Consumer Complaint: Nationstar had acquired my mortgage from XXXX XXXX XXXX sometime in XXXX XXXX after I purchased my house on XXXX XXXX XXXX XXXX, NY XXXX in XX/XX/XXXX or XX/XX/XXXX. I subsequently sold the house on XXXX XXXX, XXXX to XXXX XXXX. It came to my attention in XXXX XXXX while doing my income taxes, having received tax documentation from NationStar, that they had paid {$5500.00} of my escrow for the XXXX taxes for XXXX XXXX . I contacted Nationstar, they agreed it was an oversight however, they REFUSE to refund the {$5500.00} to me. I am requesting that not only the {$5500.00} be returned but also treble damages be attached in the amount of {$16000.00} for Nationstar 's blatant refusal to address my issue, even after having admitted to their mistake. I also ask that a 3.99 % interest rate be added ( current mortgage interest rate in my area ) making a total of {$23000.00} to be refunded.

Consumer Complaint: This complaint against Champion Mortgage concerns questionable business practices when a reverse mortgage becomes due, and seeks answers from their upper management. My Mother had a Reverse Mortgage with Champion Mortgage. When she passed away on XXXX/XXXX/16, she owed Champion about {$120000.00}. With her house at XXXX XXXX XXXX XXXX, XXXX, CT XXXX valued at about {$270000.00}, our plan was to sell it and pay off the mortgage. After the funeral and spending some time organizing myself to deal with my Mother 's estate, I contacted Champion Mortgage on XXXX/XXXX/16. I was told that by XXXX/XXXX/16 I needed to provide the following : Copy of the Death Certificate Copy of the Will Letter of Intent to Sell the House Listing Agreement with Real Estate Company/XXXX. On XXXX/XXXX/16 I mailed the first XXXX documents to Champion, and stated in the Letter of Intent " We are working with XXXX XXXX of XXXX XXXX XXXX XXXX to get the house listed as soon as practical ''. On XXXX/XXXX/16 I contacted Champion again after having signed the Listing Agreement ( document # XXXX ), and our real estate agent XXXX XXXX sent it to them as an e-mail attachment later that day. Within a few weeks we were fortunate to receive and accept an offer for the house for {$270000.00} with a closing date of XXXX/XXXX/16. Much to my surprise, I received a letter from Champion Mortgage dated XXXX/XXXX/16 stating " your loan was referred for foreclosure processing today ''. I e-mailed Champion on XXXX/XXXX/16 asking what the heck was going on, provided them with the sale and closing date information, and stated emphatically that I wanted to hear back from them. I received no reply ; they seem to deal only in form letters. On XXXX/XXXX/16, with the closing date of XXXX/XXXX/16 imminent, Champion included a charge of {$3000.00} for " Attorney Fees and Cost '' in the Loan Payoff document they submitted to our attorney. I spent the entire afternoon of XXXX/XXXX/16 going back and forth via e-mail and phone with our attorney, our real estate agent, and Champion. Champion claimed that they had not received the Listing Agreement, and therefore were entitled to {$3000.00} as the cost of initiating foreclosure. To make a long story short, it was proven to Champion that they had in fact received the Listing Agreement on XXXX/XXXX/16, and the {$3000.00} charge was dropped. Various business practices that were followed by Champion on this reverse mortgage once my Mother passed away were very troubling to our family. Perhaps their very aggressive approach has become an accepted way of doing business, but to me they lacked both the professionalism and decency that I would expect from any bank or mortgage company.

