I have submitted a dispute, but have also found fraud in the note of loan rates and adjustments and pre-payment penalty. I have attached a copy with the highlighted forged signature.

Consumer Complaint: On XX/XX/XXXX, Nationstar Mortgage , LLC received final summary judgment to foreclose on my property located at XXXX XXXX XXXX, XXXX, Fl, XXXX. The sale date scheduled for XX/XX/XXXX. They were no evidentiary hearings in this case. The foreclosing lender Nationstar Mortgage , LLC does not have possession of the mortgage by a valid chain of assignments, thus, the lender did not have proper standing to foreclose. The Mortgage was assigned first by XXXX XXXX XXXX to XXXX XXXX, XXXX, second, by XXXX as Nominee for XXXX XXXX XXXX to XXXX XXXX, formerly known as XXXX XXXX XXXX, third, by XXXX XXXX XXXX, XXXX as successor by merger to XXXX XXXX XXXX, formerly known as XXXX XXXX XXXX in favor of Nationstar Mortgage , LLC and lastly by Nationstar Mortgage , LLC as Attorney-in-Fact for XXXX XXXX XXXX, XXXX to Nationstar Mortgage , LLC itself. 1. The second assignment states that XXXX was a party to the mortgage contract, however, this claim is unfounded. The subject mortgage is not in the MERS database. Consequently, MERS did not have the authority to assign the mortgage. 2. There is evidence that the signatures of the endorser 's representative on the second endorsement and those of the assignor 's representative on the first assignment and the assignor 's representative and the notarizing official on the second assignment were forged or robo-signed or signed by surrogate signers. 3. The foreclosing lender Nationstar Mortgage , LLC does not have possession of the mortgage by a valid chain of assignments, thus, the lender did not have proper standing to foreclose. Nationstar 's unfair and deceptive practices. I did not receive my default notice prior to Nationstar Mortgage initiating the foreclosure filing. According to Nationstar 's demand letter dated XX/XX/XXXX, I was XXXX in arrears, Nationstar failed to provide a viable resolution when I contacted them upon becoming XXXX in XX/XX/XXXX. When my former attorney, XXXX XXXX stopped communicating with me, I alerted Nationstar 's attorneys, XXXX XXXX XXXX and XXXX XXXX XXXX via e-mail that I did not get a default letter. Instead of responding to me, Nationstar attorneys submitted an e-filing motion to withdraw from the case within hours after I sent my e-mail. When my attorney, XXXX XXXX abruptly withdrew from the case at a Summary of Judgment hearing, I complained to the FL Attorney General XX/XX/XXXX about not receiving the default notice, the Attorney General requested of Nationstar Mortgage to respond to the inquiry. In response, Nationstar 's counsel, XXXX XXXX XXXX, sent the response letter to my former attorney, XXXX XXXX and to the Attorney General. I did not get Nationstar 's response letter, which included the default letter, until XX/XX/XXXX ( after final judgment ) when Attorney General, XXXX XXXX forward the document to me. XXXX XXXX agreed that Nationstar should have sent the letter to me having full knowledge XXXX XXXX had withdrawn from the case and has spoken to Nationstar about their misconduct. Nationstar promise to submit a letter about this matter but to date, Nationstar have not. At the hearing on XX/XX/XXXX, I told Nationstar 's atty, XXXX XXXX XXXX, I was under medical care, and my due process violated by my former counsel, and I desperately wanted to keep my home. XXXX told me Nationstar still wanted to foreclose and I can apply for a modification after the judgment. Additionally, Nationstar failed to respond to my new counsel in my original CFPB complaint # Case number : XXXX. Nationstar 's foreclosure on my property on XXXX is in clear violation of XXXX, SEC, XXXX XXXX XXXX laws, Fair Debt Collections, Florida Foreclosure laws. Assignment of mortgage is fraudulent

