Consumer Complaint: We are filing a complaint based on illegal representation of loan modification procedures and omissions of Nationstar Mortgage ( NSM ). After a long and heated battled in foreclosure court our family was finally awarded/granted a loan modification under the Making Home Affordable program ( MHA ). This modification outlined payments to start on XXXX XXXX, 2016. As my family was of course elated to finally have an opportunity to resume payments on our loan which had been delinquent for some time due to job loss. We promptly made our payment of {$700.00}, only to be rejected by NSM. When we made our inquiry with NSM, as to why the payment was returned, it was brought to our attention that a mistake had been made on the loan documents. A mistake which NSM, advised would need to be corrected before any payments could be accepted toward the new plan. It was stated that the plan did not contain my wife 's name XXXX XXXX and they needed to be reprinted. This negligence has led to further disarray and miscommunication between myself, NSM and the loan documentation department. Once the documents were finally corrected and resent to my family. I was then instructed to hold my payments until I was contacted and was not contacted until XXXX XXXX, 2016. At that point, I was instructed to complete an ( ACH ) draft payment from my personal checking account on the date of XXXX XXXX, 2016 in the amount of {$2100.00}, which would then bring the account current and finalize my permanent loan modification. After this payment was completed NSM, still refused to complete the loan modification and covert to permanent deal. I was then contacted and advised that by agent XXXX XXXX, that it was necessary to pay {$1400.00}, or my loan modification would be canceled. This act of extortion has gone too far and refuse to continue to be misled by NSM and their deceptive servicing and lending practices. In fact, XXXX XXXX advised that he is not positive that if this amount of {$1400.00} is paid there is no guarantee the deal will be made whole. Now NSM, is attempting to undermine the terms of the national mortgage settlement as well as the MHA program itself. They are intentionally forcing my loan back into a delinquent status and ultimate foreclosure. This is evident and has been identified on multiple levels. This crime need stop be brought to a halt, and our family is prepared to file a civil lawsuit in order to correct this matter immediately. We implore the CFPB to take action regarding this tragedy of events.

Consumer Complaint: A loan modification request was submitted on XXXX/XXXX/2016 to Nationstar mortgage 37 days prior to a sale date ( Hereto attached ). A letter was received from Nationstar on XXXX XXXX, 2016 advising us who the assigned representative was and to contact them if we had further questions regarding the status of the loan assistance ( Hereto attached ). A missing documents letter was never received from Nationstar within 5 days of the submission advising us the package was incomplete. On XXXX/XXXX/2016 Nationstar moved forward with requesting a sale date for XXXX/XXXX/2016 rather than suspending the foreclosure while the borrower was in the loan modification review. Nationstar was aware of the borrower 's legal counsel and spoke to the borrower advising they only received XXXX pages of the package on several occasions during the week of XX/XX/XXXX-XX/XX/XXXX, thereby disregarding our Notice of Representation advising there should be no further communications rather verbal or written with our client due to the borrower 's legal representation. The package was resubmitted on XXXX/XXXX/2016. Nationstar 's disregard for the HAMP and CFPB Directives as well as their disregard for Non-Communications with borrower 's under legal counsel is reflective of their neglect and duty as a servicer.

Consumer Complaint: We obtained a loan with Nationstar Mortgage LLC. A Deed of Trust was recorded on behalf of Nationstar in relation to that financing ( on or about XXXX XXXX, XXXX ) ... but on XXXX XXXX, XXXX there was an additional Financing Statement recorded on behalf of Nationstar. Please see attached preliminary title report. We are now trying to refinance with a new mortgage company and can not get Nationstar to release the UCC # 3 document which would release this XXXX lien they recorded on our property. We believe that they mistakenly or fraudulently placed this XXXX lien on our property. We have tried to obtain the UCC # 3 document from Nationstar since XXXX XXXX, XXXX. We have contacted them numerous times by phone and email and they give us no reason why they cant give us the UCC # 3 document or why the lien was even placed on the property. The individuals that we have been in contact with are no longer answering our requests. No one will call us back and no one seems to know what is happening with our request. In other words, I feel like we are getting the run around from Nationstar. More details can be provided if necessary along with names and email addresses of those individuals we have been dealing with.

