Issue: Attempts to collect debt not owed
Subissue: Debt is not yours
Consumer Complaint: According to XXXX, I owe {$8200.00} to the XXXX XXXX in XXXX. This is unfair since I never lived in XXXX XXXX XXXX. I should not be owing anyone money. Apparently this debt has been going on since XXXX XXXX, 2018. I am unsure if this is a case of identity theft or someone messing with me. I've asked around, especially the banks where I have an account for guidance in resolving this matter. My credit score has taken an unnecessary hit and I've been unable to make any purchase that would require good credit history, like a car.

Consumer Complaint: We were given XXXX XXXX days to move out of our apartment. We BARELY had time to move out, and we had absolutely no time to clean at all. We were told that if we didn't turn in our keys when we did, they were going to call the police on us to evict us. We were NOT given a form to fill out about the condition of the apartment when we moved in. They are trying to very unfairly try to charge us almost {$1000.00} and there's NO EXCUSE for it!!! They've put it on my credit report. I have proof of emails that I sent to them saying that we never received a form to fill out about the condition of the apartment when we moved in. Also, once we turned in our move out notice last XXXX, they completely REFUSED to do any maintenance to fix anything at all!!! I have proof of those requests that they canceled. I NEVER CANCELED ANY MAINTENANCE REQUESTS AND I ALSO HAVE EMAILS TELLING THEM THAT I DIDN'T CANCEL ANY MAINTENANCE REQUESTS. I took screen shots of them with my phone. I also could NEVER get any maintenance request addressed while we were living there until after I called the corporate office in XXXX XXXX. EVERY SINGLE TIME!!!! XXXX, getting our breaker box replaced, which the owner of a local appliance store came to my apartment and told me that they had hooked up my washer and dryer correctly and that the breaker box needed to be replaced. I have their emails confirming that they informed the office about our breaker box needing to be replaced, but they REFUSED to replace it for about 3 months, until my next door neighbor told me that the only way that they would fix anything is if I called the corporate office in XXXX XXXX. Then they FINALLY replaced the breaker box in our apartment. But in the mean time, I had to go to a laundry mat every weekend to do our laundry because my dryer wouldn't work because they refused to replace the breaker box for about 3 months, and it cost me about {$25.00} each weekend to do our laundry. They also don't have a laundry facility on the property. They are trying to steal almost {$1000.00} unfairly from me for nothing. It was an absolute NIGHTMARE living there!!!! XXXX night our toilet overflowed XXXX weekend and our hallway was covered in toilet water. They did NOT have their emergency maintenance line working. We had to wait until the next Monday to get it addressed. They overcharged us for our water bill because they refused to fix water leak issues, which I have proof of as well. They were the worst apartment complex that we've ever lived in and we've lived at XXXX different apartment complexes before living at XXXX XXXX apartments. They were constantly changing the staff and management in the office, so no one knew what was going on. As I said, the apartment complex is XXXX XXXX Apartments. Their address is XXXX XXXX XXXX in XXXX, Texas. The corporate office is XXXX XXXX XXXX. They're at XXXX XXXX XXXX, XXXX XXXX, TX XXXX. Their number is ( XXXX ) XXXX. Any information that the previous apartment manager gave them or pictures probably weren't even our apartment complex. They have {$950.00} on my credit report, claiming that I owe them for nothing. They are extremely shady and dishonest people!!!! I've disputed their claim on my credit report multiple times, providing lots of proof, but the debt collector refuses to remove it from my account, even with all of my proof.

Consumer Complaint: I have attempted to contact the original rental company, debt collection agency, FTC and credit bureaus to remove this debt collection. It still is being associated with me despite having absolutely no connection to this debt. I have provided extensive documentation to prove that I have never lived at the address where this debt is owed.

