Issue: Attempts to collect debt not owed
Subissue: Debt is not yours
Consumer Complaint: I was a guarantor of a lease for my daughter from XX/XX/XXXX until XX/XX/XXXX. My daughter signed a new lease for XX/XX/XXXX until XX/XX/XXXX. I did not sign the 2nd lease as my daughter then had rental history and is an adult. For several months on the 2nd lease the apartment manager/maintenance entered her apartment without proper notice ( along with other unsafe practices ) where my daughter felt very unsafe and like she had no other option but to move. She moved at the end of XX/XX/XXXX after giving a 30 day notice and trying to work it out with management. The apartments have now sent her to National Credit Systems Inc. to collect the remaining balance of her lease ( {$1100.00} ). She is objecting to owing the amount due to the illegal entering of her apartment. I now have also received a collection notice from National Credit Systems. I've contacted the apartments via email ( XX/XX/XXXX ) and talked with XXXX XXXX of NCS ( XX/XX/XXXX ) relaying that I am not a guarantor for the lease period. XXXX mentioned today that since I signed the original lease I'm on the hook for all future leases and that he has reported me to the credit bureau agencies. Also, when returning my call the call ID showed a local phone number in Oregon and NCS is located in Georgia. I feel like National Credit Systems is violating not only my rights by trying to collect a debt not owed by me but my daughters by contacting me about her debt.

Consumer Complaint: Dear Collection Agency Rep. THIS COMPANY HAS REPORTED A NEGATIVE AND INVALID COLLECTION ACCOUNT ON MY CREDIT REPORT CAUSING SEVERE DAMAGE TO MY CREDIT SCORE STOPING ME FROM PURCHASING A HOUSE AND I NEED IT REMOVED IMMEDIATELY! I have thoroughly reviewed my credit report and I would like to inform you of the inaccuracies it contains I am requesting, under the provisions of the FCRA, 15 USC section 168ii, that you investigate this account. I am requesting that you provide validation of these debts. True validation should not be simply verifying the original creditor, my name, and my social security number. Validation must have the requisites to enable it to be recognized and enforced by the law. In Hinkle v. Midland Credit Management , Inc., the Courts said, during a dispute and subsequent reinvestigation, with the original creditor, collection or a credit bureau, that the original creditor or collector must provide account level documentation. That means an original contract or similar proof ; not just a printout of the payments that were made. It does not suffice. Provide me with the following : A copy of the original contract you alleged I signed. An accounting of how payments were applied. The interest that was added along with any ancillary charges. Identify the original creditor. Prove the Statute of Limitations has not expired. Provide verification or copy of a judgement if there is one. Provide licensing information that allows you to collect in my state. Per the FDCPA 1692G, all collection activity must cease until validation is supplied. Collection activity includes credit reporting. Per the FDCPA this should not be reported to an CRA until validation is provided. If you fail to comply to this request to investigate and delete 30 days from the date of this letter, I will be forced to file a complaint with the CFPB. I will avail myself to pursue all my rights of private action under the FDCPA and or the FCRA where appropriate.

Consumer Complaint: I have a garnishment by the XXXX XXXX XXXX XXXXXXXX XXXX XXXX who is collecting a past eviction debt for XXXX XXXX XXXX. XXXX XXXX XXXXXXXX has been collecting this debt since XX/XX/2019. National Credit Systems is a collection agency collecting a debt for XXXX XXXX XXXX as well, which is the same debt. NCS is reporting a balance of {$4500.00} on my credit report for this debt and XXXX XXXX XXXXXXXX is collecting $ XXXX/ Court documents. {$1900.00} has already been applied to this debt to XXXX XXXX XXXX XXXX XXXX XXXX XXXX but NCS is reporting on my credit report this same debt as {$4500.00}. I contacted the law firm who stated they have NO affiliation with this agency. I contacted NCS who stated they have NO affiliation with XXXX. The only thing both parties agreed on was not having affiliation with each other. 2 people can not collect on the same debt at the same time. This is illegal. This collection agency needs to take this off my report because I do not owe them anything. I'm court ordered to pay and has already paid 98 % of this debt already. It's bad enough I'm paying this kind of money for 1 month {$700.00} but to pay an additional {$4500.00} to a collection agency for {$700.00} is ludicrous. This debt is causing financial distress and undue hardship and needs to be removed from my report.