Consumer Complaint: Your submission, [ Case number : XXXX XXXX Hello I 'm doing a follow up complaint against Nation star mortgage : Regarding the shortage spread that 's included in my mortgage payment $ XXXX {$3800.00} for a 27 month period.. I will state again, my mortgage was current as well as my taxes have been current since XXXX. So there would be no need to have an overage shortage, ( not only are you taken additional funds out of my pocket but your taken food off the table as the additional alleged had places a hardship on my family ) I have been trying to get a clear answer regarding the alleged shortage since XXXX XXXX when the updated escrow analysis came out.. Not on person in your escrow not cs department know 's what 's going on. When i ask 2 months ago to have the shortage put on hold until the loan was investigate they C/R said it would take 48 hours.. When i called back to follow up the shortage was still on my loan and not phone log of the conversation was documented, when i ask for print out of all of the recording since XXXX XXXX i was places on hold for over an 1 hour then the call was disconnected.. Frustrated and stress over mortgage lender bullies i 'm just at a lost. when i called in to see if I could do a forbearance until this could get resolved i was transfer to the lost mitigation department and the guy said not Forbearance was not an options, but this is what 's on Nation star web site : Partial Payment or Forbearance : this is on the payment assistance site : https : //www.nationstarmtg.comXXXX If you 're experiencing or have experienced a temporary hardship, Nationstar may be able to offer you a forbearance agreement, which could possibly delay or reduce your payments until you can bring your mortgage current. This option could help you get your finances back on track without the worry of losing your home. There are also options specifically for borrowers who are currently unemployed. Click on the Getting Started tab to learn how to begin the process. I received the statement as to why my payment increased and it 's False and not true which is why i 'm contacting you guys again.. I 'm in the process of completed a loan modification with XXXX as i did not sign up to have Nationstar Fraudulent add fees to my loan, if I dont make my payment because someone at Nationstar did not do there due diligence when they purchased my current loan from XXXX Then XXXX needs to go back to XXXX and do a bit more Due Diligence before you start added fees on to consumers mortgage loans causing them hardship.. Shortage Explanation for XXXX : XXXX. stated that when they purchased my loan for XXXX that the escrow balance was XXXX as XXXX had not completed the Escrow analysis.. " WHICH IS A FALSE STATEMENT '' Not only was the Analysis completed ( twice ) the first time Bof A rolled over XXXX in taxes and interest into my loan, the 2nd time XXXX rolled {$12000.00} into the loan, just to get more fees. when the loan was sold to N.S all taxes were current. What needs to happen is XXXX needs to contact XXXX .My loan needs to be assigned to XXXX point of contact until this is resolved.. Attached is the dispute respond as well as my taxes from XXXX to current..

Consumer Complaint: I was suppose to receive my overage checks through refinance and they did not make it to me. They mailed it to my physical address. We do n't have mail service here in XXXX XXXX, Ca., just XXXX. I 've contacted the mortgage co. several times and was supposed to have been reissued. Somehow they 've intercepted and cashed. I requested copies of the checks, received them and they 're not signatures. I faxed a letter to the research dept and requested reissues of the the checks. I 'm submitting a complaint because this has been over 2 months now of trying get my checks. ( XXXX to be exact ). Thank you.

