Consumer Complaint: In XXXX XXXX XXXX XXXX began foreclosure proceedings on our home at XXXX XXXX XXXX XXXX XXXX XXXX MD, XXXX. We fought the foreclosure but lost and our home was scheduled to be sold at auction. We were contacted by XXXX XXXX XXXX before the sale and given the option to enter into a loan rehabilitation program that would allow us to keep our home and get out of foreclosure. The program was for the year XXXX and at the end of the year our original loan would be modified from XXXX to XXXX but the interest rate would remain at 9.99 %. We successfully completed the program and our loan was transferred to Nationstar. We have been making our mortgage payment on time for the last four years. We recently attempted to get a refinance on our home and were told that we did n't own it. County records showed that our home was actually sold at auction while we were in the rehab program. The deed to the property is not in our name but the mortgage note is. We were told by lawyers that we are essentially renting our home and could legally be evicted at any time and still be held responsible for the mortgage note. We contacted Nationstar to attempt a resolution to this issue and were told the best they could do was put the deed back ion our names after we had finished paying off the note. The lawyers told us the best solution would be to file a complaint with the state and the state referred us to you.

Consumer Complaint: I paid off my Nationstar Mortgage " in full '' on XXXX XXXX, 2016, as I am closing on my home. I have made it very clear to Nationstar, I DO NOT need the lean to be recorded as I have been advised by my attorney the XXXX will record at closing. I have been reaching out to Nationstar for the past two weeks requesting the necessary document " ORIGINAL SATISFACTION OF MORTGAGE '' ( release of lean ), so I may close on my home. My buyer has already sold his home and his commitment is due to expire. I continue to get the run-around with Nationstar who is sending me letters stating it takes 30 to 60 days " PREPARE '' the Release of Lien ''. " Once the document is PREPARED, it is sent to the appropriate county for recording. I would be very grateful for any help you may be able to provide. I though I was being responsible by paying off my mortgage but instead I feel I am being penalized. I must close on my home ASAP so I do not lose my buyer, but I told I can not close without the " ORIGINAL SATISFACTION OF MORTGAGE. I know this can be expedited as I received the Original Satisfaction of Mortgage within two business day. As of Friday, XXXX XXXX, it was confirmed nationstar had not even started working on my request.

There are no prepayment penalties. I now have funds to pay down the principal by XXXX. I called NationStar and they said I could do that but simply needed to submit a recast request. I did so and received a written reply that a recast was not " available ''. When asked on the phone why not, the agent was unable to answer and unwilling to transfer me to someone who could.

Consumer Complaint: On XXXX XXXX, 2016, I made a {$6700.00} Principle and Interest payment to Nationstar Mortgage. The employees of Nationstar Mortgage confirmed on this date, my payment would go directly to Principle and Interest and make my mortgage payment due for XXXX XXXX, 2016. Nationstar Employees also told me starting in XXXX 2016 my payments would now include escrow with any and all past due escrow to be spread out over 60 months. ( Audio recordings confirm these conversations ) Nationstar Mortgage applied my {$6700.00} incorrectly. Instead of the full payment being applied to Principle and Interest as I was told would happen, {$2400.00} went to escrow and {$1900.00} into a " unapplied funds '' account. Throughout the month of XXXX, I have talked to several employees at Nationstar Mortgage who have told me they would get this resolved and have all of my XXXX XXXX, 2016 payment applied to Principle and Interest and have the escrow begin in XXXX 2016 as I was told. None of this has happened. I am asking for help in having Nationstar Mortgage correct their error and apply my XXXX XXXX, 2016 payment of {$6700.00} to Principle and Interest with escrow beginning in XXXX, 2016 with any past due escrow spread out over 60 months, as I was told. I am also asking for help in having Nationstar Mortgage correct my credit report to reflect that I am current and not delinquent in my payments. thank you!

Consumer Complaint: I have not received this year 's {$21000.00} principal reduction promised to me in Nationstar 's XX/XX/XXXX HAMP approval letter to me on page XXXX, " [ s ] o long as [ my ] modified loan remains in good standing. '' Obviously that was a huge inducement and caused me to go ahead with the loan modification. I have never missed or even been late with a payment since my approval but somehow I am now being denied the promised inducement. On XX/XX/XXXX, prior to sending the completed loan modification paperwork in, I spoke with an XXXX ( or XXXX ) and a XXXX from Nationstar 's help line on two separate phone calls to their customer service line, XXXX. I wanted to make doubly sure that the promises and inducements referred to in their XX/XX/XXXX Hamp approval letter like the one referred to above still applied even though they were not mentioned in the modification documents I signed. They both assured me that those promises and inducements still applied as a separate agreement " [ s ] o long as [ my ] modified loan remains in good standing. '' They also said that those promises and inducements were not included in the modification documents because I do not become entitled to them unless and until I have qualified for them by keeping the loan in good standing for the requisite period. Based on those conversations and those promises and inducements, I sent the loan modification documents in. In addition I sent Nationstar a " qualified written request '' under Section 6 of the Real Estate Settlement Procedures Act ( RESPA ) giving you Notice of Error, Complaint, Request for Information and written answers to my questions about this on XX/XX/XXXX. I understand that under Section 6 of RESPA they are required to acknowledge my request within 20 business days and must try to resolve the issue within 60 business days. I did receive a cryptic response from them setting up some new condition and calculation that was never mentioned or included in their XX/XX/XXXX Hamp approval letter to me. They did not give me any details as to why I did not qualify, what this new calculation is, why I was never appraised of this prior to my decision to go ahead with the loan modification and finally, they did not even send me that information within the required 60 day period. Their response letter was dated XX/XX/XXXX, some 76+ days later.

Consumer Complaint: Nationstar Mortgage company lost 5 monthly mortgage checks of mine and ruined my credit score. I have sent them proof that I paid, by sending them cancelled/cashed checks, but have not gotten a reply from them since. Instead they sent me a statement, showing I failed to make 5 mortgage payments, which is incorrect as I mentioned. To top it all off, Nationstar just send me a notice of foreclosure. I have been paying my mortgage for 8 1/2 years, and have never been late, and I can prove it. I can not get hold of any person in charge at Nationstar Mortgage, that can stop this predatory and illegal foreclosure!! On top of that, they are now demanding a 50 % increase in my mortgage payments, even though I signed a fixed 15 year loan at 6 1/4 %. Reason given : I did not pay my mortgage for 5 months, therefore they demand that I open an escrow shortage account at monthly payments of {$750.00} instead {$470.00}, an increase of approx. 50 % in monthly payments. I do not want an escrow account, since I have been paying my taxes and insurance myself. Nationstar also refuses to refund {$950.00} in overpaid escrow fund charges. To put it in a nutshell : Nationstar owes me {$950.00} and I owe them nothing, since I 'm paid up with my mortgage payments. And now they want to foreclose - that got to be a cruel joke! This is a mortgage company from XXXX. PLEASE HELP!!
