Issue: Problem with a credit reporting company's investigation into an existing problem
Subissue: Their investigation did not fix an error on your report
Consumer Complaint: In XX/XX/XXXX two separate accounts for the same debt of {$100.00} from my previous rental location with XXXX XXXX XXXX appeared on my XXXX, XXXX and XXXX reports under two different debt collection agencies. One, under XXXX XXXX XXXX which has now been removed as it was correctly updated to reflect that the debt had been paid as of XX/XX/XXXX ; and the other under NATIONAL CREDIT SYSTEMS which is still present on my credit files as unpaid. I have submitted disputes with XXXX starting XX/XX/XXXX, then on XX/XX/XXXX, again on XX/XX/XXXX, and most recently XX/XX/XXXX. Each time XXXX denied my dispute claiming that the information was accurate, and in some instances of their investigation, they did not take the full 30 days to come to that conclusion nor did they reach out to me to receive the documents of my proof to make a full and correct assertion to that claim. I have emailed NATIONAL CREDIT SYSTEMS twice as it relates to this, and have not received any communication back from them either time. I've called them and was told to email them with my proof which is exactly what I did, but they have yet to respond or remove the fraudulent debt reporting from my records either. Under 807 ( 2 ) ( A ) False or misleading representations, a debt collector may not use any false, deceptive, or misleading representation as it pertains to the character, amount, or legal status of any debt. And I am aware that under 813 Civil liability, any debt collector who fails to comply with any provision of the US Code with respect to any person is liable to such person in an amount equal to the sum of any damage sustained, which, in my case, I can show that this has hindered my application for auto leasing, as well as hindering my ability to obtain credit, and small loans since this is the only present collections on record aside from my student loans. This has also caused a great deal of emotional distress as I have been faced with denials that are highly based on the fact that I have this reported collection. ( XXXX v. XXXX, XXXX )