Consumer Complaint: Submitted refinancing request with Nationstar Mortgage in XXXX of 2016. They sent documents confirming rate and referred to their appraiser. their appraiser had NO availability until & gt ; 60 days after rate lock. I received NO communication that the rate would be cancelled if the appraisal was not completed and the request submitted within 60 days and in fact they were made aware of the date the appraisal was scheduled from the beginning. I also sent an email asking for confirmation that there would be no problem with a delay in the appraisal until early XXXX which went unanswered by Nation Star but replied to by the appraisal company stating that Nation Star was aware of the situation and it would not be an issue. I was just informed that my request for refinancing has been cancelled because it " timed out. '' but they are happy to begin the process again - at a higher mortgage rate of course because the rates have increased. This is clearly a deliberate method to avoid offering refinancing at the lowest interest rates, especially when they anticipate the interest rates will be rising.

Consumer Complaint: I put my house up for sale. I received an offer and I excepted that offer. The buyer had numerous issues with their lender ( required paperwork and inspections that they were not aware of ) This caused numerous delays and postponement of the final closing. I notified my lender ( NATIONSTAR ) of these delays, I assured them that the property was in contract and would be sold. The Nationstar Reps. repeatedly assured me that there was no problem and that everything was OK. It was always very difficult to talk to a live person at Nationstar and when I was able to talk to someone it was always a person with a very heavy accent that did not seem to understand English very well. So to protect myself I wrote a letter to to Nationstar explaining the situation on two different occasions. We were finally ready to close on the property and requested the Payoff from Nationstar. Nationstar sent us a statement with the payoff amount. We closed and the house was officially SOLD. Six days later Nationstar sent another payoff statement. This statement is {$2400.00} more. Nationstar said the additional charge is for " Legal Fees '' because they had started the foreclosure process!

Consumer Complaint: Had a XXXX mortgage for a number of years. In 2012I XXXX was unable to work. I called XXXX, they told me that they would work with me. They forclosed on me instead. I was able to stop the sale by borrowing XXXX. They told me that I would be able to get a 2 % loan. I could never get all the documents they wanted ... I always needed one more.They have since sold my loan to Nationstar. Nationstar put me on a trial payment. They told me that I would get a better rate and a lower payment. They kept the rate the same and extended the mortgage 10 years. This takes XXXX % of my income to pay this. They have lied to me just like XXXX. I want to know what my rights really are. Consumer Complaint: This situation with Nationstar Mortgage started with the sale of my mortgage from XXXX to Nationstar in late XX/XX/XXXX. There is no way to make this a short document, but I will try to be as concise and clear as possible. I have documentation for everything that I am relating to you. During this time I have continued to make the monthly mortgage payments. XX/XX/XXXX *Documents available* * Telephone calls begin and I decide I better start to document as much as possible When I attempt to make my normal payment, the website will only allow me make a payment of {$2600.00} - I start my research and communications with NS I make a complaint with them. XX/XX/XXXX I make payment of {$2600.00} as it is the only amount NS will accept. XX/XX/XXXX letter from NS ref # XXXX stating " We have conducted an investigation and did not find any error in application of payments based upon the information you provided. '' In the same document NS states " On XX/XX/XXXX, your payment, total in the amount of {$5800.00}, was applied to your unpaid principal balance, interest due and escrow charges by your prior servicer. In reviewing our records and the documentation you provided we determined your payment, total in the amount of {$5800.00} was returned by your bank due to authorization being revoked by you because of the double draft. Therefore, the application of these funds was reversed from your loan and returned to your prior servicer. '' o This statement is incorrect on many levels. I did not make a payment to Nationstar for that amount on that date. Therefore, it is blatantly false that the payment was revoked by me for any reason. A double payment was made to XXXX before the move to NS. Those payments were NOT revoked at any time. Documents from XXXX and my bank provided to NS. XXXX : When I go to pay normal mortgage payment of {$2900.00} online, the statement the Amount due is {$9000.00} ( see XX/XX/XXXX and XX/XX/XXXX mortgage statements ) Nationstar states that I had not made payments for XX/XX/XXXX and XXXX Case opened with XXXX XXXX Department XXXX XXXX Bank statements provided showing XXXX payments for XXXX XXXX and XXXX XXXX Copies Confirmation of payments from website provided XX/XX/XXXX I receive a letter " Research Reference # XXXX '' from XXXX stating that " a credit correction was not necessary at this time '' and that " while you are participating in the Trial Period Plan '' I had never been notified, nor agreed to any Trial Period Plan NS offers to " help '' by offer me a refinance, a new 40 year mortgage at 6.5 % with the continued trial payment of {$2600.00}. This offer was also rejected by me. Package sent certified, signature required, return requested to NS office containing all documentation they have requested and more documentation of issue.XX/XX/XXXX My XX/XX/XXXX mortgage statement XXXX XXXX : {$9100.00}. See " Past Payment Breakdown '' my payment of {$2900.00} is " unapplied '' and only reflects the " Trial payment '' of {$2600.00} Note Principle balance of {$360000.00} XXXX XXXX Principle Balance {$370000.00} XX/XX/XXXX Principle Balance {$370000.00} This is only some of the issues that I can document. I can provide a more detailed timeline. I have everything documented. We have been trying to refinance and because of XXXX accounting we have been unable to. This has been costing us approx {$1000.00} a month ( which we could save with a refinance ). We are at our wits end on how to resolve this. BBB case and case with Attorney General Texas has not resolved the problems. What do we do???