Consumer Complaint: I am writing to report a violation of the Fair Debt Collection Practices Act ( FDCPA ) by NATIONAL CREDIT SYSTEM, who failed to provide verification of a disputed debt and continued collection efforts without supplying the required verification. as Pursuant to my rights under the Fair Debt Collection Practices Act ( FDCPA ) 809 ( b ), I dispatched a certified mail dispute letter to NATIONAL CREDIT SYSTEM on XX/XX/2023, within the XXXX-day validation window, demanding verification of the alleged debt. This action was taken to formally contest the legitimacy of the debt and to seek definitive proof to substantiate their claims. A copy of the dispute letter and the certified mail receipt, affirming its delivery, are consolidated in Attachment. Contrary to the mandates of FDCPA 809 ( b ), which necessitates the cessation of collection activities until the debt is verified, NATIONAL CREDIT SYSTEM has not provided the requisite verification as of XX/XX/2023 and has perpetuated their collection endeavors, inclusive of validating the debt with XXXX without validating the debt with me on XXXX witch is a clear violation of 15 U.S.C. 1692g ( b ) Validation of Debts which states : " If the consumer notifies the debt collector in writing within the thirty-day period described in subsection ( a ) that the debt, or any portion thereof, is disputed, or that the consumer requests the name and address of the original creditor, the debt collector shall cease collection of the debt, or any disputed portion thereof, until the debt collector obtains verification of the debt or a copy of a judgment, or the name and address of the original creditor, and a copy of such verification or judgment, or name and address of the original creditor, is mailed to the consumer by the debt collector. This non-compliance has engendered my process of getting funds for my business or any type of help credit wise and precipitated significant emotional distress, a byproduct of the unwarranted and legally nonconforming collection attempts

Consumer Complaint: Subject : IMMEDIATE Removal of Fraudulent Account from XXXX XXXX XXXX NATLCRSYS , Account # XXXX To Whom It May Concern, I am writing to notify you that National Credit Systems , Inc. is continuing to furnish a fraudulent account on my XXXX Credit Report. On XX/XX/XXXX, I communicated to National Credit Systems , Inc. and all 3 credit reporting agencies that the account appearing on my consumer report as NATLCRSYS, Account # XXXX, opened on XX/XX/XXXX, with a reporting balance of {$2200.00}, was a result of identity theft, and I did not provide written permission or instructions for the identified transactions to be reported on my consumer report. Pursuant to Section 605B of the Fair Credit Reporting Act ( FCRA ) ( 15 U.S.C. 1681c-2 ), I formally requested that the fraudulent account be blocked and deleted from my consumer report. In that request, I provided all the necessary documentation required by the FCRA to support my dispute and the removal of the fraudulent account. Despite my efforts, upon reviewing my most recent XXXX consumer report, I found that the fraudulent account is still being reported. Moreover, National Credit Systems , Inc. has failed to provide me with any documentation to validate this fraudulent debt or any documentation to support their claim that I owe this money pursuant to the Fair Debt Collection Practices Act, 1 : USC 1692g Sec 809 ( b ). To further clarify, the Fair Debt Collection Practices Act, 1 : USC 1692g Sec 809 ( b ) requires that if the consumer notifies the debt collector in writing within the thirty-day period described in subsection ( a ) that the debt, or any portion thereof, is disputed, or that the consumer requests the name and address of the original creditor, the debt collector shall cease collection of the debt, or any disputed portion thereof, until the debt collector obtains verification of the debt or any copy of a judgment, or the name and address of the original creditor, and a copy of such verification or judgment, or name and address of the original creditor, is mailed to the consumer by the debt collector.

Consumer Complaint: I had been working with XXXX XXXX in house XXXX XXXX Department for a couple of months to resolve a past due rent balance and keep this debt from going to a 3rd party outside collection agency. Some point during the months I had making payments., National Credit Systems , Inc had contracted me about this past due balance- stating that I had not made suitable arrangements to pay this debt. In response I told them that I'm disputing this debt entirely and requested debt validation under the fair debt collection practices act. It has been over 3 months since they received the letter and to this day, I had received no supporting documents that proof that this debt as mine and they still continue to pursue collection activity including reporting this debt on my credit reports!
