Consumer Complaint: I have been filing unemployment off and on since XX/XX/XXXX. After depleting my retirement, I notified my mortgage company of the financial issues I was having and my unemployment status. My mortgage company offered a modification package that was quite involved and tedious. I submitted all of the paperwork at their request only to find out I was not eligible for the program because I was unemployed. Several months later, I asked my ex- husband, an attorney, to get involved. He contacted the mortgage company only to have the same program offered. Again, I was not eligible for their modification program since I was unemployed. On the verge of foreclosure, liquidating a few personal assets, I was able to keep my mortgage current until XX/XX/XXXX. I am now almost in foreclosure, again. Again, I contacted my mortgage company on or about XXXX/XXXX/XXXX and spoke with XXXX XXXX XXXX ext XXXX, who explained that I was likely eligible for an unemployment program offered through Nationstar that would lower my mortgage to {$50.00} a month until I was able to obtain gainful employment, again. He explained that he would escalate the program and asked me to call back Friday or Monday of the following week. When I called back Friday, XXXX XXXX was available but said he would need to call me back. I never heard from him so Monday I called Nationstar again and asked to speak XXXX XXXX who was unavailable. I cant recall exactly what she said when I spoke with her but essentially she said that I would not qualify for the program. At that point, I became quite angry and unprofessional and eventually hung up on her.

Consumer Complaint: My current adjustable mortgage was about to become variable. NationStar called to refinance into a fixed rate note. I was introduced to a XXXX speaking translator. I was told that I did not have to make the XXXX Payment because the payment would be made through the payoff. I had not refinanced before and did as instructed. The end of the month approached and I began to panic, I was told not to worry. Tuesday the XXXX I receive a call telling me that I must urgently make my XXXX payment. By the time I got off work to make a payment it rolled over to the XXXX of XXXX causing a 30 day late. I have had this loan for 10 years and " never '' made a late payment. This fact is reflected on my credit report. As it turned out, NationStar did not complete the refinance and I am unable to refinance with another mortgage company for up to 1 year due to the XXXX late payment. I have repeatedly called NationStar, spoke to various managers and no one is willing to take any responsibility and will not remove the late payment. XXXX is not my first language and considered broken XXXX. I feel foolish and misguided. I was willing and able to make the XXXX payment, why would I be instructed not to. I asked repeatedly if this could harm me, I was told the refinance would include the XXXX payment. I relied on the expertise of the person representing my best interest in a financial transaction. They should have never advised me to not make my payment. This not only harmed my credit but severely impacted my ability to refinance out of an adjustable rate mortgage. This is wrong!

Consumer Complaint: Earlier this year, I received notification from my mortgage company stating that their records indicate I have not paid my property taxes. Which I do not escrow these funds, I actually pay them directly to my city and county. At this time, I contacted them and told them, yes I did pay my taxes and I actually sent them copies of the canceled checks and even the county website showing that my taxes were paid before they were due. A few months later, I received another notification and I sent them the information again, and even called them. At this time the person I spoke with we discussed the map id # 's and it appears they had a house XXXX-doors down from me listed as my property. I asked him how this happened. The representative told me that Nationstar used a 3rd party provider to verify if property taxes were paid. I advised the person at that time, that I would send the proof in again to show that My taxes were paid. The property that owes taxes was XXXX XXXX XXXX XXXX, which is owned by my ex spouse. I even advised them that this house has NOTHING to do with me, I have never had any association with that property. They assured me they would get this resolved. On XXXX XXXX I went online to pay my mortgage and they have now added $ XXXX+ per month for escrow on my account. By this time, I was very unhappy I called them again and spoke with XXXX XXXX and explained everything to him. He told me to allow him 3- days to review. After 5-days I called him back and he advised me that they had the wrong map # associated with my house and that taxes were due. I then ask for him to call the tax office so we could discuss. We then called XXXX County Tax office and spoke with XXXX, she verified that I paid my taxes, and that I did NOT owe any taxes. I then explained to her that my ex-spouse had owed taxes on XXXX XXXX XXXX XXXX and they were linking those taxes to my property. She then advised me that in XX/XX/XXXX NationStar had paid the past taxes on his property. At that time XXXX from Nationstar asked XXXX to send him this in writing, showing that my property was current on taxes and has been. After XXXX hung up, XXXX then asked if he could have 3-more days to review this and see what recommendations he could make since they paid out {$1200.00} on an account that was not mine. He then stated they could add this to my account. I advised him absolutely not, these are not my taxes and how could a mortgage company want me to pay taxes that are not mine and that they paid out in error because of lack of competence in their own organization. Now after this ordeal I do not trust this company to not add these expenses that are not mine to my account. I have no faith in their integrity or their business practices. I am to the point of contacting an attorney to ensure that my account is handled properly.