Consumer Complaint: Nation star failed to do an initial assessment on my mortgage account.In turn, I became behind on my escrow account.To catch up on my escrow account, I paid Nation star $ XXXX has harrassed me everyday with multiple phone calls stating that I still owe them a monthly mortgage rate of XXXX, XXXX rather than the XXXX that I previously paid. I was told by a representative by the name of XXXX XXXX that my mortgage would increase around {$60.00} a month.I continually get hung up on the phone with Nation star and am at my wits end. I have spend hours upon hours trying to get this rectified with them on the phone ( my time/money ). They should be put out of business. At present, the " XXXX XXXX XXXX '' named XXXX XXXX refuses to call me back. I have reported Nationstar to the XXXX and he instructed me to call him with questions. His phone number XXXX has a voicemail that states he is not accepting calls and the only option is to get transferred to another customer service representative. Currently, Nationstar has readjusted my mortgage to an amount of XXXX and some change. I agree to pay this amount based on calculations from my increase in property tax and homeowners insurance. I received a statement in the mail stating that I owe Nationstar another {$4400.00}! I have no idea of where this calculation is coming from ... This is a copy of XXXX 's latest response to me on XXXX/XXXX/16 with my response : XXXX/XXXX/2016 WEB XXXX RECEIVED BUSINESS ' REBUTTAL RESPONSE : After a review of the account, no error was found. As previously stated, the account was past due when the funds of {$3400.00} were received. Due to the delinquency, the funds were applied to your XXXX XXXX mortgage payment rather than your escrow account. When an account is delinquent, any funds are sent to payments first and then, once the account 's current, any remaining funds are applied to other fees and charges remaining on the account. Since the funds were applied to the payment, the escrow analysis reflected a shortage. On XXXX/XXXX/2016, the loan transaction history was adjusted in order to reverse the mortgage payment and reapply it to the escrow account, per your request. In addition, we have removed the most recent escrow analysis that reflected the shortage. As of XXXX/XXXX/2016, the account is due for the XXXX/XXXX/2016 payment of {$3300.00}. The statement you recently received for XXXX 2016 does show a payment amount of {$4400.00}. However, there is a credit of {$1100.00} in the suspense account, allowing us to accept a smaller amount to complete the XXXX 2016 payment. Please note the payment history appears to be reported accurately to the main credit repository agencies ( XXXX, XXXX, and XXXX ). If you have documentation that substantiates that any of the information reported by Nationstar on the credit report is incorrect, please provide the detailed information for review.