Consumer Complaint: I was notified by mail on XX/XX/2019 that an apartment complex had turned over a debt they claimed I owed to a collection agency ( National Credit Systems Inc, XXXX GA ). I sent a letter ( per the Federal Fair Debt Collection Practices Act ) to the collection agency on XX/XX/2019 disputing the debt and asking for more information because I do NOT owe the apartment complex any money. I do not know why they sent me to a collection agency. I asked for more information and never received it from the collection agency. I called the collection agency on XX/XX/XXXX and they stated they were doing an investigation. I have not received any communication from the collection agency in writing since I have asked for proof of the debt. However, the collection agency has reported this on my credit report and I was given a higher rate on auto insurance because of the " so-called '' collection item on my report. After that happened I decided to learn how to report this unscrupulous agency.

Consumer Complaint: I am a victim of identity theft and have been since XXXX. I view my credit report often to see if my SSN, my address and my name has been stolen. Indeed it has been again. The person who stole my identity is XXXX XXXX. He left a balance of XXXX on XXXX at an apartment complex in XXXX XXXX Florida. I have never lived in XXXX XXXX Florida or have I ever visited this city. Another way I found out about this individual is because the spelling of my first name. He uses an incorrect spelling. He also uses my maiden name. National Credit Systems is now on my credit report. I have notified the FBI, IRS, SSN, my local police office. I have made reports to all offices. This person also had bank accounts with XXXX XXXX XXXX, XXXX XXXX and also has a import/export business out of XXXX XXXX Florida. Every time I have been close to finding this person by informing these institutions of my stolen identity, this person relocates and leaves my credit in shambles. I attempted four times to call National Credit Systems. I have left messages and no one calls me back. I called again today and the representative who handles these type of cases left a message but right before the agency closed for the day. I left a voicemail again. I feel violated and I feel no one is willing to help my situation.

Consumer Complaint: I found that my credit score dropped by 47 because National credit systems INC is trying to collect a dept on behalf of apartments renting office ( XXXX XXXX at XXXX XXXX ) for XXXX . I had never received this money from the creditor.I sent both parties emails and certified mail for evidence that I owe that dept but they never replied. On the website it's shown that the collection started XX/XX/2019. I am sure they did not reply because they don't have any evidence. It shows clearly in may bank account that I had never received any money from the creditor since I opened my bank account on XX/XX/2019 till present. I want to report that false dept collection and ask the collection agency to stop sending me pre-recorded voice msgs. Also i want the damage for my credit score to be reversed.

Consumer Complaint: At this point I would like to try and get this account with National Credit Systems settled. The contract and the break down of fees I do not believe are accurate and I would agree to paying the final month rent of {$1100.00}. The lease was for one year, from XX/XX/XXXX until XX/XX/XXXX. I gave notice XX/XX/XXXX and the contract expired XX/XX/XXXX had I stayed to the end of the month that would have completed the contact. The fact that they want to charge an early termination fee for a contract that was due to expire 30 days from when I moved out and charge a 60 day notice fee is absurd.

Consumer Complaint: This company XXXX XXXX XXXX XXXX XXXX ) advised me I would be able to break my lease without penalty. They submitted false documents with the incorrect move out date, false apartment damages, and it has wrongfully affected my credit. I was told I would be able to pay an extra month and would not get my deposit back due to me breaking my lease. The apartment 's corporate office will not return phone calls after about 6 months of calls/voicemails. When I contact the apartment complex the manager response to my concerns by saying " I could tell you something but the computer will do other options ''. I moved out XX/XX/2018 and never received any notice until XX/XX/2018, which was a collection notice from a law firm. This is not fair to me and wrongfully affects my credit. I would like for this to removed from my collections. There is an influx of fraud from apartment complexes going on in XXXX now. I do not want to be affected.
