Consumer Complaint: I have sent demand letter requesting signed information to show me where it states on my lease that a tenant is responsible for what they are claiming I need to pay for such as : paint and carpet cleaning. I lived in this apartment for 4 years and in Nevada that is nothing more than normal wear and tear. I have read through my lease and nowhere does it state a tenant is responsible to pay a fee for carpet cleaning and paint upon move out. Not to mention they also kept my security deposit as well. Consumer Complaint: Dear Consumer Financial Protection Bureau Consumer Complaint Division, I am submitting a formal complaint against the National Credit System, outlining their alarming failure to validate a debt within the mandated timeframe and their deliberate dissemination of inaccurate, inconsistent, incomplete, and unverifiable information to credit reporting agencies ( CRA ). This has not only resulted in a detrimental drop of over XXXX points in my credit score but also raises serious concerns about the National Credit System 's engagement in deceptive practices and potential fraud. The Fair Credit Reporting Act ( FCRA ) is explicit in its requirements for debt collectors to adhere to specific actions before furnishing information about a consumer 's debt to a credit reporting agency. It is evident that the National Credit System 's actions not only violate the FCRA but also constitute a clear violation of the Fair Debt Collection Practices Act ( FDCPA ) and the Dodd-Frank Act by engaging in unfair, deceptive, or abusive debt collection practices. The National Credit Systems reporting of data to CRAs lacks proper documentation, a blatant disregard for the FDCPA and FCRA. Their failure to produce valid documentation supporting the alleged debt, coupled with multiple inconsistent changes in the reported information, suggests a deliberate attempt to deceive and defraud. The reported final bill associated with the alleged debt has undergone XXXX changes since XX/XX/XXXX ( e.g., {$15000.00} to {$14000.00} to {$15000.00} back to {$14000.00}, etc. ). In accordance with my rights under the FDCPA, I requested proof of the debt from the National Credit System, specifically all XXXX final billing statements from XX/XX/XXXX to XX/XX/XXXX, covering the entire length of the alleged lease. Please take a moment to review the enclosed copy of XXXX of the final billing statements, which astonishingly only provide XXXX months of billing history. Shockingly, they were unable to produce these crucial documents, suggesting intentional misconduct to defraud me. Additionally, my request for a comprehensive explanation of the frequent changes in the balance during that period and access to the terms of the lease agreement to understand the basis for charges and any circumstances leading to adjustments in the balance went unanswered. The National Credit System 's intentional non-compliance with these requests not only questions the accuracy but also the legitimacy of the reported debt. Additionally, the National Credit System has failed to comply with the FDCPA, as outlined in 12 CFR 1006.34 ( c ), by not providing the required information regarding the alleged debt : Debt Collector Communication Disclosure ( 12 CFR 1006.34 ( c ) ( 1 ) ) : Provide the disclosure required by 12 CFR 1006.34 ( c ) ( 1 ) pertaining to debt collector communications. Information About the Debt ( 12 CFR 1006.34 ( c ) ( 2 ) ) : Furnish detailed information about the debt as mandated by 12 CFR 1006.34 ( c ) ( 2 ). This includes a comprehensive breakdown of the alleged debt, including all relevant dates, amounts, and the original creditor 's details. Consumer Protections Information ( 12 CFR 1006.34 ( c ) ( 3 ) ) : Include the information about consumer protections as outlined in 12 CFR 1006.34 ( c ) ( 3 ). This disclosure should encompass any rights and protections afforded to consumers under applicable laws. Consumer-Response Information ( 12 CFR 1006.34 ( c ) ( 4 ) ) : Provide the consumer-response information required by 12 CFR 1006.34 ( c ) ( 4 ). This includes details on how I may respond to the validation information provided and address any discrepancies. I bring to your attention the doctrine of estoppel by silence, established in Engelhardt v. Gravens ( Mo ) 281 SW 715, 719. The National Credit System 's failure to fulfill my request for proof within the stipulated time frame may reasonably be interpreted as an indication that no evidence of the alleged debt exists. This raises grave concerns about their deceptive practices and potential fraudulent conduct. I have the right to make sure my private information isn't shared which is backed by 15 USC 6801 which states " It is the policy of the Congress that each financial institution has an affirmative and continuing obligation to respect the privacy of its customers and to protect the security and confidentiality of those customers nonpublic personal information. '' ( Furnisher of information to credit agencies ) is a financial institution by definition under that title. 15 USC 1681 section 604 a section 2 states that " In general Subject to subsection ( c ), any consumer reporting agency may furnish a consumer report under the following circumstances and no other : in accordance with the written instructions of the consumer to whom it relates. '' ( Furnisher of information to credit agencies ) the financial institution and the Consumer reporting agencies XXXX and XXXX do not have my consent to furnish this information and they surely do not have my written consent. Any and all consent to XXXX, XXXX, ( Furnisher of information to credit agencies ) whether it be verbal, non-verbal, written, implied or otherwise is revoked. 15 USC 6802 ( b ) ( c ) states that " A financial institution may not disclose nonpublic personal information to a nonaffiliated third party unless the consumer is given an explanation of how the consumer can exercise that nondisclosure option. '' ( Furnisher of information to credit agencies ) Never informed me of my right to exercise my nondisclosure option. Not only that 15 USC 1681C ( a ) ( 5 ) states '' Except as authorized under subsection ( b ), no consumer reporting agency may make any consumer report containing any of the following items of information Any other adverse item of information, other than records of convictions of crimes which antedates the report by more than seven years. '' This account is an adverse item they are reporting again without my permission which is against the law XXXX and XXXX are consumer reporting agencies and I am the Consumer According to the Fair Credit Reporting Act 15 USC 1681 section 602 a states There is a need to insure that consumer reporting agencies exercise their grave responsibilities with fairness, impartiality, and a respect for the consumers right to privacy.15 U.S. Code 1681s2 ( A ) ( 1 ) A states " A person shall not furnish any information relating to a consumer to any consumer reporting agency if the person knows or has reasonable cause to believe that the information is inaccurate. 15 U.S. Code 1681e states '' Every consumer reporting agency shall maintain reasonable procedures designed to avoid violations of section 1681c of this title and to limit the furnishing of consumer reports to the purposes listed under section 1681b of this title. Consumer Complaint: None of the options offered pertain to my situation, but I received a notice from National Credit Systems about a debt that was incorrect. A storage company, XXXX XXXX, claimed that I did not give them 30 days notice before vacating and demanded a payment for an additional month. I, in fact, gave them 60 days notice and I had an email and letter to prove it. I contacted NCS within two days of receiving the letter. Despite that fact, they would not return my phone calls and they would not confirm receipt of documents that I sent them showing proof that I had given notification of canceling the storage unit 60 days in advance. When I tried to talk to a manager, the manager cursed at me then hung up on me. They have not investigated the debt and despite me having submitted a dispute for the debt, they have reported the debt to the credit agencies and it is showing up on my credit report. They refuse to return my calls or acknowledge receipt of documents proving I do not owe the debt.

Consumer Complaint: Moved to XXXX XXXX XXXX XX/XX/XXXX to XX/XX/XXXX. Prior to moving out I called XXXX XXXX XXXX XXXX XX/XX/XXXX requesting exit walk through as stated on lease. No response from the front office for a clearance. XX/XX/XXXX I was called and emailed with false accusations I damaged carpet and carpet had to be replaced.
