Issue: Attempts to collect debt not owed
Subissue: Debt is not yours
Consumer Complaint: I am writing in dispute of the charge from XXXX XXXX XXXX XXXX in the amount of {$8100.00}. As you can see from the attached documentation, myself, my daughter XXXX, and my ex-wife XXXX XXXX XXXX have all tried to resolve this situation with the leasing company since XX/XX/XXXX. In XXXX, XXXX XXXX was told XXXX had to request a mutual termination in writing with the leasing company. A mutual termination was explained to be a means of terminating the lease by placing another renter in the apartment. A fee of {$200.00} was to be charged to have someone placed someone in the apartment. She was further informed that there was a waiting list of applicants and it would be no problem to fill the space ; therefore, we requested that they fill the space. On XX/XX/XXXX XXXX sent the request for mutual termination via email as instructed. XXXX XXXX, the General Manager contacted XXXX regarding this request. XXXX was told she had to vacate the apartment by XX/XX/XXXX ( four days from when they spoke ) and pay the fee. On XX/XX/XXXX I moved all of XXXX belongings out and paid the final rent and mutual termination fee. See attached copy of check # XXXX in the amount of {$1000.00}. XXXX was not available when I made this payment and turned in the keys. I was given no paperwork or requested to sign any documentation. At no time during any conversations with the leasing office staff were we told if they do not fill the apartment I would be liable for the remainder of the year. Nor did anyone contact us to let us know they had not found anyone to fill the apartment. On XX/XX/XXXX XXXX received an email stating her account had a past-due balance of {$8100.00} and payment was due in two weeks. We have made several attempts to resolve the situation with XXXX and the leasing company, but it is impossible to get her on the phone. She will not email information, will only request that she be contacted. Every time an attempt is made to contact her, she is not in and we have to leave a voicemail. It is evident by the manner in which this is being handled that the leasing company has no intentions of honoring the mutual termination as previously discussed. Their lack of communication and misrepresentations of the truth are inexcusable. In XXXX email response dated XX/XX/XXXX at XXXX she states, Primary resident will need to submit a fee of {$200.00} for the process of finding a new person to sign for the remainder of her XXXX housing agreement. That fee was paid with XXXX final rent payment on XX/XX/XXXX! As further proof of their unethical business practices, the final invoice is filled with erroneous charges and inaccuracies. It is stated that the notice given date is XX/XX/XXXX, which we have email proof that XXXX requested this on XX/XX/XXXX. By dating it on XX/XX/XXXX, they have charged a {$50.00} late fee for XXXX, when she moved out on the XXXX. in addition, they are charging for cleaning and painting fees, which are included in contract when a tenant moves out. It is clear this company is taking advantage of inexperienced college students who may not know to question such charges and unethical business practices. I also called the XXXX XXXX XXXX on XX/XX/XXXX to inquire if there was any availability and they stated they were fully booked and no vacancy. They said I could provide my name for a waiting list incase someone terminates their lease they would contact me for the opening. This collection account is now causing further hardship to my family as it has delayed the refinancing of my home. I am asking that you remove this account from my credit report until a full investigation of this company and its practices can be completed. Please contact me if you need any additional documentation or information. Thanking you in advance for your assistance in this matter.

Consumer Complaint: National Credit Systems is the collection agency that is reporting inaccurate information to my credit report. I have disputed with them and through all 3 bureaus multiple times and they keep reporting that the information is accurate but refuse to provide documentation from the original creditor whom is the XXXX XXXX XXXX XXXX XXXX.I originally tried to reach out to the apartment complex myself but this complex was sold to another company and they have no record of anything. I disputed the balance they say I owe which is {$5300.00}. I've asked they send me proof of this balance and they keep sending me the last account ledger ( which is inaccurate ) from the Apartment complex prior to them being sold.

Consumer Complaint: In XX/XX/2018 I moved out of the apartment complex, " XXXX XXXX XXXX '' located at XXXX XXXX XXXX XXXX, XXXX, AZ XXXX. The address I vacated was XXXX XXXX XXXX XXXX XXXX XXXX XXXX AZ XXXX. The unit was referred to as XXXX with the unit being the letter XXXX not the number XXXX. We gave our forwarding address to the management of XXXX XXXX XXXX so that they could contact us if there were any problems. The management of XXXX XXXX XXXX never contacted any of the lease holders, XXXX XXXX, XXXX XXXX or myself XXXX XXXX XXXX. Months later I received a collection call from a company asking me to pay for damages. Our apartment was not damaged, and the XXXX XXXX XXXX was and is on my Renter 's Insurance through XXXX as a interested party. The complex could have filed a claim through Renter 's Insurance if there was a legitimate damage. XXXX confirmed that no claim had ever taken place. XXXX XXXX XXXX was non responsive to any attempts at communication. XXXX XXXX XXXX and their agent in debt recovery never took correct action after the debt was disputed. They never showed any record or proof of damages only that they had a bill from a company. I never agreed to nor did I ever see the alleged damage. Furthermore I never received an opportunity to pay damages before the debt was reported on credit. The debt collection company refused to pull the debt from my credit.

