Consumer Complaint: To Whom It Might Concern, I am a XXXX XXXX XXXX owner of XXXX XXXX XXXX XXXX XXXX XXXX, CA XXXX. After about 1 year battle with Nationstar, we finally received a letter for an approved trail payments for the three months XXXX, XXXX and XXXX, XXXX. We immediately sent in the months Trial payments for XXXX and XXXX payments to Nationstar from my XXXX account in the amount of {$2900.00} ( please see the attached evidence ). On XXXX XXXX, XXXX, I wired the XXXX 's Trial payment in the amount of {$1400.00}. As you can see, I paid all three of my payments trail on time or before it was due. Therefore, I received the Loan Modification Agreement in late XXXX. I then Signed document in front of the Notary and sent it back to Nationstar, with Fed Ex tracking XXXX showed Nationstar received it on XXXX XXXX, XXXX at XXXX XXXX. On XXXX XXXX, XXXX, I called Nationstar to make a XXXX 's Payment but XXXX, a Nationstar Rep Said she can not accept the XXXX 's payment due to Nationstar did not receive XXXX Payment. I was surprised and request her open the case for searching XXXX Trial Payment. XXXX said to Email and fax in the evidence of XXXX wire for XXXX Trial Payment to XXXXXXXXXXXX and I did. XXXX XXXX, XXXX, I received letters dated XXXX XXXX, XXXX from Nationstar confirming the receipt of XXXX 's Trial payment but the payment was applied to XXXX 2015 monthly contractual payment. I was confused of what the heck Nationstar is doing, that trial payment of {$1400.00} was never meant for XXXX XXXX payment, I called in right away to ask them to apply the payment to the right month : XXXX 's Trial Payment. On XXXX XXXX, XXXX, I did not see Sale date move back so I called Trustee to move it back and they asked me to send in the evidence of XXXX Wiring. After emailed XXXX the same docs that I have send to Nationstar research dept, they moved the Sale date from XXXX XXXX Sale Date to XXXX XXXX Sale Date. Nationstar made it as difficult as much as possible for an old lady like me to keep my own home and it is non-compliant of how they do it. Begin of XXXX, I certify mail the XXXX 's and XXXX 's payment while waiting for the correction. Recently, I just received a denial letter from Nationstar dated XXXX XXXX, XXXX that the reason of denial is I did not make the required Trial Period Plan payment. I professionally request the help of Consumer Finance Protection Bureau to please request Nationstar to be compliant. They have received all 3 months of trail payments and sent us the Loan Modification Agreement to sign and notarized and sent back to them and then they reject our mortgage payment and put the subject property in foreclosure sale date. How is this possible? Please review all the documents attached evidently proof that Nationstar Mortgage wrongfully foreclosing my property. They received mortgage payments and signed Loan Mod Agreement and then reject mortgage payments for XXXX. This is such a contrary.

Consumer Complaint: Nationstar Mortgage They took over our loan in 2015. Immediately started calling and saying we were late on our payments. At this point they are reporting that we are 3 months behind but we have proof of payments. They sent us to research department, but could only contact through uploading documents. They said that their research is correct and we are late. They keep offering ( through letters ) to do a loan reset. When we actually talk to someone they deny it. They keep offering to assist us to get our loan up to date, but deny all options. They keep sending us letters of foreclosure.

Consumer Complaint: As a result of my home owner bill of rights being violated I never received a approval or denial. I was forced into filing BK ch XXXX to stop Nationstar from taking my home from me. Had I dealt with a team of people that knew what the other one was doing my file would have made it to underwriting.I never just had one point of contact. Guaranteed single point of contact : Homeowners are guaranteed a single point of contact as they navigate the system and try to keep their homes - a person or team at the bank who knows the facts of their case, has their paperwork and can get them a decision about their application for a loan modification.