Consumer Complaint: Re ; loan # XXXX Over the past years Nation Star assumed servicing of my home mortgage from XXXX ( XXXX ), who assumed it from XXXX XXXX XXXX XXXX XXXX XXXX, who assumed it from XXXX who was the original bank on XXXX/XXXX/XXXX. XXXX invited me to a loan mod out reach event in XXXX RI years ago when they serviced loan in which they identified mine as " preditory '' however were unable to help me after it was determined the " investors '' didnt participate in a program of relief for my product ...??? Over the years since XXXX no servicer has honored my adjustable rate rider terms which was to drop my rate annualy & calculated an inflated arrears amt since I fell behind in XXXX that year. This inflated balance has also effected numerous in house loan mod denials as it throws off ratios. Last month Nation Star falsely claimed {$350000.00} amount in arrears on my loan mortgage ( if determined to be valid ) is incorrect. At time I fell behind in XXXX XXXX my principal was around $ XXXX & now I 'm informed its $ XXXX along with this additional $ XXXX in arrears! In past servicers such as XXXX & your own co. had indicated the wrong interest rate at 6.75 % beyond XXXX XXXX. My rate was to be fixed for 5 years per my adjustable rate rider originally signed with XXXX. Effective XXXX XXXX it was to have adjusted to 3.75 %, 2.875 % on XXXX XXXX, 2.75 % XXXX XXXX, & 3 % XXXX XXXX. Bank XXXX acknowledged the XXXX rate adjustment in XXXX prior to XXXX servicing the loan. Sls had acknowledged the rate however it was not consistently correct on statements nor in calculations as with your co. Although they now finally indicate the correct rate is being applied currently ; I retained a CPA who can not substantiate a past even less recent aggregate amount. In the past I had an Attorney, a CPA, & myself requested a review of this matter as well as a corrected amortization schedule. I no longer can afford to pay an attorney & CPA to make sense of the aggregate as its a waste of time & the Bank is unable to provide adequate info nor substantiate past inflated amounts. Ive requested they rectify this issue & recalculate this aggregate as well as provide an amortization otherwise I 'm trying to secure a loan mod on an inflated erroneous amount. In past I 've been denied numerous loan mods for for reasons related to insufficient income or not enough disposable income ; which this inflated aggregate is effecting the ratios on. I was most recently denied a few days ago & once again am facing foreclosure. Please Help me & my family. " Thank You ''

Consumer Complaint: I fell behind on my mortgage because my monthly payment increased from {$1600.00} per month to {$4700.00} per month. I hired an attorney to help me submit a request for a loan modification and my full application request was sent to Nationstar Mortgage. I was denied for a loan modification on XXXX/XXXX/2016 by Nationstar Mortgage. The reason given was due to " Investor does not allow loan modifications. '' They also state the investor / owner of my loan is XXXX XXXX XXXX, XXXX My attorney states that XXXX XXXX XXXX XXXX . does offer loan modifications and Nationstar Mortgage does participate in the Making Home Affordable program. Therefore Nationstar Mortgage is obligated to contact XXXX XXXX Bank and ask them to waive the restriction to allow a loan modification on my loan as an exception. I looked up online with the XXXX web site and it says ... '' If a PSA contains such a restriction ( not to allow loan modifications ), the servicer MUST make " reasonable efforts '' to get the investor to waive the restriction. Meaning Nationstar is supposed to contact the investor of my loan, XXXX XXXX XXXX XXXX, and ask them to waive the restriction to allow my loan to be reviewed for a loan modification. I do not believe they have made any effort at all to ask my investor to waive this restriction. According to the HAMP participation agreement, my attorney states Nationstar has an obligation to do this. They have not. Their letter simply states due to that restriction, " Nationstar, as the servicer, can not evaluate you for a loan modification ''. It says nothing about contacting XXXX XXXX XXXX to ask for that restriction to be waived and I am certain they have n't made a reasonable effort to contact them. I do not believe Nationstar Mortgage has made any effort to ask the investor of my loan ( XXXX XXXX XXXX XXXX ) to waive the restriction " not to modify ''. My attorney states Nationstar Mortgage ( and XXXX XXXX XXXX, XXXX. ) are both participating in the Making Home Affordable Program and therefore Nationstar Mortgage MUST make an effort to ask the owner of my loan to waive the restriction and review my loan for HAMP or regular loan modification. I do not believe for one minute that there is no help for someone who 's mortgage payment increased from {$1600.00} per month to {$4700.00} per month. This is absolutely outrageous, unacceptable and predatory.

