Consumer Complaint: My wife and I obtained a mortgage from Nationstar Mortgage last year when we purchased our home. Our account was impounded, which means our property taxes and insurance were included in the monthly payment. A few months after we obtained the mortgage, Nationstar sent me a check for approximately {$2500.00}. When I called to inquire about the check, I was told by a representative of Nationstar that it was a refund for a surplus in our escrow account. They also adjusted my monthly payment from approximately {$2400.00} per month to {$2000.00} per month. I told the representative that I believed there was a mistake, because when we obtained the loan we were told by the mortgage banker that the total monthly payment would be approximately {$2400.00} per month, which included taxes and insurance. The Nationstar representative assured me everything was fine, so I continued to pay the monthly amount of {$2000.00} that Nationstar billed me every month. This year, our tax preparer noticed that the property taxes we paid in XXXX seemed low, and suggested we look into it, as he believed we were n't paying the correct amount. My wife contacted the XXXX XXXX XXXX XXXX XXXX XXXX Office, who confirmed that we were delinquent on our property taxes, in the amount of {$6700.00}, which included fees and penalties in the amount of {$630.00}. We never received any statements from XXXX XXXX, who stated that they mailed all the notices to our previous address. However, they did notify Nationstar Mortgage in writing. Nationstar never made the payments, nor did they notify us about the delinquent tax amounts. On XXXX XXXX, XXXX, Nationstar Mortgage paid the XXXX XXXX XXXX XXXX 's Office the total balance due of {$6700.00}, including the fees and penalties. They in turn, will pass those fees and penalties on to us. Our complaint is, if Nationstar made the mistake of not collecting and paying the correct property tax amount, and they were notified by the XXXX XXXX XXXX XXXX XXXX Office, why should we be responsible for the fees and penalties? On XXXX XXXX, XXXX, we contacted Nationstar Mortgage and spoke with a representative XXXX XXXX XXXX and his supervisor ( XXXX XXXX, from the Escrow Account Department. We explained the situation, and the mistakes Nationstar Mortgage made, and explained that we did not believe it was our responsibility to pay those fees and penalties. The supervisor disagreed, and said he could not help us. Therefore, we are hoping your agency can help us, as we feel we are wrongfully being penalized for mistakes that our mortgage lender made. Consumer Complaint: Dear XXXX XXXX and CFPB representatives, I am writing this letter to inform you of the wrongful foreclosure that is occurring on my mortgage loan and to formally request that Nationstar Mortgage remove the foreclosure sale date presently on my mortgage loan against my family home/property scheduled for XXXX XXXX, 2016, to allow for a complete RMA review. As of XXXX XXXX, 2016, I submitted a compete request for mortgage assistance ( RMA ) per multiple account representatives at Nationstar Mortgage to include XXXX XXXX and XXXX ( XXXX XXXX on XXXX XXXX, 2016, and XXXX - Agent ID # XXXX on XXXX XXXX, 2016 ). I have every intention of retaining my home and have already submitted a complete Request for Mortgage Assistance ( RMA ) as of today in an effort to restructure my mortgage debt to retain my home. The only document that had been missing from my RMA was a current dated MHA HAMP RMA ( only requested 12 days ago on XXXX/XXXX/16 ), which has already been submitted to Nationstar Mortgage and is attached for confirmation. This document was delayed as a result of the lack of communication by Nationstar Mortgage to convey what was needed to submit a complete package. I was advised on XXXX/XXXX/16 that I submitted a complete package, which means that the foreclosure sale should have been removed at that time by Nationstar Mortgage to not engage in unlawful dual-tracking practices. Additionally, I was also advised that Nationstar Mortgage created a missing documents letter but NEVER SENT IT OUT to me perpetuating the wrongful foreclosure, which in unjust at a minimum. I have now submitted a complete Request for Mortgage Assistance ( RMA ) to include the current dated MHA HAMP RMA that was the justification for moving forward with the foreclosure from Nationstar Mortgage to date. Per the California Homeowner Bill of Rights, RESPA and the CFPB ; foreclosing on my mortgage loan while currently in a RMA review would be wrongful, in violation of multiple state and federal laws, and illegal. Please help me to postpone Nationstar Mortgage 's foreclosure sale date immediately to allow for a complete review for mortgage assistance on my mortgage loan. Please also ensure that Nationstar mortgage provides a missing documents letter to me detailing what documentation is still missing on the file to deem it complete since it is confusing as to what is needed when and in what time frame. Thank you in advance for your assistance with this matter. I look forward to hearing back form you in an expeditious manner since time is of the essence with the sale date pending for tomorrow!