Homeowners assert within this complaint, that Nationstar filed into XXXX separate Federal Court cases involving Homeowners XXXX different Promissory Notes ( Note ), XXXX Note being XXXX pages long and in another later case XXXX pages long, to fit an agenda, this alone is an unconscionable act of altering a contract, therein a Breach of Contract ; 2. This egregious Breach of Contract sets the stage for including but not limited to CPA violations ; 3. Homeowners understand that your jurisdiction covers Nationstar, this complaint is directly related to Nationstar ; 4. Homeowners assert : It appears Nationstar have committed a Breach of Contract, for Nationstar are allegedly in unlawful possession of Homeowners Note ; 5. Given XXXX never held the Note, therefore XXXX lacked beneficiary standing ; 6. Moreover, what Nationstar stand upon, ( allegedly holder of the Note and DOT ) how is it then XXXX on the Deed of Trust can assert it is the Beneficiary ( when it never held the Note, therefore a NON beneficiary ) and without the requisite authority proceed to transfer the Note and DOT to Nationstar ; 7. Moreover, what Nationstar stand upon, ( allegedly holder of the Note and DOT ) how is it then XXXX on the XXXX Assignment [ s ] of Deed of Trust can assert it is the Beneficiary ( when it never held the Note, therefore a NON beneficiary ) and without the requisite authority proceed to transfer the Note and DOT to Nationstar ; 8. Moreover, what Nationstar stand upon, ( allegedly holder of the Note and DOT ) how is it then XXXX on the Loan Modification can assert it is the Beneficiary ( when it never held the Note, therefore a NON beneficiary ) and without the requisite authority proceed to amend the DOT in favor of Nationstar ; 9. XXXX a non-holder without the requisite True Beneficial Interest to assign, was NOT in physical possession of the Note, to then assign the Note to Nationstar is an unlawful assignment/transfer ; 10. Moreover, Nationstar never received the alleged Note from XXXX, Therefore, Nationstar do not hold Delivery or Transfer documents as such relative to having received the Note from MERS therefore without said bona fide documentation, Nationstar lack standing to assert lawful holder of the Note status ; 11. XXXX failed to be a True Beneficiary, therefore XXXX had no standing to assign the Note in favor of Nationstar ; 12. The XXXX assignment ( s ) on the county record in favor of Nationstar appear to be invalid ; Therefore the XXXX Assignments of Deed of Trust were assigned in error ; 13. Therefore the fact of the matter is Nationstar has never held a True Beneficiary status as is required under the DTA, because it was assigned by an impotent non- beneficiary : XXXX ; 14. Rendering Nationstars appointment of XXXX as a nullity. The pending Notice of Trustee Sale ( NOS ) that Nationstar have caused XXXX to be recorded is a nullity and therefore void ; 15. In the Foreclosure Mill Industry it is called the 'Ta Da ' method of patching up or manufacturing documents in order to fill missing links in the chain of title ; 16. The XXXX XXXX report indicates that XXXX transferred to Nationstar : 'Transfer Seasoned Servicing Rights ' on or about XX/XX/XXXX. ( See : Ex A ) ; 17. Nationstar had caused to be recorded into a Federal Court Case No : XXXX dated XX/XX/XXXX in this case is a declaration of XXXX XXXX ( XXXX ), Document XXXX. " ... Consumer Complaint: Nationstar XXXX XXXX XXXX & XXXX XXXX XXXX XXXX XXXX, XXXX XXXX XXXX XXXX Yet another complaint against Nationstar for the fraudulent fake auctions, made up values, and belief that they are not required to adhere to XXXX and FDCPA guidelines. Honestly, when will the CFPB actually do something about this organization? Nationstar has run this property through their fake auction system ( in order to gain a 5 % buyer 's premium for their own personal benefit at the expense of their investor ) and surprise surprise .... No bidders. The counter offer then made to the original buyer was once again ridiculously over market value. When asked if they could explain the value -- - we were told that they do not release value information in direct violation of ECOA guidelines. When asked the last time that they had had someone inside the property to value it ... ... NO RESPONSE AT ALL. This is likely because they have not had anyone in the property and the limited pictures that they do have were given to them by us. Which raises the question .... Where did the value that they countered us at come from? They made it up and it has no basis in fact. While I know that Nationstar 's business model ( as outlined last XXXX in the XXXX ) is to defraud their investors, borrowers, and the federal government ( yes, we just caught Nationstar again defrauding the Treasury Department on a HAFA short sale and have an ongoing complaint on that file ) at some point the CFPB needs to stand up and say enough is enough. I would appreciate if Nationstar would actually complete an interior value on this property and counter the buyer appropriately ... .. I know that their goal is to attempt to get this buyer to leave so that they can attempt to run this through their fake auction again in hopes of getting a 5 % buyer 's premium ( once again at the expense of their investor ), but enough is enough.

Consumer Complaint: There is a pending foreclosures sale date XX/XX/XXXX. Despite the fact that. 1. A timely request for validation was sent to Nationstar Mortgage ( " NS '' ). ( The principal amount due, the principal balance is disputed. ) Please provide a proper ledger from the inception of the loan and mortgage with a proper chain of tittle. 2. NS is foreclosing on Loan # XXXX on behalf of XXXX National Association, As Trustee ( " U.S. Bank '' ). No record have shown that XXXX is the owner of the loan or the mortgage. U.S. Bank in 3 separate occasions have denied ownership of loan stating that they are a " mere trustee '' to the investors to the loan ( NS or XXXX have standing in this foreclosure action and it 's Authority is disputed ) see attached exhibits XXXX. The 6 year statute of limitation have expired to collect on this debt. NS 's Attorneys continue to harass me with debt collection letters. 4. Excess fees added to the loan after the loan has been accelerated are illegal. This alleged loan has been accelerated on or before XX/XX/XXXX by XXXX. ( see attached exhibit " A '' 5. NS will not assist approve a modification claiming that already had a modification. However, Modification was approved by XXXX. but was not acknowledge by XXXX after it was transferred. That resulted in voiding of the contract. XXXX later apologize but would not restate the modification instead transfer the loan to NS.