Consumer Complaint: In XXXX XXXX I made contact with XXXX XXXX XXXX Loan Specialist, at Nationstar Mortgage, in an effort to apply for a hardship modification on a home loan. She requested I send in 30 days of employment information in an effort to determine what i qualified for. XXXX XXXX I submitted a payment of {$1000.00} towards the mortgage and it was counted as a modification payment. XXXX XXXX I received a response from XXXX XXXX, she called me and told me the modification was accepted and that Nationstar was willing to work with me. She informed XXXX would be my modification payments for 3 months which included XX/XX/XXXX, XX/XX/XXXX and XX/XX/XXXX. The XX/XX/XXXX payment was covered by the XXXX payment of {$1000.00} and the balance of {$270.00} was submitted into a suspense account. I made on time agreed upon payments of {$740.00} in both XX/XX/XXXX and XXXX and am currently up to date with all payments. Payments were made and received in a timely manner and credited towards my balance, however I received notification from Nationstar escrow in XX/XX/XXXX that I was required to send an additional payment of {$530.00} in an effort to keep the payment as low as possible. Nationstar escrow did not contact me until after I already had an agreed mortgage modification with my Loan Specialist XXXX XXXX. In XXXX XXXX I attempted to purchase a new vehicle, but was declined due to a serious delinquency on my credit report. I also received notification from a credit account I had that was closed due to a serious delinquency on my credit report. Upon further investigation I discovered I was also being denied loan requests from my credit union and denied refinancing from XXXX XXXX my insurance company. My representative from XXXX XXXX XXXX informed me that Nationstar was reporting to the credit bureau I was 90 days delinquent. When I contacted my Loan XXXX XXXX XXXX and questioned the delinquency being reported as 90 days, XXXX XXXX referred me to Nationstar research department. On XXXX XXXX, XXXX I submitted my first request for investigation in regard to the the reporting to the credit bureau. I submitted a second request to the research department on XXXX XXXX, XXXX in regard to this matter because I was extremely dissatisfied with the level of professionalism I received during my initial request on XX/XX/XXXX. The research department responded to my request on XXXX XXXX, XXXX, their findings were they were not responsible for any type of credit correction and it was their policy to report based on the contractual payment amount and due date even during the modification process. When I spoke to my Loan Specialist XXXX XXXX she was unaware of this policy, she never informed me of this policy and was in shock that she was supposed to make me aware, as she had no clue that this was the company standard. My issue is this has negatively affected my credit score and the mortgage never reached 90 days late, however it is still currently reporting on my credit report as such. I do not dispute that the mortgage was late for the months XX/XX/XXXX and XX/XX/XXXX a total of 60 days. Nationstar did in fact receive a payment in XX/XX/XXXX in the amount of {$1000.00} as i previously stated, which should have been applied to the balance and not have been reported as late to the credit bureau. I have all my documentation in regard to payments made towards the mortgage and proof the payment was never 90 days delinquent.

( All items requested were submitted ) After submitting my paperwork over 16 times I had no choice but to file for Chapter XXXX.I am now again trying to modify my mortgage outside of my BK and wanted to know is their someone that I can work with from start to finish to complete this task correctly.

Consumer Complaint: My attorney XXXX XXXX sent Nationstar Mortgage a letter over a year ago demanding them to itemize everything from when I cured the default because they claim I still owe {$600.00} for leagal fees they claim they paid. I cured the default and the loan was assumed. My attorney XXXX XXXX said the amount I paid to cure the default included all fees and peneltys so he was curious as to why out of the blue I owe {$600.00}. XXXX XXXX sent Nationstar Mortgage a letter demanding they itemize and prove I owe the {$600.00}. It has been over a year since he sent that letter and Nationstar has not responded. My father died nearly 3 years ago, I sent them a death certificate right after he passed in XXXX, in XXXX I get a letter from them saying they just found out my father passed and wanted to know who was handling his estate?????? That 's just it there is no estate of XXXX XXXX XXXX, it was handled years ago by XXXX XXXX and I. How many times do I have to prove it??? Nationstar is a horrible company that does not respond to Letters from attorneys and obviously cant file documents I have sent 2 different times. I have filed a complaint here on this site in the past for the exact same problem.
