Consumer Complaint: I use to rent from XXXX XXXX XXXX their address XXXX XXXX XXXX XXXX, GA XXXX United States. When I moved out I called them to schedule a walk through but no one returned my calls. So I moved out and left the key with the receptionist at the front desk. Year go by I dont hear anything from them. Two years ago I was applying for another apartment and Im told Im in collections with National Credit System their contact number is XXXX. I called them and they said they are a law firm handling the debt I have with XXXX XXXX. I asked them what debt the read this long list. I told them theres no way Im being charged for normal ware and requested a receipt for all of the damages they were claiming as well as pictures because I left that apartment in perfect condition. I received nothing from them.

Issue: Attempts to collect debt not owed

Subissue: Debt is not yours

Consumer Complaint: The collection agency NATIONAL CREDIT SYSTEMS placed a debt that is not mine without my knowledge on my credit report back in XX/XX/2019. I requested proof of this debt to be verified from this collection agency and all 3 credit bureau agencies but no compliance which has decreased my fico score and prevents me from getting a new apartment. They have not followed the law after making 3 attempts to contact. I provided proof that I owe no money. Original creditor is XXXX XXXX XXXX AT XXXX XXXX who I also contacted but they would not resolve. I applied for an apartment with them but was declined and their paperwork stated I would be refunded {$150.00} deposits but I wasn't. Two months latest collection company NATIONAL CREDIT SYSTEMS sends me a notice saying I owe {$270.00} to XXXX XXXX XXXX when the amount to apply which I paid was {$200.00}. So they are trying to commit fraud by not only not refunding my money, but also trying to get more money then destroying my credit.

Consumer Complaint: National Credit System is attempting to collect on a debt that they claim I, my wife and roommate owe for XXXX XXXX XXXX claiming they were not giving notice of our move out. I sent them a letter requesting that they validate the debt and provide documentation that they are licensed to collect this debt. They have ignored my dispute letter which included the notice of intent to vacate that I sent to XXXX XXXX XXXX and are now threatening to report this debt on my credit report and the credit reports of my wife and former roommate if I do not pay them immediately. They claim they did not receive the dispute letter I sent but I have proof that a representative of theirs picked up the letter and signed for it at the PO Box they instructed my to send a dispute letter. They have also ignored my verbal requests for the documentation validating that this debt is valid and that they are properly licensed to collect it.

Subissue: Debt is not yours

Consumer Complaint: I, along with 3 other roommates rented a 4 bedroom apartment at XXXX XXXX XXXX XXXX, XXXX, Illinois XXXX from XXXX XXXX XXXX ( XXXX ) in year XXXX. I signed here as I am a XXXX at the University XXXX XXXX, XXXX ( XXXX ). The four of us signed a joint lease with a rent charge of $ XXXX/month each. The lease was from XX/XX/XXXX to XX/XX/XXXX. I also paid a security deposit of {$540.00}. The total security deposit paid for the entire apartment by all four of us was {$540.00} x 4 = {$2100.00}. In XX/XX/XXXX, I signed a lease with XXXX for another apartment in the same building for XXXX XXXX XX/XX/XXXX. The lease was a joint lease with 2 of 3 of my previous roommates. We signed to pay a rent of $ XXXX/month. XXXX asked us to pay the difference of our old rent ( {$540.00} ) and new rent ( {$650.00} ) as the security deposit. Thus, each one of us paid $ XXXX $ XXXX {$100.00} for the deposit, in addition to the {$540.00} they already had as a deposit. In total, I had paid {$650.00} for my security deposit with XXXX. In the middle of this XXXX XXXX-XXXX XXXX lease, the apartment complex was bought by a new property management company, XXXX XXXX. We were told that the signing of our next XXXX XXXX-XXXX XXXX lease is still valid, as all previous leases would be transferred to XXXX XXXX. In XXXX of XXXX after move-out, I received a charge of {$670.00} from XXXX XXXX, citing cleaning charges, carpet replacement, and repainting. This charge was for the full apartment of 3 people, and yet I was the only one to receive it. The charge per person should have been $ XXXX/3 = {$220.00}. We returned the apartment in the same condition we received it. For using this apartment of 1 year, the charge of ~ {$670.00} seems excessive and unilateral. Additionally, I have photographic evidence of damaged carpet during move-in, which XXXX XXXX is attempting to charge us for. I have yet to receive my security deposit of {$650.00} back. XXXX XXXX, as per the law, is supposed to send the deposit back within 15 days of move-out. However, it has been 5 months and still my deposit has yet not been returned. Instead, on XX/XX/XXXX, I received a letter from the National Credit Systems Collections Agency stating that I owed a debt of {$670.00} ( the full apartments cleaning charges ) to XXXX XXXX, which is factually incorrect. Instead of giving me my deposit back, I was charged the cleaning charges for the full apartment which is again incorrect. I sent the National Credit Systems a description of what had occurred to no response. I also tried to talk to various employees but left to only leave voicemails that were never returned. I tried to resolve this issue by speaking to the property manager of XXXX XXXX on XX/XX/XXXX. He assured me that he will get back to me by XX/XX/XXXX with resolution. However, as usual, XXXX XXXX property managers have failed to get back to me in a timely manner and resolve the issue.

