Consumer Complaint: On XXXX XXXX, XXXX, we filed for chapter XXXX bankruptcy, at the time we surrendered our house back to XXXX XXXX XXXX, previously XXXX XXXX XXXX XXXX owned our mortgage loan. In XXXX, during our chapter XXXX bankruptcy XXXX XXXX XXXX sold our loan to Nationstar Mortgage LLC on XXXX/XXXX/XXXX. Nationstar mortgage foreclosed on our house in XXXX of XXXX. Our bankruptcy was discharged in XXXX XXXX, XXXX. Now XXXX XXXX XXXX is reporting our mortgage on our credit report and Nationstar Mortgage is reporting it as a foreclosure in XXXX XXXX. Our credit score has dropped XXXX points since Nationstar Mortgage started reporting the foreclosure in XXXX XXXX. Please help us, this mortgage was included in our chapter XXXX bankruptcy and is the only reason we filed. It was our understanding that the mortgage loan was supposed to be marked in bankruptcy on our credit report. Our credit score has taken a hit with the Chapter XXXX bankruptcy ( the house loan was included in the bankruptcy ), and now we are taking another hit with the foreclosure reporting ( it is not being reported as included in the bankruptcy that has been discharged ). XXXX XXXX XXXX and Nationstar Mortgage are both reporting the same mortgage loan that was discharged in the bankruptcy on our credit report. I am attaching documentation supporting our bankruptcy. I am attaching several of our bankruptcy forms to support our story. We hired XXXX to help us with this situation and still have not seen results from any letters sent to the credit agencies. We do n't know where else to turn. We have spent many hours trying to get help with this situation. Consumer Complaint: Nationstar Mortgage LLC wrongfully continued charging MIP at approximately {$1000.00} per year after my termination date, when mortgage was scheduled to reach 78 percent of original value of property. By law, MIP should have automatically terminated not later than the termination date.12 USC 4902 ( b ) ( 1 ). I was never in default under this mortgage. Upon inquiry about terminating MIP, Nationstar responded that the " LTV must be equal to or less than 80 % '' and that I did not meet requirement to cancel mortgage insurance, stating : " In reviewing our records you do not meet these requirements, as of the date of this letter your loan to value is 77.3 % ''. Apparently, Nationstar Mortgage mistakenly believes the LTV has to be " above '' 80 %, and that I somehow had to get " up to '' 80 % LTV from the admitted existing 77.3 % LTV- which, of course, is nonsense even if the 80 % LTV were the applicable measure. In fact, the applicable standard I was addressing was the automatic termination date.12 USC 4902 ( b ) ( 1 ). Nationstar continued to wrongfully charge MIP until I closed on the sale of my home on XX/XX/2016 and paid off the mortgage in full. The mortgaged property was my principal residence throughout the term of the loan.