Consumer Complaint: Nationstar is in violation of CA Homeowner Bill of Rights anti dual tracking policy by continuing with a foreclosure proceeding when borrower is seeking an alternative to foreclosure. A short sale request was submitted on XXXX/XXXX/16 and Nationstar set a foreclosure sale date for XXXX/XXXX/16. Furthermore Nationstar has stated they will move forward with the foreclosure which is a clear violation of CA Homeowner Bill of Rights which explicitly states lenders and servicers " CAN NOT CONTINUE WITH THE FORECLOSURE PROCESS ONCE A FORECLOSURE ALTERNATIVE PROGRAM HAS BEEN SUBMITTED ''. There is nothing in the CAHBOR which limits dual tracking to only modifications nor is there anything in CAHBOR which states a short sale must be approved to avoid dual tracking. This is a fallacy concocted by Nationstar which is not accceptable nor is it legal.

Consumer Complaint: After a home refinance, my loan was repackaged and sold to a new servicing company, Nationstar. I setup my first loan payments on a timely basis as well as an additional amount that I designated to be applied to principal on a monthly ongoing basis. Nationstar started withdrawing only the loan payment and upon calling them back they were able to get the additional principal payment setup. However, the setup was apparently created incorrectly. Although payments approximately XXXX the actual amount due were being withdrawn from my checking account on a monthly basis, they were initially incorrectly applied and then some 5 months later my wife noted that we were getting notices for late payment of the mortgage. I called Nationstar and they assured me they would rectify the problem and it would not be reported and would not affect my credit, this was in XXXX of 2015. Again in XXXX I received a notice from a credit reporting agency that my credit score was being lowered due to unpaid mortgage payments. I again called Nationstar and was again told it would be fixed. I did not follow up assuming after twice being assured it would be done, after already being assured my credit would never be touched. This past week on XXXX XXXX I was applying for a refinance of a business loan and when queried about my mortgage by the banker I went online to check my rate with Nationstar. Since my inception they added an online history of payments section and free FICO reporting. I checked my FICO and was dismayed to find that my score which is normally around XXXX or higher was now XXXX. I again called and now got very upset at the continuous lack of attention to my account and the confabulations and empty promises made my customer service agents who really did not care about my credit. I queried about my prior calls and the logs were very thinly documented with no discussions of any of the issues that they created for me. Keep in mind I have paid almost twice what was due during the past 14 months yet my credit score took a hit due to incorrect reporting of 5 months of missed mortgage payments. I am now being told by Nationstar it could take up to 180 days for the agencies to fix my score. If my interest rate on a $ XXXX refinance of a business loan is negatively impacted by this, I will have been financially damaged by Nationstar. I called my lender to find out who regulates the Mortgage Servicing Industry and found that you are the agency that does this. Please help or advise me if I have a legal case against this incompetent and uncaring organization.

Consumer Complaint: To Whom It May Concern. In XX/XX/XXXX I had XXXX and was out of work for 2 months. I became late on my mortgage payments and behind on my real estate taxes. I tried to keep up, because I want to keep my home. In XXXX XXXX, I had to cash out my retirement in order to become current on my mortgage payments through XXXX XXXX. I do not escrow my Real estate taxes, and was unable to pay them in XXXX, 0r XXXX Though I was saving my money to bring them current as well. In XXXX XXXX, when we went to pay the Real Estate Taxes at the XXXX County Treasury Office, we were told that the XXXX-XXXX taxes were paid, as well as started adding Impounds for XXXX. At the same time Nationstar Mortgage, has added an additional {$640.00} to my monthly mortgage payment, I have tried to make my original mortgage payments, and they are putting them into a suspense account and not applying to my monthly mortgage payments. On XXXX XXXX Nationstar refused to take my mortgage payments anymore. They wanted {$3600.00}, for XXXX, to come current. when I tried to make that payment they wanted {$6300.00}, and now it is at {$8900.00}. I do n't understand how they can do this to me. I have tried repeatedly to correct this and then they go ahead and add something else that I owe, Inspection fees etc.. I want to keep my home. Thank You XXXX XXXX. XXXX/XXXX/XXXX