Issue: False statements or representation

Subissue: Attempted to collect wrong amount

Consumer Complaint: Hello there, Please be so kind to review the documents submitted. We have attempted multiple times between my husband and I to resolve this billing error and pay the rightful amount, but we have been met with hostility and refusal to review actual binding documents. We have included the Final Account Statement provided by National Credit Systems, the Apartment Lease Contract and our bank statement showing the {$1000.00} had been paid. The Apartment Lease Contract stated {$1000.00}, due on or before the date this lease contract is signed is a concrete proof showing that we have paid {$1000.00} deposit due before move-in. We discussed this point with the National Credit SystemsXXXX XXXX XXXX XXXX representatives multiple times, but they refused to take this binding document seriously which is ironic for a law firm. They have hung up on us multiple times and yelled at us Pay your bill when were trying to make a point that theres an accounting error that must be corrected first before we pay. The last document is our bank statement which shows {$1000.00} used to pay for the deposit as outlined by the contract before move-in. {$1000.00} should have been credited to the bill rather than {$500.00} showing on the bill. The difference is the amount we will pay, {$170.00}. We have told them that were willing to pay but it has to be the correct amount and they showed no interest in resolving this so we are hoping that you all will be able help us rectify this situation. Thank you for your time.

Consumer Complaint: I have been accused of being evicted from an apartment community that I have NEVER lived in. XXXX XXXX has reported an eviction on my credit report since XX/XX/2016. Again I have never stayed in this community. The also gave my information to a company ( National Credit Systems ) without my permission and they continue to destroy my credit report with a collection. I have tried to speak with them on this matter but no one seems to want to help or show any documents roving that I was evicted from an apartment community called XXXX XXXX in XXXX N.C.

Consumer Complaint: In XXXX/XX/XX/2019, not sure of the exact date. I called and spoke to the law office that was assigned by National Credit Systems for a XXXX XXXX account. When i called in the representative for the law office provided account details and tried to collect on this debt before they provided the mini miranda which is required by law. It wasnt until i mentioned this about 5 mins into the call where they tried to recite it. They stated many times " Good Luck with your housing '' knowing this was on my credit .... Due to the Violation of the FDCPA by not reciting the Mini Miranda. They need to close and remove this account from all three of the credit bureaus.

Subissue: Attempted to collect wrong amount

Consumer Complaint: While under lease with a particular apartment complex ( XXXX XXXX XXXX ) in XX/XX/XXXX, my unit was broken into and I was robbed of my personal belongings and also robbed of my peace of mind. What was more concerning to me besides my safety, was the future security of my home. The majority of the frame of the door fell completely inward as I returned home from the gym that Saturday evening to see the damage that had been done. I called police to the scene only to be given a police report ( that I no longer currently have due to misplacement over time ). The incident happened on a late Saturday evening which meant I could not report the incident to the leasing office of the apartment complex until the following business day. Once they opened, I was able to describe the actions that had taken place the previous Saturday. We were told by the office staff that there was nothing they could do about the robbery and as for the door frame, ( which made the unit impossible to live in ), we would need to put in a work order which they were 'already backed up on '. With no other options, I packed my things and left the unsafe unit with plans to dispute the matter at a later time. Within maybe a couple of weeks after moving out due to the unforeseeable circumstances, I returned to the apartment complex to dispute said matter. It was at that point I was informed that the apartment complex had a new office staff and shortly after, was under new management. At this time the apartment complex had changed their name and updated management information online etc. The new apartment complex and management company implied that that issue was not with them but instead the previous management company. I was not sure what to do at that point, but after trying to get another lease with another apartment, I was I was declined for reasons related to 'bad rental history '. I checked my credit report only to see that an outstanding balance of {$1300.00} had been sent to a collections agency, ( XXXX XXXX ) opened on XX/XX/XXXX. This was an issue because I was not able to properly dispute the matter related to the balance of {$1300.00} before it was a derogatory mark on my personal credit report. I reached out to the management company ( XXXX XXXX or according to my credit report : XXXX XXXX XXXX XXXX XXXX ), who was responsible for sending this debt to collections. I had intentions to resolve the matter. I was then informed that the issue needed to be resolved/disputed with ( XXXX XXXX ). I contacted ( XXXX XXXX ) and they were not budging nor did they seem to understand my issue. Things became discouraging because I felt that this balance was unfair to me and my credit life. On XX/XX/XXXX another outstanding balance was opened up on my credit report by ( NATIONAL CREDIT SYSTEMS ) that has a current balance of {$2000.00}. The original creditor for this balance according to my credit report is ( XXXX XXXX XXXX XXXX XXXX XXXX ). " XXXX XXXX XXXX XXXX '' is the newer name off the apartment complex. The management company for " XXXX XXXX XXXX XXXX '' is ( XXXX XXXX XXXX ). I then contacted ( NATIONAL CREDIT SYSTEMS ) by phone to resolve the matter. I asked the phone associate why do I have two separate balances related to the same incident on my report, and they implied that this balance was sold to them and that the balance of ( {$2000.00} ) was the only balance they were aware of. However according to my credit report, I have two separate balances, opened by two separate collection agencies, from two separate " original creditors '' for the SAME incident. I have tried for so many years to resolve these issues and it has been hectic and unfair for me. This process of submitting a complaint was recommended for me to resolve this issue as it is a very unique issue. I am praying this process can help. Unfortunately I do not have anything tangible to attach, however, I feel this issue can be resolved nonetheless. Please and thanks in advance.
