Its a violation of the collection practices act for a debt collector to refuse to send a fail to respond to a verification letter. Relying on an automated third-party system called XXXX is not a valid method of verification according to the Fair Debt Credit Reporting Act.

Consumer Complaint: I was contacted by XXXX XXXX @ national credit systems about debt from an apartment complex where I use to reside. I was unaware of the debt. XXXX was very argumentative. She wanted to know my credit card number. I had no idea if this was a real or a scam. She said well just XXXX it then. She refused to help me understand. she kept talking over me and then hung up. I called back and asked to speak to her manager who is XXXX at ext XXXX. XXXX explained everything to me including a break down of the payments. However, I still was unsure if this was a real company or not. XXXX said I was entitled to a copy of the lease to which I never received. I did, however, receive an itemized list of the bill. I was shocked at the charges. I made a second call to XXXX and told her I wouldn't pay for several of the charges because I had in writing from the manager the apartment would pay for portions of the debt. XXXX stated I would have to send all evidence to the PO BOX address. I told her I would make an Initial payment of {$2500.00}. I asked her what the payments would look like after that. She stated it was about {$300.00} and something per month. I said no way I could pay that much. I just had a baby and I was on maternity leave. She said ok and transferred me to XXXX x XXXX. We talk and we agreed on 2- {$100.00} payment per month with an initial payment of {$2500.00} paid that day. She asked me to call her the following Monday because i was at work and couldn't talk. Monday rolls around and she gives me the email address for my dispute documents. I went home and sent 5 emails. One email had a list of the disputes and why. The remaining 5 had additional documentation and video supporting the dispute. XX/XX/XXXX a letter was sent stating because I hadn't set up a payment plan they reported me to the credit bureaus. They threaten to sue me, garnish my wages bank levies, and property liens. ( These conversations I recorded ) I called back was sent to XXXX who wrote me the letter. I told her I didn't understand I made a payment and followed the rules. She sent me to XXXX stated she would take me off the bureaus reporting list and add the payments XXXX and I agreed on. XXXX states the emails wouldn't work and that that complex had 30 days to respond. I was then transferred to XXXX. Of course, the call dropped at this point and I had to call back ( still recording ). XXXX refuses to answer my questions. He won't tell me if the emails were sent as part of the dispute, why my account wouldn't let me in, and why I can't get a straight answer. He states its federal law to turn my account over to the bureau because I chose to dispute the charges. He states the dispute was submitted on the XXXX ( so that would have to be in XXXX ) before the documents were sent. I well past 30 days and I have heard anything from anyone. I've tried to do the right thing, but I didn't know about the debt. I didn't receive a copy of the lease. I was told in writing i was signed off the lease and do to ungodly circumstances we were told we couldn't go in the office at the complex. I received an additional letter. They reported the debt with the 3 main credit bureaus. I file a report with equafax only. The debt was reported but taken off. They are damaging my credit despite up to date payment. Consumer Complaint: I sent two pay-to-delete letters to National Credit Sytems to settle my debt of {$2400.00}. I sent my first pay-to-delete letter on XX/XX/XXXX, and requested a written correspondence letter of acceptance or denial of my offer. I received two letters from National Credit Systems dated XX/XX/XXXX and XXXX of XXXX stating that a settlement can only be made if I contact the office. I followed up with a pay to delete letter on XX/XX/XXXX and didn't receive a response. I also specifically stated in my second letter that I did not wish to be contacted via phone nor contact via phone. As of XX/XX/XXXX. I still have not received a letter in response to my second letter. Today, XX/XX/XXXX. I received 6 phone calls at XXXX XXXX after specifically stating no phone communication for this very reason. Not only are they disregarding my wishes not to be contacted, but they are not trying to settle my account in writing. I also notified them via email today to make them aware that their harassing tactics will be reported.

Consumer Complaint: National Credit Systems is reporting a collection account on all 3 credit bureaus credit reports. I sent them a letter on XX/XX/2018 asking for them to VALIDATE the debt. I also disputed the account with all 3 credit bureaus in which they stated the account was verified however I had not received any validation from them. They violated the FDCPA in which they continued to report an unvalidated debt. I sent them a follow up letter on XX/XX/2018 to advise them that they were in violation for continuing to report an unvalidated account and to advise them that they had failed to send me back required information that I requested. At this time, they have yet to send me any documentation but are still reporting this account. I am demanding them to comply with Federal law, and delete this account as they have failed to send me information to prove this account is mine.

Consumer Complaint: My husband and I moved out of the XXXX XXXX apartment complex in XXXX, Colorado as of XX/XX/XXXX, rent having been paid through the end of the month and owing no money as per the lease agreement provided to us by them. On XX/XX/XXXX I get a credit alert that they have put in a claim to collections for {$630.00} with no supporting documentation or reasons as to why or how the debt is supposedly ours. We can supply a copy of the lease agreement showing that we owe nothing upon moving out and bank records showing that rent was paid for that entire month in full. The paperwork supplied clearly states that the checked box replaces the early move out provision and the amount is blank, meaning nothing is owed if a move is conducted before the lease is up. We tried to dispute this with XXXX, to no avail. We need this removed from our credit reports as we are trying to obtain a business loan to start a new venture. After I left and return my keys, I received a bill of {$230.00} for steam clean the carpet and some garbage I left in the garbage bin. Consumer Complaint: My credit report is continuously showing a balance owed to National Credit Systems that is steadily increasing. Original creditor was XXXX XXXX. I did live here in 2012. There were some serious issues with the apartment complex ( mold, my apartment was broken into and robbed, my car was broken into twice and a homemade bomb was placed on a car in front of our building that blew the car up ). The final straw was when my apartment was broken into and robbed, I then proceeded to get a hold of the manager of the leasing company, after multiple attempts, I was finally able to reach her to explain my situation and that I no longer felt comfortable in my own home with my XXXX baby. She stated that I only had 2 months left of my lease so she would agree to let me out of my lease early as long as I was out by the end of that month, as my rent for that month had already been paid. I did as she asked and left the apartment clean before the end of the month, leaving my keys in their drop box. About 3 years later, I tried applying for an apartment complex in my local town who informed me XXXX XXXX reported I owed them $ XXXX- {$6000.00} for breaking my lease. I was never, not one time, contacted by them to have this settled from the beginning, by the time I was aware, it was too much for me to pay, as well as I felt like I wasnt responsible for this as the manager had verbally agreed I could leave with no problems. Now here we are over 6 years later and I can not find anyone to rent to me due to this and National Credit Systems is continuously increasing my balance, which I was informed is illegal. Once a debt is in collections, it should not accrue interest of any kind, is what I was told. My XXXX children and I are facing homelessness purely because of this issue. I currently work for XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX, with steady income and need housing by the end of February and this is making it extremely hard for me. I have been trying to get this dealt with for so long, on so many different occasions and have gotten no where! The balance is now up to over {$11000.00} and there is no way I can get this taken care of before XXXX, especially considering I shouldnt have owed any money to them in the first place. And, why is it steadily increasing?