Consumer Complaint: I have a mortgage with NationStar Mortgage. I try to pay my mortgage in aaaa advance by 1-4 months. I also pay extra principle with most all of these payments. I submit via mortgage coupon or wire transaction notes my instructions on which month to credit the payment towards and the balance towards extra principle payments. The company will not abide by these instructions and choose their own way to post the payments. Sometimes it is all to principle, other times not. I have to call in or email in my complaint and THEN and ONLY THEN will they post it correctly. They insist I sign up for XXXX of XXXX plans to have my payments directed. I Have chosen none of these as I want to direct my payments as my funds allow well in advance if I can. They REFUSE to post as I ask them to with each payment. Is n't this illegal? Why have transactions notes or Mortgage coupon notes if you wo n't read them? I have never, ever had such a problem in 30 years. Can I demand they read this or demand transfer my mortgage to a company more traditional? Thanks, XXXX XXXX XXXX XXXX

Consumer Complaint: In XX/XX/XXXX I obtained a home equity loan through the XXXX XXXX XXXX. Due to economic circumstances I was in default of both my XXXX and XXXX mortgages. The XXXX and XXXX were eventually modified. The XXXX apparently set aside but did not write off a portion of the debt. The XXXX involved a balloon payment that came due XX/XX/XXXX. I had made all post modification payments as required. Now the XXXX mortgage servicer, Nationstar refuses to offer any reasonable reasonable restructuring of the loan and is demanding payment in full. I have received a letter from an attorney stating they will initiate foreclosure if I do not pay the balance in full. I am also aware they may sue to collect if they so choose. It is unreasonable for Nationstar to make such a demand and not offer a rescheduling of the loan balance. I request assistance dealing with Nationstar and hope they will offer a reasonable rescheduling so I can keep making payments.

Consumer Complaint: I have been attempting to get my loan modified since XX/XX/XXXX without prevail. I had a prior modification which I defaulted on due to a job change. I informed Nationstar that I would make the back payments to catch up and requested the amount due. Within 3 days I called back to make the payment and they informed me at that point that I owed an additional {$2000.00} because they added attorney fees. I asked how they added attorney fees within 2 days of my request for the payment amount. They then refused to take my payment. I requested proof that the attorney had been paid {$2000.00} in that time frame mailed to me. I have not received any paper work in regard to that request. I applied for a modification shortly after that to try to catch the payments up. I have been declined for numerous reasons yet I have not received any sort of denial paperwork in the mail. I made a complaint with Nationstar and a rep contacted me. I informed him of some of the issues and basically informed me that I have no option beside foreclosure. I asked why and he stated my modification failed for numerour reasons. I requested all prior modification denials and copies of the prior modifications mailed or emailed to me. To date I still have not received copies of everything I have requested. I received documentation that the house will be in foreclosure so I started looking into deed in lieu of foreclosure and also had put my home up for sale for about 8 moths and the home was only viewed twice. The mortgage on the property is higher than when I bought it in XX/XX/XXXX and the property value is about $ XXXX making it impossible to sell the home. I would like copies of all the paper work including the first modification, second modification ( did n't know I even had a first XXXX ) and copies of every denial. I also want proof of the inspections that they have charges fees for monthly on the home and the attorney 's paid receipt showing the {$2000.00} that they demanded from me to be able to take my payment. I am suppose to have one contact and have several as well. One of they payments that were late was due to the XXXX not being able to make the payment when Nationstar acquired the loan as well. This has been an on going battle since they have acquired my mortgage, but further review of the paperwork from the courts show that XXXX XXXX is the person who holds the mortgage.

Consumer Complaint: They have refused to remove my PMI. Based on the tax assessed value and my current principal balance my LTV is 73 %. Tax assessed value is commonly known to be XXXX25 % less than the market rate of the home ( depending on market ). I find it fraudulent to continue to be required to pay this PMI along with being asked to pay for an appraisal with no guarantee the appraiser will provide and accurate value in my interest and not the lender 's.