Consumer Complaint: In XXXX of XXXX, Nationstar Mortgage contacted me about requiring my property to have flood insurance based on XXXX updated maps. Knowing this was a mistake, I started into doing the research to get this corrected. In XXXX of XXXX, Nationstar Mortgage informed me that they have obtained flood coverage on my behalf and debited my escrow account. In the fall of XXXX, I obtained all the documentation to submit to XXXX for a Letter of Map Amendment. In XXXX of XXXX I received the Letter of Map Amendment removing my property from the flood plain. In XXXX of XXXX, Nationstar Mortgage released my obligation to have flood insurance. Nationstar refunded a prorated balance of the insurance premium. I should have been refunded the whole premium based on accompanying documents with the Letter of Map Amendment and XXXX Flood Insurance Program " Cancellation and Nullification '' document reason # XXXX. My request for full reimbursement of premium is based on XXXX 's document titled " Addition Information Regarding Letters Of Map Amendments '' provided in the XXXX cover letter doc. Paragraph XXXX of this document states : " If a lender releases a property owner from the flood insurance requirement, and the property owner decides to cancel the policy and seek a refund, the XXXX will refund the premium paid for the current policy year, provided that no claim is pending or has been paid on the policy during the current policy year. The property owner must provide a written waiver of the insurance requirement from the lender to the property insurance agent or company servicing his or her policy. The agent or company will then process the refund request. ''

Consumer Complaint: We have had an active short sale offer on this property since XXXX/XXXX/16. After sending the package to Nationstar and becoming active in XXXX, we met every demand of Nationstar. The appraisal was completed on XXXX/XXXX/16 and came back with the value of {$26000.00}. However, because the XXXX came back at {$64000.00}, we were told that Nationstar would be ordering an additional appraisal to back up the first. We were subsequently told that the XXXX is actually {$84000.00} which we find to be high suspect considering the fair market value is at {$26000.00} per the appraisal and the previous XXXX of {$64000.00}. At this time, we were 15 days away from the Foreclosure Sale Date of XXXX/XXXX/2016. Our office faxed in an escalation request with Nationstar to get the Foreclosure stopped since we had an active buyer. Unfortunately due to lack of motion and efforts within Nationstar to protect the best interest of the FHA, Nationstar refused to stop the foreclosure sale ; therefore, we had to hire a lawyer instead to stop the FC date. The day before the original FC sale date, the XXXX was issued and our buyer raised their offer to {$27000.00} in order to exceed the required net of {$21000.00} which was requested by XXXX XXXX at Nationstar. Nationstar claimed orgininal contract was invalid due to the date of inception, therefore, the contract was redrawn. Since this date, we have been waiting for approval from Nationstar while checking in regularly. There have been 3 separate claims that Nationstar was asking for a variance on the XXXX v Appraisal values. Today we were told that the seller needs to bring the property to a marketable status before the FHA will review for a short sale. Our firm has processed XXXX of short sales over the last 7 years and never had a servicer demand that a property be rehabbed in order for the short sale to be completed. We know of no mortgee letter issued that highlights this update procedure and/or policy of the FHA. It is our opinion that Nationstar is deliberately trying to foreclose on our client and that they are taking every opportunity possible to derail the short sale. We believe we have identified a trend within Nationstar 's servicing practices. We believe the pattern is as follows : Nationstar drags a property through the short sale process thus determining its real market value, its fake market value, and its future appraised value. These costs are covered by the FHA and not by the servicer. From this point, Nationstar does what it can to deny the short sale, foreclose on a property, send that same property to their auction site XXXX, and charge a 5 % buyer 's premium. In addition, Nationstar receives a servicing fee from the FHA and receives revenue from the vendors who are advertising and/or participating in the auction process. Nationstar benefits much more through this auction process than through a short sale process so they are forcing their borrowers into foreclosure instead of letting them out of the debt. This not only hurts the homeowners but the tax payers and the real estate market as well. A complete Short Sale Package including : pay stubs, tax returns, and bank statements, is available immediately upon request.

The XXXX other Mortgage Companies that I had before Nationstar Mortgage knew that I owed the taxes Before I could sell the house I knew that all taxes would have to be paid.But Nationstar Mortgage wanted the regular mortgage payment of {$1000.00} but the {$2300.00} also in one month.Nationstar Mortgage knew that I was XXXX veteran because for close to two years tried to escrowe my account.Before this I made on time payments for three years to refinance my home from 7.99 % adjustable rate.Each time they would try and escrowe my account is it put me as late They took it off my credit report for awhile But Nationstar Mortgage never told my other creditors so my score suffered.Couldnt refinance then strong along with a modification plan.then told the forms were sent by mistake .Now in a chapter XXXX bankruptcy