Consumer Complaint: Nationstar issued approval for a short sale for a purchase price of {$130000.00} XXXX. The buyer 's appraisal was returned at {$130000.00}. Nationstar did not contact the investor for approval to issue a revised approval letter, which would have been the most effective solution. Rather than resolve the issue between servicer and investor, Nationstar instructed us to submit a copy of the buyer 's appraisal to XXXX through XXXX and assured us we would receive revised approval at the appraised value of {$130000.00}. The response was a counter in the amount of {$140000.00}. The buyer was unable to obtain a mortgage and the contract was cancelled. We have submitted several value disputes with documentation that a value of {$140000.00} is not reflective of market value and all disputes have been denied. As a result, we requested full disclosure of all valuation materials, XXXX reports, internal valuations, and appraisals. The servicer and investor refused our request, denying the homeowner her right to conduct a transaction with full disclosure and transparency. Consumer Complaint: My husband has XXXX and has been out of work since XXXX XXXX and the loss od our daughter in XXXX as well. We have falling behind in our mortgage for XXXX, XXXX, XXXX and now XXXX. We have call Nationstar to and applied for a loan modification and was denied in XXXX XXXX. We not sure if we are in foreclosure yet, but we need you help. Our complaint is this company Nationstar is rude and will not work with us, they are trying to push us into losing our home. We called hope hot line and spoke with XXXX XXXX at XXXX our client number is XXXX and our mortgage rep told him no they want XXXX payments. Nationstar rep is XXXX XXXX XXXX ext XXXX we do n't no what to do. We been in do n't want to loss our home. My husband is sicken and cant sleep. we tried to make a payment yesterday XXXX XXXX, XXXX and it was reused. Please help us.

It sounds to me that you company is refusing to investigate by documenting invalid info. Because right know i have your company documenting stuff I do n't say as well as using it in validly to file false paperwork

Consumer Complaint: Nationstar continues to pursue debt collection activity on a debt without validation and reporting false and incorrect information to all three credit bureaus. Nationstar has responded to multiple complaints referencing I have filed a suit against their predecessor and them. However, Nationstar highlights they were granted a No-evidence motion for summary judgment and a pending lawsuit against their predecessor, XXXX XXXX XXXX, validates their debt collection activity. Nationstar claims they ca n't verify or validate their debt collection activity until the lawsuit against their predecessor is adjudicated. XXXX summary judgment was denied on XXXX out of XXXX claims including fraud. Nationstar should not be able to pursue debt collection activity until the lawsuit against their predecessor is adjudicated. Nationstar only has the right to pursue collection on what their predecessor had to transfer. XXXX XXXX XXXX has not proven any right to collect the debt that was transferred. At the time XXXX XXXX XXXX transferred the debt tp Nationstar, XXXX XXXX XXXX NEVER denied an allegations in the lawsuit that was filed on XXXX XXXX, XXXX. XXXX XXXX XXXX sought to file an answer to the lawsuit in XXXX XXXX. The Court 's decision granting XXXX XXXX XXXX to answer the lawsuit almost two years late is pending in the XXXX COA. However, XXXX XXXX XXXX transferred the XXXX balanced debt to Nationstar on XXXX XXXX, 23 months after the lawsuit was filed against them.

Consumer Complaint: I started the process of a short sale on my home in XXXX 2015. I hired a reputable real estate agent and we got a contract. The lender is refusing the offer and insists on an unreasonable and unrealistic price for the house. When we asked for the basis of the figure they proposed for the sale they refused to answer. Now, they 've served me with a second set of foreclosure documents falsely indicating that they have never received an offer and the last time they contacted me was in XXXX 2015. Consumer Complaint: In XX/XX/XXXX a loan modification was approved on my loan serviced through NationStar. In XX/XX/XXXX NationStar advised me that there was an error in the XX/XX/XXXX modification and that the modification needed to be re-executed. In XXXX XXXX I re-executed the XX/XX/XXXX loan modification and returned the paperwork to NationStar. Upon inquiring with my county records office, they have no record of NationStar filing the original XX/XX/XXXX loan modification. In XXXX XXXX I received an email from Nationstar stating that the loan modification paperwork I re-executed in XXXX XXXX can not be located. NationStar continues to negotiate in bad faith by not filing the original XX/XX/XXXX Loan Modification and continuing to lose loan modification paperwork. Additionally if there was a defect in the XX/XX/XXXX loan modification why did it take approximately 2 years for the discovery. This further substantiates that the XXXX loan modification paperwork was never originally submitted to my county records office. Please see attached email from a NationStar representative confirming the loss of documents.

Nationstar refuses to accept a Quit-Claim-Deed duly recorded in the Massachusetts Registry of Deeds.Furthermore N-Star is in violation of the XXXX Guidelines requiring servircers to XXXX evaluate a borrower for XXXX prior to offering an in-house modification.N-Star has approved me for multiple in-house unsolicited, no documentation Trial Payment Plans that actually INCREASED my payment.I have never received and the servicers have never generated a HAMP Denial Letter which is in direct violation of XXXX guidelines The potential financial harm to me due to N-Stars blatant violations of XXXX Guidelines, is in excess of {$380000.00} over the life of the loan.