Consumer Complaint: Nationstar and XXXX XXXX XXXX, both banks hired, XXXX, who has demonstrated a consistent pattern of conduct in which XXXX, unjustly and illegally enter into a foreclosed home before the mortgage foreclosure process is completed and burglarize the home stealing everything in the house. Since XXXX was hired by the banks, the banks should be liable for their conduct through vicarious liability. Of course, XXXX should also be held accountable for their illegal misconduct. XXXX should not be able to hide behind the employment/agency curtain while pointing the finger at another party to avoid liability, after all it was XXXX and its agents and employees that have committed multiple felonies.

Consumer Complaint: Good evening, My name is XXXX XXXX and my mortgage is with Nationstar Mortgage. My home flooded in XXXX of XXXX. Your company 's Loss Drafts Dept. has been very difficult to deal with and I have consulted with an attorney to file a lawsuit for my remaining funds as well as pain and suffering due to the financial strain of being displaced and the extreme difficulty I 've had with your company. I was given money from XXXX for my contents coverage in which I used to start the rebuilding process of my home to move everything along so my family and I could return home. I was told to send all paid receipts for reimbursement and I did so. It took a month or so before I was reimbursed, but I was reimbursed and I used those funds to continue putting work into my home. I have increased the value of my home. Being that I increased the value of my home, the loss draft department is stating that they have overpaid me and the receipts I submitted does not add up to what was reimbursed which they should. Someone is not adding properly because before now everything was adding up. I had a XXXX inspection about a week and half from the date of the email in which the results stated that I needed to repair the garage, purchase closet doors for XXXX bedroom, and purchase appliances. I spoke with at least XXXX representatives as well as XXXX or XXXX supervisors explaining to them that I did not have the funds to purchase those items to finish the structural repairs. I was then told to submit invoices for the cost of the above list and they will send the funds for me to make the purchases. I borrowed the money from a family member and made the purchases to complete the repairs and submitted the receipts. The first XXXX representatives told me the reimbursement was denied because I 've been overpaid. I asked how would they send me funds to purchase the items if they are denying the reimbursement that I am requesting to pay my family member back of {$3000.00}? After speaking with multiple representatives, I was then transferred to a manager by the name of XXXX XXXX whom then told me that they would have made the check out to the store ( XXXX XXXX ) I was making the purchases from and myself to purchase what I needed which makes no sense if I had to go to multiple stores due to materials being out of stock. What if I had to go to XXXX? Who gives an invoice for sheetrock, sheetrock mud, paint, etc. That does n't make any sense. Some receipts I did not submit from having to purchase additional materials once the job started and more materials were needed because they continue to deny the request, but still asking for the receipts. I also had my garage door installed on XXXX/XXXX/XXXX and I was told to submit an invoice signed by the person installing the garage door with the companies ' letterhead when I spoke with the representative on last week. Today, XXXX tells me that he ca n't accept that invoice because my signature was n't on it and no XXXX for the company. Why is that needed for a garage door? This information was not told to me by the last representative and this is the most frustrating part. The employees for this company are not knowledgeable at all. They give misleading and incorrect information and this has been a problem throughout the entire process. I 've been told that receipts I submitted for the month of XXXX were not approved because it was prior to the date of the claim in XXXX which shows they do n't know the months of the year. I 've had to go through receipts and add everything with representatives on the phone for hours because they ca n't seem to do simple math and this is utterly ridiculous. I 'm at the point now of continuing the process with my attorney to file a lawsuit with XXXX

Consumer Complaint: Nationstar Mortgage acquired my home mortgage from XXXX on XX/XX/2016 after I made my XX/XX/XXXX payment. I was not notified of this until early XX/XX/XXXX via a letter from Nationstar dated XX/XX/XXXX which I did not receive until XX/XX/XXXX. The letter said I had a XXXX day grace period to make my first payment to them. I made my first payment on XX/XX/ They reported my first payment as XXXX days past due and because of this I do not qualify for Harp. I have made repeated requests that this be corrected and they just send me letters saying they are investigating.
