. With XXXX XXXX working on keeping me and my family in our home, we have been asked 4 TIMES to submit the SAME PAPERWORK. Nationstar requests a whole bunch of documents. I comply and send EVERYTHING requested. Nationstar simply sends me a denial notice and when XXXX XXXX follows up with an inquiry as to why we were denied a modification, Nationstar simply repeats the request for the EXACT SAME DOCCUMENTS. I am very frustrated and really ready to tell them they can have the house. We are a middle class family struggling on XXXX XXXX to keep our modest home. I am extremely frustrated with the way the banks handle the entire procedure. Nationstar is a HORRIBLE COMPANY and does NOT work with homeowners who have had hardships.

Consumer Complaint: I refinanced my home, paid points and fees and it dropped approximately XXXX monthly, only XXXX months later it went back up to its original amount. it was before and is now a fixed mortgage with nationstar mortgage. They gave me the most complicated reasoning for this increase.I just have to pay it the way it is for now though to keep my home.