Consumer Complaint: In XX/XX/2007, I moved to XXXX XXXX XXXX XXXX, a brand new apartment complex in XXXX XXXX, FL. I signed a lease for a year. My rent for my 1 bedroom was well over {$1000.00}. I think it was $ 120- {$1300.00} a month. Im a complete germophobe, which is why Im willing to pay over {$1000.00} a month for a 1 bedroomfor a new apartment. When I moved in, there were dirt marks and other unknown stains in the tub, on the toilet, and in the refrigerator. I complained about it to the leasing office, and the told me I could move apartments but Id have to pay a moving fee. I didnt think this was fair, so I moved out of the apartments within the same month, but I was hit with a {$4000.00} fee. Currently, National Credit Systems, a collection agency, in XXXX, GA has my account. Ive tried contacting them, but they refuse to answer simple questions. I called last week to resolve the debt and a XXXX XXXX answered the phone. She wouldnt let me get out a single word. She wanted to do all the talking. When I was able to utter a word, she hung up on me. What Id like to see happen is this debt fall off of my credit report or go to another agency because the current agency is unethical and volatile.

Consumer Complaint: National Credit Systems , Inc in XXXX, GA submitted a collection account from a previous apartment I stayed in while I was filing for ch. XXXX was submitted to my credit a year later. I left XX/XX/XXXX, the collection appeared XXXX of XXXX. My ch XXXX was submitted XXXX of XXXX. I do not know why it did not include the current resident I resided in while filing but the collection account for the apartment was not included. Again, I was staying at this apartment while filing the bankruptcy. I was told by XXXX XXXX, " it was my fault the bankruptcy didn't include the apartment. '' I corrected her and stated it would not be my fault but the lawyers who submitted the information. Maybe he made a mistake or maybe he knows something XXXX XXXX and I don't. The apartment was given notice, I let them know of financial situations changing and that I would have to break the lease 2 months early. The notoriety of the apartment complex is it's own mess but XXXX XXXX, ext XXXX, who claims to be a supervisors, lacks the proper customer service skills and has a bad habit to constantly talk over you and undermine your intelligence how credit and filing collection accounts works. I tried to resolve the issue by requesting a settlement and was given a discount of {$400.00} on a {$2900.00} notice. I'm not stating the accuracy of the collection account is correct nor do I state it belong to me. I was trying to clear up my report since it's tax season and get this debt removed from the credit since its been on there since XX/XX/XXXX. You would think a collection company would prefer settlement and money for an account rather than not get paid at all. As well as the knowledge to know you catch more flies with honey than vinegar. That being said, when I asked her to see if we could come up with a better deal and submit it to her supervisors that's when her tone quickly switched over to the negative state she had. If National Credit Systems would like another chance at coming up with a better " PAID FOR DELETION SETTLEMENT '' I'm willing to handle the account with someone else. This account from my knowledge was suppose to be included in to my bankruptcy, I'm willing to pay on something I was not expecting to have to handle from XXXX but at a lower ethical rate I can afford.

Consumer Complaint: Contacted XXXX XXXX XXXX for information about leasing with them and their policy on rental history with a past eviction. Filled out info on their website and picked unit I liked then they emailed me saying I needed to complete the application with them. Stated I wanted to know beforehand if they dealt with my issue so I didnt waste money on an application. The leasing agent emailed she would check with her manager and got back saying no they didnt accept past evictions. I never stepped foot on the property and never agreed to {$260.00} in exchange for her asking the manager a question knowing my situation. Debt is sent to a collection agency and I have written letters disputing amount with both companies. Online I saw a {$65.00} app fee which was advertised as free application then once submitting payment saw a {$150.00} admin fee as well from XX/XX/18. This company ran my application after knowing it would be denied and refused to refund my fee and cancel the application after emailing with me.

Consumer Complaint: This company never notified me of regarding the collection I had in their office, which is violation of the FDCPA. I reached out to them on a voluntary basis after speaking to the original creditor and being informed by them that my balance had been submitted to National Credit Systems. I have made numerous attempts to reach out to them in order to voluntarily setup a recurring semi monthly arrangement to resolve my balance. On all occasions I have spoken with XXXX. XXXX XXXX and she has been nothing but rude and inconsiderate. She has refused to accept payment from on 4 different occasions twice of which were on a recorded line. I did advise her that the line was being recorded and expressed that I would like to set an arrangement to resolve my balance however I could not afford the amounts being offered by her. XXXX. XXXX used very aggressive and intimidating tactics in attempts to collect the balance from. She even went as far as to deadline and say that if I didnt pay my balance by XX/XX/XXXX that they would be placing it on my credit report. I question as to how this could be done when they have never even notified me of the balance being in their office and she advised that if I didnt pay by then the damage would be done. Again I know that I cant be deadline as to when this will be applied to my credit report or threaten by damaging my credit in order to coerce me to pay. This is yet another FDCPA violation.