Consumer Complaint: In XX/XX/XXXX we approached our mortgage lender XXXX XXXX XXXX ( XXXX ). We wanted to refinance our home that we have lived in since XX/XX/XXXX. At the time we approached XXXX we were not in foreclose, we were current on all of our loan payments and we were not in distress. XXXX turned us down for a conventional refinanced mortgage loan but offered us what they explained was a NEW program for customers that were current with their mortgage but wanted to reduce their payments. We were excited about the new program unknowing that it would hurt our credit and put our home into a foreclosure situation. Our loan officer said we were accepted into the program and our payments were being reduced approximately {$540.00} per month. We were told to make this payment for three months and the new loan would be in place after that. We asked our loan officer if the mortgage came back unacceptable could we refuse it, pay back the difference and keep the original mortgage. Our loan officer reinsured us that we could do this without penalty or credit damage. After three months past, we contacted XXXX ; Our loan officer informed us that it was taking longer than expected but to keep paying the monthly mortgage at the reduced rate. After the 5th, 6th, 7th, and 8th months XXXX keep giving us the same story, it was taking longer than expected, it 's not you ( the homeowner ) but the bank that is having issues with the paperwork, XXXX instructed us to keep paying our scheduled reduced mortgage and the contract will come soon. It was on the Ninth month that the new mortgage plan finally came. The new mortgage plan was a disaster and we went from a 23 year mortgage to a 40 year mortgage with a balloon payment at the end. For obvious reasons we refused this new mortgage plan and continued with the existing mortgage. We never signed or entered into any new agreements that XXXX or Nationstar provide. No acceptance to their terms or conditions was accepted. It was only after refusing the new mortgage that XXXX destroyed our credit and sold off our mortgage to Nationstar. Once Nationstar took over the loan it went downhill from there. Nationstar would not discuss any terms or help us with the issues that XXXX left us in. We paid large fees to Nationstar that they forced us to pay to keep our home out of foreclose. All during the time while this was happening I still made my monthly payments on time, and every month with documentation of every payment. Nationstar is a debt collecting company and they also duplicated bad credit reporting from XXXX. I 'm attaching a letter from XXXX to XXXX as evidence of my complaint ; I 'm also attaching a letter from XXXX saying that they would partially correct our credit report and that it was done in error. Also I have requested a payment history on all payments made to XXXX and Nationstar. To this day I have not received any payment records nor have they corrected the errors on the XXXX credit reporting bureaus I 'm requesting that XXXX and Nationstar correct and remove all of the damaging information that 's on all XXXX credit reporting bureaus. The dates and information that they are reporting are wrong and should not be there in the first place. XXXX and Nationstar knowingly and willingly took advantage of us and should have never offered us a loan that would cause us harm to our credit and possible foreclose to our home. I believe what XXXX did was illegal and misleading, and there actions should be investigated. How many other hard working customers have they purposely for sole purpose only destroyed their credit and tried to take their home? I have personal bank records that show the history that I have made every loan payment including the trial payments on time from the beginning of the loan in XX/XX/XXXX.

I 've made all XXXX payments since being released in full and on time. However, Nationstar is now trying to collect an additional monthly payment ( {$730.00} ), late fees ( {$78.00} ), and an escrow ( {$450.00} ). The total amount they 're trying to collect is {$1200.00}. They 're claiming that it was owed to them while I was still under bankruptcy. This is against the law. I 've spoken with Nationstar on the phone 3 times to try to clear up the matter, but have yet to receive a response other than " we 'll look into it. '' They also refuse to mail me ANY documentation on the matter.

Consumer Complaint: My ARM mortgage was transferred from XXXX XXXX XXXX to Nationstar Mortgage 3 years ago. Initially it was very difficult to establish an online account. Since the account was created I have been asked to change the password several times. And every time the password has changed the amount of emails that I received and advertisement by mail regarding refinance has increased tremendously. They have also accessed my facebook account with such nonsense. Nationstar 's recent demand to sign up in the account is to provide my social security number, which I refuse. They have all my information on file, there is no need for this request. Therefore I have not access my online account for the past two months, sending my payments by mail. My request is for Nationstar 1. To stop the harrassment 2. Demands of social security number is illegal and should be stopped 3. The monthly statement is incomplete ; it does not contain the length of the loan term

Consumer Complaint: In XXXX we applied for the Keep Your Home California ( KYHC ) Principal Reduction Program ( PRP ) and in XX/XX/XXXX we received {$89000.00} in PRP funds. As part of receiving the funds we signed a note and deed of trust that was recorded in the county records. On XX/XX/XXXX Nationstar Mortgage applied the funds to our account. Shortly thereafter, Nationstar sent us a proposed recast agreement with several errors. We replied with a letter detailing the errors in the proposed recast agreement. Nationstar sent us the identical recast agreement and we again sent a letter detailing the errors in the document. Nationstar then sent us the third copy of the proposed recast that had minor changes to the amount we would owe, but still had the errors detailed in our two previous letters. On XX/XX/XXXX we sent a third letter to Nationstar again laying out the problems with the proposed recast agreement. On XX/XX/XXXX, Nationstar Vice President of Corporate Social Responsibility XXXX called me to discuss the recast agreement. XXXX stated that a signature for a recast agreement was no longer required ; that signing a recast agreement was not a requirement of KYHC and that Nationstar was adhering to the guidance provided by KYHC and the U.S. Department of the Treasury. She promised to email a document with the information. We never received the promised email and information XXXX XXXX promised to send. Our mortgage statements showed the application of the {$89000.00} to our account. In XX/XX/XXXX we applied to Nationstar for a Home Affordable Modification Program ( HAMP ) modification to our mortgage loan. On XX/XX/XXXX Nationstar approved the HAMP modification. On XX/XX/XXXX Nationstar returned the {$89000.00} in KYHC funds, removing them from our account. We never received any notice of any kind from Nationstar or anyone else suggesting that there was any problem with the KYHC PRP funds. I contacted KYHC and learned that KYHC and the Treasury require that a recast agreement be signed in order to receive funds from the program. Additionally, a borrower can not apply for both KYHC and HAMP simultaneously. Because we had not signed the recast agreement we effectively had XXXX open applications for federal programs and that mandated the return of the KYHC monies.In XX/XX/XXXX KYHC reconveyed the Deed of Trust we signed for the KYHC PRP funds. KYHC staff informed us that we could reapply for the KYHC program. By the time we had learned all the details of what had occurred, while we could reapply for KYHC and likely receive PRP funds again, we would not have been able to obtain a HAMP modification due to the termination of the program on XX/XX/XXXX. Nationstar and XXXX appear intent on forcing us into foreclosure. Nationstar has refused to work with us to resolve this, even though we have commenced litigation over their mortgage servicing violations and fraud.

Consumer Complaint: My current mortgage company Nationstar is refusing to honor the terms of a modification I received when the loan was with XXXX. As a result of this my loan has gone into foreclosure and I have a court hearing next month. I believe that Nationstar 's actions are unethical and illegal. I sent in my payments for the modification as agreed after the loan had been transferred, but Nationstar sent the payments back to me claiming they were just " partial payments. '' I tried to explain to them that I had an existing loan modification and that it had been approved by HUD since I have an FHA loan but they would not believe me and told me I had to apply for a new modification with Nationstar. When I did this I was told that I did not qualify -- because I had already recently received a modification?? I am flabbergasted and outraged at the behavior of Nationstar, who seems to want to push me into foreclosure to cash in on the insurance money instead of following the government rules and guidelines for FHA loans. I have owned this home for 12 years. We never had a problem making the payment, until I went through a separation in XX/XX/2015 and was reduced to XXXX income. At that time the loan was with XXXX and I provided all of my financial information to them and was offered a modification that allowed the late payments to be held in a silent second ( I think it is called a partial claim ) and for me to resume making payments of {$850.00} a month. I gladly accepted this agreement and made the payments as agreed. Then the loan got transferred to Nationstar and their agents would not take my payments and actually sent them back to me. When I told them I already had a modification and this was the agreed upon amount they told me I was wrong and that I would have to apply again. All during this time I could have been making payments but Nationstar refused to accept what I offered -- -- after I applied for a loan modification through Nationstar I was told that I was denied. Because I had already received a loan modification??? If I already received a loan modification why was Nationstar pretending this modification did not exist? This is the ultimate hypocrisy and unethical, immoral and illegal behavior by Nationstar. I am not asking for a handout or anything free. I am asking Nationstar to play by the rules and resolve this situation. Due to some type of internal issue or poor recordkeeping Nationstar acquired my loan and made a mistake relating to the loan modification I had received and they failed to honor this. This is a violation of the government guidelines relating to FHA government insured loans. When I tried to make payments Nationstar SENT THEM BACK. Nationstar then told me I had to apply for help again ; when I did apply I was told that I could not receive help, because I had received a modification in the past, even though Nationstar refused to recognize this when I tried to make these payments.
